TO ALL EMPLOYEES OF THE JUDICIAL BRANCH BE IT KNOWN THAT:

The Full Court, in session Nº 07-10, held on March 1st of the current year, article XIV, approved the regulations for the use and enjoyment of the facilities of the La Soledad farm within the framework of the project called Justice with Nature, which literally states:

"REGULATIONS FOR THE USE AND ENJOYMENT OF THE FACILITIES OF THE LA SOLEDAD FARM WITHIN THE FRAMEWORK OF THE PROJECT CALLED JUSTICE IN NATURE

General Provisions

CHAPTER I

For the purposes of these regulations, it is understood that users are all those who make use of the farm's facilities, regardless of whether they are employees, guests, or special visitors.

For this task, it must appoint several persons to control entry to the farm and monitor compliance with the following provisions.

a)Official activities of the Judicial Branch of Costa Rica.
b)Activities of the Justice in Nature Project, attached to the Judicial Branch.
c)Activities of the Offices of the Judicial City of San Joaquín de Flores.

ch) Activities of Offices of the Judicial Branch from across the country.

d)Activities of other institutions, subject to the approval of the Superior Council, the Executive Directorate, or the Regional Administration.

a)Active employees of the Judicial Branch.
b)Retired colleagues.
c)Special visitors to whom the Executive Directorate and the Regional Administration grant authorization for the term and under the conditions indicated.

Rights and Obligations of Users

CHAPTER II

An employee who, for special reasons, does not present their identification card, may exceptionally present their identity card, to authorize their entry to the Farm. In turn, special visitors must present the authorization and identification determined for that purpose.

The person in charge of the farm, prior to authorizing entry, must record the name of the person along with their identity card or identification number, indicating whether they are a judicial employee or a visitor. In this way, a record can be kept of the persons who enter the farm daily, in case any type of anomaly occurs.

The foregoing, without prejudice to the application of the disciplinary regime and the civil liability that may proceed, in the event that it is demonstrated that due to their negligence or that of their guests, damages to the facilities resulted.

In the event that, as a result of their negligent actions, any damage to the facilities of the Farm results, they shall be civilly liable in accordance with the provisions of article 1045 of the Civil Code.

On the Observance of these Regulations

CHAPTER III

Any behavior of the employees that compromises the image of the Judicial Branch within the facilities of the Farm shall be communicated to the Judicial Inspection so that their conduct may be investigated.

In addition to the sanctions provided for in article 195 of that law, the entry of the employee to the facilities of the Farm may be prohibited.

In the case of visitors, they shall be prohibited from entering the facilities of the Farm, until the damages caused are paid for or a period of time, to be set by the Regional Administration, has elapsed.

Once the period for the hearing referred to in this article has elapsed without a response from the summoned party, or once their defense has been received and the pertinent evidence examined, the Regional Administration shall proceed to issue the corresponding resolution.

It is understood that the Judicial Branch shall not be responsible for damages that persons visiting the facilities of the La Soledad Farm may suffer, with the exception of those relating to an activity of a labor nature, nor for the things they carry or transport with them, except in cases where there was a direct and deliberate action by the Judicial Branch or its employees that causally determined the damage suffered.

Use of the Facilities

CHAPTER IV

Likewise, the entry of animals shall be permitted for employees who, by the nature of their duties, must carry out practices or activities involving the handling of animals, as is the case of the employees working in the Canine Unit of the Judicial Investigation Agency.

A TODOS LOS EMPLEADOS DEL PODER JUDICIAL SE LES HACE SABER QUE:

La Corte Plena, en sesión Nº 07-10, celebrada el 1° de marzo del año en curso, artículo XIV, aprobó el reglamento para el uso y disfrute de las instalaciones de la finca La soledad dentro del marco del proyecto denominado Justicia con la Naturaleza, que literalmente dice:

"REGLAMENTO PARA EL USO Y DISFRUTE DE LAS INSTALACIONES DE LA FINCA LA SOLEDAD DENTRO DEL MARCO DEL PROYECTO DENOMINADO JUSTICIA EN LA NATURALEZA

CAPÍTULO I

Disposiciones generales

Entiéndase para los efectos de este reglamento, que las personas usuarias son todas aquellas que hagan uso de las instalaciones de la finca, indistintamente si se trata de servidores/as, invitados/as o visitantes especiales.

Para ese cometido deberá nombrar varias personas que se encarguen de controlar el ingreso a la finca y vigilar el cumplimiento de las siguientes disposiciones.

a)Actividades oficiales del Poder Judicial de Costa Rica.
b)Actividades del Proyecto Justicia en la Naturaleza, adscrito al Poder Judicial.
c)Actividades de los Despachos de la Ciudad Judicial de San Joaquín de Flores.

ch) Actividades de Despachos del Poder Judicial de todo el país.

d)Actividades de otras instituciones, sujetas a la aprobación del Consejo Superior, la Dirección Ejecutiva o de la Administración Regional.

a)Las y los servidores activos del Poder Judicial.
b)Las y los compañeros Jubilados.
c)Visitantes especiales a quienes la Dirección Ejecutiva y la Administración Regional concedan autorización por el término y bajo las condiciones que se indiquen.

