Reservations Any State, Country and Territory may make reservations to this Agreement at the time of its signature, ratification or accession; provided that the reservation concerns one or more specific provisions or particular elements and is compatible with the object and purpose of this Agreement. The reservations shall be submitted to the Depositary, who shall inform the other Parties thereof.

Faced with this, the ACS, within the normative framework of the Sustainable Tourism Zone of the Caribbean, is proposing the generation of its own models for endorsing sustainability.
During the II Summit of Heads of State and/or Government held in the City of Santo Domingo, Dominican Republic, in April 1999, the Ministers of Foreign Affairs of the Member Countries and Associate Members of the ACS signed the Memorandum of Understanding, in which the principles, strategies and actions for the Establishment of the Sustainable Tourism Zone of the Caribbean were defined. The actions were framed within the Immediate Action Plan which was to be applied by the National Tourism Authorities.
Likewise, the Ministers of Foreign Affairs instructed the Special Committee on Tourism to work on the elaboration of a Legally Binding Instrument that would replace the Memorandum of Understanding, as well as a document expressing the minimum criteria and values that would shape the Sustainable Tourism Zone.
The Special Committee on Tourism formed two working groups for the development of the mandate granted, one of Legal Experts to shape the Legal Instrument and another of values to be considered.
It is appropriate to clarify that there is a difference between the global goals and objectives embodied in the 12 strategies set forth in Article 3, subparagraph B of the Agreement for the Establishment of the Sustainable Tourism Zone of the Caribbean, whose achievement corresponds to the individual or integral work of the Member Countries and Associate Members of the ACS and its Secretariat, with respect to the goals and objectives for achieving the sustainability of the Tourist Destinations expressed in Indicators whose fulfillment corresponds to said destinations.
In this sense, as provided in Article 5, subparagraph B of the Agreement for the Establishment of the Sustainable Tourism Zone of the Caribbean, the regulatory instrument for the identification, approval and categorization of the destinations that comprise the Sustainable Tourism Zone of the Caribbean is presented below.
Objectives:
- To contribute to the achievement of sustainability in the tourist destinations identified by the Member Countries and Associate Members of the ACS, through categorization[1][1] by means of indicators that define the different degrees of progress, and which become, at the same time, teaching and incentive mechanisms to achieve that purpose.
1 The categorization must include the identification and the valuation criteria of the Sustainability Indicators.
- To determine Tourism Indicators capable of stimulating the generation of changes oriented towards its Sustainability, as a means for raising awareness in the rational use of tourism resources, of the Member Countries and Associate Members of the ACS, in the social, cultural, environmental and economic spheres.
- There are differences in the conditions of the Member Countries and Associate Members of the ACS. These differences make it necessary to propose a set of specific indicators that allow harmonizing the criteria for the sustainable categorization of destinations.
- The tourism sector interacts with economic, cultural, social and environmental elements that must be taken into account.
- In the countries and in the region there are institutions and organizations that possess and apply measurement systems that can contribute to the categorization of destinations. It is desirable and convenient to take advantage of those experiences.
Basic Principles that the indicators must fulfill:
- To constitute a simple, practical, feasible system to apply and achieve in the countries and destinations of the ACS.
- To be capable of measuring the level of Tourism Sustainability of the Destinations of the Member Countries and Associate Members of the ACS, through instruments or models framed in the environmental, social, cultural and economic areas.
- To form a system capable of evolving from simple to complex, progressing gradually and in the most homogeneous manner possible among all the countries of the area.
- To make up a minimum set of indicators that are synthetic, representative, comparable between destinations and preferably quantitative.
Procedure to be followed for the incorporation and categorization of a destination into the Sustainable Tourism Zone of the Caribbean:
1. The request for the incorporation of destinations shall be presented by the Member States and Associate Members of the ACS to the Special Committee on Sustainable Tourism. The Member States and Associate Members must provide the necessary information, based on the value scheme of the Tourism Sustainability Indicators, to consider the incorporation and corresponding categorization of the destination into the Sustainable Tourism Zone of the Caribbean.
2. The information to be provided and that required by the Special Committee on Sustainable Tourism must be duly endorsed by the competent authority of the respective country, as provided in Article 3, subparagraph F, of the Agreement for the Establishment of the Sustainable Tourism Zone of the Caribbean.
3. The Special Committee on Sustainable Tourism shall analyze and evaluate the proposal presented, and once the requirements are met, shall, for the purpose of its integration and categorization into the Sustainable Tourism Zone of the Caribbean, recommend its approval to the Council of Ministers.
4. If a proposal presents inconsistency in the information, the Special Committee on Sustainable Tourism shall recommend to the Member State or Associate Member of the ACS to make the pertinent corrections in order to restart the analysis and evaluation process.
5. The Secretariat of the Association of Caribbean States shall register as parts of the Zone the destinations approved by the Council of Ministers, and shall be responsible for the dissemination of the Zone and the promotion of these destinations.
Panel of Experts:
The Special Committee on Sustainable Tourism shall avail itself of a panel of experts that shall be composed of highly qualified specialists from institutions and organizations of the Member States and Associate Members of the ACS, not belonging to the evaluated destination.
The Special Committee on Sustainable Tourism shall establish a verification mechanism for the indicators.
The Panel of Experts shall have the following functions:
a. Verify compliance with the indicators and consequently recommend the inclusion or exclusion of a destination at a given degree of sustainability (sustentabilidad).
b. Specify the measurement parameters of the indicators, proposing them and submitting them for the approval of the Special Committee on Sustainable Tourism.
c. Define a standardized methodology for collecting the information for the calculation of the indicators.
How to establish the categorization of destinations:
For the purpose of categorizing tourist destinations, a continuous improvement process shall be followed, subject to periodic evaluation, in accordance with the provisions of Article 4, subsection A of the Agreement for the Establishment of the Sustainable Tourism Zone of the Caribbean (Convenio para el Establecimiento de la Zona de Turismo Sustentable del Caribe), which allows the applicant destinations to be placed within the following categories:
- Committed Tourist Destination.
Aspiring destination or one committed to achieving tourism sustainability. The destination carries out a confidential diagnosis referring to the indicators and undertakes to achieve the minimum values of the sustainability indicators within a period of no more than five years.
- Tourist Destination with a Minimum Degree of Sustainability.
The destination has met the minimum values of the tourism sustainability indicators.
- Tourist Destination with a Medium Degree of Sustainability.
The destination has reached the intermediate values of the tourism sustainability indicators.
- Tourist Destination with a Superior Degree of Sustainability.
The destination has reached the maximum values of the tourism sustainability indicators.
This Normative Document shall be modified by the Special Committee on Sustainable Tourism when deemed necessary, due to the dynamics of the tourism activity to be developed in the Sustainable Tourism Zone of the Caribbean.
