I.-That it is the function of the State to watch over the health of the inhabitants of the Republic and to guarantee their well-being; likewise, it must ensure that such measures do not become an obstacle to the establishment of competitive conditions that contribute to the development of the economic activity of the country.
II.-That the standards developed by the Codex Alimentarius are considered international reference standards by the World Trade Organization.
III.-That said international reference body has recommended, through standard CODEX STAN 234-1999 and its amendments, a series of analysis and sampling methods to verify the quality and safety (inocuidad) of foods.
IV.-That within Costa Rican legislation, there are technical regulations for food products that establish maximum or minimum tolerance limits for certain substances, the non-compliance with which affects the quality or safety (inocuidad) of the product defined in the respective technical regulation and puts at risk the health and the life of consumers.
V.-That some of those technical regulations do not indicate the required analysis methods to verify the quality and safety (inocuidad) parameters contained therein. Therefore, They Decree:

I.-Que es función del Estado velar por la salud de los habitantes de la República y garantizar su bienestar; asimismo, debe procurar que dichas medidas no se constituyan en un obstáculo para el establecimiento de condiciones de competitividad, que contribuyan en el desarrollo de la actividad económica del país.
II.-Que las normas elaboradas por el Codex Alimentarius son consideradas de referencia internacional por parte de la Organización Mundial de Comercio.
III.-Que dicho organismo de referencia internacional ha recomendado mediante la norma CODEX STAN 234-1999 y sus enmiendas, una serie de métodos de análisis y muestreo para comprobar la calidad e inocuidad de los alimentos.
IV.-Que dentro de la legislación costarricense, existen reglamentos técnicos para productos alimenticios que establecen límites máximos o mínimos de tolerancia para ciertas sustancias, cuyo incumplimiento afecta la calidad o inocuidad del producto definido en el reglamento técnico respectivo y ponen en riesgo la salud y la vida de los consumidores.
V.-Que algunos de esos reglamentos técnicos no indican los métodos de análisis requeridos, para verificar los parámetros de calidad e inocuidad contenidos en los mismos. Por tanto,