Derechos y obligaciones de las personas usuarias

CAPÍTULO II

El servidor o servidora que por motivos especiales no presente su carné, podrá presentar excepcionalmente su cédula de identidad, para autorizar su ingreso a la Finca. Por su parte, los visitantes especiales deberán presentar la autorización y la identificación que se determine para ese fin.

El encargado de la finca de previo a autorizar el ingreso, deberá consignar el nombre de la persona con su número de cédula o identificación, haciendo indicación si se trata de un servidor/a judicial o de un visitante. De esa forma, se podrá llevar un control de las personas que ingresan diariamente a la finca, en caso de que se presente algún tipo de anomalía.

Lo anterior, sin perjuicio de la aplicación del régimen disciplinario y de la responsabilidad civil que proceda, en caso de que se demuestre que por su negligencia o la de sus invitados resultaron daños en las instalaciones.

En caso de que producto de su actuar negligente, resulte algún daño en las instalaciones de la Finca, serán civilmente responsables de conformidad con lo dispuesto en el artículo 1045 del Código Civil.

De la observancia de este reglamento

CAPÍTULO III

Todo comportamiento de los/as servidores/as que comprometa la imagen del Poder Judicial dentro de las instalaciones de la Finca, será comunicado a la Inspección Judicial para que se investigue su proceder.

Además de las sanciones previstas en el artículo 195 de esa ley, se podrá prohibir el ingreso del servidor/a a las instalaciones de la Finca.

En el caso de los visitantes se procederá a prohibirles el ingreso a las instalaciones de la Finca, hasta que se cancelen los daños ocasionados o transcurra un plazo, el cual será fijado por la Administración Regional.

Una vez transcurrido el plazo de la audiencia, a que se refiere este artículo, sin respuesta del emplazado o una vez recibida su defensa y evacuadas las pruebas pertinentes, la Administración Regional procederá a dictar la resolución que corresponda.

Queda entendido que el Poder Judicial no será responsable de los daños que pudieren sufrir las personas que visitan las instalaciones de la Finca La Soledad, con excepción de aquellas que se refieran a una actividad de índole laboral, ni de las cosas que lleven o transporten consigo, salvo en los casos en que hubiera una acción directa y deliberada del Poder Judicial o de sus servidores/as que hubiera determinado causalmente el daño sufrido.

Uso de las instalaciones

CAPÍTULO IV

Asimismo, se permitirá el ingreso de animales a los servidores/as que por la naturaleza de sus funciones, deban realizar prácticas o actividades que involucre el trato con animales, como es el caso de los/as servidores/as que laboran en la Unidad Canina del Organismo de Investigación Judicial.

Regulations for Use of Finca La SoledadReglamento para uso de la Finca La Soledad

Artículo 1 — The provisions of these regulations are mandatory for the employees of the Judicial Branch, as well as for all those persons who make use of the facilities of the La Soledad farm, which is located in the Judicial City of San Joaquín de Flores, in the province of Heredia.

Artículo 4 — The following shall have the right to the use and enjoyment of the facilities of the La Soledad Farm, at no cost:

Artículo 5 — The facilities of the La Soledad Farm shall be ceded free of charge for the realization of the activities indicated in article three.

Artículo 6 — Users shall have the right to use the facilities of the La Soledad Farm, which include, among others, green areas, a butterfly garden (mariposario), ranch-style structures (ranchos), a multipurpose hall, trails, and reforestation areas.

Artículo 7 — Judicial employees may enter the facilities of the La Soledad Farm, upon prior identification by means of their respective identification card.

Artículo 8 — Judicial employees shall be responsible for observing and complying with the provisions on the use and care of the facilities of the La Soledad Farm.

Artículo 9 — Special visitors to whom the Regional Administration grants authorization, pursuant to the provisions of article 4, must observe and comply with the provisions on the use and care of the same.

Artículo 10 — Users must ensure the care of the facilities and the flora and fauna of the place, in addition to ensuring they do not leave waste or garbage outside the containers placed for this purpose.

Artículo 11 — It is the duty of users to maintain order and cleanliness in the facilities of the Recreation Farm.

Artículo 12 — Users have the right and the duty to denounce before the Judicial Inspection, the Regional Administration, or the caretaker of the Farm, those acts that in their opinion have offended the conventional rules of morality or that have damaged the physical facilities of the Farm.

Artículo 13 — The Regional Administrator or the person in charge of the Farm shall be empowered to evict from the farm's facilities those users who have incurred in improper behavior, without prejudice to any other sanction that may be imposed upon them.

