in the entirety of the text - Complete Text of Regulation 35679 Modifies for the Costa Rican Institute of Aqueducts and Sewers the maximum budgetary expenditure set for the year 2010 Complete Text record: D2E1F Nº 35679-H THE ACTING PRESIDENT OF THE REPUBLIC AND THE MINISTER OF FINANCE Based on the powers conferred upon them by articles 140, subsections 3) and 18) and 146 of the Political Constitution; articles 25, subsection 1); 27, subsection 1) and 28, subsection 2), paragraph b) of Law Nº 6227, General Law of Public Administration of May 2, 1978 and its amendments; Law Nº 8131, Law of Financial Administration of the Republic and Public Budgets of September 18, 2001 and its amendments; its Regulation, Decreto Ejecutivo Nº 32988-H-MP-PLAN of January 31, 2006 and its amendments; Law Nº 2726, Constitutive Law of the Costa Rican Institute of Aqueducts and Sewers of April 14, 1961 and its amendments and Decreto Ejecutivo Nº 35111-H of March 4, 2009 and its amendments.
1º-Whereas by Law Nº 2726, published in La Gaceta Nº 89 of April 20, 1961 and its amendments, there was created the Costa Rican Institute of Aqueducts and Sewers (ICAA), entrusted with providing Costa Ricans with the public services of potable water and sanitary sewerage.
2º-Whereas by means of official communication PLA-2009-361 of September 27, 2009, the Director of Strategic Planning of the ICAA requests the expansion of the Institute’s maximum budgetary expenditure by ¢4,421,396,570.00 (exactly four thousand four hundred twenty-one million three hundred ninety-six thousand five hundred seventy colones), for the purpose of prioritizing the operation and maintenance activities of the aqueduct and sewer systems, and reinforcing the budget for aqueducts assumed by the institution, among others.
3º-Whereas said amount will be financed with resources generated by the institution itself and will be used to finance the assumed aqueducts; the operation, maintenance and commercialization of aqueducts; administrative expenses; the sanitary quality seal (PSCS); standardization of offices; special projects and the Limón-Ciudad Puerto project.
4º-Whereas by means of Decreto Ejecutivo Nº 35111-H, published in La Gaceta Nº 58 of March 24, 2009 and its amendments, the General Budgetary Policy Guidelines for the year 2010 were issued, establishing in article 1 of the cited Decree, the budgetary expenditure for the year 2010 for the entities covered by the scope of the Budgetary Authority.
5º-Whereas with official communication STAP-0650-2009 of April 28, 2009, the ICAA was notified of the maximum budgetary expenditure authorized for said institution for the year 2010, which was set at ¢51,824,000,000.00 (exactly fifty-one thousand eight hundred twenty-four million colones), a figure that does not contemplate the expenses indicated in the present decree.
6º-Whereas due to the foregoing, it is necessary to modify the maximum budgetary expenditure set for the Costa Rican Institute of Aqueducts and Sewers for the year 2010, increasing it by the sum of ¢4,421,396,570.00 (exactly four thousand four hundred twenty-one million three hundred ninety-six thousand five hundred seventy colones).
