As well as to allow the development and institutionalization of other financing mechanisms, such as the sale of environmental services for mitigation of greenhouse gases and the mechanism for charging for the environmental service of conservation of the water resource in Costa Rica.

Article 38 of the Regulation to the Forest Law Nº 7575 and its modifications, the Executive Power shall establish, by executive decree, the priority areas in which environmental services are to be paid, the number of hectares available, and the amount per hectare.

11.-That through Executive Decree Nº 32750-MINAE published in La Gaceta Nº 218 of November 11, 2005, the payment amounts for environmental services were established in dollars, in order to ensure the competitiveness of the PSA.

12.-That FONAFIFO, as a body attached to MINAET, will seek to improve the Social Development Index (IDS), especially in rural areas, by placing resources in these sites. Therefore, They decree:

"PAYMENT OF ENVIRONMENTAL SERVICES FOR THE YEAR 2011"

FONAFIFO may vary the distribution established in the previous table according to the supply based on the applications seeking to enter the modalities, provided they do not exceed the total amount of the resources authorized in this Decree.

However, in the event of having a greater allocation of resources as established in Article 5 of Law Nº 8114, which corresponds to the "Law for Tax Simplification and Efficiency" (Ley de Simplificación y Eficiencia Tributarias), and other financial resources from projects under negotiation, or from other income that FONAFIFO captures for the payment of environmental services, they will be distributed according to the criteria of the donors and FONAFIFO. In any case, the resources used for these purposes must have the budgetary content duly approved by the Office of the Comptroller General of the Republic.

The contracts that FONAFIFO issues for this purpose shall establish the conditions, terms, form of payment, and other requirements to comply with the stipulations in this article.

• a)Three hundred and twenty dollars exactly ($320) per hectare, for the Payment of Environmental Services for forest protection, disbursed over a period of five years.
• b)Four hundred dollars exactly ($400) per hectare, for the Payment of Environmental Services for water resource protection, in zones of water importance identified by the Water Directorate of MINAET and FONAFIFO, disbursed over a period of five years.
• c)Three hundred and seventy-five dollars exactly ($375) per hectare, for the Payment of Environmental Services for forest protection in conservation gaps, in zones identified by SINAC and FONAFIFO, disbursed over a period of five years.
• d)Two hundred and fifty dollars exactly ($250) per hectare, for the Payment of Environmental Services per hectare for forest management contracts, in which harvesting was carried out according to the Sustainability Standards for Natural Forest Management: Principles, Criteria and Indicators, Code of Practices and Procedures Manual, Executive Decrees Nº 27388-MINAE published on November 2, 1998 and the Decree Nº 34559-MINAE, published in La Gaceta Nº 115 of June 16, 2008, disbursed over a period of five years.
• e)Nine hundred and eighty dollars exactly ($980) per hectare, for the Payment of Environmental Services for reforestation, disbursed over a period of five years.
• f)One thousand four hundred and seventy dollars exactly ($1,470) per hectare, for the Payment of Environmental Services for reforestation strictly with native species contained in Decrees Nº 25663-MINAE of October 8, 1996 and Nº 25700-MINAE of November 15, 1996, disbursed over a period of five years.
• g)Two hundred and five dollars exactly ($205) per hectare, for the Payment of Environmental Services for natural regeneration in pastures and also areas with productive potential on sites with at least one year of abandonment and free of grazing outside Kyoto areas, disbursed over a period of five years.
• h)Three hundred and twenty dollars exactly ($320) per hectare, for the Payment of Environmental Services for the recovery of areas through natural regeneration in pastures and grazing lands that were deforested before December 31, 1989. These projects may only be carried out in areas defined as priority lands for an aforestation project under the Kyoto Protocol-Clean Development Mechanism (MDL) regime or another that recognizes an additional payment for the carbon credits that FONAFIFO can commercialize, disbursed over a period of five years.
• i)One dollar and thirty cents ($1.30) per tree, for the Payment of Environmental Services for reforestation integrated into agroforestry systems and small blocks of less than five hectares, disbursed over a period of three years.
• j)One dollar and ninety-five cents ($1.95) per tree, for the Payment of Environmental Services for reforestation integrated into agroforestry systems, strictly with native species contained in the Decrees Nº 25663-MINAE of October 8, 1996 and Nº 25700-MINAE of November 15, 1996, disbursed over a period of three years.

