Francisco González Chávez, MBA of the Occupational Health Office, he points out the importance of keeping the procedures of the Regulation for the Handling, Storage, Maintenance and Transport of Chlorine Gas Cylinders updated, as well as the Manual and Protocols for the attention of chlorine emergencies, in order to mitigate risks from possible leaks, both for AyA officials and for the population in general.

Ricardo Sancho Chavarría, Executive President of AyA, points out the importance of all the Institution's officials having the minimum, basic safety and hygiene implements for the exercise of their functions.

I.Article 11, subsection i) of the Constitutive Law of the Costa Rican Institute of Aqueducts and Sewers, empowers the Board of Directors to issue, reform, and interpret the internal regulations necessary for the better development of its purposes, one of them being the Regulation for the Handling, Storage, Maintenance and Transport of Chlorine Gas Cylinders; which will be modified by the present Regulation, hereinafter called "Regulation for the Mitigation of Risk, the Attention of Emergencies and Disasters due to the Handling of Chlorine in the Processes of AyA and the Manual of Standards and Procedures," of the Costa Rican Institute of Aqueducts and Sewers.

27434-MTSS "Regulation on Occupational Health Offices and Departments," published in La Gaceta No. 229 of November 25, 1998, Title IV of the Labor Code indicates that the necessary regulation must be promoted to guarantee optimal occupational health conditions in every workplace.

Therefore, The Board of Directors of the Costa Rican Institute of Aqueducts and Sewers agrees to approve the present Regulation for the Mitigation of Risk, the Attention of Emergencies and Disasters due to the Handling of Chlorine in the Processes of AyA and the Manual of Standards and Procedures.", whose text shall read:

REGULATION FOR THE MITIGATION OF RISK, THE ATTENTION OF EMERGENCIES AND DISASTERS DUE TO THE HANDLING OF CHLORINE IN THE PROCESSES OF AYA AND THE MANUAL OF STANDARDS AND PROCEDURES

General Provisions

The purpose of this Regulation is to establish the standards, dependencies, procedures, and guidelines that shall mandatorily regulate, in the different processes, everything related to the handling, use, transport, and safety measures of chlorine in which the Costa Rican Institute of Aqueducts and Sewers is involved, for the mitigation of risks, attention of emergencies and disasters.

• a)AyA: Costa Rican Institute of Aqueducts and Sewers.
• b)Cylinders: Containers that must mandatorily comply with the Standard DOT 3A480 or DOT 3AA480.
• c)Containers: Receptacles that must mandatorily comply with the standard DOT 106A500X or DOT 106A500W.
• d)Chlorine: Under normal conditions, it is a greenish-yellow chlorine gas, 2.5 times denser than air, with a penetrating, unpleasant, and poisonous odor. It is used as a disinfectant agent in potabilization processes.
• e)Dispatch: Process that takes place when the warehouse sends the full chlorine cylinders to the disinfection stations.
• f)Return: Refers to that process or series of routines whose purpose is to return the empty cylinders from the disinfection stations to the accounting warehouse.
• g)Disinfection Stations: Are all those physical spaces located in plants, stations, or installations owned by AyA or by other operators in which chlorine is used for disinfection processes.
• h)Operators: Entities responsible for each aqueduct system throughout the country: AyA and ASADAS.
• i)Resupplied: Full cylinder received by the central chlorine warehouse from the supplier.
• j)Chlorine cylinder: Understood as chlorine cylinders and containers. Understood as chlorine in a mostly liquid state, packaged under pressure (liquefied chlorine), inside the cylinder, and that during use, this chlorine transitions to a gaseous state commonly called chlorine.
• k)Regulation: The Regulation for the Mitigation of Risk, the Attention of Emergencies and Disasters Related to the handling of chlorine in all the processes of AyA.
• l)Manual: Manual of Standards and Procedures for the Mitigation of Risk, the Attention of Emergencies and Disasters Related to the Handling of Chlorine in all the Processes of AyA.
• ll)Shipment: Process by which the central chlorine warehouse returns the empty chlorine cylinders, coming from the disinfection stations or warehouses, to the suppliers for their review and resupply.
• m)Passive subject: Any individual or legal entity involved in matters relating to the handling, use, transport, safety measures, mitigation of risks, and attention of emergencies and disasters due to chlorine.

