in the entirety of the text - Complete Text of Regulation 36098 Regulation of the Regional Council of the Arenal Tempisque Conservation Area Complete Text of record: D249E No. 36098-MINAET THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT, ENERGY AND TELECOMMUNICATIONS In exercise of the constitutional powers conferred in articles 140, subsections 3) and 18) and 146 of the Political Constitution of Costa Rica, articles 29 and 30 of the Biodiversity Law No. 7788 of April 30, 1998 and articles 22 and 38 of the Regulation to the Biodiversity Law, Executive Decree No. 34433-MINAE of March 11, 2008.
I.-That article 50 of the Political Constitution enshrines in favor of all inhabitants of the Nation the right to a healthy and ecologically balanced environment, this right including the conservation, sustainable use and management of biodiversity and the equitable distribution of benefits derived from it, ensuring the greatest participation of the community.
II.-That article 22 of the Biodiversity Law creates the National System of Conservation Areas, with its own legal personality, as a deconcentrated and participatory system of institutional management and coordination that integrates the competencies in forestry, wildlife, and protected areas matters of the Ministry of Environment, Energy and Telecommunications, for the purpose of dictating policies, planning and executing processes aimed at achieving sustainability in the management of the natural resources of Costa Rica, with the protection and conservation of the use of hydrographic basins and water systems being included as a competency of SINAC, in accordance with institutional competence.
III.-That article 27 subsection a) of the Biodiversity Law, No. 7788 of April 30, 1998 establishes that within the administrative structure of the conservation areas there must exist as an administrative unit, the Regional Council of the Conservation Area known as CORAC.
IV.-That article 38 of the Regulation to the Biodiversity Law, Executive Decree No. 34433-MINAE of March 11, 2008, provides for the functioning of the Regional Councils, establishing that these must draft their own operating regulations based on the general guidelines issued by the National Council of Conservation Areas (CONAC), which must be consistent with Executive Decree No. 34433-MINAE and the Costa Rican legal system.
V.-That in accordance with article 12 subsection d) of the Regulation to the Biodiversity Law, Executive Decree No. 34433-MINAE of March 11, 2008, the National Council of Conservation Areas (CONAC), in Ordinary Session No. 11-2009 held on November 23, 2009, through Agreement No. 23 approved the Regulation for the internal functioning of the Regional Council of the Arenal Tempisque Conservation Area. General Provisions
Considering:
CHAPTER I

Of the purposes of the CORACAT
CHAPTER II.
. Integrating the different sectors of society, public and private, to promote activities for the conservation of natural resources and socio-cultural development in the environment of the ACAT.
. Guaranteeing the efficiency and effectiveness of the conservationist and administrative management of the ACAT, in accordance with environmental and public administration legislation.
. Projecting, promoting and defending the interests of the ACAT in all instances, both nationally and internationally.
Of the structure of the CORACAT
CHAPTER III
The positions shall be the following:
. Presidency . Vice-Presidency . Secretariat (Secretaría) . Treasury (Tesorería) . Member-at-Large I (Vocal I) . Member-at-Large II (Vocal II) The members of the Council shall hold their positions for three years and may be continuously reelected for equal periods.
They shall have a voice but no vote, in accordance with the provisions of article 30 of the Regulation to the Biodiversity Law, Executive Decree No. 34433-MINAE.
For this purpose, the provisions of article 49 of the Regulation to the Biodiversity Law, Executive Decree No. 34433-MINAE shall be taken as a reference.
Of the functions of the CORACAT
CHAPTER IV

. Supervising the execution of the financial resources allocated to the CORACAT.
. Rendering the financial reports of the CORACAT to the Council.
. Ensuring the proper management of the accounting statements and the performance of the CORACAT and of the Executive Secretariat.
. Presenting its recommendations and reports to the CORACAT when the latter requires them.
. Being present at the meetings of the CORACAT.
. Any other function that the CORACAT assigns to it.
It shall have access to the documentation of the CORACAT and shall coordinate with the Executive Secretariat, except in the cases established in the Law.

Of the removals and sanctions to the members of the CORACAT
CHAPTER V
34433-MINAE. Against such removals, a motion for reconsideration (recurso de revocatoria) may be filed before the CORACAT itself, within the time limits provided for in article 346 of the General Law of Public Administration.

The following shall be grounds for removal from office:
. Missing more than 3 consecutive CORACAT sessions without prior justification.
. Failing on four occasions to fulfill the duties inherent to the member's office according to this regulation.
. Acting in opposition to the principles that give foundation to the CORACAT.
Of the financing of the CORACAT
CHAPTER VI
The financing must be included within the annual budget of the ACAT, for which the CORACAT shall prepare an annual activity plan of the economic requirements.

