1917 of July 30, 1955, the governing body in tourism matters is the Costa Rican Tourism Institute, which is responsible for promoting and overseeing private activity related to tourism services.

Therefore, They decree:

Regulation for the Granting of the Certificate of Tourism Sustainability

Of the purpose and definitions

For this purpose, specific manuals will be available, which respond to the dynamics of the different tourism activities, in which environmental, economic, sociocultural, and physical plant elements that will make up the so-called CST Norm will be considered.

• a)Sustainability: Deliberate and concerted policy among all sectors of society, which facilitates the action of the public and private sector as well as national cooperation within a planning framework, in which the profitable operation of the tourism sector, the provision and effective control of the impact on other areas of the regional economies, the environment, and culture are permanently and harmoniously articulated, sharing with the communities the benefits generated by the activity.
• b)Certificate of Tourism Sustainability (CST): Voluntary accreditation system, approved by the National Accreditation Commission for companies that meet the requirements of this Regulation and the respective manuals. It includes the processes, requirements, norms, manuals, and others that give foundation to the Certificate of Tourism Sustainability program or system.
• c)CST Norm: Document that contains the specific areas and parameters, according to the tourism activity in question, that the company must comply with to obtain the certificate.
• d)CST Certificate: Public and formal recognition through which the CNA confers the CST to the tourism company.
• e)Induction: It is a transfer of knowledge and information provided to tourism companies aspiring to the Certification process.
• f)Evaluation: Process carried out by the Technical Execution Committee of the CST or by the external evaluation bodies (O.E.E) to determine the level of sustainability of a tourism company based on the CST Norm.
• g)External Evaluation Body (OEE): Legal entity, for-profit or non-profit, that advises, manages, trains, and evaluates or reevaluates tourism companies applying for the CST.
• h)Accreditation: It is an exclusive function of the National Accreditation Commission through which OEEs are authorized to operate and academic entities are authorized to train within the CST program.

Of the purposes of the CST program

• a)To be the instrument through which Costa Rica differentiates itself in the world as a sustainable tourism destination.
• b)To provide reliable information about certified companies.
• c)To establish sustainability as an element of competitiveness within the companies that make up the tourism sector at the national and international level.

Of the national accreditation commission

The Commission shall have technical and certification competence in the field of sustainable tourism, and its members shall be solely responsible for the technical administration of the program.

• a)Costa Rican Tourism Institute (ICT), which will preside over it.
• b)National Biodiversity Institute (INBIO) c) Central American Institute of Business Administration (INCAE) d) International Union for Conservation of Nature (IUCN) e) National Chamber of Tourism (CANATUR) f) University of Costa Rica (UCR) g) Ministry of Environment, Energy and Telecommunications (MINAET) h) National Chamber of Ecotourism and Sustainable Tourism (CANAECO).

(The previous subsection was thus added by article 2° of executive decree No. 37749 of May 9, 2013)

The CNA shall have a vice president, appointed by itself from among its other representatives, who shall preside over the sessions in the absence of the president. The CNA and its members shall perform their functions on an ad honorem basis.

Quorum shall be with the attendance of at least five members.

(The previous paragraph was thus amended by article 1° of executive decree No. 37749 of May 9, 2013)

Its agreements shall be adopted by absolute majority, which shall become final at the next session as provided in the General Law of Public Administration, unless the members present agree to its finality by a vote of two-thirds of the total members of the CNA. In the event of a tie in voting, the President shall have a double vote.

Once declared final, the final acts of the CNA shall have the power to exhaust the administrative route.

