in the entirety of the text - Full Text of Norm 35864 Declares of Public Utility for the interests of the State the Administrative Association of the Rural Aqueduct of Santa María, San Francisco, and Pilar de Cajón de Pérez Zeledón Full Text acta: 102D25 N° 35864-J (This executive decree was revoked and rendered without effect by article 1 of executive decree N° 38893 of November 27, 2014) THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF Based on the provisions of articles 140, subsection 18) and 146 of the Political Constitution, article 32 of the Law of Associations, and articles 27 and following of its Regulations.
I.-That article 32 of the Law of Associations number 218 of August 8, 1939, and its reforms, grants the Executive Branch the power to declare of Public Utility those simple, federated, or confederated Associations, whose development and activities are particularly useful for the interests of the State, and that thereby contribute to solving a social need.
II.-That the Administrative Association of the Rural Aqueduct of Santa María, San Francisco, and Pilar de Cajón de Pérez Zeledón, legal entity identification number: 3-002-296515, was registered in the Associations Registry of the Public Registry as of May 9, 2005, under volume No. 485, entry 19359.
III.-That the purposes pursued by the Association, according to article three of its bylaws, are: ". Article Three: The purposes of the Association are the following: a) To improve and expand the existing aqueduct in Santa María, San Francisco, and el Pilar, all in the district of Cajón; b) To administer, observe, and preserve the aqueduct in good condition, in accordance with the provisions and Regulations issued in this regard by the Department of Rural Aqueducts of the National Institute of Aqueducts and Sewers; c) To obtain the effective participation of the community in the expansion and maintenance of the aqueduct; d) To collaborate in the educational programs and campaigns that are undertaken; e) To help explain and disseminate within the community the provisions and Regulations of the Department of Rural Aqueducts of the National Institute of Aqueducts and Sewers; f) To cooperate with the plans, projects, and works undertaken by the Department of Rural Aqueducts of the National Institute of Aqueducts and Sewers in the community; g) To participate in the surveillance and protection of the aqueduct's supply sources, to avoid their contamination, and to help in the protection of the hydrographic basins of the Region.". IV.-That such purposes address a social need of the highest order, for which reason they merit the support of the Costa Rican State. Therefore, They Decree:

I.-Que el artículo 32 de la Ley de Asociaciones número 218 de ocho de agosto de mil novecientos treinta y nueve y sus reformas, confiere al Poder Ejecutivo la potestad de declarar de Utilidad Pública a las Asociaciones simples, federadas o confederadas, cuyo desarrollo y actividades sean particularmente útiles para los intereses del Estado, y que por ello contribuyan a solventar una necesidad social.
II.-Que la Asociación Administrativa del Acueducto Rural de Santa María, San Francisco y Pilar de Cajón de Pérez Zeledón, cédula de persona jurídica número: 3-002-296515, se inscribió en el Registro de Asociaciones del Registro Público desde el día nueve de mayo del dos mil cinco, bajo el tomo N°. 485, asiento 19359.
III.-Que los fines que persigue la Asociación, según el artículo tercero de sus estatutos, son: ". Artículo Tercero: Los fines de la Asociación son los siguientes: a) Mejorar y ampliar el acueducto existente en Santa María, San Francisco y el Pilar, todos del distrito de Cajón; b) Administrar, observar y conservar en buenas condiciones el acueducto, de acuerdo con las disposiciones y Reglamentos que al respecto emita el Departamento de Acueductos Rurales del Instituto Nacional de Acueductos y Alcantarillados; c) Obtener la participación efectiva de la comunidad en la ampliación y el mantenimiento del acueducto; d) Colaborar en los programas y campañas de índole educativo que se emprendan; e) Ayudar a explicar y divulgar en la comunidad las disposiciones y Reglamentos del Departamento de Acueductos Rurales del Instituto Nacional de Acueductos y Alcantarillados; f) Cooperar con los planes, proyectos y obras que emprenda el Departamento de Acueductos Rurales del Instituto Nacional de Acueductos y Alcantarillados en la comunidad; g) Participar en la vigilancia y protección de las fuentes de abastecimiento del acueducto, evitar la contaminación de las mismas y ayudar a la protección de las cuencas hidrográficas de la Región.". IV.-Que tales fines solventan una necesidad social de primer orden, por lo cual merecen el apoyo del Estado Costarricense. Por tanto,
