in the entirety of the text - Complete Text of Norm 35849 Declaration of Public Interest of the Interinstitutional Commission of the Northern Border Corridor National Wildlife Refuge Zone and other Territories of the Northern Zone of Costa Rica Complete Text record: CEAF9 Nº 35849-MINAET THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT, ENERGY AND TELECOMMUNICATIONS In exercise of the powers conferred upon them by articles 50, 140 subsections 3) and 18) and 146 of the Political Constitution, articles 82, 83, 84, 85 and 87 of the Wildlife Conservation Law, Nº 7317 of October 30, 1992, articles 28, 29, 30 and 32 of the Organic Law of the Environment, Nº 7554 of October 4, 1995, articles 52, 58, 59, 60 and 61 of the Biodiversity Law, Nº 7788 of April 30, 1998 and article 27 of the General Law of Public Administration, Nº 6227, of May 2, 1978.
I.-That the problem of legal insecurity of the inhabitants and settlers located within the territories that make up the Costa Rican Northern Border Corridor National Wildlife Refuge Zone is a priority for the State, since it is the function of the State to ensure the conservation of renewable natural resources, especially those that contribute to the well-being and better social, economic, political and ecological development of the region's inhabitants.
II.-That the Northern Border Corridor National Wildlife Refuge Zone is administered by the Ministry of Environment, Energy and Telecommunications (MINAET) and is characterized as an inalienable zone.
III.-That many of the inhabitants and settlers who live in said zones not only inhabit those lands, but that the same, by their nature and location, have contributed and currently contribute to providing sustenance to thousands of families through rural tourism as a means of subsistence.
IV.-That it is the duty of the State, through institutions such as the Ministry of Environment, Energy and Telecommunications, to resolve the problem of land tenure (tenencia de la tierra) of the inhabitants and settlers who are within the territories located within the Northern Border Corridor National Wildlife Refuge Zone.
V.-That various legal interpretations endanger the existence and permanence of Costa Rican farmers and rural workers, promoting the uprooting and cultural extinction of said settlements, for which reason an evaluation study must be urgently promoted to determine the environmental, social and economic relevance of the Northern Border Corridor National Wildlife Refuge Zone, the result of which reflects the need and basis for a proposal for the disaffection (desafectación) via law of said territory.
VI.-That the Political Constitution of the Republic of Costa Rica establishes in its numeral 50 that the Costa Rican State must ensure the right of every citizen to a healthy, ecologically balanced and environmentally sustainable environment, this being understood as development that satisfies basic human needs without compromising the options of future generations.
VII.-That article 7 of the Political Constitution states that public treaties, international conventions and concordats, duly approved by the Legislative Assembly, shall have, from their promulgation or from the day they designate, authority superior to the laws.
VIII.-That our country signed, on June 13, 1992, the Rio Declaration on Environment and Development.
IX.-That in the Central American Alliance for Sustainable Development (ALIDES), signed during the XV Central American Summit of Presidents, held in August 1994, through the Declaration of Guácimo, Costa Rica, it has been established that an ecologically balanced environment implicitly carries the concept of sustainable development. In this regard, let us see the definition given for sustainable development in this international instrument:
"Sustainable development is a process of progressive change in the quality of life of the human being, which places him as the center and primary subject of development, through economic growth with social equity and the transformation of production methods and consumption patterns, and which is sustained by the ecological balance and the life support of the region. This process implies respect for regional, national and local ethnic and cultural diversity, as well as the strengthening and full citizen participation, in peaceful coexistence and in harmony with nature, without compromising and guaranteeing the quality of life of future generations." X.-That there is, on the part of the Minister of Environment, Energy and Telecommunications, great interest in carrying out the proper interinstitutional coordination, with a view to solving the existing problems related to the administration of the territories in the Northern Border Corridor National Wildlife Refuge Zone. Therefore, They Decree:
DECLARATION OF PUBLIC INTEREST OF THE INTERINSTITUTIONAL COMMISSION OF THE NORTHERN BORDER CORRIDOR NATIONAL WILDLIFE REFUGE ZONE AND OTHER TERRITORIES OF THE NORTHERN ZONE OF COSTA RICA
Considering:
1. The Executive President of the Institute of Agrarian Development; 2. The Minister of Tourism, and 3. The Minister of Environment, Energy and Telecommunications.