The amounts pending disbursement from contracts of previous years shall be governed by the provisions established in the respective Executive Decrees for each year.

• 1)Reforestation Projects: Areas without forest in sites that present high productive potential for the development of forest plantations are established as priority for the execution of reforestation projects.
• a)For reforestation projects with species contained in the decrees on bans and threatened or endangered species (Decrees Nº 25663-MINAE of October 8, 1996 and Nº 25700-MINAE of November 15, 1996), the entire country is established as a priority.
• b)For reforestation projects established in the protection areas according to Article 33 of the Forest Law N° 7575, the entire country will be considered a priority.
• c)Sites where there is a high potential for plantation blocks, giving special priority to projects that use improved genetic material and to projects that use seed certified by the Oficina Nacional de Semillas.
• d)Areas where reforestation projects financed through incentives were executed and that have complied with the approved management plans and the effective period may be included.
• e)Reforestation projects with forest-industry integration.
• 2)Forest Protection Projects: The areas established by the Executive Power according to Decree N° 35762-MINAET of December 4, 2009, or others that have been established by agreements or special provisions, are established as priority areas for all Forest Protection Projects. For the application of these priorities to applications, the following Evaluation Matrix is established, which will determine the score they will have once evaluated.

• 3)Projects for the Establishment of Forest Trees in Agroforestry Systems (SAF): Areas without forest are established as priority for the execution of projects for the establishment of trees in SAF with the following criteria:
• a)Lands with land-use capability I, II, III, IV, V, VI, as established by the Methodology for Determining the Land-Use Capability of Lands in Costa Rica, Executive Decree Nº 23214-MAG-MIRENEM.
• b)Areas for the establishment of trees under specific agreements with FONAFIFO.
• c)Priority will be given to projects processed by organizations that have a current agreement with FONAFIFO.
• 4)Natural Regeneration Projects: Areas without forest are established as priority for the execution of natural regeneration projects with the following criteria:
• a)Natural regeneration projects in pastures and grazing lands, as established in subsections b and c, in areas defined as Kyoto lands or others that recognize an additional payment for the carbon credits that FONAFIFO can commercialize, and that were deforested before December 31, 1989.
• b)Natural regeneration projects in pastures and grazing lands, which may be carried out outside areas defined as Kyoto lands, with at least one year of abandonment and free of grazing.
• c)Natural regeneration projects with productive potential on sites with at least one year of abandonment and free of grazing.
• d)For natural regeneration in the protection areas according to Article 33 of the Forest Law Nº 7575, the entire country will be considered a priority.
• 5)Forest Management Projects: Areas with the following criterion are established as priorities for forest management projects:
• a)Properties that have management plans approved by the State Forest Administration, in which harvesting was carried out according to the Sustainability Standards for Natural Forest Management: Principles, Criteria and Indicators, Code of Practices and Procedures Manual, Executive Decrees Nº 27388-MINAE published on November 2, 1998 and Executive Decree Nº 34559-MINAE, published in La Gaceta Nº 115 of June 16, 2008; SINAC or the forest regent will certify compliance with the provisions in the Management Plan.

In each of the Subregional Offices of SINAC and Regional Offices of FONAFIFO, an updated map shall be maintained, physically and in digital shapefile format, with the priority areas for locating farms that apply to the Program of Payment for Environmental Services in the forest protection modality.

• a)In reforestation contracts that incorporate various forest species with different harvest rotations, the effective period of the contract shall be equal to that of the species with the longest harvest rotation, and this shall not exceed fifteen years, in which case this would be the maximum duration of the effective period. In all cases, the effective period of reforestation contracts cannot be less than ten years.
• b)For forest protection contracts, forest protection in conservation gaps contracts, and water resource protection contracts, the effective period of the contract shall be five years, extendable for an equal period, subject to prior compliance with the requirements established for this purpose.
• c)For forest management contracts, in which harvesting was carried out according to the Sustainability Standards for Natural Forest Management: Principles, Criteria and Indicators, Code of Practices and Procedures Manual, Executive Decrees Nº 27388-MINAE published on November 2, 1998 and Executive Decree Nº 34559-MINAE, published in La Gaceta Nº 115 of June 16, 2008, the effective period of the contract shall be five years, extendable for an equal period, subject to prior compliance with the requirements established for this purpose.
• d)For natural regeneration contracts in pastures and sites with productive potential outside areas defined as Kyoto lands, the effective period of the contract shall be five years, extendable for an equal period, subject to prior compliance with the requirements established for this purpose.
• e)For natural regeneration contracts in which carbon credits are commercialized under a specific agreement or project, the effective period of the contract shall be five years.
• f)For contracts in which agroforestry systems are developed, the term of the contracts shall be five years. In this modality, the encumbrance of the property will not be registered before the Public Property Registry.

