Agreement 3, article 6:
The study of costs and the fees that users must pay in order to apply for a Plant Breeder's Right title are unanimously approved, in accordance with Article 31 of the Law on Plant Breeder's Rights No. 8631, as follows:
a. Formal examination, application fee: (*)$277.50* (*)(Corrected by means of Fe de Erratas, and published in La Gaceta No. 28 of February 10, 2010) b. Publication of the application: at the expense of the interested party.
c. Substantive examination, technical verification of the variety: Cost: $170.00* d. Issuance of the certificate, communication. Cost: $2.50* e. Granting of the breeder's certificate: $50.00*.
The fees (cost of the service) cited above are part of the regular and minimum procedure for the approval or rejection of an application for protection of a plant breeder's right and therefore shall be charged jointly or as a single item as follows:
Total fee for the regular service: $500.00 + 10% administrative costs = $550.00*.
f. If the application is incomplete, the applicant has a period of 30 days to submit the missing documents or information. Reactivation of the case file: $5.50 g. Corrections to the document for reasons attributable to the applicant: $ 55.00 h. If the application is inadmissible: return documents and 50% of the fee.
i. If the application is withdrawn in writing before publication, 50% of the fee shall be reimbursed. After publication, there shall be no reimbursement.
j. If the application is archived due to formal omissions, there is no refund of the fee.
The fees for the services cited hereafter shall be charged at the time they are requested by the user.
Initially, the ONS shall not carry out the technical examinations. Any visit to test fields for verification or identification shall be charged independently according to costs for special services. * 4) Annual maintenance of the right: $200.00* 5) Changes of names of natural or legal persons or of the denomination: $55.00*.
New license or modification of a preexisting one: $99.00 * 7) Opposition application.

Inspections to verify the maintenance of the varieties shall be charged by the ONS according to what is established in the billing procedure for special services. If the establishment of comparison trials is required, the ONS shall contract the necessary services for that purpose and the cost thereof must be covered by the right holder.

Acuerdo 3, artículo 6:
Se aprueban por unanimidad el estudio de costos y los canones que los usuarios deberán cancelar para optar por un título de Derecho de Obtentor Vegetal de conformidad al artículo 31 de la Ley de Obtenciones Vegetales Nº 8631, como sigue:
a. Examen de forma, tasa de solicitud: (*)$277,50* (*)(Corregido mediante Fe de Erratas, y publicada en La Gaceta N° 28 del 10 de febrero de 2010) b. Publicación de la solicitud: a costas del interesado.
c. Examen de fondo, verificación técnica de la variedad: Costo: $170,00* d. Emisión del certificado, comunicación. Costo: $2,50* e. Concesión del certificado de obtentor: $50,00*.

i. Si la solicitud es retirada por escrito antes de la publicación, se reembolsará el 50 % de la tasa. Después de la publicación no habrá reembolso.
j. Si la solicitud es archivada por omisiones de forma no hay devolución de la tasa.
Las tasas de los servicios que se citarán en adelante, se cobrarán al momento de demandarse por el usuario.
Inicialmente la ONS no realizará los exámenes técnicos. Cualquier visita a campos de prueba para verificación o identificación, se cobrará independientemente según costos por servicios especiales. * 4) Mantenimiento anual del derecho: $ 200,00* 5) Cambios de nombres de personas físicas o jurídicas o de la denominación: $ 55,00*.
Licencia nueva o modificación de una ya existente: $99,00 * 7) Solicitud de oposición.
Se aplica a las oposiciones presentadas contra una solicitud en trámite o a una ya resuelta: $99,00.* 8) Recurso de revocatoria Se aplica a las solicitudes rechazadas: $99,00.* 9) Prestación de servicios administrativos:
a. Cambio de domicilios y de otras señas: $5,50* b. Copias certificadas del expediente. Costo $ 1 por página.
c. Copias certificadas del Título de Obtentor: $ 10,00* cada una d. Certificaciones: $ 5,50 cada una * e. Declaraciones de renuncia al derecho de obtentor. Sin costo.
Las inspecciones para comprobar el mantenimiento de las variedades serán cobradas por la ONS según lo que se establece en el procedimiento de cobro de servicios especiales. En caso de ser requerido el establecimiento de ensayos de comparación, la ONS contratará los servicios necesarios para tal efecto y el costo del mismo deberá ser cubierto por el derechohabiente.
* Se cobrará en colones al tipo de cambio del día.