Of the responsibilities in the different processes of handling, use, transport, and safety measures of chlorine

Responsible Subjects

Their responsibilities are:

• a)To inform all personnel directly or indirectly involved in each process about the guidelines established in this Regulation and in the Manual of Standards and Procedures.
• b)To inform in writing the needs for personal protective equipment, safety equipment, or others to their hierarchical Superior.
• c)To routinely verify the good condition and maintenance of the cylinders d) To ensure that the chlorine cylinders at their disposal are returned to the Central Chlorine Warehouse once they are empty.
• e)To ensure that the chlorine cylinders under their custody are given proper use.
• f)To manage the necessary stock of equipment, spare parts, and accessories for the maintenance of chlorine cylinders.
• g)To manage the acquisition for the replacement of chlorine cylinders.
• h)To promptly report any anomaly detected in the normal use of the chlorine cylinders.
• i)To maintain the updated technical data sheet for each chlorine cylinder.

Their responsibilities are:

• a)To perform preventive and corrective maintenance on the chlorine cylinders.
• b)To apply the guidelines established in the Manual of Standards and Procedures.
• c)To inform in writing the recommendations they consider necessary to include or modify in the Manual of Standards and Procedures to their hierarchical Superior.
• d)To inform in writing the needs for personal protective equipment, safety equipment, or others to their hierarchical Superior.

Responsible Parties for the Transport of Chlorine

Their responsibilities are:

• a)They must implement the routes and schedules specified by the General Directorate of Traffic Engineering of the Ministry of Public Works and Transport, for the transit of toxic and hazardous substances on public roads.
• b)To verify that AyA vehicles and those of suppliers have the physical conditions, safety devices, signaling, and respective labeling required by the current legal system.
• c)To instruct and train the drivers of AyA vehicles about risk prevention and the attention of emergencies and disasters caused by chlorine.

Their responsibilities are:

• a)To abide by the orders, directives, and provisions indicated by their immediate superiors for the transport and handling of Chlorine.
• b)To verify beforehand the good physical and mechanical condition of the motor vehicle, which must mandatorily have the required physical conditions, safety devices, signaling, and respective labeling.
• c)To mandatorily use the attire and equipment that safety standards require for the transport and handling of chlorine.
• d)In case of accident, emergency, or disaster, to abide by what is established in the Manual of Standards and Procedures.

Of the responsibilities of the Department of Occupational Health

Its responsibilities shall be:

• a)To regulate the policies, procedures, and technical criteria related to safety and hygiene measures in all processes of handling, use, transport, and safety measures for chlorine, to mitigate risks and improve the attention of emergencies and disasters.
• b)To ensure the implementation and application of this Regulation and the Manual of Standards and Procedures.
• c)To convene the technical team to carry out the revisions and modifications of the Regulation and the Manual of Standards and Procedures.
• d)To evaluate and inform the responsible parties and the higher authorities about compliance with this Regulation and the Manual of Standards and Procedures.
• e)To verify, when deemed appropriate, the existence of the signage, personal protective equipment, and safety equipment necessary for the transport of chlorine cylinders.

