in the entirety of the text - Full Text of Regulation 0 Declaration of local tourist interest and restrict lucrative activities carried out in those areas to those compatible with the development of ecotourism and modalities such as rural community tourism, ecotourism, and others Full Text of Minute: CE961 MUNICIPALITY OF MORA The Municipal Corporation of the Canton of Mora transcribes the agreement adopted in ordinary session No. 94-2008-2010, held on February 15, 2010, which textually states:
Article fifteen: The Council agrees to publish the agreement related to the declaration of tourist interest of the Canton of Mora detailed below:
"II.- Text of the motion: First: To agree to declare of local tourist interest the circuit formed by the following communities and zones of the canton: Eastern Circuit: District of Colón with the following localities: 1. Urban Core, 2. Cerro de Escazú Protective Zone, 3. Jaris, 4. El Rodeo, 5. Quitirrisí; district of Guayabo with the following localities: 6. Guayabo, 5. Quitirrisí; district of Tabarcia with the following localities: 5. Quitirrisí, 7. Bustamante; district of Piedras Negras: 8. Piedras Negras, 9. La Palma; Western Circuit: district of Picagres: 10. Picagres, 11. Jateo, 12. Cordel, 13. Balsilla de Mora, 14. Llano Grande.
Second: To agree to restrict lucrative activities carried out in those areas to those compatible with the development of ecotourism and its modalities such as rural community tourism, agro-ecotourism, and others; and the residential vocation.
Third: Additionally, to carry out projects that require land clearing, excavations, and fills greater than 500 m3 or of a smaller area but with a certain degree of hazard, an Environmental Fragility Index specific to the project area and its potential impact zone must be provided, an updated opinion issued by the National Commission for Risk Prevention and Emergency Response indicating the risks or impacts present on the land and its mitigation or control recommendations, an updated opinion issued by MINAE indicating whether the land is affected by springs or similar, and a materials or debris management plan, describing:

b. Machinery and equipment to be used, with their respective responsible person or supervisor.
c. For any site used for the final disposal of waste or debris, a copy of the respective permit issued by the competent institutions (MINAE or municipality) must be presented.
d. Description of the mitigation and control measures for dust, gases, or other waste during its transport or displacement.
e. Description of the route to be used for the displacement of the material.
Fourth: Publish in La Gaceta.
III.Legal Basis: I base this motion on the regulations provided by articles 17 subsection a), 44, and 45 of the Código Municipal and the Ley General de la Administración Pública, No. 6227.
IV.Prayer for Relief: By virtue of the considerations set forth, I request this honorable Municipal Council to adopt this motion in its entirety, dispensing with the opinion procedure and declaring the agreement as definitively approved. With dispensation from Committee, firm and substantive agreement, the Council agrees to approve this motion." Definitive agreement.

Artículo quince: El Concejo acuerda publicar el acuerdo relacionado con la declaratoria de interés turístico del Cantón de Mora que se detalla a continuación:
"II.-Texto de la moción: Primero: Para que se acuerde declarar de interés turístico local, el circuito conformado por las siguientes comunidades y zonas del cantón: Circuito Este: Distritos Colón con las siguientes localidades: 1.Casco Urbano, 2.Zona Protectora C. de Escazú, 3. Jaris, 4. El Rodeo, 5. Quitirrisí, distrito Guayabo con las siguientes localidades: 6. Guayabo, 5. Quitirrisí, distrito Tabarcia con las siguientes localidades: 5. Quitirrisí, 7. Tercero: Adicionalmente, para realizar proyectos que requieran limpieza de terreno, excavaciones y rellenos mayores a 500m3 o de área menor pero con cierto grado de peligrosidad, se deberá contar con un índice de Fragilidad Ambiental específico para el área del proyecto y su zona de impacto potencial, un dictamen actualizado extendido por la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias en el que se indiquen los riesgos o afectaciones presentes en el terreno y sus recomendaciones de mitigación o control, dictamen actualizado extendido por el MINAE en el que se indique si el terreno está afectado por nacientes o similares y plan de manejo de materiales o escombros, donde se describa:

b. Maquinaria y equipo a utilizar, con sus respectivos responsable o encargado.
c. Todo sitio utilizado para la disposición final de los desechos o escombros debe presentarse copia del permiso respectivo extendido por las instituciones competentes (MINAE o municipalidad).
d. Descripción de las medidas de mitigación y control del polvo, gases u otros deshechos para su transporte o desplazamiento.
e. Descripción de la ruta a utilizar para el desplazamiento del material.
Cuarto: Publíquese en La Gaceta.
III.Fundamentos de Derecho: Fundamento la presente moción, en la normativa dispuesta por los artículos 17 inciso a), 44 y 45 del Código Municipal y Ley General de la Administración Pública, Nº 6227.
IV.Petitoria: En virtud de las consideraciones expuestas, solicito a ese honorable Concejo Municipal acoger en todos sus extremos la presente moción, dispensando del trámite de dictamen y declarando el acuerdo como definitivamente aprobado. Con dispensa de Comisión, acuerdo firme y de fondo, el Concejo acuerda aprobar esta moción". Acuerdo definitivo.
