of the full text - Complete Text of Norm 231 Requirements for the Granting of Tourist Fishing Licenses Complete Text of act: DC44A Costa Rican Institute of Fisheries and Aquaculture A.J.D.I.P./231-2011.-Puntarenas, on the tenth day of June of two thousand eleven.
1º-The Executive President states that he received notes from both Lic. Edwin Salazar Serrano, Head of the Department of Protection and Registration, and Biól. Marvin Mora Hernández, Deputy Technical General Director, through which they indicate that inconveniences have been arising in the granting of tourist fishing licenses under Law No. 8436.
4º-Sres. Salazar Serrano and Mora Hernández recommend that INCOPESCA validly issue the tourist fishing license, conditioning its effectiveness on the presentation of the tourism declaration in the sport fishing modality issued by the ICT.
5º-Having analyzed the arguments put forth by the signatories; the Board of Directors, Therefore; AGREES:
1º-The Regional Directorates, Regional Offices, Auxiliary Offices, and the Department of Protection and Registration are authorized so that, in those cases where tourist fishing licenses are requested, meeting the requirements established by current regulations, except for the requirement corresponding to registration with the ICT by the applicants, the respective tourist fishing license is granted in accordance with Article 79 of the Fisheries and Aquaculture Law, Law No. 8436; for the legal term, its effectiveness being conditioned, by means of the corresponding resolution, to the accreditation of the respective registration by the ICT.
2º-Once this registration is accredited before INCOPESCA, the tourist fishing licenses shall fully enjoy by right the conditions established for them in the Fisheries and Aquaculture Law.
Considering:

1º-Comenta el Sr. Presidente Ejecutivo que recibió notas tanto del Lic. Edwin Salazar Serrano; Jefe del Departamento de Protección y Registro, como del Biól. Marvin Mora Hernández, Subdirector General Técnico, mediante las cuales señalan que se han venido presentando inconvenientes para el otorgamiento de las licencias de pesca turística al amparo de la Ley N°. 8436.
4º-Recomiendan los Sres. Salazar Serrano y Mora Hernández que el INCOPESCA extienda válidamente la licencia de pesca turística condicionando su eficacia a la presentación de la declaratoria turística en la modalidad de pesca turística extendida por el ICT.
5º-Analizadas las argumentaciones vertidas por los signatarios; la Junta Directiva, Por tanto; ACUERDA:
1º-Se autoriza a las Direcciones Regionales; Oficinas Regionales, Oficinas Auxiliares y al Departamento de Protección y Registro para que en aquellos casos en los cuales se solicitan licencias de pesca turística cumpliendo con los requisitos establecidos por la normativa vigente, salvo lo correspondiente al registro en el ICT por parte de los petentes; se otorgue la respectiva licencia de pesca turística de conformidad con el artículo 79 de la Ley de Pesca y Acuicultura, Ley N°. 8436; por el plazo de ley, quedando condicionada su eficacia mediante resolución correspondiente, a la acreditación del registro respectivo por parte del ICT.