• a)To confer the CST level, as well as to cancel said certification in the cases indicated in this regulation.
• b)To propose, approve and update the contents, implementation, and execution of the Training Program for Evaluators of the CST Norm.
• c)To accredit academic or research entities in fields related to the certificate, so that they can deliver the Training Program for Evaluators of the CST Norm.
• d)To propose to the Board of Directors of the ICT the execution of agreements with legally constituted organizations in fields related to the certificate.
• e)To accredit the OEEs and establish the necessary requirements for it.
• f)To establish and approve the entry requirements for companies aspiring to the CST certification.
• g)To propose, approve, and amend the CST Norm corresponding to each tourism activity, including the use of new technical sustainability standards.
• h)To recommend to the Board of Directors of the ICT, when applicable, the approval of the regulations necessary for the organization and operation of the CST program.
• i)To recommend to the Board of Directors of the ICT and the Executive Committee of Tourism Sustainability, when applicable, the approval of initiatives for the strengthening of the CST.
• j)To ensure the correct application of the procedure for obtaining the CST, as well as the strict compliance with the provisions contained in this Regulation.
• k)To know and opine on the Annual Operational Plan and the special reports presented by the Technical Secretariat.
• l)To know and opine on all other matters related to the CST program.

Of the technical unit

Of the technical secretariat

• a)To prepare, together with the Presidency, the agenda of the matters to be discussed at each meeting.
• b)To perform the functions that correspond to it or supervise to whom the CNA delegates to:

i- Convene the members of the CNA to the sessions, distribute the agenda and the materials to be discussed in each case.

ii- Draft the minutes of the sessions held by the CNA.

iii- Keep the record, file, and custody of the CNA documents.

iv- Duly notify the agreements.

v- Inform the CNA about any other matter of interest.

• c)To maintain an updated general information system on the CST Certification and the OEEs.
• d)To provide the necessary information to keep the electronic page of the CST Program updated.
• e)To receive and process applications for accreditation of OEEs.
• f)To instruct, coordinate, and supervise the Technical Execution Committee and the OEEs in the functions assigned to them in this regulation.
• g)To receive the evaluation, reevaluation, and audit reports prepared by the Technical Execution Committee and by the OEEs and submit them to the knowledge of the CNA.
• h)To carry out the administrative, budgetary, and logistical procedures to support the objectives of the CNA and the CST, including the Annual Operational Plan.
• i)To provide information to the public on the progress of the CST certification and keep confidentiality in matters strictly pertaining to the tourism companies.
• j)To carry out the studies requested by the CNA, for which it will have the support of the Technical Execution Committee and of those appointed by the CNA.
• k)To instruct the Technical Execution Committee on those obligations demanded by the CNA.
• l)Other functions assigned by the CNA.

Of the technical execution committee

• a)To provide the management or representatives of the tourism company with the induction on the CST Norm.
• b)To coordinate, analyze, and carry out the evaluations of the applicant companies or, when applicable, audit and supervise the inductions, evaluations, reevaluations, audits, and training corresponding to the CST norm carried out by the OEEs.
• c)To carry out, when so determined by the CNA, audits of certified tourism establishments, in order to verify the evaluations carried out by the OEEs.
• d)To technically analyze the applications submitted by companies interested in being accredited as OEEs and recommend to the Commission those that meet the requirements established for it.
• e)To periodically review the parameters considered in the CST Norm to adapt them to new technologies and economic, social, cultural, and environmental changes, as well as propose the pertinent amendments to the CNA.
• f)To keep confidentiality in matters strictly pertaining to the tourism companies.
• g)Other functions assigned to it by the General Management of the ICT.

Of the external evaluation bodies (OEEs) and the accreditation process

• a)Certification of approval by their evaluators of the training courses for external evaluators duly authorized by the CNA.
• b)Be composed of at least two accredited evaluators.
• c)Submit the OEE Registration Application form signed by their legal representative or by a person with sufficient power to do so.
• d)Submit a document with the description of the organization, organization chart, and team of evaluators to be accredited.
• e)Sworn Statement affirming to be up to date in the payment of national taxes.
• f)To be up to date with the payment of the employer-worker quotas of the Costa Rican Social Security Fund (Caja Costarricense de Seguro Social), which will be verified by the Administration.