• a)To promote that individuals and legal entities implement and apply this Regulation and the Manual of Standards and Procedures.
• b)To promote Training activities in the safe handling of chlorine.
• c)To convene the technical team to carry out the revisions and modifications of the Regulation and the Manual of Standards and Procedures.
• d)To appoint the Occupational Health technician in charge of evaluating compliance with this Regulation and the Manual of Standards and Procedures.
• e)To determine, together with the responsible persons in charge of each process, the needs and technical specifications for safety equipment and emergency response protocols.
• f)To forward to the higher authorities the technical studies carried out for the mandatory hazard pay for every person involved with the handling, storage, maintenance, transport, and attention of emergencies with chlorine cylinders.
• g)To review and promote adjustments and periodic modifications to the percentage for the concept of hazard pay for the workers involved with the handling, storage, maintenance, transport, and attention of emergencies with chlorine cylinders.
• h)To manage the performance of mandatory preventive medical exams, at least once a year, for the workers who are closely linked to the handling, storage, maintenance, transport, and attention of emergencies with chlorine cylinders.

Final Provisions

The Regulation and the Manual of Standards and Procedures issued by AyA shall be mandatory for the institution, its workers, throughout the country.

This Regulation and Manual of Standards and Procedures completely repeals the Regulation for the Handling, Storage, Maintenance and Transport of Chlorine Gas Cylinders of the Costa Rican Institute of Aqueducts and Sewers, published in La Gaceta No. 85 of the year 2005, as well as any other internal agreement or directive that opposes it.

It is effective as of its publication in the Official Gazette. Let it be published. Let it be communicated. Let it be notified.

Francisco González Chávez, MBA de la Oficina de Salud Ocupacional, señala la importancia de mantener actualizado los procedimientos del Reglamento para la Manipulación, Almacenamiento, Mantenimiento y Transporte de Recipientes de Cloro Gas, así como el Manual y los Protocolos para la atención de emergencias de cloro, con el fin de mitigar riesgos por posibles fugas, tanto para los funcionarios del AyA como para la población en general.

Ricardo Sancho Chavarría, Presidente Ejecutivo del AyA, señala la importancia de que todos los funcionarios de la Institución tengan los implementos de seguridad e higiene mínimos, elementales para el ejercicio de las funciones.

I.El artículo 11 inciso i) de la Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados, faculta a la Junta Directiva para dictar, reformar e interpretar los reglamentos internos necesarios para el mejor desarrollo de sus fines, siendo uno de ellos el Reglamento para la Manipulación, Almacenamiento, Mantenimiento y Transporte de Recipientes de Cloro Gas; el cual será modificado por el presente Reglamento que en adelante se llamará "Reglamento para la Mitigación del Riesgo, la Atención de Emergencias y Desastres por la Manipulación del Cloro en los Procesos del AyA y el Manual de Normas y Procedimientos", del Instituto Costarricense de Acueductos y Alcantarillados.

Por tanto, La Junta Directiva del Instituto Costarricense de Acueductos y Alcantarillados acuerda aprobar el presente Reglamento para la Mitigación del Riesgo, la Atención de Emergencias y Desastres por la Manipulación del Cloro en los Procesos del AyA y el Manual de Normas y Procedimientos"., cuyo texto dirá:

REGLAMENTO PARA LA MITIGACIÓN DEL RIESGO, LA ATENCIÓN DE EMERGENCIAS Y DESASTRES POR LA MANIPULACIÓN DEL CLORO EN LOS PROCESOS DEL AYA Y EL MANUAL DE NORMAS Y PROCEDIMIENTOS

De las Disposiciones Generales

El presente Reglamento tiene como objeto establecer las normas, dependencias, procedimientos y directrices que regularán obligatoriamente en los diferentes procesos, todo lo relativo a la manipulación, uso, transporte y medidas de seguridad del cloro en que intervenga el Instituto Costarricense de Acueductos y Alcantarillados, para la mitigación de los riesgos, atención de emergencias y desastres.