The Regional Offices of FONAFIFO shall be responsible for processing and verifying compliance with the legal and regulatory requirements of applications for payment for environmental services; once these have been fulfilled, they shall prepare a resolution of approval and forward the contract for signature to the Director of the National Forest Financing Fund.

• a)The payment of environmental services for reforestation projects with areas less than or equal to fifty hectares may receive the first payment in advance, whether processed through organizations or individually. For these projects, the first disbursement of 50% shall be made once the contract with the State is formalized, as long as the amount to be disbursed is guaranteed as established in the Procedures Manual for the Payment of Environmental Services. In the following years, the payment will be distributed as follows: 20% in the second year, 15% in the third year, 10% in the fourth year, and 5% in the fifth year. These payments are made starting from the average date of planting. Reforestation projects that do not receive payment in advance shall receive the first payment of 50% once the contract with the State is formalized, the plantation has been established, and the requirements established in the Procedures Manual for the Payment of Environmental Services are met. In the following years, the payment will be distributed as follows: 20% in the second year, 15% in the third year, 10% in the fourth year, and 5% in the fifth year. Likewise, payments shall be made starting from the average date of planting.
• b)The payment of environmental services for forest protection, water resource protection, and forest protection for conservation gaps projects: the first disbursement of 20% shall be made once the contract with the State is signed and the requirements established in the Procedures Manual for the Payment of Environmental Services are met. The disbursements for the following years shall be 20% each year until the fifth year. These may be requested at twelve, twenty-four, thirty-six, and forty-eight months from the effective date of the contract, except for contracts with payments per year elapsed, maintaining, in this case, the effective period of the contract until the year of the last payment.
• c)The payment of environmental services for forest management contracts in which harvesting was carried out according to the Standards of Sustainability for Natural Forest Management: Principles, Criteria and Indicators, Code of Practices and Procedures Manual, Executive Decrees Nº 27388-MINAE published on November 2, 1998 and the Executive Decree Nº 34559-MINAE, published in La Gaceta Nº 115 of June 16, 2008: the first disbursement of 20% shall be made once the contract with the State is signed and the requirements established in the Procedures Manual for the Payment of Environmental Services are met. The disbursements for the following years shall be 20% each year until the fifth year. These may be requested at twelve, twenty-four, thirty-six, and forty-eight months from the effective date of the contract.
• d)The payment of environmental services for natural regeneration projects: the first disbursement of 20% shall be made once the contract with the State is signed and the requirements established in the Procedures Manual for the Payment of Environmental Services are met. The disbursements for the following years shall be 20% each year until the fifth year. These may be requested at twelve, twenty-four, thirty-six, and forty-eight months from the effective date of the contract.
• e)The payment of environmental services for projects in which agroforestry systems are developed: the first disbursement shall be made once the respective contract is signed and the establishment of the trees and their average planting date are certified by the forest regent. This first disbursement shall be 65% of the established amount, for the second year it shall be 20%, and 15% for the third year, and may be requested at twelve and twenty-four months after the average date of establishment of the trees certified by the forest regent.
• f)These payment percentages may vary in accordance with agreements, covenants, or contracts with donor entities or partners that recognize higher amounts than those established.

Issued at the Presidency of the Republic.-San José, on the twenty-fifth day of the month of January of the year two thousand eleven.

Así como, permitir que se desarrollen e institucionalicen otros mecanismos de financiamiento, como la venta de servicios ambientales de mitigación de gases con efecto invernadero y el mecanismo de cobro del servicio ambiental de conservación del recurso hídrico en Costa Rica.

