in its entirety - Full Text of Norm 35462 Creates Technical Commission for the Prevention and Control of Citrus Pests Full Text act: C8D73 No. 35462-MAG THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF AGRICULTURE AND LIVESTOCK In exercise of the powers conferred by Articles 140, subsections 3), 18) and 20) and 146 of the Political Constitution; Articles 25 subsection 1), 27 subsection 1), 28 subsections b) and j), of Law No. 6227 of May 2, 1978, General Law of Public Administration; the Law for the Promotion of Agricultural Production FODEA and Organic Law of the Ministry of Agriculture and Livestock, Law No. 7064, of April 29, 1987; and Articles 4 and 7 of Law No. 7664 of April 8, 1997, Phytosanitary Protection Law.
1st-That it is the responsibility of the Ministry of Agriculture and Livestock to protect plants from the damages caused by pests, as well as to avoid and prevent the introduction and spread of pests that threaten the economic activity based on agricultural production.
2nd-That the opinion and advice of the different actors involved in productive agricultural activities are of interest to the Administration, in search of joint solutions to the different problems affecting the activity.
3rd-That the Ministry of Agriculture and Livestock is empowered to establish advisory commissions related to the application of Law No. 7664, as established in its Article 7.
4th-That it is necessary to strengthen at the national level the prevention and control of pests in citrus species, similar species, and others susceptible to them.
5th-That citrus production represents an important factor for the country's economy, since currently the cultivation area dedicated to this activity is around twenty-five thousand hectares, which in turn generates a significant percentage of direct and indirect jobs. Furthermore, citrus fruits represent an important source of nutrients and vitamins in the daily diet of Costa Ricans.
6th-That the State has the obligation to defend and promote the economic interests of the community and its general welfare. Therefore,
CREATION OF THE TECHNICAL COMMISSION FOR THE PREVENTION AND CONTROL OF PESTS OF CITRUS

The Technical Commission for the Prevention and Control of Citrus Pests is created, as an advisory body of the Ministry of Agriculture and Livestock.
This Commission shall be composed of:
The Commission shall have the following functions:
The Commission shall meet ordinarily once every two months at the place agreed upon in the first session, the first session being required to be held at the Ministry of Agriculture and Livestock; and extraordinarily, whenever convened at the request of its coordinator or three of its members.
The quorum for sessions shall be formed with half plus one of its members at the time indicated for the first call and one hour later with the members present, at a minimum of three. Agreements shall be adopted by a simple majority of votes, and in the event of a tie, the Chair shall have the casting vote.

La Comisión se reunirá ordinariamente una vez cada dos meses en el lugar que se acuerde en la primera sesión, debiendo realizarse la primera en el Ministerio de Agricultura y Ganadería; y extraordinariamente, cada vez que sea convocada a solicitud de su coordinador o de tres de sus miembros.
El quórum de las sesiones se formará con la mitad más uno de sus miembros en la hora señalada para la primera convocatoria y una hora después con los miembros presentes, en un mínimo de tres. Los acuerdos se tomarán por mayoría simple de votos, y en caso de empate, el Presidente tendrá voto de calidad.