• a)Those established in this regulation, in the respective manuals, and in the other applicable regulations.
• b)Keep confidentiality in matters strictly pertaining to the tourism companies.
• c)Request authorization from the Technical Unit before proceeding to carry out an evaluation or reevaluation of a tourism company regarding any existing, prior, or future link between the evaluators themselves or their organization and the company, in which a conflict of interest may arise.
• d)The other guidelines issued by the CNA that are applicable to them.

Once the preliminary investigation report is rendered, it shall be submitted to the knowledge of the CNA, which will decide on the opening of the corresponding administrative procedure.

• a)Written warning.
• b)Suspension of its accreditation for a period of one to six calendar months.
• c)Suspension of its accreditation for a period of seven months to one calendar year.
• d)Cancellation of its accreditation.

To determine the sanction to apply in each case, the CNA shall take into account the following aspects: seriousness of the violation committed, the harm caused to the purposes of the CST, and recidivism. The suspension and cancellation sanctions that are final against an OEE shall be communicated to the public by the CNA, through publication in the Official Gazette La Gaceta.

Of the executive committee of tourism sustainability

This Committee is constituted as a coordination, planning, and consensus-building body for those national and international promotion and marketing actions of the CST program.

• a)To coordinate with other institutions and organizations the role of the CST in national and international policies related to sustainability issues.
• b)To propose and coordinate matters related to promoting the CST, including holding award events, launching campaigns, among others.
• c)To propose to the Board of Directors of the ICT the necessary actions for strengthening the CST program.
• d)To propose to the Board of Directors of the ICT marketing strategies and other value-added strategies for the benefit of companies certified with the CST.
• e)To design the internationalization strategy of the CST.
• f)To inform the CNA about its projects and decisions.

Of the evaluation of tourism companies

• a)Submit an application for registration to the CST program using the "Registration Form".
• b)Present a sworn statement in which the compliance of the applicant company with the legislation in force related to its activity is declared, especially with the payment of taxes before the ICT and with the employer-worker obligations before the Costa Rican Social Security Fund (Caja Costarricense del Seguro Social).

Likewise, and during the evaluation process, the tourism company shall have the following obligations:

• a)Implement the actions recommended by the respective CST Norm, making the company's collaborators participants in the process and appointing for such purposes a CST coordinator within the company's team.
• b)Attend to the evaluation team at the company's facilities.
• c)Provide at the time of the evaluation the validation evidence supporting the compliance actions with the CST Norm, insofar as applicable to its tourism activity, which must be presented in Spanish.
• d)Provide all information requested by the evaluation team or the CNA that is considered necessary to support the evaluation and subsequent certification.
• e)Establish mechanisms for the custody of the documents that supported the evaluation, which shall be made available to the CNA when so requested.

This, while trying to take into account the tariff recommendations made by the CNA.

In the event that a certified tourism company fails to maintain level one of sustainability, the CNA shall warn it in writing so that within a period not exceeding six calendar months, it takes the necessary measures to reach that minimum level in the result of a new reevaluation.

Once the granted period has expired, the company must submit the result of said reevaluation to the CNA, which, if it does not achieve at least level one of sustainability, shall be grounds for cancellation of its certificate.

• a)Upon the automatic expiration of the certificate's duration period, which shall be two years; b) When they request a reclassification six months after the certificate was granted; c) When the interested company does not reach the minimum required by the program and requests the reevaluation in writing.

Of the CST logo

Both said certified tourism companies and accredited OEEs may use the CST logo in their promotional material and stationery according to the guidelines issued for such purposes by the CNA.

Of the benefits of the CST

• a)Access to information on environmentally friendly technologies and all other information necessary to apply the CST standard according to their operation.
• b)Specific promotional material for the Program.
• c)Differentiated promotion in tourism activities and fairs at the national and international level, and priority technical and logistical support for their participation in them.
• d)Exemption or discount on the international fair participation fee, depending on the level obtained, in accordance with the Regulation of International Events approved by the ICT, whether or not the company has a tourism declaration (declaratoria turística).
• e)Participate in events, seminars, and workshops organized by the CNA to share or discuss the scope of CST certification.
• f)Differentiated participation in the Internet Site of the Certification for Tourism Sustainability.
• g)Link from the program's Website to the certified company's Site.
• h)Priority in training programs.
• i)Other benefits that the ICT may manage with other national and international organizations.

