article 22 of the Biodiversity Law Nº 7788 of April 30, 1998, the National System of Conservation Areas (SINAC) is an organ of maximum deconcentration of the Ministry of Environment, Energy and Telecommunications, which has instrumental legal personality and is a deconcentrated and participatory institutional management and coordination system, which will integrate the competencies in forestry, wildlife, and protected areas, for the purpose of issuing policies, planning, and executing processes aimed at achieving sustainability in the management of Costa Rica's natural resources.

Therefore,

"Regulation for the recognition of the incentive for Zonaje for officials of the National System of Conservation Areas"

• a)That the cost of living is higher than that of their domicile, according to the indices of the General Directorate of Statistics and Censuses.
• b)That the communication routes with the place of their neighborhood are expensive and difficult; or c) That it does not offer educational and medical care facilities for the servant's family, or there is evident risk to the health of the latter or the former.

The amount corresponding to each percentage, after the General Comptroller of the Republic makes any variation in the total amount cited in the preceding article, shall be varied by the Human Resources Office of the SINAC after determination of the existence of economic content for said adjustment.

• a)When separated from their post for up to one month due to disability, even if they have to return to their domicile; without prejudice to what is regulated in article 7 of the Regulation for Payment of Zonaje to Servants of the Public Administration, number 90-S.C. of December thirteen, nineteen sixty-five.
• b)When in order to fulfill functions inherent to their position they attend training courses with leave with pay and must transfer for a period not exceeding one month.
• c)When they must transfer for a period not exceeding one month to a zone where zonaje is not paid.

Furthermore, it will hear adjustments to the zonaje incentive, only when they are submitted for its judgment by the Human Resources Office of the SINAC; all other cases shall be heard solely by said office.

In order not to cause harm to the officials, in cases where it is demonstrated that periods of the incentive are owed to the official, the Commission may recognize the same retroactively through a reasoned administrative resolution, in order to safeguard the interests of the Administration and the officials of the SINAC; which recognition will be subject to the existence of budgetary content.

Likewise, for officials who work in Protected Wild Areas and who comply with what is indicated in article 1 of this regulation, 100% of zonaje shall be recognized, regardless of the management category it holds.

Issued at the Presidency of the Republic.-San José, at one o'clock in the afternoon on the fifth day of October of the year two thousand nine.

Por tanto,

"Reglamento para el reconocimiento del incentivo por concepto de Zonaje para los funcionarios del Sistema Nacional de Áreas de Conservación"

• a)Que el costo de la vida sea más alto que el de su domicilio, de acuerdo con los índices de la Dirección General de Estadística y Censos.
• b)Que las vías de comunicación con el lugar de su vecindario sean caros y difíciles; o c) Que no ofrezca facilidades de educación y de atención médica para la familia del servidor, o exista evidente riesgo para la salud de éste o de aquella.

El monto correspondiente a cada porcentaje, luego de que la Contraloría General de la República haga cualquier variación en el monto total citado en el artículo precedente, será variado por la Oficina de Recursos Humanos del SINAC previa determinación de la existencia de contenido económico para dicho ajuste.

• a)Cuando se separe hasta por un mes de su puesto por motivo de incapacidad, aunque tenga que regresar a su domicilio; sin perjuicio de lo regulado en el artículo 7 del Reglamento para Pago de Zonaje a Servidores de la Administración Pública, número 90-S.C. del trece de diciembre de mil novecientos sesenta y cinco.
• b)Cuando para cumplir funciones propias de su cargo asista a cursos de capacitación con licencia con goce de salario y deba trasladarse por un período que no exceda de un mes.
• c)Cuanto tenga que trasladarse por un período que no exceda de un mes a una zona en que no se pague zonaje.

Además, entrará a conocer ajustes del incentivo de zonaje, únicamente cuando los mismos le sean sometidos a su juicio por parte de la Oficina de Recursos Humanos del SINAC, todos los demás casos serán conocidos únicamente por dicha oficina.

A fin de no causar perjuicio a los funcionarios, en los casos que se demuestre, que se adeudan periodos del incentivo al funcionario, la Comisión, podrá reconocer el mismo en forma retroactiva por medio de resolución administrativa razonada, a fin de salvaguardar los intereses de la Administración y de los funcionarios del SINAC; reconocimiento que quedará sujeto a la existencia de contenido presupuestario.

Asimismo, a los funcionarios que laboren en las Áreas Silvestres Protegidas y que cumplan con lo indicado en el artículo 1º del presente reglamento se les reconocerá el 100% de zonaje, independientemente de la categoría de manejo que ostente.
