in the entirety of the text - Complete Text of Standard 009 Amendment to RES-DGA-707-2005 "Establishes the Procedure for the Application of the Inspection Certificate for Technical Notes 59, 53, 35, and 44 of the Ministry of Agriculture and Livestock" Complete Text of record: CD207 RES-DGA-009-2010.- Dirección General de Aduanas.- San José, at fifteen hours and thirty minutes on the eleventh day of January, two thousand ten.
I.- That in fulfillment of the facilitation and control role that a modern customs must have in foreign trade operations, the Dirección General de Aduanas has made efforts to provide the National Customs System with the necessary tools for the development of that role.
II.- That by resolution RES-DGA-203-2005, of June 22, 2005, and its amendments, of the Dirección General de Aduanas, published in Supplement No. 23 to La Gaceta No. 143 dated July 26, 2005, the Customs Procedures Manual for the implementation of the new Technology System for Customs Control Tica was published.
III.- That by resolution RES-DGA-707-2005 of December 29, 2005, the procedure for the application of the inspection certificate for technical notes 59, 53, 35, and 44 of the Ministry of Agriculture and Livestock (hereinafter MAG) was incorporated into the Customs Procedures Manual, effective as of January 17, 2006.
IV.- That of the aforementioned Procedure, it has been deemed necessary to modify the use of exception code 0018, when the MAG has not transmitted the inspection certificate. Therefore:
Based on the powers granted in the General Customs Law No. 7557 of October 20, 1995, and its reforms, and the Regulations to the General Customs Law, Decreto No. 25270-H of June 14, 1996, and its reforms:
THE DIRECTOR GENERAL OF CUSTOMS, RESOLVES:
1º.- To modify point B. of the "Por tanto" of resolution RES-DGA-707-2005 of December 29, 2005, as follows:
"MODALITY B B) At the time of transmission of the import DUA, the MAG has not transmitted the inspection certificate.
1. To transmit the import Customs Declaration, the customs broker must use exception code number 0017, which allows the acceptance of the Customs Declaration without having the inspection certificate, which will be validated before the release (levante).
2. In its own time, the MAG must transmit the inspection certificate to the TIC@ system after acceptance, and the system validates it.
3. The customs broker, once verifying that the MAG has transmitted the inspection certificate, must proceed with the transmission of the association message, called "Asociación DUA - Documentos Previos al Levante" version 1.2. (hereinafter association message).

I.-Que en cumplimiento al rol de facilitación y control que debe tener la aduana moderna, en las operaciones de comercio exterior, la Dirección General de Aduanas ha efectuado esfuerzos para dotar al Sistema Aduanero Nacional de herramientas necesarias para el desarrollo de ese papel.
II.-Que mediante resolución RES-DGA-203-2005, del 22 de junio del 2005 y sus modificaciones, de la Dirección General de Aduanas, publicada en el Alcance Nº 23 a La Gaceta Nº 143 de fecha 26 de julio del 2005, se publicó el Manual de Procedimientos Aduaneros para la implementación del nuevo Sistema de Tecnología para el Control Aduanero Tica.
III.-Que mediante resolución RES-DGA-707-2005 de fecha 29 de diciembre del 2005, se incorporó al Manual de Procedimientos Aduaneros, el procedimiento para la aplicación de la constancia de inspección para las notas técnicas 59, 53, 35 y 44 del Ministerio de Agricultura y Ganadería (en adelante MAG), con rige a partir del 17 de enero del 2006.
IV.-Que del citado Procedimiento, se ha considerado necesario modificar la utilización de código de excepción 0018, cuando el MAG no ha transmitido la constancia de inspección. Por tanto:
Con base en las potestades otorgadas en la Ley General de Aduanas Nº 7557 del 20 de octubre de 1995 y sus reformas, el Reglamento a la Ley General de Aduanas, Decreto Nº 25270-H del 14 de junio de 1996 y sus reformas:
EL DIRECTOR GENERAL DE ADUANAS, RESUELVE:
1º-Modificar el punto B. del Por tanto de la resolución RES-DGA-707-2005 de fecha 29 de diciembre del 2005, en los siguientes términos:
"MODALIDAD B B)En el momento de la transmisión del DUA de importación, el MAG no ha transmitido la constancia de inspección.
1. Para transmitir la Declaración Aduanera de importación, el agente aduanero deberá utilizar el código de excepción número 0017, lo que permite la aceptación de la Declaración Aduanera sin contar con la constancia de inspección, la cual se validará antes del levante.
2. En su oportunidad, el MAG deberá transmitir al sistema TIC@ la constancia de inspección posterior a la aceptación y el sistema valida la misma.
3. El agente aduanero una vez que verifica que el MAG ha transmitido la constancia de inspección, deberá proceder a la transmisión del mensaje de asociación, denominado "Asociación DUA - Documentos Previos al Levante" versión 1.2. (en adelante mensaje de asociación).
