Full Text of acta: D3A17 MUNICIPALITY OF SANTA CRUZ The agreement adopted by the Municipal Council is hereby transcribed, in extraordinary session No. 18-2010, article 03, item 09, dated July 01, 2010, where the following was agreed:
Item 09: The Opinion of the Maritime-Terrestrial Zone Commission signed by council members Róger Sánchez Fonseca, Celia Pastrana Gutiérrez, and Francisco Zúñiga Barrantes is acknowledged; which states:
Commission Opinion:
We, members of the Maritime-Terrestrial Zone Commission, have studied and analyzed the document presented by "Lic. Juan Carlos Borbón Marks," general manager of the ICT, and forwarded to this Commission by the Council Secretariat via official memorandum SM-1585-ORD.50-2009. We have agreed to recommend to this Honorable Municipal Council, based on the recommendation sent to us by the Legal Advisor, who has given us a satisfactory explanation stating the following:
"c) For the case of granting concessions, the respective Municipality must use the current State Natural Heritage Certification to verify that the requested parcel does not conflict with the State Natural Heritage. Concession applications will only be processed when the respective cadastral map is not affected in any way by the State Natural Heritage certified as of that date." In this manner, I recommend issuing, by the Municipal Council, a directive addressed to the Municipal Mayor, so that the Maritime-Terrestrial Zone Department is ordered to incorporate the following into the requirements for Concession applications in the Maritime-Terrestrial Zone:
"Prior to the publication of the Edict in La Gaceta, the applicant must submit a Certification indicating that the map describing the area intended for concession is not located within a State Natural Heritage area. This requirement applies to all concession applications currently in process and future ones, as well as to current and future concession renewal applications. Warning that in case of omission, the file will be archived and the concession or renewal application will be declared inadmissible." As the foregoing is a directive binding on third parties, order the Municipal Procurement Office to publish it once in the Official Gazette La Gaceta; said directive shall take effect from the day following its publication.
Therefore, we recommend Approving this Opinion, and also request the Municipal Council Secretariat to notify the ICT, the Z.M.T. Department, and the Municipal Mayor's Office.
It is agreed unanimously: to accept in all its aspects the opinion of the Maritime-Terrestrial Zone Commission.
2.- The Municipal Mayor is authorized to issue the following directive to the Maritime-Terrestrial Zone Department, which states: "Prior to the publication of the Edict in La Gaceta, the applicant must submit a Certification indicating that the map describing the area intended for concession is not located within a State Natural Heritage area. This requirement applies to all concession applications currently in process and future ones, as well as to current and future concession renewal applications. Warning that in case of omission, the file will be archived and the concession or renewal application will be declared inadmissible." 3.- It shall take effect from the day following its publication.

Inciso 09: se conoce Dictamen de Comisión de Zona Marítimo Terrestre firmado por los regidores Róger Sánchez Fonseca, Celia Pastrana Gutiérrez y Francisco Zúñiga Barrantes; que dice:

Nosotros, miembros de la Comisión de Zona Marítimo Terrestre, hemos estudiado y analizado el documento presentado por "Lic. Juan Carlos Borbón Marks" gerente general del ICT y trasladado a esta Comisión por la Secretaría del Concejo mediante el oficio SM-1585-ORD.50-2009, hemos acordado recomendarle a este Honorable Concejo Municipal, en base a la recomendación que nos ha hecho llegar el Asesor Legal, el cual nos ha dado una explicación satisfactoria que dice lo siguiente:
"c) Para el caso del otorgamiento de las concesiones, la Municipalidad respectiva deberá utilizar la Certificación de Patrimonio Natural del Estado vigente, para comprobar que la parcela solicitada no se contrapone con el Patrimonio Natural del Estado. Sólo se dará trámite a solicitudes de concesión cuando el respectivo plano de catastro no esté afectado de ninguna forma por el Patrimonio Natural del Estado certificado a la fecha." De esta manera, recomiendo emitir, por parte del Concejo Municipal, una directriz dirigida al señor Alcalde Municipal, para que se le ordene al Departamento de Zona Marítimo Terrestre que incorpore a los requisitos de solicitudes de Concesiones en la Zona Marítimo Terrestre lo siguiente:
"Previo a la publicación del Edicto en La Gaceta, el solicitante deberá presentar una Certificación que indique que, el plano en el cual se describe el área que se pretende concesionar no se encuentra dentro de un área Patrimonio Natural del Estado. Que este requisito es para todas aquellas solicitudes de concesión que se encuentren en trámite y futuras, así como de las solicitudes de prórrogas de concesión actuales y futuras. Advirtiendo que en caso de omisión, se archivará el expediente y se declarará inadmisible la solicitud de concesión o prórroga." Por ser la anterior una directriz vinculante para terceros, ordénese a la Proveeduría Municipal publicarlo por una sola vez en el Diario Oficial La Gaceta, dicha directriz regirá a partir del día siguiente de su publicación.
Por lo tanto recomendamos Aprobar el presente Dictamen, asimismo que se le solicita a la Secretaría del Concejo Municipal se notifique a ICT, al Departamento de Z.M.T, y Alcaldía Municipal.
Se acuerda por unanimidad: acoger en todos sus extremos el dictamen de la Comisión de Zona Marítimo Terrestre.
2.- Se autoriza al señor Alcalde Municipal, se sirva girar la siguiente directriz al Departamento de Zona Marítimo Terrestre, que dice: "Previo a la publicación del Edicto en La Gaceta, el solicitante deberá presentar una Certificación que indique que, el plano en el cual se describe el área que se pretende concesionar no se encuentra dentro de un área Patrimonio Natural del Estado. Que este requisito es para todas aquellas solicitudes de concesión que se encuentren en trámite y futuras, así como de las solicitudes de prórrogas de concesión actuales y futuras. Advirtiendo que en caso de omisión, se archivará el expediente y se declarará inadmisible la solicitud de concesión o prórroga." 3.- Regirá a partir del día siguiente de su publicación.
