30131-MINAE-S is amended to read as follows:
"Article 72.- Study and approval. The remodeling or expansion of service stations and other storage facilities must be submitted for study and approval by MINAET through the DGTCC under the terms of this executive decree, and in accordance with the provisions of other laws, regulations, and technical standards in force. Approval by the Ministry of Health is also required in accordance with the General Health Law. Authorizations granted prior to the entry into force of this decree shall remain valid, provided that the conditions to protect human, animal, or plant health, safety, and the environment are satisfied, and compliance with the safety requirements contained in this regulation is met, which shall be confirmed through the respective tightness tests (pruebas de hermeticidad) and inspections. In the event that the requirements are not satisfied, and having been notified by means of a technically and legally reasoned resolution, a project for the replacement of the establishment's petroleum-derived fuel storage tanks must be submitted, in order to modernize them in accordance with the Regulation in force on this matter.
The application made for the replacement of storage tanks due to the expiration of their useful life term stipulated in this Executive Decree No. 30131, shall not be considered an application for remodeling the entire service station but only for the fuel tanks that present tightness failures, or that have completed their useful life as defined in the Executive Decree, and only the procedure established herein for the installation of such tanks must be observed. Service stations whose operating approval was granted in compliance with the legislation in force at the time of their authorization are not obliged to conform to the distances contained in this Decree."