• a)AyA: Instituto Costarricense de Acueductos y Alcantarillados.
• b)Cilindros: Recipientes que deben cumplir obligatoriamente con la Norma DOT 3A480 o DOT 3AA480.
• c)Contenedores: Recipientes que deben cumplir obligatoriamente con la norma DOT 106A500X o DOT 106A500W.
• d)Cloro: En condiciones normales es un gas de cloro amarillo verdoso, 2.5 veces más denso que el aire, de olor penetrante desagradable y venenoso. Se utiliza como agente desinfectante en procesos de potabilización.
• e)Despacho: Proceso que se efectúa cuando la bodega envía los recipientes de cloro llenos a las estaciones de desinfección.
• f)Devolución: Se refiere a aquel proceso o serie de rutinas que tienen la finalidad de devolver los recipientes vacíos de las estaciones de desinfección a la bodega contable.
• g)Estaciones de Desinfección: Son todos aquellos espacios físicos ubicados en las plantas, estaciones o instalaciones propiedad de AyA o de otros operadores en los que se utiliza cloro para procesos de desinfección.
• h)Operadores: Entes responsables de cada sistema de acueductos en todo el país: AyA y ASADAS.
• i)Reabastecido: Recipiente lleno que es recibido por la bodega central de cloro proveniente del proveedor.
• j)Recipiente de cloro: Entiéndase como cilindros y contenedores de cloro. Entiéndase al cloro en estado mayoritariamente líquido, envasado a presión (cloro licuado), dentro del recipiente y que en el uso, este cloro pasa a estado gaseoso llamado comúnmente cloro.
• k)Reglamento: El Reglamento para la Mitigación del Riesgo, la Atención de Emergencias y Desastres Relacionados con la manipulación del cloro en todos los procesos del AyA.
• l)Manual: Manual de Normas y Procedimientos para la Mitigación del Riesgo, la Atención de Emergencias y Desastres Relacionados con la Manipulación del Cloro en todos los Procesos del AyA.
• ll)Remisión: Proceso mediante el cual la bodega central de cloro devuelve los recipientes de cloro vacíos, provenientes de las estaciones de desinfección o bodegas, a los proveedores para su revisión y reabastecimiento.
• m)Sujeto pasivo: Toda persona física o jurídica involucrada en lo relativo a la manipulación, uso, transporte, medidas de seguridad, mitigación de los riesgos, la atención de emergencias y desastres por el cloro.

De las responsabilidades en los diferentes procesos de manipulación, uso, transporte y medidas de seguridad del cloro

Sujetos Responsables

Les corresponde:

• a)Informar a todo el personal directa o indirectamente involucrado en cada proceso acerca de los lineamientos establecidos en el presente Reglamento y en el Manual de Normas y Procedimientos.
• b)Informar por escrito las necesidades de equipo de protección personal, seguridad u otros a su superior Jerárquico.
• c)Verificar rutinariamente el buen estado y mantenimiento de los cilindros d) Velar porque los recipientes de cloro a su disposición sean devueltos a la Bodega Central de Cloro una vez que estos se encuentren vacíos.
• e)Velar porque a los recipientes de cloro que estén bajo su custodia se le brinde el debido uso.
• f)Gestionar el stock necesario de equipos, repuestos y accesorios para el mantenimiento de los recipientes de cloro.
• g)Gestionar la adquisición para la reposición de recipientes para cloro.
• h)Reportar oportunamente cualquier anomalía detectada en el uso normal de los recipientes de cloro.
• i)Mantener la ficha técnica actualizada para cada recipiente de cloro.

Les corresponde:

• a)Ejecutar el mantenimiento preventivo y correctivo a los recipientes de cloro.
• b)Aplicar los lineamientos establecidos en el Manual de Normas y Procedimientos.
• c)Informar por escrito las recomendaciones que considera necesarias incluir o modificar en el Manual de Normas y Procedimientos a su superior Jerárquico.
• d)Informar por escrito las necesidades de equipo de protección personal, seguridad u otros a su superior Jerárquico.

Responsables del Transporte del Cloro

Les corresponde:

• a)Deberán Implementar las rutas y horarios especificados por la Dirección General de Ingeniería de Tránsito del Ministerio de Obras Públicas y Transporte, para el trasiego por las vías públicas de las sustancias tóxicas y peligrosas.
• b)Verificar que los vehículos del AyA y los proveedores, deben contar con las condiciones físicas, dispositivos de seguridad, señalización y rotulación respectiva que exija el ordenamiento jurídico vigente.
• c)Instruir y capacitar a los conductores de los vehículos del AyA acerca de la prevención del riesgo, la atención de emergencias y desastres por el cloro.

