in the entirety of the text - Full Text of Regulation 35775 Regulation for the Creation and Operation of the National Advisory Commission to the Minister and to the State Phytosanitary Service Full Text of record: CE323 No. 35775-MAG THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF AGRICULTURE AND LIVESTOCK In exercise of the powers conferred by Articles 140, subsections 3), 18), and 20), Article 146 of the Political Constitution; Articles 25 subsection 1), 27 subsection 1), 28 subsections b) and j), of Law No. 6227 of May 2, 1978, which is the General Law of Public Administration, and Law No. 7664 of April 8, 1997, which is the Law of Phytosanitary Protection.
1.—That it is the responsibility of the Ministry of Agriculture and Livestock to protect plants from the harm caused by pests, as well as to avoid and prevent the introduction and spread of pests that threaten the economic activity based on agricultural production.
2.—That the opinion and advice of the different actors involved in productive agricultural activities, such as the producer, exporter, university, and research sectors, are of interest to the administration in the search for joint solutions to the different problems that occur in the activity.
3.—That the Ministry of Agriculture and Livestock may establish advisory commissions for the application of Law 7664, as established in Article 7 of said Law.
4.—That the State Phytosanitary Service is the public body responsible for the application of phytosanitary measures, ensuring they are those necessary to protect the health and life of persons and animals or to preserve plants, provided that such measures are not incompatible with the provisions of the Agreement on Sanitary and Phytosanitary Measures of the World Trade Organization (WTO), and is the official counterpart for the Multilateral and Bilateral Agreements signed by the country on phytosanitary matters. Therefore, They Decree:
Regulation for the Creation and Operation of the National Advisory Commission to the Minister and to the State Phytosanitary Service
Considering:
1. The General Director of the SFE, who shall preside over CONAFI.
2. A representative of the College of Agronomist Engineers (CIAgro).
3. A representative of the National Chamber of Agriculture and Agroindustry (CNAA).
4. A representative of the Chamber of Exporters of Costa Rica (CADEXCO).
5. A representative of the organizations of small and medium-sized agricultural and livestock producers, designated by the Minister of Agriculture and Livestock.
6. A representative of the state Universities, designated by the National Council of Rectors (CONARE).
The Minister of Agriculture and Livestock shall designate, from among the various organizations of small and medium-sized agricultural and livestock producers, which group shall represent the sector on CONAFI.
Except for the representative of the small and medium-sized producers, who shall be designated by the Minister.
The General Director of the SFE must send the request for nomination to the organizations that make up CONAFI within a period not exceeding eight business days each time a vacancy arises.
In the event of resignation or removal, the General Director of the SFE shall request the respective entity to provide a substitute.
The members of CONAFI shall not receive per diem allowances or any emolument whatsoever for participating in and making up said collegiate body.
1. To advise the Minister of Agriculture and Livestock and the General Director of the SFE so that they efficiently and effectively fulfill their functions and obligations in phytosanitary matters, responding to the current needs of the agricultural sector and the international trade of agricultural products.
2. To analyze and give opinions on the technical recommendations or phytosanitary measures proposed by the SFE, in matters within its competence, brought to the attention of CONAFI by the General Director of the SFE.
3. To analyze and give opinions on the progress of the pest prevention and control programs executed by the SFE, brought to the attention of CONAFI by the General Director of the SFE.
4. To form the working subcommittees necessary for its better operation within the scope of action of CONAFI.
5. To recommend phytosanitary research programs, as well as training programs for field technicians and producers in matters of phytosanitary protection in general, as well as in all work areas of the SFE when a specific need arises.
6. To propose topics in phytosanitary matters that require analysis and coordination by the public and private sectors; as well as those that the private sector has brought to the attention of CONAFI, defining their priority.
7. To collaborate on tasks entrusted by the General Director of the SFE or the Minister of Agriculture and Livestock.
1. To preside over the sessions of CONAFI, decide when discussion topics have been sufficiently discussed, and submit them to a vote.
2. To request the Secretariat of CONAFI to convene extraordinary sessions.
3. To set technical directives and issue instructions regarding the procedural aspects of CONAFI's tasks.
4. The other functions inherent to the position.
It may also meet extraordinarily whenever convened by the presidency or by three of its members.
Decisions shall be adopted by simple majority. In the event of a tie, the president shall exercise a double vote.
The Director of the SFE shall communicate this situation to the institution or sector represented for the purpose of proceeding with the substitution of the representative.
The agreements declared firm may be executed as of the date they were adopted. These may be declared firm at the same session where the resolution was taken. CONAFI shall designate who shall execute them, and the Secretariat shall follow up.
Said request must be made effective at the time of the reading and discussion of the minutes of the previous session.
1. To issue the invitations and officially convene the ordinary sessions, as well as to convene the extraordinary ones, at the request of the President, the interested parties, or three members of CONAFI, with no less than forty-eight hours’ notice.
2. To receive and submit for the knowledge of CONAFI the correspondence, requests, and technical documents for analysis.
3. To maintain the Book of Minutes, which must be duly and consecutively foliated and sealed, where the agreements adopted by CONAFI shall be recorded.
4. To present, together with the Presidency, the agenda of matters to be addressed at each meeting.
5. To register, archive, classify, and organize chronologically the correspondence or documents received and issued by CONAFI.