Of the obligations of companies certified with the CST

• a)Comply with the provisions of this regulation and with the current environmental legislation governing their activity, whether or not evaluated in the provisions of the CST Norm applicable to them.
• b)Comply with the environmental, social, economic, and cultural measures necessary to maintain the minimum sustainability level of the program, according to the provisions of the CST Norm applicable to their activity.
• c)Use the certificate, logo, link to the CST electronic page, and the obtained CST sustainability level, solely for the institutional purposes of development and promotion of tourism sustainability.
• d)Provide all information required by the CNA regarding their operation and their actions within the parameters of their level.
• e)Provide truthful and updated information to the general public regarding their CST certification, including the sustainability level granted.
• f)Disseminate the principles and objectives of the CST program in their business actions related to good practices and sustainability in tourism, as well as in their advertising and/or promotion.
• g)Undergo a new evaluation in accordance with the provisions of this regulation.

Of the grounds for cancellation of the CST

• a)When the certified company fails to comply with the obligations set forth in this Regulation and with the current environmental legislation governing its activity, whether or not evaluated in the provisions of the CST Norm applicable to them.
• b)When the certificate, logo, link to the CST electronic page, and the level achieved are used for purposes and companies different from those for which they were granted, or any other incorrect use is made of them.
• c)When the certified company engages in misleading advertising about the levels obtained, inducing the tourism service user into error.
• d)When the certified company fails to remain at level one of the CST, following its failure to comply with the warning established in article 24 of this regulation.

When the CST is cancelled for the grounds contemplated in subsections b) and c) of the previous article, the company may not reapply to the program until two years have elapsed.

Once the CST is cancelled, the interested party may file the remedies of reconsideration (revocatoria) or reinstatement (reposición) before the CNA within a term of 3 days counted from the communication of the agreement. In the event that the CNA declares the reconsideration or reinstatement without merit, it shall deem the administrative route exhausted.

Given at the Presidency of the Republic on the seventh day of the month of April of the year two thousand ten.

Reglamento para el Otorgamiento del Certificado de Sostenibilidad Turística

De la finalidad y las definiciones

Para esto se dispondrá de manuales específicos, que respondan a la dinámica de las distintas actividades turísticas, en los que se considerarán elementos ambientales, económicos, socioculturales y de planta física que conformarán la denominada Norma CST.

• a)Sostenibilidad: Política deliberada y concertada entre todos los sectores de la sociedad, que facilita la acción del sector público y privado así como la cooperación nacional en el marco de una planeación, en la cual se articulan de manera permanente y armónica la operación rentable del sector turístico, la previsión y control eficaz del impacto sobre otras áreas de la economía de las regiones, el medio ambiente, y la cultura, compartiendo con las comunidades los beneficios generados por la actividad.
• b)Certificación de Sostenibilidad Turística (CST): Sistema de acreditación voluntario, aprobado por la Comisión Nacional de Acreditación a las empresas que cumplan con los requisitos de este Reglamento y los manuales respectivos. Incluye los procesos, requisitos, normas, manuales y otros, que le dan fundamento al programa o sistema de Certificación de Sostenibilidad Turística.
• c)Norma CST: Documento que contiene los ámbitos y parámetros específicos, de acuerdo a la actividad turística que se trate y que deberá de cumplir la empresa para obtener el certificado.
• d)Certificado del CST: Reconocimiento público y formal a través del cual la CNA confiere a la empresa turística el CST.
• e)Inducción: Es una transferencia de conocimiento e información que se le brinda a las empresas turísticas que aspiran al proceso de Certificación.
• f)Evaluación: Proceso llevado a cabo por el Comité Técnico de Ejecución del CST o bien por los órganos de evaluación externa (O.E.E) para determinar el nivel de sostenibilidad de una empresa turística basada en la Norma CST.
• g)Órgano Evaluador Externo (OEE): Persona jurídica, con o sin fines de lucro que asesora, gestiona, capacita y evalúa o reevalúa a las empresas turísticas que aplican al CST.
• h)Acreditación: Es una función exclusiva de la Comisión Nacional de Acreditación por medio de la cual se autoriza a las OEE a operar y a las entidades académicas a capacitar dentro del programa del CST.

