in the entirety of the text - Full Text of Norm 35530 Modification to the Classification of the Camaronal National Wildlife Refuge, from Mixed Ownership to State Ownership and Expansion of its Limits and Creates the Local Council of the Camaronal National Wildlife Refuge Full Text record: CB504 No. 35530-MINAET THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT, ENERGY AND TELECOMMUNICATIONS In exercise of the powers conferred in articles 11, 50, 89, 140 subsections 3 and 18 and 146 of the Political Constitution; article 28 of the General Law of Public Administration No. 6227 of May 2, 1978; and based on the provisions of articles 82 and related articles of the Wildlife Conservation Law No. 7317 of October 30, 1992 published in La Gaceta No. 235 of December 7, 1992; articles 35 and 36 of the Organic Law of the Environment No. 7554 of October 4, 1995; article 60 of the Biodiversity Law No. 7788 of April 30, 1998 and articles 71 and 72 of the Regulations to the Biodiversity Law, Executive Decree No. 34433-MINAE of March 11, 2008.
1st-That article 60 of the Biodiversity Law No. 7788 regulates the ownership of protected wilderness areas (áreas silvestres protegidas), as well as ensures the conservation and sustainable use of the country's biodiversity, through the creation of new protected wilderness areas, a power thus established in articles 35 and 36 of the Organic Law of the Environment.
2nd-That through Executive Decree No. 23150-MIRENEM of April 7, 1994, published in La Gaceta No. 83 of May 2, 1994, the Camaronal National Wildlife Refuge, mixed class, was created.
3rd-That Camaronal beach is an important site for the reproduction of a large number of marine-coastal species. Furthermore, it constitutes a site of worldwide interest for the nesting of leatherback (Dermochelys coriacea), hawksbill (Eretmochelys imbricata), black (Chelonia mydas agassizii) and olive ridley (Lepidochelys olivacea) sea turtles.
4th-That the objective of national wildlife refuges is the protection and research of wild flora and fauna, especially those that are endangered (en vías de extinción).
5th-That in the establishment of national wildlife refuges, their inhabitants shall participate with the purpose of fostering the comprehensive development (desarrollo integral) of the communities and ensuring the protection of ecosystems.
6th-That prior to the issuance of this decree, all the requirements set forth in the Regulations to the Biodiversity Law, Executive Decree No. 34433-MINAE of March 11, 2008, were fulfilled, namely the technical report indicated in articles 71 and 72 of said regulations, duly approved by the Regional Council of the Tempisque Conservation Area (Área de Conservación Tempisque) and by the National Council of Conservation Areas.
7th-That the respective Management Plan (Plan de Manejo) of the Camaronal National Wildlife Refuge was prepared in 2006, which remains in force to date, given that the lifespan (plazo de vida) of such plans is 5 years.
Said Plan was approved by the Technical Committee of the Tempisque Conservation Area in ordinary session No. 05-2005 of December 8, 2005, agreement number 8; by the Regional Council of the Tempisque Conservation Area in extraordinary session No. 1 of January 6, 2006, article 1, and by the National Council of Conservation Areas in session extraordinary No. 06-2006 of February 22 and 23, 2006, item number 13, agreement number 18.
8th-That the change in classification from mixed to state ownership is due to the fact that the owners of the private property subjected under this regime transferred the same, thus changing their interest in continuing voluntarily with the encumbrance (afectación) of the property, leaving only state property, namely the State Natural Heritage (Patrimonio Natural del Estado) forming part of the Refuge. Therefore, They Decree:
"Modification to the Classification of the Camaronal National Wildlife Refuge, from Mixed Ownership to State Ownership and Expansion of its Limits"
Considering:
23150-MIRENEM of April 7, 1994, so that from now on and for all its legal effects, it is recorded and provided that every management activity to be carried out in the area of encumbrance (afectación), corresponds to the class of National Wildlife Refuge state ownership.
From this point, it continues along the ordinary high tide until reaching the point with geographic coordinates 203,750 north and 382,350 east, which corresponds to the point of origin. Furthermore, a marine zone of 12 nautical miles is included, from Punta Islita to Punta El Roble, being delimited by the following coordinates: starting at point 203,750 north and 382,350 east, it continues in a straight line to point 204,000 north and 375,350 east, continues to point 181,800 north and 375,350 east, continues to point 181,800 north and 382,350 east, until reaching the starting point at geographic coordinates 203,750 north and 382,350 east.
The internal marine waters located between geographic coordinates 203,750 north and 382,350 east and geographic coordinates 204,000 north and 375,350 east, also form part of the marine protected area of the Camaronal National Wildlife Refuge.
This local council will have the functions described in the management plan (plan de manejo) of the Camaronal National Wildlife Refuge and by current legislation. It shall be composed, at a minimum, of a President, a Secretary, a Treasurer, and a Vocal (Vocal) elected from among the various stakeholders accredited before the Regional Council of the Tempisque Conservation Area (CORACT).
The members of the Local Council of the Camaronal National Wildlife Refuge will be appointed and removed by a majority of the CORACT and may be reelected for one year. In addition, the administrator of the Camaronal National Wildlife Refuge will have the function of Executive Secretary.
