COMPLEMENTARY AGREEMENT TO THE TECHNICAL COOPERATION AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF COSTA RICA AND THE GOVERNMENT OF THE FEDERATIVE REPUBLIC OF BRAZIL FOR THE IMPLEMENTATION OF THE PROJECT "DYNAMIZATION AND TRANSFER OF KNOWLEDGE FOR THE SUSTAINED DEVELOPMENT OF COSTA RICAN PROTECTED AGRICULTURE" The Government of the Federative Republic of Brazil and The Government of the Republic of Costa Rica (hereinafter referred to as the "Parties"), Considering that their cooperation relations have been strengthened under the umbrella of the Technical Cooperation Agreement between the Government of the Republic of Costa Rica and the Government of the Federative Republic of Brazil, signed in Brasília, on September 22, 1997; Considering the common desire to promote cooperation for development; and Considering that technical cooperation in the area of agriculture is of special interest to the Parties, Agree as follows:

1. The purpose of this Complementary Agreement is the implementation of the Project "Dynamization and transfer of Knowledge for the Sustained Development of Costa Rican Protected Agriculture" (hereinafter referred to as the "Project"), whose aim is to exchange knowledge and experiences on topics of relevance for Costa Rican protected agriculture, benefiting relations between the public and private sectors and fostering joint work between Brazilian and Costa Rican specialists.

2. The Project will encompass the objectives, activities, and results to be achieved.

3. The Project will be approved and signed by the coordinating and executing institutions.

1. The Government of the Federative Republic of Brazil designates:

• a)the Brazilian Cooperation Agency of the Ministry of Foreign Affairs (ABC/MRE) as the institution responsible for the coordination, monitoring, and evaluation of the activities resulting from this Complementary Agreement; b) the Brazilian Agricultural Research Corporation (EMBRAPA) as the institution responsible for the execution of the activities resulting from this Complementary Agreement; and c) the Technical Assistance and Rural Extension Company of the Federal District (EMATER - DF) as the accompanying institution according to specialties, for the execution of the activities resulting from this Complementary Agreement.

2. The Government of the Republic of Costa Rica designates:

• a)the Directorate of International Cooperation of the Ministry of Foreign Affairs and Worship of the Republic of Costa Rica as the institution responsible for the coordination of the activities resulting from this Complementary Agreement; and b) the National Program for Agricultural Production Under Protected Environments (ProNAP) of the Ministry of Agriculture and Livestock (MAG) as the institution responsible for the coordination, monitoring, and evaluation of the activities resulting from this Complementary Agreement, as well as for the execution of the referred activities.

1. It is incumbent upon the Government of the Federative Republic of Brazil to:

• a)designate and send technicians to develop in Costa Rica the technical cooperation activities foreseen in the Project, through the methodology proposed therein; b) offer facilities and infrastructure adequate for the execution of the technical cooperation activities foreseen in the Project.
• c)provide operational support to the technicians sent by the Costa Rican Government, by offering all necessary information for the execution of the Project; and d) monitor and evaluate the development of the Project.

2. It is incumbent upon the Government of the Republic of Costa Rica to:

• a)designate technicians to develop in Brazil the technical cooperation activities foreseen in the Project, through the methodology proposed therein; b) offer facilities and infrastructure adequate for the execution of the activities foreseen in the Project; c) provide operational support to the technicians sent by the Brazilian Government, by offering all the information necessary for the execution of the Project; and d) monitor and evaluate the development of the Project.

3. This Complementary Agreement does not imply any commitment to transfer financial resources or any other activity burdensome to the national patrimony of the Parties.

In the execution of the activities foreseen in the Project, the Parties may utilize resources from public and private institutions, non-governmental organizations, international bodies, technical cooperation agencies, and regional and international funds and programs, which must be contemplated in instruments other than this Agreement.

All activities mentioned in this Complementary Agreement shall be subject to the laws and regulations in force in the Federative Republic of Brazil and in the Republic of Costa Rica.

