in the entirety of the text - Full Text of Regulation 35492 Creates the Hacienda El Viejo Wildlife Refuge, Private Category Full Text of record: CA37D No. 35492-MINAET THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT, ENERGY, AND TELECOMMUNICATIONS In exercise of the constitutional powers conferred in Articles 140, subsections 3) and 18) and 146 of the Political Constitution of Costa Rica, Articles 1, 35 subsections a), b), c), and d), and 36 of the Organic Law of the Environment No. 7554, of October 4, 1995, Article 82, category c) and Article 87 of the Wildlife Conservation Law No. 7317, of October 30, 1992, Article 6, subsection a) of the Forest Law (Ley Forestal) No. 7575, of February 13, 1996, Articles 58 and 60 of the Biodiversity Law No. 7788 of April 30, 1998, and based on the provisions of Article 28, subsection b) of the General Law of Public Administration No. 6227, of May 2, 1978.

1. 1That it is in the interest of the Costa Rican State to ensure that all the country's ecosystems are represented within the system of protected wild areas, particularly within those management categories whose purpose is the protection, conservation, and management of biodiversity.
2. 2That Article 58 of the Biodiversity Law No. 7788 establishes that protected wild areas are delimited geographical zones, constituted by lands, wetlands, and portions of the sea.
3. 3That the Wildlife Conservation Law No. 7317 in its Article 82 states that national fauna and wildlife refuges are those that the Executive Branch declares or has declared as such, for the protection and investigation of wild flora and fauna, especially those that are in danger of extinction. For the purpose of classifying them, there are three classes of national wildlife refuges: State-owned Refuges, Mixed-ownership Refuges, and Privately-owned Refuges.
4. 4That the Organic Law of the Environment in its Article 41 declares wetlands and their conservation to be of public interest, due to their multiple use, whether or not they are protected by the laws governing this matter.
5. 5That Desarrollos Mil Novecientos Veintiuno, Sociedad Anónima, legal identification number 3-101-237706, through its legal representative Mr. José Álvaro Jenkins Rodríguez, identification number 2-0367-0674, owner of the property farm No. 5-119634-000, located in the first district of Filadelfia, fifth canton of Carrillo, Province of Guanacaste, promoted the creation of the National Wildlife Refuge called Hacienda El Viejo of private category and submitted an application to voluntarily incorporate into it a section of the property currently called Hacienda El Viejo, which occupies an area of 1138 ha with 8309.94 m2, corresponding to the cadastral map No. G-636506-2000, for a period of 10 years.
6. 6That said property is located in district 01 Filadelfia, canton 05 Carrillo, province of Guanacaste, specifically on the alluvial plain formed between the Tempisque and Bolsón rivers, bordering to the north and west with the rest of the properties of Desarrollos Mil novecientos veintiuno, Sociedad Anónima, to the south with the Bolsón River, to the east with the right bank of the Tempisque River, and that said farm is located on the cartographic sheet Tempisque No. 3147-III at a scale of 1:50,000.
7. 7That the area to be dedicated as a refuge is considered of great importance for the protection of biodiversity in the region of Guanacaste, since as a result of geographic interrelations (geology, topography, soils, climate), the formation of plant groups has occurred, ranging from forest formations in mountain range areas (hills and mountains) to semi-aquatic ecosystems where herbaceous swamps and flooded forests stand out.
8. 8That the plant associations of the lower basin of the Tempisque River possess high environmental, economic, and social value, not only for their scenic beauty but also because the intricate network of ecosystemic relationships among these habitats allows for water balance and the regulation of the vital cycles upon which agro-industrial, tourism, and fishing activities depend.
9. 9That Desarrollos Mil Novecientos Veintiuno, Sociedad Anónima, prepared a Management Plan (Plan de Manejo) that was approved by resolution ACT-OR-007 of November 15, 2007, by the Technical Committee of the Tempisque Conservation Area (Área de Conservación Tempisque), by the Regional Council of the Tempisque Conservation Area on December 20, 2007, and by the National Council of Conservation Areas (CONAC) in session No. 3-2008, Agreement number 16 of April 1, 2008.

10.-That upon analyzing the documentation submitted by Desarrollos Mil Novecientos Veintiuno, Sociedad Anónima, it was determined that it complied with the provisions of Article 171 of Executive Decree No. 32633-MINAE called the Regulation to the Wildlife Conservation Law.

11.-That through Agreement No. 16 of the Extraordinary Session No. 3-2008 of March 31 and April 1, 2008, the National Council of Conservation Areas (CONAC) approved the Management Plan and creation of the Hacienda El Viejo National Wildlife Refuge, private property, in accordance with Article 12 subsection d) of the Regulation to the Biodiversity Law, Executive Decree No. 34433-MINAE of March 11, 2008. Therefore:

en la totalidad del texto - Texto Completo Norma 35492 Crea Refugio de Vida Silvestre Hacienda El Viejo, Categoría Privada Texto Completo acta: CA37D Nº 35492-MINAET EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE AMBIENTE, ENERGÍA Y TELECOMUNICACIONES En ejercicio de las facultades constitucionales conferidas en los artículos 140, incisos 3) y 18) y 146 de la Constitución Política de Costa Rica, los artículos 1, 35 incisos a), b), c), y d), y 36 de la Ley Orgánica del Ambiente Nº 7554, del 4 octubre de 1995, artículo 82, categoría c) y artículo 87 de la Ley de Conservación de la Vida Silvestre Nº 7317, del 30 de octubre de 1992, artículo 6, inciso a) de la Ley Forestal Nº 7575, del 13 de febrero de 1996, los artículos 58 y 60 de Ley de Biodiversidad Nº 7788 del 30 abril de 1998 y con fundamento en lo dispuesto en el artículo 28 incisos b) de la Ley General de la Administración Pública Nº 6227, del 2 de mayo de 1978.