10.-Que según el artículo 38 del Reglamento a la Ley Forestal Nº 7575 y sus modificaciones, el Poder Ejecutivo establecerá mediante decreto ejecutivo, las áreas prioritarias en las que se debe pagar servicios ambientales, la cantidad de hectáreas disponibles y el monto por hectárea.

11.-Que mediante el Decreto Ejecutivo Nº 32750-MINAE publicado en La Gaceta Nº 218 del 11 de noviembre del 2005 se estableció los montos de pago de servicios ambientales en dólares, a fin de asegurar la competitividad del PSA.

12.-Que FONAFIFO como órgano adscrito al MINAET procurará mejorar el Índice de Desarrollo Social (IDS), especialmente en las áreas rurales mediante la colocación de recursos en estos sitios. Por tanto,

FONAFIFO podrá variar la distribución establecida en el cuadro anterior de acuerdo con la oferta según las solicitudes que pretendan ingresar a las modalidades, siempre y cuando no sobrepasen el monto total de los recursos autorizados en este Decreto.

Pero, en caso de disponer de una mayor asignación de recursos según lo establece el artículo 5 de la Ley Nº 8114 que corresponde a la "Ley de Simplificación y Eficiencia Tributarias" y otros recursos financieros provenientes de proyectos en negociación, o de otros ingresos que capte el FONAFIFO para el pago de servicios ambientales, se distribuirán según criterio de los donantes y del FONAFIFO. En todo caso, los recursos utilizados para estos fines deberán tener el contenido presupuestario debidamente aprobado por la Contraloría General de la República.

Los contratos que al efecto emita el FONAFIFO, establecerán las condiciones, plazos, forma de pago y otros requisitos para cumplir con lo estipulado en este artículo.

• a)Trescientos veinte dólares exactos ($320) por hectárea, para el Pago de Servicios Ambientales por protección de bosque, desembolsados en un período de cinco años.
• b)Cuatrocientos dólares exactos ($400) por hectárea, para el Pago de Servicios Ambientales por protección de recurso hídrico, en las zonas de importancia hídrica identificadas por la Dirección de Aguas de MINAET y FONAFIFO, desembolsados en un período de cinco años.
• c)Trescientos setenta y cinco dólares exactos ($375) por hectárea, para el Pago de Servicios Ambientales por protección de bosque en vacíos de conservación, en las zonas identificadas por el SINAC y FONAFIFO, desembolsados en un período de cinco años.
• d)Doscientos cincuenta dólares exactos ($250) por hectárea, para el Pago de Servicios Ambientales por hectárea para contratos de manejo de bosque, en los cuales se realizó la cosecha de acuerdo a los Estándares de Sostenibilidad para Manejo de Bosques Naturales: Principios, Criterios e Indicadores, Código de Practicas y Manual de Procedimientos, Decretos Ejecutivos Nº 27388-MINAE publicado el 2 de noviembre de 1998 y el Decreto Nº 34559-MINAE, publicado en La Gaceta Nº 115 del 16 de junio del 2008, desembolsados en un período de cinco años.
• e)Novecientos ochenta dólares exactos ($980) por hectárea, para el Pago de Servicios Ambientales por reforestación, desembolsados en un período de cinco años.
• f)Mil cuatrocientos setenta dólares exactos ($1.470) por hectárea, para el Pago de Servicios Ambientales por reforestación estrictamente con especies nativas contenidas en los Decretos Nº 25663-MINAE de 08 de octubre de 1996 y Nº 25700-MINAE de 15 de noviembre de 1996, desembolsados en un período de cinco años.
• g)Doscientos cinco dólares exactos ($205) por hectárea, para el Pago de Servicios Ambientales por regeneración natural en potreros y también áreas con potencial productivo en sitios con al menos un año de abandono y libres de pastoreo fuera de áreas Kyoto, desembolsados en un período de cinco años.
• h)Trescientos veinte dólares exactos ($320) por hectárea, para el Pago de Servicios Ambientales por la recuperación de áreas mediante regeneración natural en pastos y potreros que hayan sido deforestadas antes del 31 de diciembre de 1989. Estos proyectos se podrán realizar solo en áreas definidas como tierras prioritarias para un proyecto de aforestación bajo el régimen del Protocolo de Kyoto-Mecanismo de Desarrollo Limpio (MDL) u otro que reconozca un pago adicional por los créditos de carbono que el FONAFIFO pueda comercializar, desembolsados en un período de cinco años.
• i)Un dólar con treinta centavos ($1,30) por árbol, para el Pago de Servicios Ambientales por reforestación integrados a sistemas agroforestales y bloques pequeños de menos de cinco hectáreas, desembolsados en un período de tres años.
• j)Un dólar con noventa y cinco centavos ($1,95) por árbol, para el Pago de Servicios Ambientales por reforestación integrados a sistemas agroforestales, estrictamente con especies nativas contenidas en los Decretos Nº 25663-MINAE de 08 de octubre de 1996 y Nº 25700-MINAE de 15 de noviembre de 1996, desembolsados en un período de tres años.