Les corresponde:

• a)Acatar las órdenes, directrices, disposiciones que le indiquen sus superiores inmediatos para el transporte y manipulación del Cloro.
• b)Verificar de previo el buen estado físico y mecánico del vehículo automotor, el cuál debe contar obligatoriamente con las condiciones físicas, dispositivos de seguridad, señalización y rotulación respectiva exigidas.
• c)Utilizar obligatoriamente la indumentaria y equipamiento que las normas de seguridad exigen para el transporte y manipulación del cloro.
• d)En caso de accidente, emergencia o desastre, acatar lo establecido en el Manual de Normas y Procedimientos.

De las responsabilidades del Departamento de Salud Ocupacional

Le corresponderá:

• a)Normar las políticas, procedimientos y criterios técnicos relacionados con las medidas de seguridad e higiene en todos los procesos de manipulación, uso, transporte y medidas de seguridad del cloro, para mitigar los riesgos y mejorar la atención de emergencias y desastres.
• b)Velar por la implementación y aplicación del presente Reglamento y el Manual de Normas y Procedimientos.
• c)Convocar al equipo técnico para realizar las revisiones y modificaciones del Reglamento y el Manual de Normas y Procedimientos.
• d)Evaluar e informar a los responsables y a las autoridades superiores, acerca del cumplimiento de este Reglamento y el Manual de Normas y Procedimientos.
• e)Verificar cuando considere oportuno, la existencia de la señalización, equipo de protección personal y de seguridad necesario para el transporte de recipientes cloro.

• a)Promover que las personas físicas y jurídicas implementen y apliquen el presente Reglamento y en el Manual de Normas y Procedimientos.
• b)Promover las actividades de Capacitación en el manejo seguro del cloro.
• c)Convocar al equipo técnico para realizar las revisiones y modificaciones del Reglamento y en el Manual de Normas y Procedimientos.
• d)Nombrar al técnico de Salud Ocupacional encargado de evaluar el cumplimiento de este Reglamento y en el Manual de Normas y Procedimientos.
• e)Determinar junto con los encargados responsables de cada proceso, las necesidades y especificaciones técnicas de los equipos de seguridad y protocolos de atención de emergencias.
• f)Remitir a las autoridades superiores, los estudios técnicos que se lleven a cabo para el pago obligatorio de peligrosidad para toda persona involucrada con la manipulación, almacenamiento, mantenimiento, transporte y atención de emergencias con recipientes de cloro.
• g)Revisar y promover los ajustes y modificaciones periódicamente del porcentaje por el concepto del pago de peligrosidad para las y los trabajadores involucrados con la manipulación, almacenamiento, mantenimiento, transporte y atención de emergencias de recipientes de cloro.
• h)Gestionar la realización de exámenes médicos preventivos obligatorios, al menos una vez al año, para las y los trabajadores que se encuentren estrechamente ligadas con la manipulación, almacenamiento, mantenimiento, transporte y atención de emergencias de recipientes de cloro.

El Reglamento y el Manual de Normas y Procedimientos dictado por el AyA será de acatamiento obligatorio para la institución, sus trabajadoras y trabajadores en todo el país.

El presente Reglamento y Manual de Normas y Procedimientos, deroga totalmente al Reglamento para la Manipulación, Almacenamiento, Mantenimiento y Transporte de Recipientes de Cloro Gas del Instituto Costarricense de Acueductos y Alcantarillados, publicado en La Gaceta Nº 85 del año 2005, así como cualquier otro acuerdo o directriz interna que se le oponga.

Rige a partir de su publicación en el Diario Oficial. Publíquese. Comuníquese. Notifíquese.
