Subject: Official Communication MPD-P-483-2010, Approval of Declaration in the Maritime Terrestrial Zone of the canton of La Cruz, Guanacaste.

Dear Sirs, In Ordinary Session of the Board of Directors No. 5639, article 5, subsection IV, held on May 11, 2010, the following agreement was adopted, which textually states:

IT IS AGREED:

• 1)In accordance with the technical recommendation contained in official communication No. MPD-P-483-2010, issued by the Macroprocess of Planning and Development and in accordance with the powers conferred by Article 27 of Law No. 6043 on the Maritime Terrestrial Zone to the Costa Rican Tourism Institute, to declare the maritime terrestrial zone of the canton of La Cruz, province of Guanacaste, as having tourist suitability (aptitud turística), which is established under the following conditions:
• a)Starting point at the coordinate in the CRTM05 projection: 1224438 N - 316676 E (reference to the Lambert projection: 338870 N - 352888 E), located at the northern end of the coast on the boundary with the Corredor Fronterizo, continuing south along the shoreline (borde de costa), to the point at coordinate in the CRTM05 projection: 1209410 N - 312852 E (reference to the Lambert projection: 323846 N - 349085 E), including the lands that border the mangroves in accordance with the provisions of Article 4 of the Regulation to Law No. 6043 on the Maritime Terrestrial Zone.
• b)This declaration excludes the lands that have been classified and certified as Natural Heritage of the State (Patrimonio Natural del Estado, PNE) by the Área de Conservación Guanacaste in accordance with the documentation that was sent in due course to the Costa Rican Tourism Institute according to the attached table:

• 3)To repeal any other declaration (declaratoria) that has been made and published in the past for the canton of La Cruz, province of Guanacaste, that is comprised between the coordinates of this declaration.

4)To request the Administration to carry out the procedures for publication in the Official Gazette La Gaceta for the formalization of this present tourist suitability declaration (declaratoria turística).

Asunto: Oficio MPD-P-483-2010, Aprobación de Declaratoria en la Zona Marítimo Terrestre del cantón de La Cruz, Guanacaste.

Estimados señores En Sesión Ordinaria de Junta Directiva Nº 5639, artículo 5, inciso IV, celebrada el día 11 de mayo del 2010, se tomó el siguiente acuerdo que textualmente dice:

SE ACUERDA:

• 1)De conformidad con la recomendación técnica contenida en el oficio N° MPD-P-483-2010, suscrito por el Macroproceso de Planeamiento y Desarrollo y de conformidad con las potestades que le confiere el Artículo 27 de la Ley N° 6043 de la Zona Marítimo Terrestre al Instituto Costarricense de Turismo, declarar de aptitud turística la zona marítimo terrestre del cantón de La Cruz, provincia de Guanacaste, misma que se establece por los siguientes condiciones:
• a)Punto de inicio en la coordenada de la proyección CRTM05: 1224438 N - 316676 E (referencia a la proyección Lambert: 338870 N - 352888 E), ubicada el extremo norte de la costa en el límite con el Corredor Fronterizo, continuando hacia el sur por el borde de costa, hasta el punto de coordenada de la proyección CRTM05: 1209410 N - 312852 E (referencia a la proyección Lambert: 323846 N - 349085 E), incluyendo los terrenos que bordean los manglares de conformidad con lo establecido en el Artículo 4 del Reglamento a la Ley N° 6043 de la Zona marítimo Terrestre.
• b)Esta declaratoria excluye los terrenos que se han clasificado y certificado como Patrimonio Natural del Estado por el Área de Conservación Guanacaste de conformidad con la documentación que fue remitida en su momento al Instituto Costarricense de Turismo según el cuadro adjunto:

• d)Se excluye de esta declaratoria todos aquellos terrenos que se encuentren bajo las condiciones establecidas en el Artículo 73 de la Ley N° 6043 de la Zona marítimo Terrestre en donde se establece: "La presente ley no se aplica a las zonas marítimas terrestres, incluidas en los parques nacionales y reservas equivalentes, las cuales se regirán por la legislación respectiva".
• 2)Rectificar la declaratoria turística aprobada en la Sesión N° 1913 celebrada el día 26 de agosto de 1970, publicada en La Gaceta N° 220 del 20 de febrero de 1970, excluyendo el sector que se encuentra enmarcado dentro de las siguientes coordenadas: 1208445 N - 311907 E y 1210211 N - 310451 E en la proyección CRTM05, (322881 N - 348139 E y 324621 N - 346697 E proyección Lambert).
• 3)Derogar cualquier otra declaratoria que se haya realizado y publicado en el pasado para el cantón de La Cruz, provincia de Guanacaste, que se encuentre comprendida entre las coordenadas de este declaratoria.

4)Solicitar a la Administración, realizar los trámites de publicación en el Diario Oficial La Gaceta para la oficialización de la presente declaratoria turística.