Los montos pendientes a desembolsar de contratos de años anteriores, se regirán según lo establecido en los Decretos Ejecutivos respectivos para cada año.

• 1)Proyectos de Reforestación: Se establecen como prioritarias para la ejecución de proyectos de reforestación las áreas sin bosque en los sitios que presenten un alto potencial productivo para el desarrollo de plantaciones forestales.
• a)Para los proyectos de reforestación con especies contenidas en los decretos de vedas y especies amenazadas o en peligro de extinción (Decretos Nº 25663-MINAE de 08 de octubre de 1996 y Nº 25700-MINAE de 15 de noviembre de 1996), se establece como prioritario todo el país.
• b)Para proyectos de reforestación establecidos en las áreas de protección según el artículo 33 de la Ley Forestal N° 7575, se considerará como prioritario todo el país.
• c)Sitios donde haya un alto potencial de bloques de plantación dando especial prioridad a los proyectos que utilicen material genético mejorado y a los proyectos que utilicen semilla certificada por la Oficina Nacional de Semillas.
• d)Se podrán incluir áreas en donde se ejecutaron proyectos de reforestación financiados por medio de incentivos y que hayan cumplido con los planes de manejo aprobados y el período de vigencia.
• e)Proyectos de reforestación con integración bosque industria.
• 2)Proyectos de Protección de Bosque: Se establecen como áreas prioritarias para todos los Proyectos de Protección de Bosque las establecidas por el Poder Ejecutivo según Decreto N° 35762-MINAET del 4 de diciembre de 2009, u otras que se hayan establecido por convenios o disposiciones especiales. Para la aplicación de estas prioridades a las solicitudes, se establece la siguiente Matriz de Valoración, la cual determinará la puntuación que tendrán una vez evaluadas.

La vigencia de los nuevos contratos iniciará al día siguiente de la fecha de vencimiento del contrato anterior. | 5 puntos adicionales | | II | Bosques en fincas ubicadas en los distritos con IDS menor a 40% según la determinación realizada por MIDEPLAN (2007). | 5 puntos adicionales | | III | Bosques en cualquiera de las prioridades anteriores, con solicitud de ingreso al PSA en áreas menores a 50 hectáreas. | 10 puntos adicionales | | IV | Para solicitudes no tramitadas en el año anterior, que reiteren su interés de ingreso, cumpliendo todos los requisitos. | 5 puntos adicionales | En caso de puntajes iguales entre dos o más solicitudes éstas se tramitarán dando prioridad según el orden de presentación. Aquellas solicitudes que después de aplicada la matriz obtengan un puntaje igual o mayor a 100, serán enviadas en forma inmediata a valoración legal; las que tengan menor puntaje esperarán la calificación de la totalidad de solicitudes recibidas y se tramitarán hasta agotar el presupuesto de acuerdo al puntaje obtenido.

