I.—That article 11 of the Ley General de Aduanas provides that "The General Directorate of Customs is the senior hierarchical national body in customs matters. In the exercise of this competence, it is responsible for the technical and administrative direction of the customs functions that this law and the other provisions of the branch grant to the Servicio Nacional de Aduanas; the issuance of policies and guidelines for the activities of the customs offices and units under its charge; the exercise of customs powers, and the decision of challenges filed before it by citizens." The foregoing, in accordance with articles 6 and 7 of the Reglamento a la Ley General de Aduanas.

II.—That article 6 of the Ley General de Aduanas, subparagraph b) establishes among the purposes of the customs legal regime "To facilitate and of Customs has among its priorities the facilitation of customs service procedures, through the provision to the National Customs System of agile and timely procedures, maximizing the use of technology.

III.—That article 9 of the Ley General de Aduanas, subparagraph f), provides that among the functions of the Servicio Nacional de Aduanas is "To apply, in coordination with the other competent offices, the non-tariff regulations (regulaciones no arancelarias) that govern the entries into and exits from the customs territory of vehicles, transport units, and goods." IV.—That Article 4 of the Ley General de la Administración Pública No. 6227 of May 2, 1978, regulates that "The activity of public entities must be subject in its entirety to the fundamental principles of public service, to ensure its continuity, its efficiency, its adaptation to any change in the legal regime or in the social need they satisfy, and equality in the treatment of recipients, users, or beneficiaries." V.—That Article 6 of the Reglamento a la Ley General de Aduanas, Decreto Ejecutivo No. 25270-H of June 14, 1996, its current amendments and modifications, establishes:

"It is the competence of the General Directorate to determine and issue the policies and guidelines that orient the decisions and actions toward the effective fulfillment of the purposes of the customs legal regime and the achievement of the objectives of the Servicio Nacional de Aduanas." VI.—That article 7 of the Reglamento a la Ley General de Aduanas, Decreto Ejecutivo No. 25270-H of June 14, 1996, its current amendments and modifications, provides that among the functions of the General Directorate of Customs are:

"i. To coordinate actions with the Ministries, bodies, and other entities related to the customs process, in order to harmonize customs policies." VII.—That article 18 bis of the Reglamento a la Ley General de Aduanas, among the functions of the Dirección de Gestión Técnica, establishes:

"e. To keep the information and auxiliary registration systems updated, ensuring their adequate control.

f. To provide technical support to the units of the Servicio Nacional de Aduanas, public or private entities, and to coordinate the corresponding actions in matters of its competence." VIII.—That according to article 21 of the Reglamento a la Ley General de Aduanas, cited supra, "The Departamento de Técnica Aduanera is responsible for the definition of matters related to the issuance of guidelines on tariff classification (clasificación arancelaria) and origin of goods. It is responsible for the implementation and fulfillment of international agreements, as well as keeping the tariff updated, facilitating the transmission of knowledge in said areas." IX.—That article 21 bis, subparagraph b., of the Reglamento a la Ley General de Aduanas already cited, charges the Departamento de Técnica Aduanera of the Dirección de Gestión Técnica with, among other functions:

"e. To analyze the decrees that are published, official letters, requests, and others that imply the modification of the Integrated Tariff (Arancel Integrado) and to carry out the corresponding actions and coordination with the competent units, for their inclusion.

g. To keep the Integrated Tariff updated and to define the policies, plan, and coordinate the entry of tariff information and technical standards.

j. To provide information on the tariff and technical standards." X.—That with Ley 7346 of January 9, 1992, the SAC "Sistema Arancelario Centroamericano" is adopted, based on the nomenclature of the Harmonized System, H.S. "nomenclature of the Harmonized Commodity Description and Coding System", sponsored by the Customs Cooperation Council, which constitutes the tariff classification of import and export goods at the Central American level.

XI.—That through Decreto Ejecutivo No. 22593 of November 12, 1993, published in La Gaceta No. 217, Alcance 39, and Decreto Ejecutivo No. 22594 of November 12, 1993, published in La Gaceta No. 217, Alcance 39, six columns are added to the SAC that include, among others, "(e) the codes of the Technical Notes (N.T.) that identify the type of document and the office responsible for issuing it." XII.—That the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES), signed in Washington on March 3, 1973, and amended in Bonn on June 22, 1979, is an international agreement concluded between governments and has the purpose of ensuring that international trade in specimens of wild animals and plants does not constitute a threat to their survival.

