1That in accordance with Law No. 7384, published in La Gaceta No. 62 of March 29, 1994, and its amendments, the Costa Rican Institute of Fisheries and Aquaculture has among its functions proposing the national program for the development of fisheries and aquaculture in accordance with the guidelines established in the National Development Plan.
2That Law No. 8436, published in La Gaceta No. 78 of April 25, 2005, indicates that the Costa Rican Institute of Fisheries and Aquaculture shall exercise control over fishing and aquaculture activities carried out in marine and inland waters and shall provide technical assistance to aquaculture activities in continental and marine waters.
3That through official communication PESJ-412-10-2009 of October 7, 2009, supplemented by official communication PEP-0614-10-2009 of October 16, 2009, both signed by the Executive President of the Costa Rican Institute of Fisheries and Aquaculture, a request is made to expand the maximum budgetary expenditure set for that institution, in order to incorporate into its budget for the year 2010 an amount of ¢650,000,000.00 (six hundred fifty million exact colones).
4That the resources included in this expansion shall be allocated as follows:

An amount of ¢141,680,000.00 (one hundred forty-one million six hundred eighty thousand exact colones) shall be used to cover expenses related to the fulfillment of the Agreement between the Costa Rican Institute of Fisheries and Aquaculture and the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC), and shall have as its financing source current transfers from decentralized bodies.

b. An amount of ¢59,200,000.00 (fifty-nine million two hundred thousand exact colones) shall be used to finance expenses of the National Plan for Food Reactivation, and shall have as its financing source a transfer from the Central Government.

c. An amount of ¢123,594,570.00 (one hundred twenty-three million five hundred ninety-four thousand five hundred seventy exact colones) shall be used to invest in the Integrated System of Services for the Fisheries and Aquaculture Sector (SISPA) and the purchase of land for the installation of an office, and shall have as its financing source the specific surplus from prior fiscal years.

d. An amount of ¢325,525,430.00 (three hundred twenty-five million five hundred twenty-five thousand four hundred thirty exact colones) shall be used to cover operating expenses and investments and shall have as its financing source own resources.

5That the amount of ¢1,190,306.00 (one million one hundred ninety thousand three hundred six exact colones) must be excluded from the request for expanding budgetary expenditure, which corresponds to the following items: Employer Contribution to the Caja Costarricense del Seguro Social, Contribution to the Instituto Mixto de Ayuda Social, Contribution to the Instituto Nacional de Aprendizaje, Contribution to the Fondo de Desarrollo Social y Asignaciones Familiares, Contribution to the Fondo de Desarrollo Social y Asignaciones Familiares, Complementary Pensions, Capitalization Fund. Said exclusion is made because Article No. 2 of Executive Decree No. 35111-H, published in La Gaceta No. 58 of March 24, 2009, and its amendments, so establishes.
6That through Executive Decree No. 32452-H, published in La Gaceta No. 130 of July 6, 2005, and its amendments, the Guideline for the application of Article 6 of Law No. 8131, Law of Financial Administration of the Republic and Public Budgets, and the regulation of the Public Sector revenue class called Financing are issued.
7That in relation to the specific surplus, numeral 9 of the aforementioned Executive Decree No. 32452-H enables its use for the payment of expenses defined within the purposes established in the special or legal provisions applicable to such resources.
8That through the above-cited Executive Decree No. 35111-H, the General Budgetary Policy Guidelines for 2010 were issued, establishing in Article 1 of the cited decree the maximum budgetary expenditure for the year 2010 for the institutions covered under the scope of the Budgetary Authority.
9That through official communication STAP-0709-09 of April 29, 2009, the Costa Rican Institute of Fisheries and Aquaculture was notified of the maximum budgetary expenditure set for the year 2010, in the sum of ¢2,451,300,000.00 (two billion four hundred fifty-one million three hundred thousand exact colones), which does not include the additional expenses requested to be incorporated.

10.—That due to the foregoing, it is necessary to modify the maximum budgetary expenditure set for the Costa Rican Institute of Fisheries and Aquaculture for the year 2010, increasing it by the sum of ¢648,809,694.00 (six hundred forty-eight million eight hundred nine thousand six hundred ninety-four exact colones). Therefore;