• 3)Proyectos de Establecimiento de Árboles Forestales en Sistemas Agroforestales (SAF): Se establecen como prioritarias para la ejecución de proyectos de establecimiento de árboles en SAF las áreas sin bosque con los siguientes criterios:
• a)Tierras con capacidad de uso I, II, III, IV, V, VI, según dispone la Metodología para la Determinación de la Capacidad de Uso de las Tierras en Costa Rica, Decreto Ejecutivo Nº 23214-MAG-MIRENEM.
• b)Áreas para el establecimiento de árboles en convenios específicos con FONAFIFO.
• c)Se dará prioridad a proyectos tramitados por organizaciones que tengan convenio vigente con el FONAFIFO.
• 4)Proyectos de Regeneración Natural: Se establecen como prioritarias para la ejecución de proyectos de regeneración natural las áreas sin bosque con los siguientes criterios:
• a)Proyectos de regeneración natural en pastos y potreros, según lo establecido en los incisos b y c, en áreas definidas como tierras Kyoto u otras que se reconozca un pago adicional por los créditos de carbono que FONAFIFO pueda comercializar, y hayan sido deforestadas antes del 31 de diciembre de 1989.
• b)Proyectos de regeneración natural en pastos y potreros, que se podrán realizar fuera de áreas definidas como tierras Kyoto, con al menos un año de abandono y libres de pastoreo.
• c)Proyectos de regeneración natural con potencial productivo en sitios con al menos un año de abandono y libres de pastoreo.
• d)Para la regeneración natural en las áreas de protección según el artículo 33 de la Ley Forestal Nº 7575, se considerará como prioritario todo el país.
• 5)Proyectos de Manejo de Bosque: Se establecen como prioridades para proyectos de manejo de bosque las áreas con el siguiente criterio:
• a)Inmuebles que tienen planes de manejo aprobados por la Administración Forestal del Estado, en los cuales se realizó la cosecha de acuerdo a los Estándares de Sostenibilidad para Manejo de Bosques Naturales: Principios, Criterios e Indicadores, Código de Prácticas y Manual de Procedimientos, Decretos Ejecutivos Nº 27388-MINAE publicado el 2 de noviembre de 1998 y Decreto Ejecutivo Nº 34559-MINAE, publicado en La Gaceta Nº 115 del 16 de junio del 2008, el SINAC o el regente forestal certificará el cumplimiento de lo establecido en el Plan de Manejo.

En cada una de las Oficinas Subregionales del SINAC y Oficinas Regionales del FONAFIFO, se mantendrá un mapa actualizado físico y en formato digital fileshape, con las áreas prioritarias para ubicar las fincas que apliquen al Programa de Pago por Servicios Ambientales en la modalidad de protección de bosque.

• a)En contratos de reforestación que incorporen varias especies forestales y con diferentes turnos de cosecha, la vigencia del contrato será igual al de la especie que tenga el turno más largo de cosecha y que éste no exceda de quince años, en cuyo caso este sería el lapso máximo de tiempo de la vigencia. En todos los casos, la vigencia de los contratos de reforestación no puede ser menor a diez años.
• b)Para contratos de protección de bosque, contratos de protección de bosque en vacíos de conservación y contratos de protección del recurso hídrico, la vigencia del contrato será de cinco años prorrogables por un período igual, previo cumplimiento de los requisitos que para este fin se establezcan.
• c)Para contratos de manejo de bosque, en los cuales se realizó la cosecha de acuerdo a los Estándares de Sostenibilidad para Manejo de Bosques Naturales: Principios, Criterios e Indicadores, Código de Prácticas y Manual de Procedimientos, Decretos Ejecutivos Nº 27388-MINAE publicado el 2 de noviembre de 1998 y el Decreto Ejecutivo Nº 34559-MINAE, publicado en La Gaceta Nº 115 del 16 de junio del 2008, la vigencia del contrato será de cinco años prorrogables por un período igual, previo cumplimiento de los requisitos que para este fin se establezcan.
• d)Para contratos de regeneración natural en potreros y sitios con potencial productivo fuera de áreas definidas como tierras Kyoto, la vigencia del contrato será de cinco años prorrogables por un período igual, previo cumplimiento de los requisitos que para este fin se establezcan.
• e)Para contratos de regeneración natural en los que se comercialice créditos de carbono bajo convenio o proyecto especifico, la vigencia del contrato será de cinco años.
• f)Para los contratos en los que se desarrollan sistemas agroforestales el plazo de los contratos será de cinco años. En esta modalidad no se realizará la afectación del inmueble ante el Registro Público de la Propiedad.

