Full Text of Regulation 35670 Regulation for the Internal Functioning of the Regional Council of the Cordillera Volcánica Central Conservation Area (CORAC-CVC) Full Text of record: CF02E No. 35670-MINAET THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT, ENERGY AND TELECOMMUNICATIONS In exercise of the powers conferred upon them by Articles 50, 140 subsections 3) and 18), and 146 of the Political Constitution; the Convention on Biological Diversity and Annexes ratified by Ley 7416 of June 30, 1994; Articles 25, 27 subsection 1, and 28 subsection 2.b) of the General Public Administration Act, No. 6227 of May 2, 1978; Article 6 of the Organic Environmental Act, No. 7554 of October 4, 1995; Articles 27, 29, and 30 of the Biodiversity Act, No. 7788 of April 30, 1998; and Article 38 of the Regulation to the Biodiversity Act, Decreto Ejecutivo No. 34433-MINAE of March 11, 2008.
Considerando; I.—That Article 50 of the Political Constitution enshrines in favor of all inhabitants of the Nation the right to a healthy and ecologically balanced environment, this right encompassing the conservation, use, and sustainable management of biodiversity and the equitable distribution of benefits derived from it, ensuring the greatest participation of the community.
II.—That as established by the Convention on Biological Diversity and Annexes, ratified by Costa Rica through Ley 7416 of June 30, 1994, the State shall exercise complete and exclusive sovereignty over the elements of biodiversity, authorizing the exploration, research, bioprospecting, use, and exploitation of the elements of biodiversity that constitute public domain assets, as well as the utilization of all genetic and biochemical elements and resources.
III.—That Article 22 of the Biodiversity Act, No. 7788 of April 30, 1998, grants the National System of Conservation Areas (SINAC) instrumental legal personality and defines it as a deconcentrated and participatory system of institutional management and coordination that integrates the competencies in forestry, wildlife, and protected areas matters of the Ministry of Environment, Energy, and Telecommunications, for the purpose of issuing policies, planning, and executing processes aimed at achieving sustainability in the management of the country's natural resources.
IV.—That Article 27 subsection a) of the Biodiversity Act, No. 7788 of April 30, 1998, establishes that within the administrative structure of the conservation areas (áreas de conservación), there must exist as an administrative unit the Regional Council of the Conservation Area known as CORAC.
V.—That Article 38 of the Regulation to the Biodiversity Act, Decreto Ejecutivo No. 34433-MINAE of March 11, 2008, provides for the functioning of the Regional Councils, establishing that these must draft their own internal functioning regulation based on the general guidelines issued by the National Council of Conservation Areas (CONAC), which must be concordant with Decreto Ejecutivo No. 34433-MINAE and the Costa Rican legal order.
VI.—That in accordance with Article 12 subsection d) of the Regulation to the Biodiversity Act, Decreto Ejecutivo No. 34433-MINAE of March 11, 2008, the National Council of Conservation Areas (CONAC), in Ordinary Session No. 08-2009 held on August 31, 2009, through Agreement No. 13 approved the Regulation for the Internal Functioning of the Regional Council of the Cordillera Volcánica Central Conservation Area (CORAC-CVC). CHAPTER I
1
The full (propietarios) and alternate (suplentes) members of the CORAC-CVC are elected by simple majority of the General Assembly, from among the designated representatives of the following sectors present in the Cordillera Volcánica Central Conservation Area:
- The Municipal Sector. (a municipal representative must always be elected) - Community organizations. - The governmental sector, State institutions. - The higher education sector (private and public Universities). - Non-governmental organizations (NGOs and Foundations). - The business sector (agricultural, forestry, industrial, tourism).

The Regional Council of the Cordillera Volcánica Central Conservation Area shall be composed of:
- A President - A Vice President - A Secretary - A Treasurer - Two Voting Members (Vocales) - An Executive Secretary, held by the Director of the ACCVC - An Auditor (Fiscal)

The alternate (suplentes) members of the representatives that compose the CORAC-CVC fulfill the substitution on behalf of the sector, to establish a quorum.

