1That Costa Rica is a party to the United Nations Convention on the Law of the Sea (CONVEMAR), Law No. 7291 of March 23, 1992.
2That the continental shelf regime is established in Part VI of the CONVEMAR (Articles 76 to 85).
3That in accordance with the provisions of Article 75 of the CONVEMAR, on January 13, 1997, Costa Rica deposited with the United Nations the official map establishing the outer limits of its exclusive economic zone in the Pacific Ocean.
4That if it were to be determined that Costa Rica meets the conditions established in Article 76 of CONVEMAR, there would be a possibility for the country to establish the outer limits of its continental shelf beyond the two hundred nautical miles that currently correspond to it under the protection of its exclusive economic zone.
5That to achieve the aforementioned objective, it is necessary to compile the data and information required in Article 76 of the CONVEMAR and in the Scientific and Technical Guidelines of the Commission on the Limits of the Continental Shelf (CLCS/11) and other related instruments, and to prepare the formal submission to be brought before the Commission on the Limits of the Continental Shelf of the United Nations.
6That on May 11, 2009, the Minister of Foreign Affairs and Worship submitted a preliminary information document on the outer limits of the continental shelf of Costa Rica to the Office of the Secretary-General of the United Nations in New York.
7That with the submission of this preliminary document, Costa Rica ensures that it can submit the complete documentation before the Commission on the Limits of the Continental Shelf in the future.
8That given the need to complete and perfect said documentation, submitting a document with sufficient scientific and technical grounding, the formation of an Interinstitutional Commission of a technical-scientific nature is required.
9That said Interinstitutional Commission must include the participation of the Ministries and their dependencies and autonomous institutions of the Costa Rican State whose work relates to the subject matter, which, through the official letters indicated below, have expressed their consent to form part of the Interinstitutional Commission: the Costa Rican Oil Refinery (RECOPE) via official letter P-691-2009 of July 16, 2009; and the Costa Rican Electricity Institute via official letter 0060-0191-2009 of July 22, 2009.

10.-That in addition to the pertinent bodies of the Costa Rican Executive Branch, due to the scientific and technical nature of the work and the information required, it is highly convenient that the Interinstitutional Commission include the participation of representatives from national academic institutions of the highest prestige, such as the University of Costa Rica and the National University, which, through the official letters indicated below, have expressed their consent to form part of the Interinstitutional Commission: the University of Costa Rica via official letter R-4733-2009 of July 15, 2009; and the National University via official letter R-2410-2009 of August 1, 2009. Therefore,

Considering:

Decree:

The Commission shall be under the authority of the Ministry of Foreign Affairs and Worship and shall be composed of a principal representative and their respective alternate from:

a)The Ministry of Foreign Affairs and Worship.
b)The Ministry of Environment, Energy and Telecommunications.
c)The Ministry of National Planning and Economic Policy.
d)The National Geographic Institute of the Ministry of Public Works and Transport e) The Costa Rican Oil Refinery (RECOPE).
f)The Costa Rican Electricity Institute (ICE).
g)The University of Costa Rica.
h)The National University.
i)Any other that is determined and approved by the Minister of Foreign Affairs and Worship or by a simple majority of the members.

Representatives from other institutions, as well as private individuals who, due to their technical knowledge, can contribute in a personal capacity to the work and purposes of the Commission, may attend and participate in the sessions of the Commission, if so determined by the Minister of Foreign Affairs and Worship.

Likewise, it shall determine its procedures and work schedules.

a)Coordinate and conduct studies, as well as compile the technical and scientific data and information, that are necessary for the preparation of the final submission of the Republic of Costa Rica for the definition of the outer limits of its continental shelf beyond two hundred nautical miles.
b)Coordinate advisory and training workshops on this subject.
c)Formulate work plans and action programs.
d)Prepare the final submission that will be brought before the Commission on the Limits of the Continental Shelf of the United Nations.
e)Advise and collaborate during the review stage of the Costa Rican submission, including its defense before the Commission on the Limits of the Continental Shelf of the United Nations.
f)Any other function that is agreed upon by the Commission itself and that is related to the foregoing purposes.

1Que Costa Rica es parte de la Convención de las Naciones Unidas sobre el Derecho del Mar (CONVEMAR), Ley Nº 7291 del 23 de marzo de 1992.
2Que el régimen de la plataforma continental se encuentra establecido en la Parte VI de la CONVEMAR (artículos 76 al 85).
3Que de conformidad con lo establecido en el artículo 75 de la CONVEMAR, el 13 de enero de 1997 Costa Rica depositó ante la Organización de las Naciones Unidas el mapa oficial estableciendo los límites externos de su zona económica exclusiva en el Océano Pacífico.
4Que si se llegara a determinar que Costa Rica cumple con las condiciones establecidas en el artículo 76 de CONVEMAR, existiría la posibilidad de que el país pueda fijar los límites externos de su plataforma continental más allá de las doscientas millas náuticas que actualmente le corresponden bajo la protección de su zona económica exclusiva.
5Que para lograr el objetivo anterior, es necesario recopilar los datos e información requeridos en el artículo 76 de la CONVEMAR y en las Directrices Científicas y Técnicas de la Comisión de Límites de la Plataforma Continental (CLCS/11) y demás instrumentos relacionados, y preparar la presentación formal para ser sometida a conocimiento de la Comisión de Límites de la Plataforma Continental de la Organización de las Naciones Unidas.
6Que el día 11 de mayo del 2009, el Ministro de Relaciones Exteriores y Culto presentó ante la Oficina del Secretario General de las Naciones Unidas, en Nueva York, un documento de información preliminar de los límites externos de la plataforma continental de Costa Rica.
7Que con la presentación de este documento preliminar, Costa Rica se asegura poder presentar a futuro la documentación completa ante la Comisión de Límites de la Plataforma Continental.
8Que ante la necesidad de completar y perfeccionar dicha documentación, presentando un documento con suficiente asidero científico y técnico, se requiere la conformación de una Comisión Interinstitucional de naturaleza técnico-científica.
9Que dicha Comisión Interinstitucional debe contar con la participación de los Ministerios y sus dependencias e instituciones autónomas del Estado costarricense cuyo trabajo se relacione con la temática, los cuales mediante los oficios que se indican a continuación han expresado su anuencia a formar parte de la Comisión Interinstitucional: la Refinadora Costarricense de Petróleo (RECOPE) mediante oficio P-691-2009 de 16 de julio de 2009; y el Instituto Costarricense de Electricidad mediante oficio 0060-0191-2009 de 22 de julio de 2009.