I.-Que el artículo 50 de la Constitución Política consagra a favor de todos los habitantes de la Nación el derecho a un ambiente sano y ecológicamente equilibrado, siendo que este derecho incluye la conservación, uso y manejo sostenible de la biodiversidad y la equitativa distribución de beneficios derivados de ésta, asegurando la mayor participación de la comunidad.
II.-Que el artículo 22 de la Ley de Biodiversidad, crea el Sistema Nacional de Áreas de Conservación, con personería jurídica propia, como un sistema de gestión y coordinación institucional desconcentrado y participativo que integra las competencias en materia forestal, vida silvestre, y áreas protegidas del Ministerio del Ambiente, Energía y Telecomunicaciones, con el fin de dictar políticas, planificar y ejecutar procesos dirigidos a lograr la sostenibilidad en el manejo de los recursos naturales de Costa Rica, quedando incluida como competencia del SINAC, la protección y conservación del uso de cuencas hidrográficas y sistemas hídricos; de acuerdo a la competencia institucional.
III.-Que el artículo 27 inciso a) de Ley de Biodiversidad, Nº 7788 del 30 abril de 1998 establece que dentro de la estructura administrativa de las áreas de conservación debe existir como unidad administrativa, el Consejo Regional de Área de Conservación conocido como CORAC.
IV.-Que el artículo 38 del Reglamento a la Ley de Biodiversidad, Decreto Ejecutivo Nº 34433-MINAE del 11 de marzo de 2008, dispone sobre el funcionamiento de los Consejos Regionales, estableciendo que estos deberán elaborar su propio reglamento de funcionamiento con base en los lineamientos generales emitidos por el Consejo Nacional de Áreas de Conservación (CONAC), el cual deberá ser concordante con el Decreto Ejecutivo Nº 34433-MINAE y el ordenamiento jurídico costarricense.
V.-Que de conformidad al artículo 12 inciso d) del Reglamento a la Ley de Biodiversidad, Decreto Ejecutivo Nº 34433-MINAE del 11 de marzo de 2008, el Consejo Nacional de Áreas de Conservación (CONAC), en Sesión Ordinaria Nº 11-2009 celebrada el día 23 de noviembre del 2009, mediante Acuerdo Nº 23 aprobó el Reglamento para el funcionamiento interno del Consejo Regional del Área de Conservación Arenal Tempisque. Por tanto,

CAPÍTULO I
Disposiciones Generales

De los fines del CORACAT
CAPÍTULO II.
. Integrar los diferentes sectores de la sociedad, públicos y privados, para promover actividades para la conservación de los recursos naturales y el desarrollo socio-cultural en el entorno del ACAT.
. Garantizar la eficiencia y la eficacia de la gestión conservacionista y administrativa del ACAT, acorde con la legislación ambiental y de la administración pública.
. Proyectar, promocionar y defender los intereses del ACAT en todas las instancias, tanto a nivel nacional como internacional.
De la estructura del CORACAT
CAPÍTULO III
Los puestos serán los siguientes:
. Presidencia . Vicepresidencia . Secretaría . Tesorería . Vocal I . Vocal II Los miembros del Consejo, durarán en sus cargos tres años, pudiendo ser reelectos en forma continua por períodos iguales.
Tendrán voz pero no voto, de conformidad a lo indicado en el artículo 30 del Reglamento a la Ley de Biodiversidad Decreto Ejecutivo Nº 34433-MINAE.
Para ello se tomará como referencia lo indicado en el artículo 49 del Reglamento a la Ley de Biodiversidad Decreto Ejecutivo Nº 34433-MINAE.
De las funciones del CORACAT
CAPÍTULO IV
. Supervisar la ejecución de los recursos financieros destinados al CORACAT.
. Rendir los informes financieros del CORACAT ante el Consejo.
. Velar por el buen manejo de los estados contables y el desempeño de la CORACAT y de la Secretaría Ejecutiva.
. Presentar sus recomendaciones e informes al CORACAT cuando éste lo requiera.
. Estar presente en las reuniones del CORACAT.
. Cualquier otra que el CORACAT le asigne.
Tendrá acceso a la documentación del CORACAT y coordinará con la Secretaría Ejecutiva, salvo en los casos establecidos en la Ley.
De las remociones y sanciones a los miembros del CORACAT
CAPÍTULO V
Ante dichas remociones, se podrá presentar recurso de revocatoria ante el mismo CORACAT, dentro de los plazos previstos en el artículo 346 de la Ley General de Administración Pública.
Serán causas de remoción del cargo las siguientes:
. Faltar a más de 3 sesiones consecutivas al CORACAT sin justificación previa.
. Incumplir en cuatro ocasiones con los deberes propios de su cargo según este reglamento.
. Actuar en oposición a los principios que dan fundamento al CORACAT.
Del financiamiento del CORACAT
CAPÍTULO VI
El financiamiento debe estar contemplado dentro del presupuesto anual del ACAT, para lo cual el CORACAT elaborará un plan anual de actividades de los requerimientos económicos.