The members of the Council, in the exercise of their functions, shall have the status of ad-honorem public officials and shall be governed by the provisions of the General Public Administration Act.
The functions of the CORAC-CVC, in addition to those established in Article 30 of the Biodiversity Act No. 7788, shall be the following:
1. Prepare the work agenda for the CORAC meetings. 2. Meet once a month ordinarily and extraordinarily, in accordance with the provisions of Article 40 of the Regulation of the Biodiversity Act, Decreto Ejecutivo No. 34433-MINAE. 3. Maintain close coordination with the Conservation Area in the different fields of its management. 4. Analyze, approve, and follow up on the Annual Work Plans of the ACCVC.

The functions of the President shall be:
- Exercise the representation of the CORAC-CVC. - Preside over the sessions of the CORAC-CVC. - Resolve any matter in the event of a tie, in which case they shall have a double vote. - Submit for approval the minutes of the previous session as well as the agenda to be addressed. - Ensure that the Council complies with the policies, laws, and Regulations related to its function. - Moderate the sessions of the Regional Council in a participatory and democratic manner. - Issue general directives and impart instructions regarding the formal aspects of the Council's work. - Sign minutes of the Regional Council. - Render reports to the Regional Council, when required.

The Vice President shall substitute for the President, in their absence, exercising the same functions assigned to the latter.

The functions of the Secretary shall be:
- Collaborate with the Executive Secretary on the execution of the CORAC-CVC agreements. - Maintain permanent communication with the local councils and other members of the CORAC-CVC. - Collaborate in the drafting of the minutes. - Any other function assigned by the CORAC-CVC.

The functions of the Treasurer shall be:
- Administer the financial resources of the CORAC. - Render the financial reports of the Council to the General Assembly and the CORAC-CVC.

The Executive Secretary of the CORAC-CVC shall have the following functions:
- Coordinate the calls to the CORAC Assemblies. - Prepare the order of the day. - Coordinate the election of the CORAC members, ensuring that each sector or body makes its appointments in the General Assembly. - Prepare and present an annual report of their management to the General Assembly with the approval of the CORAC-CVC. - Convene the members of the CORAC-CVC to ordinary or extraordinary sessions in accordance with the provisions of Article 40 of the Regulation to the Biodiversity Act, Decreto Ejecutivo No. 34433-MINAE. - Draft minutes of the Regional Council sessions and keep the corresponding minute book updated. - Sign minutes of the Regional Council. - Execute all agreements of the Regional Council and present a quarterly report on their level of execution. - Maintain permanent communication with the members of the CORAC-CVC and the Local Councils, collaborating in the channeling of information. - Keep a file with all the documentation, minutes, resolutions, reports, and agreements of the CORAC-CVC, on which they must render reports at each session and to which any of its members shall have access. - Convene the assemblies referred to in Article 29 of the Biodiversity Act No. 7788 of April 30, 1998, and preside over them.

In accordance with Article 44 of the Regulation to the Biodiversity Act, Decreto Ejecutivo No. 34433-MINAE, the functions not established in said regulation shall be those established by the General Public Administration Act No. 6227 and, therefore, shall apply to the voting members (vocales) of the CORAC-CVC.
Functioning of the Call to Meetings

The CORAC-CVC shall hold ordinary sessions once a month and extraordinary sessions when so convened by the Executive Secretary, at the request of the President or of half plus one of the members of the CORAC-CVC.

The calls must be formally made by fax or email, with at least fifteen calendar days' notice, and the members of the CORAC-CVC must confirm their participation at least three business days before the date set for the holding of the respective session.

The full (propietarios) representatives of the CORAC-CVC must attend all ordinary and extraordinary sessions. If unable to attend due to force majeure, they must so inform the Executive Secretary and arrange for the participation of the respective alternate (suplente).

The alternate (suplentes) representatives of the different sectors before the CORAC-CVC may participate in all ordinary and extraordinary sessions with a voice but no vote, as long as their participation is not on behalf of the full (propietario) member of the sector.

For the CORAC-CVC to validly hold a session, the presence of half plus one of the members is necessary. If there is no quorum, the meeting shall be suspended, recording this in the respective minutes, which must be drafted with an indication of the persons present.

Agreements shall be adopted by a simple majority of those present; in the event of a tie, the Presidency shall exercise the double vote. When this occurs, the pertinent reasoning must be recorded in the respective minutes.
On Representation, Appointment, and Tenure in the CORAC-CVC
CHAPTER IV

The members of the CORAC-CVC shall be elected in the General Assembly for a term of four years and may be reelected indefinitely, whether consecutively or alternately.

