Considering:
8495 of April 6, 2006, establishes as the competence of SENASA the administration, planning, direction, and taking of pertinent veterinary or sanitary measures regarding the control of the safety and wholesomeness (inocuidad) of products and byproducts of animal origin, in the stages of capture, production, industrialization, and commercialization, considering food additives, residues of veterinary drugs, pesticides, and other chemical, biological, or biotechnological contaminants.
Javier Flores Galarza, in his capacity as Minister of Agriculture and Livestock at that time, by means of Directive DM-SENASA-DIR-0002-2008 of September 9, 2008, which remains in force, established that "...the matter of food safety (inocuidad de alimentos) of animal origin is the exclusive competence of the National Animal Health Service, in its capacity as Sanitary Authority and therefore the different bodies that make up the Agricultural Sector must adjust their actions, mandatory agreements, procedures, and concrete actions to this sectoral definition, and especially INCOPESCA, which must adjust its actions in this matter to what is strictly established in Article 120 of the Fisheries and Aquaculture Law .".
For its part, SENASA committed to provide, as the competent authority, in accordance with national regulations and the requirements of the target export markets for Costa Rican fishery products, a Safety Supervision Plan on Vessels, and for which it will provide the necessary training to the INCOPESCA officials designated by the latter, the procedure manuals, and likewise all the necessary documentation that must obligatorily be used within the framework of the supervision plan that is determined.

Said records must be required and evaluated by SENASA or INCOPESCA officials for the purpose of permitting the unloading of fishery products at authorized docks.
When the records indicate non-conformities due to the presentation of false or untrue data or the absence of a record, the products may not be introduced into the marketing chain for human consumption and may only be destined for use as raw material for animal feed, for which the SENASA or INCOPESCA authorities will take the corresponding precautions.