De los fines del programa del CST

• a)Ser el instrumento a través del cual Costa Rica logra diferenciarse en el mundo como destino turístico sostenible.
• b)Brindar información confiable sobre las empresas certificadas.
• c)Establecer la sostenibilidad como un elemento de competitividad dentro de las empresas que conforman el sector turístico a nivel nacional e internacional.

De la comisión nacional de acreditación

La Comisión tendrá competencia técnica y de certificación en el campo del turismo sostenible y sus miembros serán los únicos responsables de la administración técnica del programa.

• a)Instituto Costarricense de Turismo (ICT), quien la presidirá.
• b)Instituto Nacional de Biodiversidad (INBIO) c) Instituto Centroamericano de Administración de Empresas (INCAE) d) Unión Internacional para la Conservación de la Naturaleza (UICN) e) Cámara Nacional de Turismo (CANATUR) f) Universidad de Costa Rica (UCR) g) Ministerio del Ambiente, Energía y Telecomunicaciones (MINAET) h) Cámara Nacional de Ecoturismo y Turismo Sostenible (CANAECO).

(Así adicionado el inciso anterior por el artículo 2° del decreto ejecutivo N° 37749 del 9 de mayo del 2013)

La CNA contará con un vicepresidente, designado por ella misma entre sus demás representantes, quién presidirá las sesiones en ausencia del presidente. La CNA y sus miembros desempeñarán sus funciones ad honorem.

Habrá quórum con la asistencia de al menos cinco miembros.

(Así reformado el párrafo anterior por el artículo 1° del decreto ejecutivo N° 37749 del 9 de mayo del 2013)

Sus acuerdos se tomarán por mayoría absoluta, los cuales quedarán firmes en la sesión siguiente según lo dispone la Ley General de la Administración Pública, a menos que los miembros presentes acuerden su firmeza por votación de dos tercios de la totalidad de los miembros de la CNA. En los casos de empate en las votaciones, el Presidente tendrá doble voto.

Una vez declarados en firme, los actos finales de la CNA tendrán la facultad de agotar la vía administrativa.

• a)Conferir el nivel del CST, así como cancelar dicha certificación en los casos señalados en el presente reglamento.
• b)Proponer, aprobar y actualizar los contenidos, la implementación y la ejecución del Programa de Formación de Evaluadores de la Norma CST.
• c)Acreditar los entes académicos o de investigación en materias afines al certificado, para que impartan el Programa de Formación de Evaluadores de la Norma CST.
• d)Proponer a la Junta Directiva del ICT, la realización de convenios con organizaciones legalmente constituidas en materias afines al certificado.
• e)Acreditar a los OEE y establecer los requisitos necesarios para ello.
• f)Establecer y aprobar los requisitos de ingreso para las empresas que aspiran a la certificación CST.
• g)Proponer, aprobar y reformar la Norma CST correspondiente a cada actividad turística incluyendo el uso de nuevas normas técnicas de sostenibilidad.
• h)Recomendar a la Junta Directiva del ICT, cuando corresponda, la aprobación de los reglamentos que sean necesarios para la organización y funcionamiento del programa CST.
• i)Recomendar a la Junta Directiva del ICT y al Comité Ejecutivo de Sostenibilidad Turística, cuando corresponda, la aprobación de iniciativas para el fortalecimiento del CST.
• j)Velar por la correcta aplicación del procedimiento de obtención del CST, así como por el estricto cumplimiento de las disposiciones contenidas en este Reglamento.
• k)Conocer y dictaminar el Plan Anual Operativo y los informes especiales presentados por la Secretaría Técnica.
• l)Conocer y dictaminar todos los demás asuntos relacionados con el programa del CST.

