in the entirety of the text - Full Text of Norm 36336 Regulates the navigation schedule from 6:00 to 18:00 for vessels on the navigable Rivers and Canals that flow into the Río San Juan Full Text of acta: D6B21 No. 36336-MSP-MOPT THE PRESIDENT OF THE REPUBLIC AND THE MINISTERS OF PUBLIC SECURITY AND OF PUBLIC WORKS AND TRANSPORT In use of the powers conferred by articles 140, subsections 3), 6) and 18), and 146 of the Political Constitution, and 27, 28 subsection 2b), of Law No. 6227, General Law of Public Administration.
I.-That as a result of the latent threat to territorial integrity, recently arisen in the northern zone of our country, it is necessary to determine a set of actions and preventive measures with the aim of guaranteeing citizen security in said zone and the defense of the national territory.
II.-That the safety of navigation in waters under national jurisdiction is the responsibility of the State, which for this purpose has the obligation to issue the corresponding regulation to satisfy that purpose, being able to limit or restrict, for reasons of public security, the transit or stay of vessels in determined zones, ports, and access or exit channels.
III.-That the navigation of vessels must conform to essential safety criteria in order to guarantee the safeguarding of fundamental legal interests such as life, the integrity of persons, as well as their property.
IV.-That in accordance with Law No. 4786, "Reforma a la Ley de Creación del Ministerio de Transportes", it is the responsibility of the Ministry of Public Works and Transport to regulate and control international maritime, cabotage, and inland waterway transportation. Likewise, in accordance with Law No. 8000, "Ley de Creación del Servicio Nacional de Guardacostas", it is the responsibility of the Servicio Nacional de Guardacostas to monitor and guard the navigable inland waters of the State, as well as to ensure the safety of port and maritime traffic for both national and foreign vessels in the jurisdictional waters of the State.
V.-That the measures ordering the navigation of vessels established by this act do not infringe upon freedom of transit or freedom of commerce, since they do not impede the generalized use of fluvial and lacustrine routes by vessels, but rather regulate navigation in determined zones, by means of a system of schedules, for the purposes indicated in the first considerando.
VI.-That the Ministries of Public Security and of Public Works and Transport, in use of the powers legally conferred, consider that the application of the provisions related to the restriction of navigation during nighttime hours constitutes a justified, proportional, and reasonable measure. The regulation shall not apply to the vessels of the institutions and dependencies of the State, those belonging to the Fire Department, nor the Red Cross, nor to vessels transporting persons with a medical emergency.
The public authorities shall proceed to apply the sanctions, as appropriate, when the provisions of article one of this Decree are infringed, in accordance with the pertinent and current norms and regulations.
It shall enter into force upon its publication.

I.-Que como consecuencia de la amenaza latente contra la integridad territorial, suscitada reciente en la zona norte de nuestro país, es necesario determinar un conjunto de acciones y medidas preventivas con la finalidad de garantizar la seguridad ciudadana en dicha zona y la defensa del territorio nacional.
II.-Que la seguridad de la navegación en aguas de jurisdicción nacional es responsabilidad del Estado, que a tal efecto tiene la obligación de dictar la regulación que corresponda para satisfacer tal fin, pudiendo limitar o restringir, por razones de seguridad pública, el tránsito o la permanencia de embarcaciones en determinadas zonas, puertos y canales de acceso o salida.
III.-Que la navegación de las embarcaciones debe ajustarse a criterios esenciales de segundad con el fin de garantizar la salvaguarda de bienes jurídicos fundamentales como es el caso de la vida, integridad de las personas, así como su patrimonio.
IV.-Que de conformidad con la Ley N° 4786, "Reforma a la Ley de Creación del Ministerio de Transportes", es responsabilidad del Ministerio de Obras Públicas y Transportes regular y controlar el transporte marítimo internacional, de cabotaje y por vías de navegación interior. Asimismo, de conformidad con Ley N° 8000, "Ley de Creación del Servicio Nacional de Guardacostas", es responsabilidad del Servicio Nacional de Guardacostas vigilar y resguardar las aguas interiores navegables del Estado, así como velar por la seguridad del tráfico portuario y marítimo tanto de naves nacionales como extranjeras en las aguas jurisdiccionales del Estado.
V.-Que las medidas ordenadoras de la navegación de embarcaciones que por este acto se establecen no infringen la libertad de tránsito ni la libertad de comercio, por cuanto no impiden el uso generalizado de las rutas fluviales y lacustres por parte de las embarcaciones, sino que regulan la navegación en determinadas zonas, mediante un sistema de horarios, para los fines señalados en el considerando primero.
VI.-Que los Ministerios de Seguridad Pública y de Obras Públicas y Transportes en uso de las potestades conferidas legalmente, consideran que la aplicación de las disposiciones relacionadas con la restricción de la navegación en horarios nocturnos constituye una medida justificada, proporcional y razonable. Por Tanto,

La navegación de todo tipo de embarcación será únicamente entre las 6:00 y las 18:00 horas en las desembocaduras de los ríos y canales navegables que que desemboquen en el Río San Juan, entre ellos, el Sarapiquí, San Carlos y el Infiernito, y en el Río Colorado.