Said Commission must coordinate with the respective municipalities and other institutions, for which it will be empowered to appoint technical work teams at the regional level, according to the competence and territorial convenience of the affected zones. Likewise, this Commission may recommend the mechanisms that, jointly, may be implemented to efficiently administer each of the territories that make up the Northern Zone.
The Minister of Environment, Energy and Telecommunications, in his capacity as coordinator of the Commission, shall have a non-extendable period of 30 calendar days, counted from the officialization of this Executive Decree, for the integration of the same, who must prepare an emergent work plan or schedule proposed in the Commission, with the urgent measures to be taken and the deadline for their proper execution, through a schedule of tasks, as well as the formation of the technical and legal work team(s) that will have the task of consolidating the different planning proposals, according to the needs of each zone and the proper interinstitutional coordination according to their competence.
The foregoing shall be materialized through the signing of an agreement between the institutions that make up said Commission, which shall be adjusted in light of the legislation in force.
The foregoing, in accordance with their competencies and until such time as there are definitive solutions that provide legal security to all the inhabitants and settlers, according to the characteristics of each of the zones that make up the Costa Rican northern zone. However, the Commission's main objective shall be to make the maximum effort, in order to obtain in the shortest possible time, the different legal and technical proposals that will provide the solution to the different problems related to the territorial planning of the northern zone of Costa Rica.

I.-Que el problema de la inseguridad jurídica de los habitantes y pobladores que se ubican dentro de los territorios que conforman la Zona del Refugio Nacional de Vida Silvestre Corredor Fronterizo costarricense, resulta ser una prioridad para el Estado, ya que es función del mismo velar por la conservación de los recursos naturales renovables, especialmente aquellos que colaboran en el bienestar y mejor desarrollo social, económico, político y ecológico de los pobladores de la región.
II.-Que la Zona del Refugio Nacional de Vida Silvestre Corredor Fronterizo es administrada por el Ministerio de Ambiente, Energía y Telecomunicaciones (MINAET) y se caracteriza por ser una zona inalienable.
III.-Que muchos de los habitantes y pobladores que viven en dichas zonas, no sólo habitan en dichos terrenos, sino que los mismos, por su naturaleza y ubicación han contribuido y contribuyen actualmente, a llevar el sustento a miles de familias a través del turismo rural como medio de subsistencia.
IV.-Que es deber del Estado a través de las instituciones como el Ministerio de Ambiente Energía y Telecomunicaciones, resolver la problemática de tenencia de la tierra de los habitantes y pobladores que están dentro de los territorios que se ubican dentro de la Zona del Refugio Nacional de Vida Silvestre Corredor Fronterizo.
V.-Que diversas interpretaciones legales ponen en peligro la existencia y permanencia, de los agricultores y trabajadores rurales costarricenses, promoviendo el desarraigo y extinción cultural de dichos poblados, por lo que se debe promover con urgencia un estudio de evaluación que determine la relevancia de carácter ambiental, social y económica de la Zona del Refugio Nacional de Vida Silvestre Corredor Fronterizo, cuyo resultado refleje la necesidad y fundamento para una propuesta de desafectación vía ley de dicho territorio.
VI.-Que la Constitución Política de la República de Costa Rica, establece en su numeral 50 que el Estado costarricense debe velar por el derecho de todo ciudadano a un ambiente sano, ecológicamente equilibrado y ambientalmente sostenible, entendido éste, como el desarrollo que satisface las necesidades humanas básicas sin comprometer las opciones de las futuras generaciones.
VII.-Que el artículo 7 de la Constitución Política, señala que los tratados públicos, los convenios internacionales y los concordatos, debidamente aprobados por la Asamblea Legislativa, tendrán desde su promulgación o desde el día que ellos designen, autoridad superior a las leyes.