De la unidad técnica

De la secretaría técnica

• a)Preparar junto con la Presidencia la agenda de los asuntos a tratar en cada reunión.
• b)Realizar las funciones que le correspondan o supervisar a quién la CNA delegue para:

i- Convocar a los miembros de la CNA a las sesiones, distribuir la agenda y los materiales a tratar en cada caso.

ii- Levantar las actas de las sesiones que efectúe la CNA.

iii- Llevar el registro, archivo y custodia de los documentos de la CNA.

iv- Notificar debidamente los acuerdos.

v- Informar a la CNA sobre cualquier otro asunto de interés.

• c)Mantener un sistema de información general actualizado sobre la Certificación del CST y las OEE.
• d)Proporcionar la información necesaria para mantener actualizado la página electrónica del Programa del CST.
• e)Recibir y tramitar las solicitudes de acreditación de los OEE.
• f)Instruir, coordinar y supervisar al Comité Técnico de Ejecución y a los OEE, en las funciones asignadas a los mismos en este reglamento.
• g)Recibir los informes de evaluación, reevaluación y auditoría elaborados por el Comité Técnico de Ejecución y por los OEE y elevarlos al conocimiento de la CNA.
• h)Realizar los trámites administrativos, presupuestarios y logísticos de apoyo a los objetivos de la CNA y del CST, incluyendo el Plan Anual Operativo.
• i)Brindar información al público sobre los avances de la certificación CST y guardar la confidencialidad en asuntos que competen estrictamente a las empresas turísticas.
• j)Realizar los estudios que solicite la CNA, para lo cual contará con el apoyo del Comité Técnico de Ejecución y de quiénes nombre la CNA.
• k)Instruir al Comité Técnico de Ejecución en aquellas obligaciones que demande la CNA.
• l)Otras funciones que le asigne la CNA.

Del comité técnico de ejecución

• a)Brindar a las gerencias o representantes de la empresa turística la inducción sobre la Norma CST.
• b)Coordinar, analizar y realizar las evaluaciones de las empresas solicitantes o bien, cuando corresponda, auditar y fiscalizar las inducciones, evaluaciones, reevaluaciones, auditorías y capacitaciones correspondientes a la norma CST efectuadas por los OEE.
• c)Realizar, cuando así lo determine la CNA, auditorías a los establecimientos turísticos certificados, con el objeto de verificar las evaluaciones realizadas por los OEE.
• d)Analizar técnicamente las candidaturas presentadas por las empresas interesadas en acreditarse como OEE y recomendar a la Comisión aquéllas que cumplan con los requisitos establecidos para ello.
• e)Revisar periódicamente los parámetros considerados en la Norma CST para adaptarlos a nuevas tecnologías y cambios económicos, sociales, culturales y ambientales, así como proponer las reformas pertinentes a la CNA.
• f)Guardar la confidencialidad en asuntos que competen estrictamente a las empresas turísticas.
• g)Otras funciones que le sean asignadas por la Gerencia General del ICT.

De los órganos evaluadores externos (OEE) y del proceso de acreditación

• a)Certificación de aprobación por parte de sus evaluadores de los cursos de capacitación para evaluadores externos debidamente autorizados por la CNA.
• b)Estar conformadas por al menos dos evaluadores acreditados.
• c)Presentar el formulario de Solicitud de Inscripción de los OEE firmado por su representante legal o por persona con poder suficiente para ello.
• d)Presentar escrito con la descripción de la organización, organigrama y equipo de evaluadores a acreditar.
• e)Declaración Jurada en dónde manifieste estar al día en el pago de impuestos nacionales.
• f)Encontrarse al día con el pago de las cuotas obrero patronales de la Caja Costarricense de Seguro Social, lo cual será verificado por la Administración.