Las oficinas Regionales del FONAFIFO, serán las encargadas de tramitar y verificar el cumplimiento de los requisitos legales y reglamentarios de las solicitudes de pago por servicios ambientales, una vez cumplidos los mismos elaborarán una resolución de aprobación y remitirán el contrato para su respectiva firma al Director del Fondo Nacional de Financiamiento Forestal.

• a)El pago de servicios ambientales para los proyectos de reforestación con áreas menores o iguales a cincuenta hectáreas, podrán recibir el primer pago por adelantado, ya sea tramitado a través de organizaciones o en forma individual. Para estos proyectos, el primer desembolso del 50% se hará una vez formalizado el contrato con el Estado siempre y cuando el monto a desembolsar esté garantizado según se establezca en el Manual de Procedimientos para el Pago de Servicios Ambientales. En los siguientes años el pago se distribuirá así: 20% en el segundo año, 15% en el tercer año, 10% en el cuarto año y 5% en el quinto año. Estos pagos se realizan a partir de la fecha promedio de plantación. Los proyectos de reforestación que no reciban pago por adelantado, recibirán el primer pago del 50% una vez formalizado el contrato con el Estado, se haya establecido la plantación y se cumpla con los requisitos establecidos en el Manual de Procedimientos para el Pago de Servicios Ambientales. En los siguientes años el pago se distribuirá así: 20% en el segundo año, 15% en el tercer año, 10% en el cuarto año y 5% en el quinto año. Igualmente los pagos se realizarán a partir de la fecha promedio de plantación.
• b)El pago de servicios ambientales para los proyectos de protección del bosque, protección de recurso hídrico y protección de bosque para vacíos de conservación, el primer desembolso del 20%, se hará una vez firmado el contrato con el Estado y que se cumpla con los requisitos establecidos en el Manual de Procedimientos para el Pago de Servicios Ambientales. Los desembolsos de los años siguientes serán de un 20% cada año hasta el quinto año. Los mismos podrán solicitarse a los doce, veinticuatro, treinta y seis y cuarenta y ocho meses de la fecha de vigencia del contrato, exceptuando los contratos con pagos por año vencido, manteniendo en este último caso, la vigencia del contrato hasta el año del último pago.
• c)El pago de servicios ambientales para contratos de manejo de bosque en los cuales se realizó la cosecha de acuerdo a los Estándares de Sostenibilidad para Manejo de Bosques Naturales: Principios, Criterios e Indicadores, Código de Prácticas y Manual de Procedimientos, Decretos Ejecutivos Nº 27388-MINAE publicado el 2 de noviembre de 1998 y el Decreto Ejecutivo Nº 34559-MINAE, publicado en La Gaceta Nº 115 del 16 de junio del 2008, el primer desembolso del 20%, se hará una vez firmado el contrato con el Estado y que se cumpla con los requisitos establecidos en el Manual de Procedimientos para el Pago de Servicios Ambientales. Los desembolsos de los años siguientes serán de un 20% cada año hasta el quinto año. Los mismos podrán solicitarse a los doce, veinticuatro, treinta y seis y cuarenta y ocho meses de la fecha de vigencia del contrato.
• d)El pago de servicios ambientales para los proyectos de regeneración natural, el primer desembolso del 20%, se hará una vez firmado el contrato con el Estado y que se cumpla con los requisitos establecidos en el Manual de Procedimientos para el Pago de Servicios Ambientales. Los desembolsos de los años siguientes serán de un 20% cada año hasta el quinto año. Los mismos podrán solicitarse a los doce, veinticuatro, treinta y seis y cuarenta y ocho meses de la fecha de vigencia del contrato.
• e)El pago de servicios ambientales para los proyectos en los que se desarrollen sistemas agroforestales, el primer desembolso se hará una vez firmado el respectivo contrato y se certifique por parte del regente forestal el establecimiento de los árboles y su fecha promedio de plantación. Este primer desembolso será de un 65% del monto establecido, para el segundo año será de un 20% y un 15% para el tercer año y podrán solicitarse a los doce y veinticuatro meses después de la fecha promedio de establecimiento de los árboles certificada por el regente forestal.
• f)Estos porcentajes de pago pueden variar de conformidad con acuerdos, convenios o contratos con entidades donantes o socios que reconozcan montos mayores a los establecidos.