VIII.-Que nuestro país, suscribió el 13 de junio de 1992, la Declaración de Río sobre el Medio Ambiente y el Desarrollo.
IX.-Que en la Alianza Centroamericana para el Desarrollo Sostenible (ALIDES), suscrita durante la XV Cumbre Centroamericana de Presidentes, realizada en agosto de 1994, mediante la Declaración de Guácimo, Costa Rica, se ha establecido que un ambiente ecológicamente equilibrado lleva implícito el concepto de desarrollo sostenible. Al respecto veamos la definición que se da sobre desarrollo sostenible en este instrumento internacional:
"Desarrollo sostenible es un proceso de cambio progresivo en la calidad de vida del ser humano, que lo coloca como centro y sujeto primordial del desarrollo, por medio del crecimiento económico con equidad social y la transformación de los métodos de producción y de los patrones de consumo y que se sustenta en el equilibrio ecológico y el soporte vital de la región. Este proceso implica el respeto a la diversidad étnica y cultural regional, nacional y local, así como el fortalecimiento y la plena participación ciudadana, en convivencia pacífica y en armonía con la naturaleza, sin comprometer y garantizando la calidad de vida de las generaciones futuras".
X.-Que existe por parte del Ministro de Ambiente Energía y Telecomunicaciones, gran interés en realizar la debida coordinación interinstitucional, con miras a solventar la problemática existente en relación con la administración de los territorios en la Zona del Refugio Nacional de Vida Silvestre Corredor Fronterizo Norte. Por tanto,
DECLARATORIA DE INTERÉS PÚBLICO DE LA COMISIÓN INTERINSTITUCIONAL DE LA ZONA DEL REFUGIO NACIONAL DE VIDA SILVESTRE CORREDOR FRONTERIZO NORTE Y DEMÁS TERRITORIOS DE LA ZONA NORTE DE COSTA RICA
Considerando:
Decretan:
1. El Presidente Ejecutivo del Instituto de Desarrollo Agrario; 2. El Ministro de Turismo, y 3. El Ministro de Ambiente, Energía y Telecomunicaciones.
Dicha Comisión deberá coordinar con las respectivas municipalidades y otras instituciones, para lo cual quedará facultada para nombrar equipos técnicos de trabajo a nivel regional, según sea la competencia y conveniencia territorial de las zonas afectadas. Así también, esta Comisión podrá recomendar los mecanismos que de manera conjunta, puedan implementarse para administrar de manera eficiente, cada uno de los territorios que componen la Zona Norte.
El Ministro de Ambiente, Energía y Telecomunicaciones en su condición de coordinador de la Comisión dispondrá de un plazo improrrogable de 30 días naturales, contados a partir de la oficialización del presente Decreto Ejecutivo, para la integración de la misma, quien deberá elaborar un plan o programación emergente de trabajo propuesto en la Comisión, con las medidas urgentes a tomar y el plazo para su debida ejecución, por medio de un cronograma de labores, así como la conformación del (los) equipo (s) de trabajo tanto técnico(s) como legal (es) que tendrá la tarea de consolidar las diferentes propuestas de ordenamiento, según las necesidades de cada zona y la debida coordinación interinstitucional según su competencia.
Lo anterior, será concretado mediante la firma de un convenio entre las instituciones que conforman dicha Comisión, el cual se ajustará a la luz de la legislación vigente.
Lo anterior, de acuerdo a sus competencias y hasta tanto no existan de manera definitiva las soluciones que den seguridad jurídica a todos los habitantes y pobladores, según las características de cada una de las zonas que conforman la zona norte costarricense. Sin embargo, la Comisión tendrá como objetivo principal realizar el máximo esfuerzo, a fin de obtener en el menor plazo posible, los diferentes planteamientos tanto jurídicos como técnicos, que darán la solución a los diferentes problemas relacionados con el ordenamiento territorial de la zona norte de Costa Rica.