• a)Las establecidas en este reglamento, en los manuales respectivos y en la demás normativa aplicable.
• b)Guardar la confidencialidad en asuntos que competen estrictamente a las empresas turísticas.
• c)Solicitar autorización de la Unidad Técnica antes de proceder a realizar una evaluación o reevaluación de una empresa turística sobre cualquier vínculo existente, anterior o futuro entre los evaluadores mismos o su organización y la empresa, en que pueda presentarse algún conflicto de interés.
• d)Las demás directrices emitidas por la CNA, que le sean aplicables.

Una vez rendido el informe de la investigación preliminar éste será elevado al conocimiento de la CNA, la cual decidirá sobre la apertura del procedimiento administrativo correspondiente.

• a)Amonestación por escrito.
• b)Suspensión de su acreditación por un período de uno a seis meses calendario.
• c)Suspensión de su acreditación por un período de siete meses a un año calendario.
• d)Cancelación de su acreditación.

Para la determinación de la sanción a aplicar en cada caso, la CNA tomará en cuenta los siguientes aspectos: gravedad de la violación cometida, el perjuicio causado a los fines del CST y la reincidencia. Las sanciones de suspensión y de cancelación que se encuentren firmes en contra de un OEE, serán comunicadas al público por la CNA, mediante publicación en el Diario Oficial La Gaceta.

Del comité ejecutivo de sostenibilidad turística

Este Comité se constituye como una figura de coordinación, planificación y concertación de aquellas acciones de promoción y mercadeo, nacional e internacional, del programa CST.

• a)Coordinar con otras instituciones y organismos el papel del CST en las políticas nacionales e internacionales relacionadas con temas de sostenibilidad.
• b)Proponer y coordinar lo que corresponde a efecto de promocionar el CST, incluyendo la realización de eventos de premiación, lanzamiento de campañas, entre otros.
• c)Proponer a la Junta Directiva del ICT, las acciones necesarias para el fortalecimiento del programa del CST.
• d)Proponer a la Junta Directiva del ICT, estrategias de mercadeo y otras de valor agregado, en beneficio de las empresas certificadas con el CST.
• e)Diseñar la estrategia de internacionalización del CST.
• f)Informar a la CNA sobre sus proyectos y decisiones.

De la evaluación de las empresas turísticas

• a)Realizar solicitud de inscripción al programa del CST utilizando la "Boleta de Inscripción".
• b)Presentar una declaración jurada en la cual se manifieste el cumplimiento de la empresa solicitante con la legislación vigente relacionada a su actividad y especialmente con el pago de impuestos ante el ICT y con las obligaciones obrero patronales ante la Caja Costarricense del Seguro Social.

Asimismo y durante el proceso de evaluación, la empresa turística tendrá las siguientes obligaciones:

• a)Implementar las acciones que recomienda la Norma CST respectiva, haciendo partícipe del proceso a los colaboradores de la empresa y nombrando a tales efectos a un coordinador del CST dentro del equipo de la misma.
• b)Atender al equipo evaluador en las instalaciones de la empresa.
• c)Proporcionar en el momento de la evaluación, las pruebas de validación que amparan las acciones de cumplimiento a la Norma CST, en lo aplicable a su actividad turística, las cuales deberán presentarse en idioma español.
• d)Proporcionar toda la información que le solicite el equipo evaluador o la CNA y que se considere necesaria para fundamentar la evaluación y posterior certificación.
• e)Establecer los mecanismos para la custodia de los documentos que dieron respaldo a la evaluación, misma que pondrá a disposición de la CNA cuando así se solicite.

Ello procurando tener en cuenta las recomendaciones en materia tarifaria que haga la CNA.

En el caso de que una empresa turística ya certificada no logre mantenerse en el nivel uno de sostenibilidad, la CNA le prevendrá por escrito para que en un plazo no mayor a seis meses calendario, efectúe las medidas necesarias para alcanzar ese nivel mínimo en el resultado de una nueva reevaluación.

Vencido el plazo otorgado, la empresa deberá presentar el resultado de tal reevaluación ante la CNA, el cual de no alcanzar al menos el nivel uno de sostenibilidad, será causal de cancelación de su certificado.

