1Que es función esencial del Estado proteger la salud y la vida de las personas y de los animales, así como garantizar la efectiva y eficiente protección de los cultivos agrícolas de las plagas que puedan poner en riesgo o causar daños al patrimonio agrícola del País.
2Que corresponde al Ministerio de Agricultura y Ganadería a través del Servicio Fitosanitario del Estado, velar por la protección fitosanitaria de los cultivos, disponiendo, una vez comprobada la existencia de una plaga, las medidas técnicas y de control que eviten la propagación de estas.
3Que corresponde al Instituto de Desarrollo Agrario (IDA) determinar que la propiedad de la tierra se debe promover para el aumento gradual de su productividad y para una justa distribución de su producto, elevando la condición social del campesino y haciéndolo participe consciente del desarrollo económico-social de la Nación.
4Que los factores climáticos han favorecido el desarrollo y diseminación de nuevas plagas de importancia económica y cuarentenaria que afectan cultivos básicos y de exportación.
5Que el Servicio Fitosanitario del Estado confirmó la presencia de la plaga Puccinia kuehnii (Roya Naranja), afectando severamente las áreas de cultivo de caña de azúcar en los cantones de Pérez Zeledón y Buenos Aires en la Zona Sur, y San Carlos y Los Chiles en la Zona Norte, poniendo en riesgo la manutención y supervivencia de un número importante de productores y sus familias, lo cual motivó que se emitiera el Decreto Ejecutivo Nº 34791-MAG, publicado en La Gaceta Nº 201 del 17 de Octubre de 2008.
6Que si bien se ha venido desarrollando una importante labor interinstitucional para mitigar los efectos y el impacto productivo de la plaga Puccinia kuehnii (Roya Naranja), ésta aún no ha sido controlada totalmente en las zonas afectadas, según informe técnico del Servicio Fitosanitario del Estado, razón por la cual hace necesaria la prórroga de la Declaratoria de Emergencia, para continuar ejecutando las medidas técnicas necesarias para controlar la plaga antes mencionada. Artículo 2 — The state of phytosanitary emergency shall be extendable for as long as the pest known as Orange Rust is controlled or the problem has been satisfactorily resolved.

Artículo 3 — It shall be effective as of its publication.
