in the entirety of the text - Complete Text of Norm 36564 Authorizes the National System of Conservation Areas to accredit support personnel hired by Non-Governmental Organizations to work for the different Conservation Areas and amends the Regulation for Vehicle Use, Control, and Maintenance Complete Text of act: E1CE3 No. 36564-MINAET (This decree was repealed by article 1 of executive decree No. 36936 of October 4, 2011) THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT, ENERGY, AND TELECOMMUNICATIONS In exercise of the powers conferred upon them by subsections 3) and 18) of article 140 and 146 of the Political Constitution; articles 27 and 111 of the General Law of Public Administration, No. 6227 of May 2, 1978; the Law Creating the National Parks Service, No. 6084, published in La Gaceta No. 169 of September 7, 1977; the Wildlife Conservation Law, No. 7317 published in La Gaceta No. 235 of December 7, 1992; the Organic Environmental Law, No. 7554, published in La Gaceta No. 215 of November 13, 1995; the Forest Law (Ley Forestal), No. 7575, published in La Gaceta No. 72 of April 16, 1996; and the Biodiversity Law, No. 7788, published in La Gaceta No. 101 of May 27, 1998.
Considering (Considerando):
I.-That article 50 of the Political Constitution establishes that the State must preserve and guarantee the right of the country's inhabitants to enjoy a healthy and ecologically balanced environment, since the action that the State must carry out implies ensuring the existence of conditions that allow for the emergence of environmentally pure spaces, an obligation that has been reiterated by the jurisprudence of the Constitutional Chamber (Sala Constitucional).
II.-That the Law Creating the National Parks Service, No. 6084, has the function of developing and administering the Protected Wilderness Areas (Áreas Silvestres Protegidas) for the conservation of the State's Natural Heritage.
III.-That article 2, subsection a) of the Organic Environmental Law, No. 7554 establishes that the environment is the common heritage of all the inhabitants of the Nation, where the State and private individuals must participate in its conservation and sustainable use, as they are of public utility and social interest.
IV.-That article 1 of the Forest Law (Ley Forestal), No. 7575, established as an essential and priority function of the State, to ensure the conservation, protection, and administration of natural resources.
V.-That article 22 of the Biodiversity Law provided that the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC) would integrate the competencies in forestry (materia forestal), wildlife (vida silvestre), and protected areas (áreas protegidas) matters, in order to dictate policies, plan, and execute processes aimed at achieving sustainability in the management of Costa Rica's natural resources.
VI.-That article 61 of the Biodiversity Law, No. 7788 obligates the State to seek the financial and operational mechanisms necessary to guarantee the operation and integrity of the Protected Wilderness Areas (Áreas Silvestres Protegidas) as well as sufficient and duly accredited personnel to execute the necessary actions.
VII.-That article 111 of the General Law of Public Administration No. 6227 considers a public servant (servidor público) any person who provides services to the administration or on behalf and for the account of it, as part of its organization by virtue of a valid and effective act of investiture, with complete independence from the imperative, representative, remunerated, permanent, or public nature of the respective activity.
VIII.-That Executive Decree No. 26665-MINAE of December 4, 1997, called "Regulation for the Use, Control, and Maintenance of Vehicles of MINAE", has the purpose of regulating the use, maintenance, and control of the official vehicles belonging to said Ministry, and also regulates the duties and obligations of the officials who use them, so that their use is in a rational manner and in strict observance of related norms.
IX.-That the State, through the Ministry of Environment, Energy and Telecommunications (MINAET) and the National System of Conservation Areas (SINAC), given budgetary and personnel limitations, have entered into cooperation agreements with non-governmental organizations, in order for these to hire personnel under their charge to work for the different conservation areas (áreas de conservación), carrying out activities for the management and conservation of the environment and performing support functions for the officials of SINAC. "TO AUTHORIZE THE NATIONAL SYSTEM OF CONSERVATION AREAS TO BE ABLE TO ACCREDIT SUPPORT PERSONNEL HIRED BY NON-GOVERNMENTAL ORGANIZATIONS IN ORDER FOR THESE TO WORK FOR THE DIFFERENT CONSERVATION AREAS, CARRYING OUT ACTIVITIES FOR THE MANAGEMENT AND CONSERVATION OF THE ENVIRONMENT AND PERFORMING SUPPORT FUNCTIONS AND MODIFICATION TO ARTICLE 20 OF EXECUTIVE DECREE NO. 26665-MINAE OF DECEMBER 4, 1997"
DECREE:
The requirements for the accreditation of personnel shall be made in accordance with the Manual of Specialties and Classes of the Ministry of Environment, Energy and Telecommunications.
The accreditation of personnel may be revoked at the request of the Director of the Conservation Area (Área de Conservación), through the contracting organization, when they do not fulfill the functions assigned by the Administration.
The hiring and dismissal shall correspond only to the contracting non-governmental organization.

