Whereas:

6877, published in La Gaceta No. 143 of 29 July 1983, the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA) was created, whose objectives, among others, are to promote the agricultural development of the country, through the establishment and operation of irrigation, drainage, and flood protection systems; to contribute to preferentially developing those agricultural development projects based on a just distribution of land; and to ensure that in the territory benefitted by the creation of irrigation and drainage districts, a rational and democratic modification of land ownership is undertaken.

32452-H, published in La Gaceta No. 130 of 6 July 2005 and its amendments, the "Lineamiento para la aplicación del Artículo 6 de la Ley Nº 8131 de la Administración Financiera de la República y Presupuestos Públicos y la regulación de la clase de ingresos del Sector Público denominada Financiamiento" was issued.

32452-H enables its use for the payment of expenses defined within the purposes established in the special or legal provisions applicable to such resources.

35111-H, published in La Gaceta No. 58 of 24 March 2009 and its amendments, the General Budget Policy Guidelines for the year 2010 were issued, establishing in Article 1 of the cited decree the maximum budget expenditure for the year 2010 for the entities covered by the scope of the Budgetary Authority.

10.-That therefore, it is necessary to amend the maximum budget expenditure set for the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento for 2010, increasing it by the sum of ¢3,916,673,963.48 (three billion nine hundred sixteen million six hundred seventy-three thousand nine hundred sixty-three colones and forty-eight céntimos). Therefore;

Decree:

35111-H, published in La Gaceta No. 58 of 24 March 2009 and its amendments, is amended, making the maximum budget expenditure the sum of ¢6,746,373,963.48 (six billion seven hundred forty-six million three hundred seventy-three thousand nine hundred sixty-three colones and forty-eight céntimos) for that period.

Considerando:

10.-Que por lo anterior, resulta necesario modificar el gasto presupuestario máximo fijado para el Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento para el 2010, incrementándolo en la suma de ¢3.916.673.963,48 (tres mil novecientos dieciséis millones seiscientos setenta y tres mil novecientos sesenta y tres colones con cuarenta y ocho céntimos). Por tanto;

Decretan:

Dado en la Presidencia de la República, a los nueve días del mes de febrero del dos mil diez.

Artículo 1 — The maximum budget expenditure set for the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA) for the year 2010, established in Decreto Ejecutivo No.

Artículo 2 — It is the responsibility of the active administration of the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA) to comply with the provisions of Article 6 of Law No.

Artículo 3 — It enters into force upon its publication.

Artículo 5 — Que con el superávit específico por la suma de ¢636.937.320,00 (seiscientos treinta y seis millones novecientos treinta y siete mil trescientos veinte colones sin céntimos) se cancelará la ejecución del proyecto Trasvase de Aguas para el riego del Río Corobicí al Canal Oeste.

Artículo 7 — Que en relación con el superávit específico, el numeral 9° del referido Decreto Ejecutivo Nº 32452-H, posibilita la utilización de éste, para el pago de gastos definidos en los fines establecidos en las disposiciones especiales o legales aplicables a tales recursos.

Artículo 3 — Rige a partir de su publicación.