XIII.—That in the amendments to Appendices I and II of the Convention approved by the Conference of the Parties, at its 15th meeting, Doha (Qatar), from March 13 to 25, 2010, in accordance with the provisions of Article XV of the Convention, the following decision was adopted: to include in Appendix II of the Convention: "Amphibia Hylidae Agalychnis spp." XIV.—That by official letter SINAC-DE-GMRN-352, dated August 19, 2010, signed by Mr. José Joaquín Calvo Domingo, CITES Focal Point, CITES Administrative Authority, he informs that at the 15th meeting of the CITES Convention, all species of the amphibian genus Agalychnis were included in Appendix II, and therefore, their import and export are subject to the CITES permit, and he thus requests the inclusion of the technical note for said species.

XV.—That the "Import and export permit of the convention on International Trade in endangered species of wild fauna and flora (CITES)" is currently identified as a technical note with code 81.

XVI.—That in order to implement the preceding provision requested by SINAC, the necessary change has been made in the Automated Tariff (Arancel Automatizado) as indicated in the operative part (Por tanto) of this Resolution, and Customs Agencies are reminded that they must carry out the corresponding update in the tariff that each one uses. Therefore, THE DIRECTOR GENERAL OF CUSTOMS,

Based on the powers granted in the Ley General de Aduanas, number 7557 of October 20, 1995, its current amendments and modifications, the Reglamento a la Ley General de Aduanas, Decreto Ejecutivo number 25270-H of June 14, 1996, its current amendments and modifications, and with support in the foregoing considerations, this General Directorate of Customs orders:

1. To implement a national entry in the Automated Tariff to identify the frogs of the species of the amphibian genus Agalychnis and to add Technical Note 81 to it, as detailed below.

en la totalidad del texto - Texto Completo Norma 329 Realiza apertura nacional en el Arancel Automatizado para identificar las ranas de la especie del género anfibios agalychnis y adiciona la Nota Técnica 81 Texto Completo acta: D3FD9 DIRECCIÓN GENERAL DE ADUANAS Resolución RES-DGA-329-2010.-San José, a las quince horas del veintitrés de setiembre del dos mil diez.

I.-Que el artículo 11 de la Ley General de Aduanas, dispone que "La Dirección General de Aduanas es el órgano superior jerárquico nacional en materia aduanera. En el uso de esta competencia, le corresponde la dirección técnica y administrativa de las funciones aduaneras que esta ley y las demás disposiciones del ramo le conceden al Servicio Nacional de Aduanas; la emisión de políticas y directrices para las actividades de las aduanas y dependencias a su cargo; el ejercicio de las atribuciones aduaneras y la decisión de las impugnaciones interpuestas ante ella por los administrados". Lo anterior, en concordancia con el artículo 6 y 7 del Reglamento a la Ley General de Aduanas.

II.-Que el artículo 6 de la Ley General de Aduanas, punto b) establece entre los fines del régimen jurídico aduanero "Facilitar y agilizar las operaciones de comercio exterior", por ende la Dirección General de Aduanas, tiene entre sus prioridades la facilitación de los trámites de los servicios aduaneros, a través de la dotación al Sistema Aduanero Nacional de procedimientos ágiles y oportunos maximizando el uso de la tecnología.

III.-Que el artículo 9 de la Ley General de Aduanas, punto f), dispone que entre las funciones del Servicio Nacional de Aduanas, está "Aplicar, en coordinación con las demás oficinas competentes, las regulaciones no arancelarias que norman las entradas y salidas del territorio aduanero, de vehículos, unidades de transporte y mercancías." IV.-Que el Artículo 4º de la Ley General de la Administración Pública Nº 6227 de 02 de mayo de 1978, regula "La actividad de los entes públicos deberá estar sujeta en su conjunto a los principios fundamentales del servicio público, para asegurar su continuidad, su eficiencia, su adaptación a todo cambio en el régimen legal o en la necesidad social que satisfacen y la igualdad en el trato de los destinatarios, usuarios o beneficiarios".

V.-Que el Artículo 6º del Reglamento a la Ley General de Aduanas, Decreto Nº 25270-H de 14 de junio de 1996, sus reformas y modificaciones vigentes, establece:

"Es competencia de la Dirección General, determinar y emitir las políticas y directrices que orienten las decisiones y acciones hacia el efectivo cumplimiento de los fines del régimen jurídico aduanero y la consecución de los objetivos del Servicio Nacional de Aduanas".

VI.-Que el artículo 7, del Reglamento a la Ley General de Aduanas, Decreto Nº 25270-H de 14 de junio de 1996, sus reformas y modificaciones vigentes, dispone que entre las funciones de la Dirección General de Aduanas están:

"i. Coordinar acciones con los Ministerios, órganos y demás entes relacionados con el proceso aduanero, con el fin de armonizar las políticas aduaneras".