"Persons authorized to drive vehicles: The following are authorized to drive vehicles for administrative use of the Ministry: the servers who occupy a position of Mobile Equipment Operators, those other officials or servers authorized by the Oficialía Mayor or Administrative Directorate, the support personnel who are hired by non-governmental organizations, and the ad-honorem officials of MINAET, accredited through executive agreements; for which they will be provided with an identification card, and therefore there will be an identification card for regular officials and another for those accredited as ad-honoren officials and those hired by non-governmental organizations. I.-Que el artículo 50 de la Constitución Política establece que el Estado debe preservar y garantizar el derecho de los habitantes del país a gozar de un ambiente sano y ecológicamente equilibrado, ya que la acción que debe llevar adelante el Estado implica velar por la existencia de condiciones que permitan el surgimiento de espacios ambientalmente puros, obligación que ha sido reiterada por la jurisprudencia de la Sala Constitucional.
II.-Que la Ley de Creación del Servicio de Parques Nacionales, N° 6084, tiene como función el desarrollo y administración de las Áreas Silvestres Protegidas para la conservación del Patrimonio Natural del Estado.
III.-Que el artículo 2, inciso a) de la Ley Orgánica del Ambiente, N° 7554 establece que el ambiente es patrimonio común de todos los habitantes de la Nación, donde el Estado y los particulares deben participar en su conservación y utilización sostenibles, ya que son de utilidad pública e interés social.
IV.-Que el artículo 1 de la Ley Forestal, N° 7575, estableció como función esencial y prioritaria del Estado, velar por la conservación, protección y administración de los recursos naturales.
V.-Que el artículo 22 de la Ley de Biodiversidad dispuso que el Sistema Nacional de Áreas de Conservación integraría las competencias en materia forestal, vida silvestre, áreas protegidas, con el fin de dictar políticas, planificar y ejecutar procesos dirigidos a lograr la sostenibilidad en el manejo de los recursos naturales de Costa Rica.
VI.-Que el artículo 61 de la Ley de Biodiversidad, N° 7788 obliga al Estado a buscar los mecanismos financieros y operativos necesarios para garantizar la operación e integridad de las Áreas Silvestres Protegidas así como el personal suficiente y debidamente acreditado para ejecutar las acciones necesarias.
VII.-Que el artículo 111 de la Ley General de la Administración Pública N° 6227 considera servidor público a toda persona que presta servicios a la administración o a nombre y por cuenta de ésta, como parte de su organización en virtud de un acto válido y eficaz de investidura con entera independencia del carácter imperativo, representativo, remunerado, permanente o público de la actividad respectiva.
VIII.-Que el Decreto Ejecutivo N° 26665-MINAE del 04 de diciembre de 1997 denominado "Reglamento para el Uso, Control y Mantenimiento de Vehículos del MINAE", tiene como finalidad regular el uso, mantenimiento y control de los vehículos oficiales pertenecientes a dicho Ministerio, además regula los deberes y las obligaciones de los funcionarios que los utilicen, para que su uso sea de manera racional y en estricta observancia de las normas afines.
IX.-Que el Estado a través del Ministerio de Ambiente, Energía y Telecomunicaciones (MINAET) y el Sistema Nacional de Áreas de Conservación (SINAC), ante las limitaciones presupuestarias y de personal han celebrado convenios de cooperación con organizaciones no gubernamentales, con el fin de que estas contraten personal a cargo de las mismas para que laboren para las diferentes áreas de conservación, ejerciendo actividades para el manejo y la conservación del ambiente y desempeñando funciones de apoyo a los funcionarios del SINAC. Por tanto,
"AUTORIZAR AL SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN PARA QUE PUEDA ACREDITAR PERSONAL DE APOYO CONTRATADO POR ORGANIZACIONES NO GUBERNAMENTALES CON EL FIN DE QUE ESTAS LABOREN PARA LAS DIFERENTES ÁREAS DE CONSERVACIÓN, EJERCIENDO ACTIVIDADES PARA EL MANEJO Y LA CONSERVACIÓN DEL AMBIENTE Y DESEMPEÑANDO FUNCIONES DE APOYO Y MODIFICACIÓN AL ARTÍCULO 20 DEL DECRETO EJECUTIVO N° 26665-MINAE DEL 04 DE DICIEMBRE DE 1997"
Considerando:
DECRETAN:
Los requisitos para la acreditación de personal se harán acorde con el Manual de Especialidades y Clases del Ministerio del Ambiente, Energía y Telecomunicaciones.
La acreditación del personal podrá ser revocada a solicitud del Director del Área de Conservación, a través de la organización contratante, cuando no cumpla las funciones asignadas por la Administración.
La contratación y el despido corresponderán únicamente a la organización no gubernamental contratante.
"Personas autorizadas para conducir vehículos: Están autorizadas para conducir vehículos de uso administrativo del Ministerio los servidores que ocupen plaza de Operadores de Equipo Móvil, aquellos otros funcionarios o servidores que autorice la Oficialía Mayor o Dirección Administrativa, el personal de apoyo que se encuentre contratado por las organizaciones no gubernamentales y los funcionarios ad-honorem del MINAET, acreditados mediante acuerdos ejecutivos; para lo que se les proveerá de un carné, y por tanto existirá el carne para los funcionarios regulares y otro para los acreditados como funcionarios ad-honoren y los contratados por las organizaciones no gubernamentales. En el caso de los vehículos de uso discrecional solo podrán ser conducidos por la persona que lo tiene asignado o por el funcionario que sea autorizado por éste para hacerlo."