1Que de conformidad con la Ley Nº 7384, publicada en La Gaceta Nº 62 de 29 de marzo de 1994 y sus reformas, el Instituto Costarricense de Pesca y Acuicultura, tiene entre sus funciones proponer el programa nacional para el desarrollo de la pesca y la acuicultura de conformidad con los lineamientos que se establezcan en el Plan Nacional de Desarrollo.
2Que la Ley Nº 8436, publicada en La Gaceta Nº 78 de 25 de abril de 2005, señala que el Instituto Costarricense de Pesca y Acuicultura, ejercerá el control de la actividad pesquera y acuícola que se realice en aguas marinas e interiores y brindará asistencia técnica a la actividad acuícola en aguas continentales y marinas.
3Que mediante el oficio PESJ-412-10-2009 de 07 de octubre de 2009, adicionado por el oficio PEP-0614-10-2009 de 16 de octubre de 2009, ambos suscritos por el Presidente Ejecutivo del Instituto Costarricense de Pesca y Acuicultura, se solicita ampliar el gasto presupuestario máximo fijado para esa institución, a fin de incorporar a su presupuesto para el año 2010 un monto de ¢650.000.000,00 (seiscientos cincuenta millones de colones exactos).
4Que los recursos incluidos en esta ampliación serán destinados a lo siguiente:

Un monto de ¢141.680.000,00 (ciento cuarenta y un millones seiscientos ochenta mil colones exactos), se utilizará para atender gastos relativos al cumplimiento del Convenio entre el Instituto Costarricense de Pesca y Acuicultura y el Sistema Nacional de Áreas de Conservación, y tendrá como fuente de financiamiento transferencias corrientes de órganos descentralizados.

b. Un monto de ¢59.200.000,00 (cincuenta y nueve millones doscientos mil colones exactos), se utilizará para financiar gastos del Plan Nacional de Reactivación de Alimentos, y tendrá como fuente de financiamiento transferencia del Gobierno Central.

c. Un monto de ¢123.594.570,00 (ciento veintitrés millones quinientos noventa y cuatro mil quinientos setenta colones exactos), se usará para invertir en el Sistema Integrado de Servicios al Sector Pesquero y Acuícola (SISPA) y la compra de un terreno para instalación de una oficina, y tendrá como fuente de financiamiento el superávit específico de vigencias anteriores.

d. Un monto de ¢325.525.430,00 (trescientos veinticinco millones quinientos veinticinco mil cuatrocientos treinta colones exactos), se utilizará para cubrir gastos operativos e inversiones y tendrá como fuente de financiamiento recursos propios.

5Que de la solicitud de ampliación del gasto presupuestario debe excluirse el monto de ¢1.190.306,00 (un millón ciento noventa mil trescientos seis colones exactos) que corresponde a los siguientes rubros: Contribución Patronal a la Caja Costarricense del Seguro Social, Contribución al Instituto Mixto de Ayuda Social, Contribución al Instituto Nacional de Aprendizaje, Contribución al Fondo de Desarrollo Social y Asignaciones Familiares, Contribución al Fondo de Desarrollo Social y Asignaciones Familiares, Pensiones Complementarias, Fondo de Capitalización. Dicha exclusión se efectúa por establecerlo así el artículo Nº 2 del Decreto Ejecutivo Nº 35111-H, publicado en La Gaceta Nº 58 de 24 de marzo de 2009 y sus reformas.
6Que mediante el Decreto Ejecutivo Nº 32452-H, publicado en La Gaceta Nº 130 de 6 de julio de 2005 y sus reformas, se emite el Lineamiento para la aplicación del artículo 6 de la Ley Nº 8131 de la Administración Financiera de la República y Presupuestos Públicos y la regulación de la clase de ingresos del Sector Público denominada Financiamiento.
7Que en relación con el superávit específico, el numeral 9° del referido Decreto Ejecutivo Nº 32452-H, posibilita la utilización de éste, para el pago de gastos definidos en los fines establecidos en las disposiciones especiales o legales aplicables a tales recursos.
8Que mediante el Decreto Ejecutivo Nº 35111-H supracitado, se emitieron las Directrices Generales de Política Presupuestaria para el 2010, estableciéndose en el artículo 1° del citado decreto, el gasto presupuestario máximo del año 2010, para las instituciones cubiertas por el ámbito de la Autoridad Presupuestaria.
9Que mediante el oficio STAP-0709-09 de 29 de abril de 2009, se le comunicó al Instituto Costarricense de Pesca y Acuicultura el gasto presupuestario máximo fijado para el año 2010, por la suma de ¢2.451.300.000,00 (dos mil cuatrocientos cincuenta y un millones trescientos mil colones exactos), el cual no contempla los gastos adicionales que se solicita incorporar.

10.-Que por lo anterior, resulta necesario modificar el gasto presupuestario máximo fijado al Instituto Costarricense de Pesca y Acuicultura para el año 2010, incrementándolo en la suma de ¢648.809.694,00 (seiscientos cuarenta y ocho millones ochocientos nueve mil seiscientos noventa y cuatro colones exactos). Por tanto;