• a)Al vencimiento automático del período de duración del certificado el cual será de dos años; b) Cuando soliciten una recalificación a los seis meses después de otorgado el certificado; c) Cuando la empresa interesada no alcance el mínimo exigido por el programa y solicite por escrito la reevaluación.

Del logotipo del CST

Tanto dichas empresas turísticas certificadas como los OEE acreditados, podrán hacer uso del logotipo del CST en su material promocional y papelería de acuerdo a las directrices que para tales efectos emita la CNA.

De los beneficios del CST

• a)Acceso a información sobre tecnologías amigables con el ambiente y a toda otra información necesaria para aplicar el estándar del CST según sea su operación.
• b)Material promocional específico del Programa.
• c)Promoción diferenciada en actividades y ferias turísticas a nivel nacional e internacional y apoyo técnico y logístico prioritario para su participación en las mismas.
• d)Exoneración o descuento en la cuota de participación en ferias internacionales, dependiendo del nivel obtenido, de conformidad con el Reglamento de Eventos Internacionales aprobado por el ICT, tenga la empresa o no la declaratoria turística.
• e)Participar en eventos, seminarios y talleres organizados por la CNA para compartir o discutir los alcances de la certificación CST.
• f)Participación diferenciada en el Sitio Internet de la Certificación para la Sostenibilidad Turística.
• g)Enlace del Sitio Web del programa con el Sitio de la empresa certificada.
• h)Prioridad en los programas de capacitación.
• i)Otros beneficios que el ICT pueda gestionar ante otros organismos nacionales e internacionales.

De las obligaciones de las empresas certificadas con el CST

• a)Cumplir con lo dispuesto en este reglamento y con la legislación vigente en materia ambiental que regule su actividad, evaluada o no en las disposiciones de la Norma CST que le sean aplicables.
• b)Cumplir con las medidas ambientales, sociales, económicas y culturales necesarias para conservar el nivel mínimo de sostenibilidad del programa, según las disposiciones de la Norma CST aplicables a su actividad.
• c)Utilizar el certificado, logotipo, vínculo con la página electrónica del CST y el nivel de sostenibilidad del CST obtenido, únicamente para los fines institucionales del desarrollo y el fomento de la sostenibilidad turística.
• d)Brindar toda información que requiera la CNA en relación con su operación y su accionar dentro de los parámetros de su nivel.
• e)Brindar en forma veraz y actualizada al público en general, la información relativa a su certificación del CST, incluyendo el nivel de sostenibilidad otorgado.
• f)Divulgar los principios y objetivos del programa del CST en su accionar empresarial relacionado con las buenas prácticas y la sostenibilidad en el turismo, así como en su publicidad y/o promoción.
• g)Cumplir con una nueva evaluación de acuerdo a lo establecido en el presente reglamento.

De las causales de cancelación del CST

• a)Cuando la empresa certificada incumpla con las obligaciones que dispone este Reglamento y con la legislación vigente en materia ambiental que regule su actividad, evaluada o no en las disposiciones de la Norma CST que le sean aplicables.
• b)Cuando se utilice el certificado, el logotipo, el vínculo con la página electrónica del CST y el nivel alcanzado para fines y empresas distintas para los cuales les fue otorgado o se les dé cualquier otro uso incorrecto.
• c)Cuando la empresa certificada realice publicidad engañosa sobre los niveles obtenidos induciendo a error al usuario del servicio turístico.
• d)Cuando la empresa certificada no logre mantenerse en el nivel uno del CST, previo incumplimiento por su parte de la prevención establecida en el artículo 24 del presente reglamento.

Cuando se cancele el CST por las causales contempladas en los incisos b) y c) del artículo anterior, la empresa no podrá aplicar nuevamente al programa hasta que transcurran dos años.

Al cancelarse el CST el interesado podrá interponer los recursos de revocatoria o reposición ante la CNA dentro del término de 3 días contados a partir de la comunicación del acuerdo. En caso de que la CNA declare sin lugar la revocatoria o reposición dará por agotada la vía administrativa.