If a full (propietario) member of the CORAC-CVC or an alternate (suplente), representing the full member, misses two consecutive sessions or three alternate sessions without just cause, or incurs any of the causes established in Article 34 of the Regulation to the Biodiversity Act, they shall lose their status as a member of the Council, subject to a prior agreement adopted by a qualified majority of the CORAC-CVC, and the corresponding organization or sector shall be notified within the five business days following the respective session, so that a new representative may be appointed.
For the purpose of explaining absences, it shall be necessary to present the justification in writing (email, fax, or note) to the CORAC-CVC prior to the adoption of the removal agreement.

If the full member (propietario) for any reason loses their capacity to represent the civil sector, the alternate (suplente) of said sector shall assume the status of full member (propietario) with all the obligations and rights attributed to that position. In the event that the alternate member cannot assume the position on the CORAC-CVC, each sector shall designate another alternate member elected within its own Assembly, convened for this purpose; and said designation shall be submitted for consideration to the General Assembly of the CORAC-CVC, which shall make the corresponding appointment as a member of the Council.
On Auditing
CHAPTER V

The auditor (fiscal) must be appointed by the General Assembly and may be a representative of any of the sectors present in the Assembly.
The auditor (fiscal) must participate in all ordinary and extraordinary sessions convened for the functioning of the CORAC-CVC, in which they shall have the right to a voice but not a vote.

The functions of the Auditor (Fiscal) shall be:
- Ensure that the provisions and agreements of the CORAC-CVC are consistent with the provisions of the Biodiversity Act and its Regulation. - Oversee compliance with the Regulation of the CORAC-CVC.

Considerando; I.-Que el artículo 50 de la Constitución Política consagra a favor de todos los habitantes de la Nación el derecho a un ambiente sano y ecológicamente equilibrado, comprendiendo este derecho la conservación, uso y manejo sostenible de la biodiversidad y la equitativa distribución de beneficios derivados de ésta, asegurando la mayor participación de la comunidad.
II.-Que según establece el Convenio sobre Diversidad Biológica y Anexos, ratificado por Costa Rica mediante Ley Nº 7416 del 30 de junio de 1994, el Estado ejercerá la soberanía completa y exclusiva sobre los elementos de la biodiversidad, autorizando la exploración, la investigación, la bioprospección, el uso y el aprovechamiento de los elementos de la biodiversidad que constituyan bienes de dominio público, así como la utilización de todos los elementos y recursos genéticos y bioquímicos.
III.-Que el artículo 22 de la Ley de Biodiversidad, Nº 7788 del 30 abril de 1998, le otorga al Sistema Nacional de Áreas de Conservación (SINAC) personería jurídica instrumental y lo define como un sistema de gestión y coordinación institucional, desconcentrado y participativo, que integra las competencias en materia forestal, vida silvestre y áreas protegidas del Ministerio de Ambiente, Energía y Telecomunicaciones, con el fin de dictar políticas, planificar y ejecutar procesos dirigidos a lograr la sostenibilidad en el manejo de los recursos naturales del país.
IV.-Que el artículo 27 inciso a) de Ley de Biodiversidad, Nº 7788 del 30 abril de 1998 establece que dentro de la estructura administrativa de las áreas de conservación debe existir como unidad administrativa, el Consejo Regional de Área de Conservación conocido como CORAC.
V.-Que el artículo 38 del Reglamento a la Ley de Biodiversidad, Decreto Ejecutivo Nº 34433-MINAE del 11 de marzo de 2008, dispone sobre el funcionamiento de los Consejos Regionales, estableciendo que estos deberán elaborar su propio reglamento de funcionamiento con base en los lineamientos generales emitidos por el Consejo Nacional de Áreas de Conservación (CONAC), el cual deberá ser concordante con el Decreto Ejecutivo Nº 34433-MINAE y el ordenamiento jurídico costarricense.
VI.-Que de conformidad al artículo 12 inciso d) del Reglamento a la Ley de Biodiversidad, Decreto Ejecutivo Nº 34433-MINAE del 11 de marzo de 2008, el Consejo Nacional de Áreas de Conservación (CONAC), en Sesión Ordinaria Nº 08-2009 celebrada el día 31 de agosto del 2009, mediante Acuerdo Nº 13 aprobó el Reglamento para el funcionamiento interno del Consejo Regional del Área de Conservación Cordillera Volcánica Central (CORAC-CVC). De la integración y funciones
Decretan:
CAPÍTULO I
1
Los miembros del CORAC-CVC propietarios y suplentes, son electos por mayoría simple de la Asamblea General, entre los representantes designados de los siguientes sectores presentes en el Área de Conservación Cordillera Volcánica Central:
. El Sector Municipal. (siempre deberá elegirse un representante municipal) . Las organizaciones comunales.
. El sector gubernamental, las instituciones del Estado.
. El sector educación superior (Universidades privadas y públicas).
. Las organizaciones no gubernamentales (ONG y Fundaciones).
. El sector empresarial (agrícola, forestal, industrial, turístico).

