in the entirety of the text - Complete Text of Norm 35477 Declares of public interest the actions and execution of works aimed at the relocation, construction and/or reconstruction of housing and/or building infrastructure, and the delivery of materials to towns affected by the earthquake of January 8, 2009 Complete Text of record: C8DAA No. 35477-MP-MCI THE PRESIDENT OF THE REPUBLIC THE MINISTER OF THE PRESIDENCY AND THE MINISTER OF INTERINSTITUTIONAL COORDINATION In exercise of the powers conferred upon them by articles 140, subsections 3), 8), 18) and 20) and 146 of the Political Constitution; articles 25, 27 and 28, paragraph 2, subsection b) of the General Law of Public Administration, Law No. 6227 of May 2, 1978.

1That by the principles of social justice and solidarity that shape our constitutional order (articles 74 and 50 of the Political Charter), the Costa Rican State must ensure the minimum material conditions required for human beings to live with dignity, especially in the face of contingencies that place individuals in a more vulnerable position.
2That at 13:21 hours on January 8, 2009, an earthquake of magnitude 6.2 degrees on the Richter scale occurred, with its epicenter located 10 kilometers east of the community of San Pedro de Poás de Alajuela, associated with a strike-slip fault due to surface rupture of the fault, with a hypocenter at 10 kilometers. Following this main event, multiple aftershocks occurred with moderate magnitudes between 3 and 4 degrees.
3That said earthquake caused damage to property and persons directly, due to the collapse of structures in the area closest to the epicenter, such as houses, commercial premises, infrastructure on agricultural farms, public infrastructure such as schools and health centers, damage to the road network due to landslides and obstructions, with the loss of sections of highways and bridges, as well as the occurrence of avalanches in different rivers due to landslides, which generated the isolation of the affected communities, even reporting the loss of human lives, loss of communications, agriculture and public services, among others.
4That by virtue of the foregoing, through Executive Decree No. 34993-MP published in Supplement No. 2 to La Gaceta No. 9 of January 14, 2009, the Executive Branch declared a state of emergency in the cantons of Alajuela, Grecia, Poás, Alfaro Ruiz and Valverde Vega of the province of Alajuela, and in the cantons of Heredia, Barva, Santa Bárbara and Sarapiquí of the province of Heredia.
5That once the initial impact phase and the rehabilitation phase were addressed, the Executive Branch had to begin the reconstruction phase, for which it needs to take measures that facilitate the economic reactivation of the area, the relocation and construction of new housing, the delivery of materials, the repair of housing with minor and partial damage, the replacement of infrastructure, communications, and in general all damaged public services located within the area affected by the earthquake.
6That the Government of the Republic, through guiding principles, promotes a recovery plan for the area affected by the earthquake, whose implementation actions require greater agility in the processing of the various respective procedures and permits under the responsibility of the Public Administration. Therefore,

Therefore, the various public Administrations involved, in accordance with their respective powers and legal framework, and without prejudice to their own purposes, within an environment of interinstitutional cooperation and coordination, shall act and contribute with other state institutions in a priority and effective manner with the necessary efforts to achieve that public purpose.

1Que por los principios de justicia social y de solidaridad que configuran nuestro ordenamiento constitucional (artículos 74 y 50 de la Carta Política), el Estado costarricense debe asegurar las condiciones materiales mínimas que requiere el ser humano para vivir dignamente, máxime frente a contingencias que colocan a los individuos en una posición más vulnerable.
2Que a las 13:21 horas del 8 de enero del 2009, ocurrió un sismo de magnitud 6,2 grados en la escala Richter con epicentro ubicado 10 kilómetros al este de la comunidad de San Pedro de Poás de Alajuela, asociado a una falla de corrimiento lateral por ruptura superficial de la falla, con hipocentro a 10 kilómetros. En forma posterior a dicho evento principal, ocurrieron múltiples réplicas en magnitudes moderadas entre los 3 y 4 grados.
3Que dicho sismo provocó daños en los bienes y las personas en forma directa, debido a la caída de estructuras en la zona más cercana al epicentro, tales como casas, locales comerciales, infraestructura en fincas agropecuarias, infraestructura pública como escuelas y centros de salud, daños en la red vial por derrumbes y obstrucciones, con la pérdida inclusive de tramos de carreteras y puentes, así como la ocurrencia de avalanchas en diferentes ríos por deslizamientos, lo cual generó el aislamiento de las comunidades afectadas, reportándose incluso la pérdida de vidas humanas, pérdida de las comunicaciones, la agricultura y los servicios públicos, entre otros.
4Que en virtud de lo anterior, mediante el Decreto Ejecutivo Nº 34993-MP publicado en el Alcance Nº 2 de La Gaceta Nº 9 de 14 de enero del 2009, el Poder Ejecutivo declaró estado de emergencia en los cantones de Alajuela, Grecia, Poás, Alfaro Ruiz y Valverde Vega de la provincia de Alajuela, y en los cantones de Heredia, Barva, Santa Bárbara y Sarapiquí de la provincia de Heredia.
5Que una vez atendida la fase de impacto inicial y la fase de rehabilitación, el Poder Ejecutivo debió iniciar la fase de reconstrucción, para lo cual requiere tomar las medidas que faciliten, la activación económica de la zona, la reubicación y construcción de nuevas viviendas, la entrega de materiales, la reparación de viviendas con daños leves y parciales, la reposición de la infraestructura, las comunicaciones, y en general todos los servicios públicos dañados que se ubican dentro de la zona afectada por el terremoto.
6Que el Gobierno de la República mediante principios orientadores impulsa un plan de recuperación de la zona afectada por el terremoto, cuyas acciones de implementación requieren mayor agilidad en la gestión de los distintos trámites y permisos respectivos a cargo de la Administración Pública. Por tanto,

Por lo cual, las distintas Administraciones públicas involucradas, de acuerdo con sus competencias y marco legal respectivo, y sin perjuicio de sus propios fines, dentro de un entorno de cooperación y coordinación interinstitucional, actuarán y contribuirán con otras instituciones estatales en forma prioritaria y efectiva con las gestiones necesarias para lograr aquél cometido público.

Artículo 1 — To declare of public interest the actions and execution of works aimed at the relocation, construction and/or reconstruction of housing and/or building infrastructure and the delivery of materials for the towns affected by the earthquake of January 8, 2009.

Artículo 3 — To advise that all persons and other public bodies or entities must comply with the requirements pre-established in the legislation in force for this purpose.

Artículo 4 — To establish that the supreme hierarchical superior of the Public Administrations concerned in this decree shall ensure and be responsible for its strict compliance.