VII.-Que el artículo 18 bis del Reglamento a la Ley General de Aduanas, entre las funciones de la Dirección de Gestión Técnica establece:

"e. Mantener actualizados los sistemas de información y registro de auxiliares, asegurando su adecuado control.

f. Brindar apoyo técnico a las dependencias del Servicio Nacional de Aduanas, entidades públicas o privadas y coordinar las acciones correspondientes en materia de su competencia".

VIII.-Que según el artículo 21 del Reglamento a la Ley General de Aduanas, supra citado, "Al Departamento de Técnica Aduanera le compete la definición de los asuntos relacionados con la emisión de los lineamientos en materia de clasificación arancelaria y origen de las mercancías. Le compete la implementación y cumplimiento de convenios internacionales, así como mantener actualizado el arancel, facilitando la transmisión de conocimiento en dichas áreas." IX.-Que el artículo 21 bis, literal b., del Reglamento a la Ley General de Aduanas ya citado, encarga al Departamento de Técnica Aduanera de la Dirección de Gestión Técnica entre otras funciones:

"e. Analizar los decretos que se publiquen, oficios, solicitudes y otros que impliquen la modificación del Arancel Integrado y realizar las acciones y coordinaciones que correspondan con las dependencias competentes, para su inclusión.

g. Mantener actualizado el arancel integrado y definir las políticas, planificar y coordinar el ingreso de la información arancelaria y normas técnicas.

j. Brindar información sobre el arancel y normas técnicas." X.-Que con la Ley 7346 de 09 de enero de 1992, se adopta el SAC "Sistema Arancelario Centroamericano", basado en la nomenclatura del Sistema Armonizado, S.A. "nomenclatura del Sistema Armonizado de Designación y Codificación de Mercancías", auspiciado por el Consejo de Cooperación Aduanera, el cual constituye la clasificación arancelaria de las mercancías de importación y exportación a nivel centroamericano.

XI.-Que mediante Decreto Ejecutivo Nº 22593 de fecha 12 de noviembre de 1993, publicado en La Gaceta Nº 217 Alcance 39 y el Decreto Ejecutivo Nº 22594 de fecha 12 de noviembre de 1993, publicado en La Gaceta Nº 217, Alcance 39, se adiciona al SAC seis columnas que incluyan entre otros "(e) los códigos de las Notas Técnicas (N.T.) que identifican el tipo de documento y la oficina encargada de emitirlo." XII.-Que la Convención sobre el Comercio Internacional de Especies Amenazadas de Fauna y Flora Silvestres (CITES) Firmada en Washington el 3 de marzo de 1973 Enmendada Bonn, el 22 de junio de 1979 es un acuerdo internacional concertado entre los gobiernos y tiene por finalidad velar por que el comercio internacional de especímenes de animales y plantas silvestres no constituye una amenaza para su supervivencia.

XIII.-Que en las enmiendas a los Apéndices I y II de la Convención aprobadas por la Conferencia de las Partes, en su 15ª reunión, Doha (Qatar), del 13 al 25 de marzo del 2010, de conformidad con lo dispuesto en el Artículo XV de la Convención adoptó la siguiente decisión, incluir en el Apéndice II de la Convención: "Amphibia Hylidae Agalychnis spp." XIV.-Que con oficio SINAC-DE-GMRN-352, de fecha 19 de agosto del 2010, suscrito por el señor José Joaquín Calvo Domingo, Punto Focal CITES, Autoridad Administrativa CITES, informa que en la 15ª reunión de la Convención CITES, fue incluido en el Apéndice II todas las especies del género de anfibios Agalychnis y por lo tanto, su importación y exportación está sujeta al permiso de CITES, por lo que solicita incluir la nota técnica a dichas especies.

XV.-Que el "Permiso de importación y exportación de la convención sobre el Comercio Internacional de especies amenazadas de fauna y flora silvestres (CITES), actualmente se identifica como nota técnica con el código 81.

XVI.-Que con el fin de implementar la disposición precedente solicitada por el SINAC se ha efectuado el cambio necesario en el Arancel Automatizado tal y como se indica en el Por tanto de esta Resolución y se les recuerda a las Agencias de Aduana que deben realizar la correspondiente actualización en el arancel que cada una utilice. Por tanto, EL DIRECTOR GENERAL DE ADUANAS,

Con base en las potestades otorgadas en la Ley General de Aduanas número 7557 de fecha 20 de octubre de 1995, sus reformas y modificaciones vigentes, el Reglamento a la Ley General de Aduanas Decreto Ejecutivo número 25270-H de fecha 14 de junio de 1996, sus reformas y modificaciones vigentes, y con sustento en las consideraciones anteriores, esta Dirección General de Aduanas dispone:

1. Realizar apertura nacional en el Arancel Automatizado para identificar las ranas de la especie del género anfibios Agalychnis y adicionarle la Nota Técnica 81, como se detalla de seguido.