Artículo 14 — In the case of judicial employees, the provisions of Title VIII of the Organic Law of the Judicial Branch, which deals with the disciplinary regime, shall apply.

Artículo 15 — Prior to the imposition of a sanction, the visitor against whom a formal complaint is filed shall be summoned by the Regional Administration, for a period of five business days, to respond and offer the evidence they deem pertinent.

Artículo 17 — Entry to the facilities with any type of animal is prohibited, with the exception of those animals trained to assist persons with some physical disability.

Artículo 18 — The use of firearms, compressed air weapons, or arrows of any type is prohibited within the facilities of the La Soledad Farm.

Artículo 19 — The use of sound equipment and television sets is permitted, provided that their sound does not disturb the tranquility of other persons.

Artículo 20 — The hunting of any species and the removal of any type of plant and tree within the La Soledad Farm is prohibited.

Artículo 21 — It is prohibited to pick fruits from the trees and plants, as these are for the feeding of the local fauna.

Artículo 22 — Any activity officially scheduled by the Superior Council of the Judicial Branch shall have priority in the order of use of the facilities of the La Soledad Farm.

Artículo 23 — Regarding any other aspect of access and use of the facilities of the La Soledad Farm not provided for in these Regulations, the provisions of the Superior Council of the Judicial Branch shall apply.

Artículo 24 — These Regulations take effect upon their publication."

Artículo 4 — Tendrán derecho al uso y disfrute de las instalaciones de la Finca La Soledad, sin costo alguno:

Artículo 5 — Las instalaciones de la Finca La Soledad se cederán gratuitamente para la realización de las actividades indicadas en el artículo tercero.

Artículo 6 — Las personas usuarias tendrán derecho a utilizar las instalaciones de la Finca La Soledad, que comprende entre otras, áreas verdes, mariposario, ranchos, salón multiuso, senderos y áreas de reforestación.

Artículo 7 — Las servidoras y los servidores judiciales podrán ingresar a las instalaciones de la Finca La Soledad, previa identificación mediante el respectivo carné.

Artículo 8 — Las servidoras y los servidores judiciales serán responsables de observar y acatar las disposiciones sobre el uso y cuido de las instalaciones de la Finca La Soledad.

Artículo 9 — Los visitantes especiales a quienes la Administración Regional les conceda autorización, según lo dispuesto en el artículo 4, deberán observar y acatar las disposiciones sobre el uso y cuido de las mismas.

Artículo 10 — Las personas usuarias deberán velar por el cuidado de las instalaciones y la flora y fauna del lugar, además de asegurarse de no dejar desechos ni basura fuera de los recipientes colocados para ese fin.

Artículo 11 — Es deber de las personas usuarias mantener el orden y el aseo en las instalaciones de la Finca de Recreo.

Artículo 13 — El Administrador Regional o el encargado de la Finca, estarán facultados para desalojar de las instalaciones de la finca a las personas usuarias que hayan incurrido en comportamientos indebidos, sin perjuicio de cualquier otra sanción que se les pueda imponer.

Artículo 14 — En el caso de los servidores/as judiciales, se aplicará lo dispuesto en el Título VIII de la Ley Orgánica del Poder Judicial que trata acerca del régimen disciplinario.

Artículo 15 — De previo a la imposición de una sanción, el visitante contra quien se presente una queja formal, será emplazado por la Administración Regional, por un plazo de cinco días hábiles, para que responda y ofrezca la prueba que considere pertinente.

Artículo 17 — Es prohibido el ingreso a las instalaciones con cualquier tipo de animales, con excepción de aquellos animales adiestrados para asistir a personas con alguna discapacidad física.

Artículo 18 — Se prohíbe el uso de armas de fuego, de aire comprimido o flechas de cualquier tipo dentro de las instalaciones de la Finca La Soledad.

Artículo 19 — El uso de equipos de sonido y aparatos de televisión está permitido, siempre y cuando su sonido no perturbe la tranquilidad de otras personas.

Artículo 20 — Es prohibida la caza de cualquier especie y el retiro de cualesquier tipo de planta y árbol dentro de la Finca La Soledad.

Artículo 21 — Es prohibido bajar frutas de los árboles y plantas, ya que estas son para la alimentación de la fauna del lugar.

Artículo 22 — Toda actividad programada en forma oficial por el Consejo Superior del Poder Judicial tendrá prioridad en el orden de uso de las instalaciones de la Finca La Soledad.

Artículo 23 — Tratándose de cualquier otro aspecto sobre acceso y utilización de las instalaciones de la Finca La Soledad, no previstos en este Reglamento, se estará a lo dispuesto por el Consejo Superior del Poder Judicial.

Artículo 24 — Este Reglamento rige a partir de su publicación."