1. 1Que es interés del Estado costarricense asegurar que todos los ecosistemas del país se encuentren representados dentro del sistema de áreas silvestres protegidas, particularmente dentro de aquellas categorías de manejo que tienen como fin la protección, conservación y manejo de la biodiversidad.
2. 2Que el artículo 58 de la Ley de la Biodiversidad Nº 7788, establece que las áreas silvestres protegidas son zonas geográficas delimitadas, constituidas por terrenos, humedales y porciones del mar.
3. 3Que la Ley de Conservación de la Vida Silvestre Nº 7317 en su artículo 82 dice que son refugios nacionales de fauna y vida silvestre, los que el Poder Ejecutivo declare o haya declarado como tales, para la protección e investigación de la flora y la fauna silvestres, en especial de las que se encuentren en vías de extinción. Para efecto de clasificarlos, existen tres clases de refugios nacionales de vida silvestre: Refugios de propiedad estatal, Refugios de propiedad mixta y Refugios de propiedad privada.
4. 4Que la Ley Orgánica del Ambiente en su artículo 41 declara de interés público los humedales y su conservación, por ser de uso múltiple, estén o no estén protegidos por las leyes que rijan esta materia.
5. 5Que Desarrollos Mil Novecientos Veintiuno, Sociedad Anónima, cédula jurídica número 3-101-237706, a través de su representante legal el señor José Álvaro Jenkins Rodríguez, cédula número 2-0367-0674, propietaria del inmueble finca Nº 5- 119634-000, ubicada en el distrito primero Filadelfia, cantón quinto Carrillo de la Provincia de Guanacaste, promovió la creación del Refugio Nacional de Vida Silvestre denominado Hacienda El Viejo de categoría privada y presentó solicitud para incorporar voluntariamente a éste, una sección de la propiedad actualmente llamada Hacienda El Viejo, la cual ocupa una superficie de 1138 ha con 8309,94 m2, correspondiente al plano catastrado Nº G-636506-2000, por un periodo de 10 años.
6. 6Que dicha propiedad se encuentra ubicada en el distrito 01 Filadelfia, del cantón 05 Carrillo, provincia de Guanacaste, específicamente en la planicie aluvial formada entre los ríos Tempisque y Bolsón, colinda al norte y oeste con resto de las propiedades de Desarrollos Mil novecientos veintiuno, Sociedad Anónima, al sur con el río Bolsón, al este con margen derecho del río Tempisque y que dicha finca se localiza en la hoja cartográfica Tempisque Nº 3147-III escala 1:50.000.
7. 7Que el área que se dedicará a refugio es considerada de gran importancia para la protección de la biodiversidad de la región de Guanacaste, pues producto de las interrelaciones geográficas (geología, topografía, suelos, clima), se ha dado lugar a la formación de grupos vegetales que van desde formaciones boscosas en áreas de serranías (lomas y cerros), hasta ecosistemas semiacuáticos en donde se destacan los pantanos herbáceos y bosques anegados.
8. 8Que las asociaciones vegetales de la cuenca baja del río Tempisque poseen un alto valor ambiental, económico y social no sólo por su belleza paisajística, sino porque la intrincada red de relaciones ecosistemáticas entre dichos hábitat permite el equilibrio hídrico y la regulación de los ciclos vitales de los que dependen las actividades agroindustrial, turística y pesquera.
9. 9Que Desarrollos Mil Novecientos Veintiuno, Sociedad Anónima, elaboró un Plan de Manejo que fue aprobado mediante resolución ACT-OR-007 del 15 de noviembre de 2007 por el Comité Técnico del Área de Conservación Tempisque, por el Consejo Regional del Área de Conservación Tempisque el 20 de diciembre del 2007 y por el Consejo Nacional de Áreas de Conservación en la sesión Nº 3-2008, Acuerdo número 16 del 1º de abril del 2008.

10.-Que analizada la documentación presentada por Desarrollos Mil Novecientos Veintiuno, Sociedad Anónima se determinó que cumplió con lo establecido en el artículo 171 del decreto Ejecutivo Nº 32633- MINAE denominado Reglamento a la Ley de Conservación de la Vida Silvestre.

11.-Que mediante Acuerdo Nº 16 de la Sesión Extraordinaria Nº 3-2008 del 31 de marzo y 01 de abril del 2008 el Consejo Nacional de Áreas de Conservación (CONAC) aprobó el Plan de Manejo y creación del Refugio Nacional de Vida Silvestre Hacienda El Viejo, propiedad privada, de conformidad al artículo 12 inciso d) del Reglamento a la Ley de Biodiversidad, Decreto Ejecutivo Nº 34433-MINAE del 11 de marzo del 2008. Por tanto:

Créase el Refugio Nacional de Vida Silvestre Hacienda El Viejo, Categoría Privada