El Consejo Regional del Área de Conservación Cordillera Volcánica Central estará conformado por:
. Un Presidente . Un Vicepresidente . Un Secretario . Un Tesorero . Dos Vocales . Un Secretario Ejecutivo, a cargo del Director del ACCVC . Un Fiscal

Los miembros suplentes de los representantes que conforman el CORAC-CVC, cumplen con la suplencia en representación del sector, para conformar el quórum.

2. Reunirse una vez al mes en forma ordinaria y en forma extraordinaria, de conformidad con lo establecido en el artículo 40 del Reglamento de la Ley de Biodiversidad, Decreto Ejecutivo Nº 34433-MINAE.
3. Mantener estrecha coordinación con el Área de Conservación en los diferentes campos de su gestión.
4. Analizar, aprobar y dar seguimiento a los Planes Anuales de Trabajo del ACCVC.

Serán funciones del Presidente:
. Ejercer la representación del CORAC-CVC.
. Presidir las sesiones del CORAC-CVC.
. Resolver cualquier asunto en caso de empate, en cuyo caso tendrá doble voto.
. Someter a aprobación el acta de la sesión anterior así como la agenda a tratar.
. Velar porque el Consejo cumpla las políticas, leyes y Reglamentos relativos a su función.
. Moderar en forma participativa y democrática las sesiones del Consejo Regional.
. Emitir directrices generales e impartir instrucciones en cuanto a los aspectos de forma de las labores del Consejo.
. Firmar actas del Consejo Regional.
. Rendir informes al Consejo Regional, cuando sean requeridos.

El Vicepresidente sustituirá al Presidente, en su ausencia, ejerciendo las mismas funciones asignadas al segundo.

Serán funciones del Secretario:
. Colaborar con el Secretario Ejecutivo con la ejecución de los acuerdos del CORAC-CVC.
. Mantener una permanente comunicación con los consejos locales y demás integrantes del CORAC-CVC.
. Colaborar en el levantamiento del acta.
. Cualquier otra función que le asigne el CORAC-CVC.

Serán funciones del Tesorero:
. Administrar los recursos financieros del CORAC.
. Rendir los informes financieros del Consejo ante la Asamblea General y el CORAC-CVC.

Le corresponderán al Secretario Ejecutivo del CORAC-CVC las siguientes funciones:
. Coordinar las convocatorias a las Asambleas del CORAC.
. Confeccionar el orden del día.
. Coordinar la elección de los integrantes del CORAC, procurando que cada sector u organismo haga sus nombramientos en la Asamblea General.
. Elaborar y presentar un informe anual de su gestión ante la Asamblea General con la aprobación del CORAC-CVC.
. Convocar a los miembros del CORAC-CVC a sesiones ordinarias o extraordinarias conforme a lo establecido en el artículo 40 del Reglamento a la Ley de Biodiversidad, Decreto Ejecutivo Nº 34433-MINAE.
. Levantar actas de las sesiones del Consejo Regional y llevar actualizado el correspondiente libro de actas.
. Firmar actas del Consejo Regional.
. Ejecutar todos los acuerdos del Consejo Regional y presentar informe trimestral del nivel de ejecución de los mismos.
. Mantener una permanente comunicación con los integrantes del CORAC-CVC y de los Consejos Locales, colaborando en la canalización de la información.
. Llevar un archivo con toda la documentación, actas, resoluciones, informes y acuerdos del CORAC- CVC, del cual deberá rendir informes en cada sesión y a la que tendrá acceso cualquiera de sus integrantes.
. Convocar las asambleas a que se refiere el artículo 29 de la Ley de Biodiversidad Nº 7788 del 30 de abril de 1998 y presidirlas.

