Use of Terms In the Convention for the Establishment of the Sustainable Tourism Zone of the Caribbean, unless the context otherwise requires; "Caribbean Region" or any other similar geographical indication, means the portion of land and marine areas over which the Member States and Associate Members of the Association of Caribbean States, created by the Constitutive Convention of Cartagena (1994), exercise sovereignty, sovereign rights, and jurisdiction, as the case may be, in accordance with international law; "Convention" means the Convention for the Establishment of the Sustainable Tourism Zone of the Caribbean; "destination" means a specified geographical area of one of the Contracting Parties or the entire country or territory of one of the Contracting Parties, as the case may be.

Scope of Application Number the existing provision of Article 2 of the Convention as paragraph 1 and insert a new paragraph 2 to read as follows:

"2. For the purposes of this Convention, 'the Caribbean Sea basin' means 'the Caribbean Region'."

Obligations of the Parties Number the existing provisions of Article 3 of the Convention as paragraph 1 and insert a new paragraph 2 to read as follows:

"2. Nothing in this Article shall be interpreted as granting a right to the ACS Special Committee on Transport to negotiate or determine international civil aviation route traffic rights on behalf of one of the Parties."

Functions of the Special Committee on Sustainable Tourism (1) Insert a new paragraph at the beginning of Article 4 of the Convention to read as follows:

"The Sustainable Tourism Committee established by Ministerial Council Agreement 13/96, approved during the Second Ordinary Meeting held in Havana, Cuba, in December 1996 (and renamed by Agreement 1/00 as the Special Committee on Sustainable Tourism), shall be the principal agent for the development and implementation of this Convention." (2) Amend subparagraph E. of Article 4 of the Convention as follows:

"E. Recommend a mechanism for the Parties to receive assistance in the application and implementation of the strategies and other decisions of the Ministerial Council relating to the Zone, taking into account regional initiatives;" (3) Amend the last paragraph of Article 4 of the Convention as follows:

"To carry out the assigned functions, the Special Committee on Sustainable Tourism shall establish a panel of technicians and experts from the Contracting Parties to the Convention, appointed on the basis of an equitable geographical and linguistic distribution among such Parties, whose composition and obligations shall be defined in the 'Norms for the Identification, Approval, and Categorization of the Destinations that comprise the Sustainable Tourism Zone of the Caribbean'."

Amendments In Article 12 of the Convention, the word "Signatories" shall be replaced by the words "Contracting Parties."

Relationship between the Convention and the Protocol This Protocol shall be read as a single instrument with the Convention. The specific provisions of this Protocol shall be considered amendments to the Convention.

Signature This Protocol shall be open for signature by any State, Country, or Territory referred to in Article IV of the Constitutive Convention of the Association of Caribbean States that has signed, ratified, or acceded to the same.

Entry into Force 1. This Protocol shall enter into force when it has been signed by fifteen States Parties to the Convention.

2. For any State, Country, or Territory that accedes to this Protocol after it has entered into force, the Protocol shall enter into force for that State, Country, or Territory on the date on which the Convention enters into force for that State, Country, or Territory.

Uso de Términos En el Convenio para el Establecimiento de la Zona de Turismo Sustentable del Caribe, a menos que el contexto lo requiera de otra manera; "Región del Caribe" o cualquier otra indicación geográfica similar, significa la porción de tierra y áreas marinas sobre las cuáles los Estados Miembros y Miembros Asociados de la Asociación de Estados del Caribe, creada mediante el Convenio Constitutivo de Cartagena (1994) ejercen soberanía, derechos soberanos y jurisdicción, según sea el caso, conforme al derecho internacional; "Convenio" significa el Convenio para el Establecimiento de la Zona de Turismo Sustentable del Caribe; "destino" significa un área geográfica especificada de una de la Partes Contratantes o el país o territorio entero de una de las Partes Contratantes, según pueda ser el caso.

Ámbito de Aplicación Numerar la previsión existente del Artículo 2 del Convenio, como párrafo 1 e insertar un nuevo párrafo 2 para que lea como sigue:

"2. Para los propósitos de este Convenio "la cuenca del Mar Caribe" significa "la Región del Caribe".

Obligaciones de las Partes Numerar las previsiones existentes del Artículo 3 del Convenio como párrafo 1 e insertar un nuevo párrafo 2 para que lea como sigue:

"2. Nada en este Artículo puede ser interpretado como otorgamiento de derecho al Comité Especial de Transporte de la AEC para negociar o determinar derechos de tráfico de ruta de aviación civil internacional en nombre de una de las Partes".

Funciones del Comité Especial de Turismo Sustentable (1) Insertar un nuevo párrafo al inicio del Artículo 4 del Convenio que diga lo siguiente:

"El Comité de Turismo Sustentable establecido mediante el Acuerdo 13/96 del Consejo de Ministros, aprobado durante la Segunda Reunión Ordinaria celebrada en la Habana, Cuba, en diciembre de 1996 (y renombrado mediante Acuerdo 1/00, como el Comité Especial de Turismo Sustentable), será el principal agente para el desarrollo e implementación de este Convenio".

(2) Se modifica el literal E. del Artículo 4 del Convenio de la siguiente forma:

"E. Recomendar un mecanismo para que las Partes reciban asistencia en la aplicación y ejecución de las estrategias y otras decisiones del Consejo de Ministros relativas a la Zona teniendo en cuenta las iniciativas regionales"; (3) Se modifica el último párrafo, del Artículo 4 del Convenio, de la siguiente forma:

"Para llevar a cabo las funciones asignadas, el Comité Especial de Turismo Sustentable establecerá un panel de técnicos y expertos de las Partes Contratantes del Convenio, designado sobre la base de una distribución geográfica y lingüística equitativa entre tales Partes, cuya formación y obligaciones serán definidas en las "Normas para la Identificación, Aprobación y Categorización de los Destinos que integran la Zona de Turismo Sustentable del Caribe".

Enmiendas En el Artículo 12 del Convenio, la palabra "Suscriptores" será substituida por las palabras "Partes Contratantes".

Relación entre el Convenio y el Protocolo Este Protocolo será leído como un solo instrumento con el Convenio. Las previsiones específicas de este Protocolo serán consideradas modificaciones al Convenio.

Firma Este Protocolo estará abierto a la firma por cualquier Estado, País o Territorio referido en el Artículo IV del Convenio Constitutivo de la Asociación de Estados del Caribe, que haya firmado, ratificado o adherido al mismo.

Entrada en vigencia 1. Este Protocolo entrará en vigencia cuando sea firmado por quince Estados Partes del Convenio.

2. Para cualquier Estado, País o Territorio que se adhiera este Protocolo después que el mismo haya entrado en vigor, el Protocolo entrará en vigor para ese Estado, País o Territorio, en la fecha en que el Convenio entre en vigor para ese Estado, País o Territorio.