1. The executing institutions mentioned in Article II shall prepare reports on the results achieved in the Project developed within the scope of this Complementary Agreement, which shall be presented to the coordinating institutions.

2. The documents resulting from the activities developed in the context of the Project shall be jointly owned by the Parties. In the event of publication of the referred documents, the Parties shall be previously and formally consulted and mentioned in the published document.

This Complementary Agreement shall enter into force on the date on which both parties communicate the fulfillment of their internal requirements and shall have a validity of two (2) years, being automatically renewed, until the fulfillment of its objective, unless one of the Contracting Parties indicates otherwise.

Any dispute relating to the interpretation or execution of this Complementary Agreement shall be resolved directly by the Parties, through diplomatic channels.

Either of the Parties may notify, at any time, through diplomatic channels, its decision to denounce this Complementary Agreement. The Parties shall decide on the continuity of the activities that are under execution. The denunciation shall take effect three (3) months after the date of notification.

In matters not foreseen in this Complementary Agreement, the provisions of the Technical Cooperation Agreement between the Government of the Republic of Costa Rica and the Government of the Federative Republic of Brazil, signed in Brasília, on September 22, 1997, shall apply.

Done in Brasília, on April 4, 2011, in two original copies, in Spanish and Portuguese, both texts being equally authentic.

ACUERDO COMPLEMENTARIO AL ACUERDO DE COOPERACIÓN TÉCNICA ENTRE EL GOBIERNO DE LA REPÚBLICA DE COSTA RICA Y EL GOBIERNO DE LA REPÚBLICA FEDERATIVA DE BRASIL PARA LA IMPLEMENTACIÓN DEL PROYECTO "DINAMIZACIÓN Y TRANSFERENCIA DEL CONOCIMIENTO PARA EL DESARROLLO SOSTENIDO DE LA AGRICULTURA PROTEGIDA COSTARRICENSE" El Gobierno de la República Federativa de Brasil y El Gobierno de la República de Costa Rica (en adelante denominados las "Partes"), Considerando que sus relaciones de cooperación han sido fortalecidas al amparo del Acuerdo de Cooperación Técnica entre el Gobierno de la República de Costa Rica y el Gobierno de la República Federativa de Brasil, firmado en Brasília, el 22 de septiembre de 1997; Considerando el deseo común de promover la cooperación para el desarrollo; y Considerando que la cooperación técnica en el área de agricultura reviste especial interés para las Partes, Acuerdan lo siguiente:

1. El presente Acuerdo Complementario tiene por objeto la implementación del Proyecto "Dinamización y transferência del Conocimiento para El Desarrollo Sostenido de la Agricultura Protegida Costarricense" (en adelante denominado "Proyecto"), cuya finalidad es intercambiar conocimiento y experiencias en temas de relevancia para la agricultura protegida de Costa Rica, beneficiando las relaciones entre sectores público e privado y propiciando el trabajo conjunto entre especialistas brasileños e costarricenses.

2. El Proyecto contemplará los objetivos, las actividades y los resultados a alcanzar.

3. El Proyecto será aprobado y firmado por las instituciones coordinadoras y ejecutoras.

1. El Gobierno de la República Federativa de Brasil designa:

• a)a la Agencia Brasileña de Cooperación del Ministerio de Relaciones Exteriores (ABC/MRE) como institución responsable de la coordinación, seguimiento y evaluación de las actividades resultantes del presente Acuerdo Complementario; b) la Empresa Brasileña de Pesquisas Agropecuarias (EMBRAPA) como institución responsable de la ejecución de las actividades resultantes del presente Acuerdo Complementario; y c) la Empresa de Asistencia Técnica y Extensión Rural del Distrito Federal (EMATER - DF) como institución acompañante según especialidades, para la ejecución de las actividades resultantes del presente Acuerdo Complementario.

