**IN THE TOTALITY OF THE TEXT** - **Complete Text of Regulation 251** **Accepts the petition that six artisanal fishing organizations and one tourism fishing organization that operate within Golfo Dulce made to declare the establishment of Golfo Dulce as the Golfo Dulce Marine Area of Responsible Fishing** **Complete Text of Minutes: C8126** COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE AJDIP/251-2009.-Puntarenas on the seventh day of August 2009

1. 1That in accordance with Ley Nº 7384 and Ley Nº 8436, the functions of INCOPESCA are to coordinate the fishing sector, promote and regulate the development of fishing, marine hunting, and research, as well as to promote, on the basis of technical and scientific criteria, the conservation, exploitation, and sustainable use of the biological resources of the sea.
2. 2That among the powers of INCOPESCA are those of controlling fishing and the hunting of marine species in jurisdictional waters, determining the species of marine organisms that may be commercially exploited, establishing the number of licenses and their regulations, as well as the technical limitations to be incorporated into them, and determining the periods and areas of closure (veda), as well as the species and sizes whose capture is restricted or prohibited.
3. 3That Golfo Dulce is a semi-enclosed body of water of tectonic origin, approximately 50 Km long by 10 to 15 Km wide, and that, surrounded by hundreds of hectares of primary forest, it is the most pristine and best-conserved marine-coastal zone in our country, whose beauty and environmental importance is recognized worldwide.
4. 4That its condition as a tropical fjord justifies its biological-fishery importance, and therefore the use of non-sustainable fishing methods that endanger its marine biodiversity is not advisable.
5. 5That these special conditions make Golfo Dulce an appropriate site to be declared and managed under the concept of a Marine Area of Responsible Fishing (Área Marina de Pesca Responsable), regulated by INCOPESCA through Acuerdo AJDIP/138-2007, in which only the use of sustainable fishing arts (artes de pesca) that guarantee the recovery of fishery resources is permitted.
6. 6That one of the primary objectives of Marine Areas of Responsible Fishing is the management for the long-term sustainable use of fishery resources.
7. 7That through an express request addressed to the Board of Directors of INCOPESCA, six artisanal fishing organizations and one tourism fishing organization that operate within Golfo Dulce formally proposed a three-stage process for the establishment of the Golfo Dulce Marine Area of Responsible Fishing, in which industrial and semi-industrial fishing would not be permitted, nor the use of any other type of trawl nets (redes de arrastre) to carry out fishing activities.
8. 8That each region of the Pacific coastline requires particular management measures.
9. 9That fishery management must promote the maintenance of the quality, diversity, and availability of fishery resources in sufficient quantities for present and future generations, in the context of food security, poverty alleviation, and sustainable development. Management measures must ensure the conservation not only of target species, but also of those species belonging to the same ecosystem or dependent on them or that are associated with them.

10.-That INCOPESCA, in use of its powers permitted by law and national regulations, with the collaboration of other entities, developed a consultation process for transparent decision-making, with the effective participation of industry and the artisanal sector, which provided timely solutions to urgent issues in Golfo Dulce, and additionally, there is a positive technical opinion regarding the measures to be implemented in said area, issued by the subdirección general técnica of INCOPESCA through official letter SDGT 091-07-2009.

11.-That recognizing in those who carry out small-scale artisanal fishing their important contribution to employment, income, and food security, the right of these persons to a secure and just livelihood must be appropriately protected, providing preferential access, where appropriate, to the fishery resources they traditionally exploit, as well as to traditional fishing zones in the waters under our national jurisdiction.

1. 1Que de conformidad con la Ley Nº 7384 y la Ley Nº 8436, son funciones del INCOPESCA, coordinar al sector pesquero, promover y ordenar el desarrollo de la pesca, la caza marítima y la investigación, así mismo, fomentar, sobre la base de criterios técnicos y científicos, la conservación, el aprovechamiento y el uso sostenible de los recursos biológicos del mar.
2. 2Que dentro de las atribuciones del INCOPESCA están las de controlar la pesca y la caza de especies marinas en aguas jurisdiccionales, determinar las especies de organismos marinos que podrían explotarse comercialmente, establecer el número de licencias y sus regulaciones, así como, las limitaciones técnicas que se han de incorporar a estas, determinar los períodos y áreas de veda, así como, las especies y tamaños cuya captura está restringida o prohibida.
3. 3Que el Golfo Dulce es un cuerpo de agua semi-cerrado de origen tectónico de aproximadamente 50 Km de largo por 10 a 15 Km de ancho y que rodeado de cientos de hectáreas de bosque primario es la zona marino costera más pristina y mejor conservada de nuestro país, cuya belleza e importancia ambiental es reconocida a nivel mundial.
4. 4Que su condición de fiordo tropical justifica su importancia biológico-pesquera y por lo tanto no es conveniente la utilización de métodos de pesca no sostenibles que pongan en peligro su biodiversidad marina.
5. 5Que estas condiciones especiales convierten al Golfo Dulce en un sitio adecuado para ser declarado y manejado bajo el concepto de Área Marina de Pesca Responsable, reglamentado por el INCOPESCA mediante Acuerdo AJDIP/138-2007, en la cual únicamente se permita el uso de artes de pesca sostenibles que garanticen la recuperación de los recursos pesqueros.
6. 6Que uno de los objetivos primordiales de las Áreas Marinas de Pesca responsable es la gestión para el uso sostenible a largo plazo de los recursos pesqueros.
7. 7Que mediante solicitud expresa dirigida a la Junta Directiva del INCOPESCA, de seis organizaciones de pescadores artesanales y una organización de pesca turística que faenan dentro del Golfo Dulce, propusieron formalmente un proceso de tres etapas para la conformación del Área Marina de Pesca Responsable Golfo Dulce en la cual no se permita la pesca industrial ni semi-industrial, ni el uso de ningún otro tipo de redes de arrastre para realizar las faenas de pesca.
8. 8Que cada región del litoral pacífico requiere medidas de ordenación particulares.
9. 9Que la ordenación de la pesca debe fomentar el mantenimiento de la calidad, la diversidad y disponibilidad de los recursos pesqueros en cantidad suficiente para las generaciones presentes y futuras, en el contexto de la seguridad alimentaria, el alivio de la pobreza, y el desarrollo sostenible. Las medidas de ordenación deben asegurar la conservación no sólo de las especies objetivo, sino también de aquellas especies pertenecientes al mismo ecosistema o dependientes de ellas o que están asociadas con ellas.

10.-Que el INCOPESCA en uso de sus facultades permitidas por la ley y los reglamentos nacionales, contando con la colaboración de otras instancias, desarrolló un proceso de consulta para la toma de decisiones de forma transparente, con la efectiva participación de la industria y el sector artesanal que vino a proporcionar soluciones oportunas a cuestiones urgentes en el Golfo Dulce y adicional se cuenta con un criterio técnico positivo respecto a las medidas a implementar en dicha aérea, emitida por la subdirección general técnica del INCOPESCA mediante oficio SDGT 091-07-2009.

11.-Que reconociendo en quienes ejecutan la pesca artesanal en pequeña escala su importante contribución al empleo, los ingresos y la seguridad alimentaria; se debe proteger apropiadamente el derecho de estas personas, a un sustento seguro y justo, proporcionando acceso preferencial, cuando proceda, a los recursos pesqueros que explotan tradicionalmente, así como a las zonas tradicionales de pesca en las aguas de nuestra jurisdicción nacional.