De conformidad con el artículo 44 del Reglamento a la Ley de Biodiversidad, Decreto Ejecutivo Nº 34433-MINAE, las funciones no establecidas en dicho reglamento serán las establecidas por la Ley General de Administración Pública Nº 6227 y por ende, aplicarán para el caso de los vocales del CORAC-CVC.

El CORAC-CVC sesionará ordinariamente una vez al mes y extraordinariamente cuando así lo convoque el Secretario Ejecutivo, a solicitud del Presidente o de la mitad más uno de los miembros del CORAC-CVC.

Las convocatorias se deberán realizar formalmente por fax o correo electrónico, con al menos quince días naturales de anticipación y los miembros del CORAC-CVC deberán confirmar su participación al menos tres días hábiles antes de la fecha fijada para la celebración de la sesión respectiva.

Los representantes propietarios deL CORAC-CVC deberán asistir a todas las sesiones ordinarias y extraordinarias. En caso de no poder asistir por fuerza mayor, deberán informarlo así al Secretario Ejecutivo y gestionar la participación del respectivo suplente.

Los representantes suplentes de los diferentes sectores ante el CORAC-CVC podrán participar en todas las sesiones ordinarias y extraordinarias con voz pero sin voto, en tanto su participación no se dé en representación del miembro propietario del sector.

Para que pueda sesionar validamente el CORAC-CVC será necesaria la presencia de la mitad más uno de los miembros. En caso de que no exista quórum se suspenderá la reunión haciéndolo constar en el acta respectiva, que deberá levantarse con indicación de las personas presentes.

Los acuerdos se tomarán por mayoría simple de los presentes, en caso de empate, la Presidencia ejercerá el doble voto. Cuando ello ocurra, deberá consignarse en el acta respectiva el razonamiento pertinente.
De la representación, nombramiento y permanencia en el CORAC-CVC
CAPÍTULO IV

Los miembros del CORAC-CVC serán electos en la Asamblea General, por un plazo de cuatro años, pudiendo ser reelectos indefinidamente ya sea, de manera consecutiva o alterna.

Si un miembro propietario del CORAC-CVC o un suplente, en representación del propietario, faltare a dos sesiones consecutivas o tres alternas sin justa causa o incurriere en alguna de las causas establecidas en el artículo 34 del Reglamento a la Ley de Biodiversidad, perderá su condición de miembro del Consejo, previo acuerdo tomado por mayoría calificada del CORAC-CVC y se le comunicará a la organización o sector correspondiente, durante los cinco días hábiles posteriores a la sesión respectiva, para que se nombre un nuevo representante.
A efectos de explicar las ausencias, será necesario presentar la justificación por escrito (correo electrónico, fax o nota) ante el CORAC-CVC de previo a la toma del acuerdo de remoción.

Si el propietario por algún motivo perdiese su capacidad de representación del sector civil, el suplente de dicho sector asumirá la condición de propietario con todas las obligaciones y derechos atribuidos a dicha posición. En caso de que el miembro suplente no pueda asumir el cargo en el CORAC-CVC, cada sector, designará a otro miembro suplente elegido en el seno de su propia Asamblea, convocada para este efecto; y dicha designación se someterá a consideración de la Asamblea General del CORAC-CVC, quien hará la correspondiente designación como miembro del Consejo.
La fiscalización
CAPÍTULO V

El fiscal deberá ser nombrado por la Asamblea General y podrá ser un representante de cualquiera de los sectores presentes en la Asamblea.
El fiscal deberá participar en todas las sesiones ordinarias y extraordinarias que sean convocadas para el funcionamiento del CORAC-CVC, en las cuales tendrá derecho a voz pero no a voto.

Serán funciones del Fiscal:
. Velar por que las disposiciones y acuerdos del CORAC-CVC, sean congruentes con lo establecido en la Ley de Biodiversidad y su Reglamento.
. Vigilar el cumplimiento del Reglamento del CORAC-CVC.