2. El Gobierno de la República de Costa Rica designa a:

• a)la Dirección de Cooperación Internacional del Ministerio de Relaciones Exteriores y Culto de la República de Costa Rica como institución responsable de la coordinación de las actividades resultantes del presente Acuerdo Complementario; y b) el Programa Nacional de Producción Agrícola Bajo Ambientes Protegidos (ProNAP) del Ministerio de Agricultura y Ganadería (MAG) como institución responsable de la coordinación, seguimiento y evaluación de las actividades resultantes del presente Acuerdo Complementario, así como por la ejecución de las referidas actividades.

1. Al Gobierno de la República Federativa de Brasil cabe:

• a)designar y enviar técnicos para desarrollar en Costa Rica las actividades de cooperación técnica prevista en el Proyecto, mediante la metodología propuesta en el mismo; b) ofrecer instalaciones e infraestructura adecuadas a la ejecución de las actividades de cooperación técnica previstas en el Proyecto.
• c)prestar apoyo operacional a los técnicos enviados por el Gobierno costarricense, mediante el ofrecimiento de todas las informaciones necesarias a la ejecución del Proyecto; y d) acompañar y evaluar el desarrollo del Proyecto.

2. Al Gobierno de la República de Costa Rica cabe:

• a)designar técnicos para desarrollar en Brasil las actividades de cooperación técnica previstas en el Proyecto, mediante la metodología propuesta en el mismo; b) ofrecer instalaciones e infraestructura adecuadas a la ejecución de las actividades previstas en el Proyecto; c) prestar apoyo operacional a los técnicos enviados por el Gobierno brasileño, mediante el ofrecimiento de todas las informaciones necesarias a la ejecución del Proyecto; y d) acompañar y evaluar el desarrollo del Proyecto.

3. El presente Acuerdo Complementario no implica cualquier compromiso de transferencia de recursos financieros o cualquier otra actividad gravosa al patrimonio nacional de las Partes.

En la ejecución de las actividades previstas en el Proyecto, las Partes podrán utilizar recursos de instituciones públicas y privadas, de organizaciones no gubernamentales, de organismos internacionales, de agencias de cooperación técnica, de fondos y de programas regionales e internacionales que deberán estar contemplados en otros instrumentos que no el presente Acuerdo.

Todas las actividades mencionadas en este Acuerdo Complementario estarán sujetas a las leyes y a los reglamentos vigentes en la República Federativa de Brasil y en la República de Costa Rica.

1. Las instituciones ejecutoras mencionadas en el Artículo II elaborarán informes sobre los resultados alcanzados en el Proyecto desarrollado en el ámbito de este Acuerdo Complementario, los cuales serán presentados a las instituciones coordinadoras.

2. Los documentos resultantes de las actividades desarrolladas en el contexto del Proyecto serán de propiedad conjunta de las Partes. En caso de publicación de los referidos documentos, las Partes deberán ser previamente y formalmente consultadas y mencionadas en el documento publicado.

El presente Acuerdo Complementario entrará en vigor en la fecha en que ambas partes se comuniquen el cumplimiento de sus requisitos internos y tendrá una vigencia de dos (2) años, siendo renovado automáticamente, hasta el cumplimiento de su objetivo, excepto si una de las Partes Contratantes manifiesta lo contrario.

Cualquier controversia relativa a la interpretación o ejecución del presente Acuerdo Complementario será resuelta directamente por las Partes, por vía diplomática.

Cualquiera de las Partes podrá notificar, a cualquier momento, por vía diplomática, su decisión de denunciar el presente Acuerdo Complementario. Las Partes decidirán sobre la continuidad de las actividades que se encuentren en ejecución. La denuncia surtirá efecto tres (3) meses después de la fecha de notificación.

En las cuestiones no previstas en este Acuerdo Complementario, se aplicarán las disposiciones del Acuerdo de Cooperación Técnica entre el Gobierno de la República de Costa Rica y el Gobierno de la República Federativa de Brasil, firmado en Brasília, el 22 de septiembre de 1997.

Hecho en Brasília, el 4 de abril del 2011, en dos ejemplares originales, en español y portugués, siendo ambos textos igualmente auténticos.