6. To execute and coordinate the studies requested by CONAFI, for which it shall have the support of all the specialized bodies in the matter under study.
7. To keep a technical archive updated.
8. To reply to correspondence.
9. To communicate and notify the interested parties of the agreements of CONAFI.
10. To prepare and distribute in a timely manner the documentation referring to the illustrative and technical background of the matter to be addressed.
11. To coordinate the participation of specialists from both the public sector and the private sector, when the President of CONAFI deems it necessary or convenient.
12. To coordinate the preparation of the conclusions and reports for the President of CONAFI on the matters that arise as a result of the sessions.
13. The other functions inherent to a Secretariat as assigned by CONAFI.
The Director of the SFE shall act as the liaison entity with the various bodies of the SFE.
The support offered to CONAFI consists solely of the contribution of an official who shall exercise the Secretariat and the contribution of a legal advisor, only when requested by agreement of CONAFI. Both officials shall participate with voice but without vote.

Reglamento de Creación y Funcionamiento de la Comisión Nacional Asesora del Ministro y del Servicio Fitosanitario del Estado
Considerando:
Decretan:
1. El Director General del SFE, quien presidirá la CONAFI.
2. Un representante del Colegio de Ingenieros Agrónomos (CIAgro).
3. Un representante de la Cámara Nacional de Agricultura y Agroindustria (CNAA).
4. Un representante de la Cámara de Exportadores de Costa Rica (CADEXCO).
5. Un representante de las Organizaciones de pequeños y medianos productores agropecuarios, designado por el Ministro de Agricultura y Ganadería.
6. Un representante de las Universidades estatales, designado por el Consejo Nacional de Rectores (CONARE).
El Ministro de Agricultura y Ganadería designará entre las diversas organizaciones de pequeños y medianos productores agropecuarios cuál será el grupo que representará al sector en la CONAFI.
Con excepción del representante de los pequeños y medianos productores, que será designado por el Ministro.
El Director General del SFE deberá enviar la solicitud de postulación a las organizaciones que conforman la CONAFI en un plazo no mayor de ocho días hábiles cada vez que se presente una vacante.
En caso de renuncia o remoción, el Director General del SFE solicitará al ente respectivo su sustitución.
Los integrantes de la CONAFI no percibirán dietas, ni emolumento alguno por participar e integrar dicho órgano colegiado.

1. Presidir las sesiones de la CONAFI, decidir cuándo los temas de discusión han sido suficientemente discutidos y someterlos a votación.
2. Solicitar a la Secretaría de la CONAFI la convocatoria a sesiones extraordinarias.
3. Fijar directrices técnicas e impartir instrucciones, en cuanto a los aspectos de forma de las tareas de la CONAFI.
4. Las demás funciones propias de su cargo.
También podrá reunirse extraordinariamente cada vez que sea convocada por la presidencia o por tres de sus miembros.
Los acuerdos se tomarán por mayoría simple. En caso de empate, el presidente ejercerá doble voto.
El Director del SFE comunicará esta situación a la institución o sector representado con el objeto de proceder a la sustitución del representante.
Los acuerdos declarados en firme podrán ejecutarse a partir de la fecha en que fueron adoptados. Éstos podrán declararse en firme en la misma sesión donde se tomó la resolución. La CONAFI designará quién los ejecuta, la Secretaría dará seguimiento.
Dicha solicitud deberá hacerse efectiva al momento de lectura y discusión del acta de la sesión anterior.
1. Efectuar las invitaciones y convocar de oficio a las sesiones ordinarias, así como convocar a las extraordinarias, a instancia del Presidente, de los interesados o de tres miembros de la CONAFI, con no menos de cuarenta y ocho horas de antelación.
2. Recibir y someter a conocimiento de la CONAFI la correspondencia, las solicitudes y documentos técnicos para su análisis.
3. Llevar el Libro de Actas, el cual deberá estar debida y consecutivamente foliado y sellado, donde se anotarán los acuerdos tomados por la CONAFI.
4. Presentar en conjunto con la Presidencia, la agenda de los asuntos a tratar en cada reunión.
5. Registrar, archivar, clasificar y ordenar cronológicamente la correspondencia o documentos recibidos y emitidos por la CONAFI.
6. Ejecutar y coordinar los estudios que solicita la CONAFI, para lo cual contará con el respaldo de todas las instancias especializadas en la materia de estudio.
7. Mantener actualizado un archivo técnico.
8. Contestar la correspondencia.
9. Comunicar y notificar a los interesados los acuerdos de la CONAFI.
10. Preparar y distribuir oportunamente la documentación referente a los antecedentes ilustrativos y técnicos de la materia a tratar.
11. Coordinar la participación de los especialistas tanto del sector público como del sector privado, cuando el Presidente de la CONAFI lo estime necesario o conveniente.
12. Coordinar la preparación de las conclusiones e informes para el Presidente de la CONAFI de los asuntos que emanen como resultado de las sesiones.
13. Las demás funciones propias de una Secretaría que le asigne la CONAFI.
El Director del SFE actuará como ente de enlace hacia las diferentes instancias de este.
El apoyo que se ofrece a la CONAFI consiste únicamente en el aporte de un funcionario que ejercerá la Secretaría y el aporte de un asesor legal, sólo cuando sea solicitado por acuerdo de la CONAFI. Ambos funcionarios participarán con voz pero sin voto.