10.-Que además de las instancias pertinentes del Poder Ejecutivo costarricense, debido a la naturaleza científica y técnica del trabajo y la información requerida, es altamente conveniente que la Comisión Interinstitucional cuente con la participación de representantes de instituciones académicas nacionales del mayor prestigio, como son la Universidad de Costa Rica y la Universidad Nacional, las cuales mediante los oficios que se indican a continuación han expresado su anuencia a formar parte de la Comisión Interinstitucional: la Universidad de Costa Rica mediante oficio R-4733-2009 de 15 de julio de 2009; y la Universidad Nacional mediante oficio R-2410-2009 de 01 de agosto de 2009. Por tanto,

Considerando:

Decretan:

La Comisión estará bajo la dependencia del Ministerio de Relaciones Exteriores y Culto y estará integrada por un representante titular y su respectivo suplente de:

a)El Ministerio de Relaciones Exteriores y Culto.
b)El Ministerio de Ambiente, Energía y Telecomunicaciones.
c)El Ministerio de Planificación Nacional y Política Económica.
d)El Instituto Geográfico Nacional del Ministerio de Obras Públicas y Transportes e) La Refinadora Costarricense de Petróleo (RECOPE).
f)El Instituto Costarricense de Electricidad (ICE).
g)La Universidad de Costa Rica.
h)La Universidad Nacional.
i)Cualquier otro que determine y apruebe el Ministro de Relaciones Exteriores y Culto o la mayoría simple de los miembros.

Podrán asistir y participar en las sesiones de la Comisión, los representantes de otras instituciones, así como los particulares que por sus conocimientos técnicos puedan contribuir a título personal al trabajo y fines de la Comisión, si así lo determina el Ministro de Relaciones Exteriores y Culto.

Asimismo, determinará sus procedimientos y cronogramas de trabajo.

a)Coordinar y realizar estudios, así como recopilar los datos e información técnica y científica, que sean necesarios para la elaboración de la presentación final de la República de Costa Rica para la definición de los límites externos de su plataforma continental más allá de las doscientas millas náuticas.
b)Coordinar talleres de asesoría y capacitación en esta materia.
c)Formular planes de trabajo y programas de acción.
d)Elaborar la presentación final que será sometida a conocimiento de la Comisión de Límites de la Plataforma Continental de la Organización de las Naciones Unidas.
e)Asesorar y colaborar durante la etapa de revisión de la presentación costarricense, incluyendo su defensa ante la Comisión de Límites de la Plataforma Continental de la Organización de las Naciones Unidas.
f)Cualquier otra que sea acordada por la propia Comisión y que tenga relación con los fines anteriores.

Dado en la Presidencia de la República, a los veintiséis días del mes de agosto del año dos mil nueve

Artículo 2 — The Commission shall be coordinated by the Minister of Foreign Affairs and Worship, or whomever he designates.

Artículo 3 — The Commission shall meet whenever deemed necessary, according to the agreement of the Minister of Foreign Affairs and Worship, or in his absence, of a simple majority of its members.

Artículo 4 — The public officials who compose this Commission shall serve in their positions on an ad honorem basis.

Artículo 5 — The functions of the Commission are the following:

Artículo 6 — The Commission may define its Principal Technical Group, which shall be responsible for the planning and execution of the technical and scientific aspects, including the obtaining of relevant data and information and the preparation of the final submission.

Artículo 7 — It is declared of public interest and consequently the collaboration of public and private entities is requested, so that, within their means and without affecting their primary objective, they support the work to be developed by the Commission.

Artículo 8 — In matters not provided for in this Decree, the Commission shall be governed by the provisions of the General Law of the Public Administration.

Artículo 9 — It shall become effective upon its publication.

Artículo 2 — La Comisión será coordinada por el Ministro de Relaciones Exteriores y Culto, o quien él designe.

Artículo 3 — La Comisión se reunirá cuando así se estime necesario, según acuerdo del Ministro de Relaciones Exteriores y Culto, o en su defecto, de la mayoría simple de sus miembros.

Artículo 4 — Los funcionarios públicos que integren esta Comisión servirán en sus cargos en forma ad honorem.

Artículo 5 — Las funciones de la Comisión son las siguientes:

Artículo 6 — La Comisión podrá definir su Grupo Técnico Principal, el cual tendrá a su cargo la planificación y ejecución de los aspectos técnicos y científicos, incluyendo la obtención de los datos e informaciones pertinentes y elaboración de la presentación final.

Artículo 7 — Se declara de interés público y consecuentemente se solicita la colaboración de las entidades públicas y privadas, para que dentro de sus posibilidades y sin que se afecte su objetivo principal, apoyen el trabajo a ser desarrollado por la Comisión.

Artículo 8 — En lo no previsto en este Decreto, la Comisión se regirá por lo dispuesto en la Ley General de la Administración Pública.

Artículo 9 — Rige a partir de su publicación.
