in the entirety of the text - Complete Text of Regulation 35362 Modifies for the Forestry Fund, the maximum budget expenditure for 2009 Complete Text of Act: C7D89 Nº 35362-H THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF FINANCE Based on the powers conferred by Articles 140 subsections 3) and 18) and 146 of the Political Constitution; Articles 25 subsection 1), 27 subsection 1) and 28 subsection 2) paragraph b) of Law Nº 6227, General Law of Public Administration of May 2, 1978 and its amendments; Law Nº 8131, Law of the Financial Administration of the Republic and Public Budgets of September 18, 2001 and its amendments; its Regulation, Decreto Ejecutivo Nº 32988-H-MP-PLAN of January 31, 2006 and its amendments; Law Nº 7554, Organic Law of the Environment of October 4, 1995 and its amendments; Law Nº 7575, Ley Forestal of February 13, 1996 and its amendments; Law Nº 7788, Law of Biodiversity of April 30, 1998 and its amendments; Decreto Ejecutivo Nº 32452-H of June 29, 2005 and its amendments; and Decreto Ejecutivo Nº 34404-H of March 5, 2008 and its amendments.

1. 1That Law Nº 7554, published in La Gaceta Nº 215 of November 13, 1995 and its amendments, establishes that the State must ensure the rational use of environmental elements, in order to protect and improve the quality of life of the inhabitants of the national territory. Likewise, it is obligated to foster economically and environmentally sustainable development, understood as development that satisfies basic human needs, without compromising the options of future generations.
2. 2That the Forestry Fund (Fondo Forestal) created by Law Nº 7575, published in Alcance Nº 21 to La Gaceta Nº 72 of April 16, 1996 and its amendments, is administered by the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC), as established in Law Nº 7788, published in La Gaceta Nº 101 of May 27, 1998 and its amendments.
3. 3That through official communication DM-602-2009 of April 21, 2009, the Minister of Environment, Energy, and Telecommunications requests to increase the maximum budget expenditure of the Forestry Fund (Fondo Forestal) by ¢70,570,024.00 (seventy million five hundred seventy thousand twenty-four colones exact), in order to meet expenses inherent to the needs of the forestry area and cover lodging and meal expenses for officials working in forestry control and protection activities.
4. 4That said amount will be financed with institutional free surplus (superávit libre) and will serve to meet outlays related to lodging and meal expenses for officials working in forestry control and protection activities; acquisition of work equipment such as diameter tapes; clinometers; compasses, among others, destined for Conservation Areas; transportation equipment for forestry supervision and control activities; and acquisition of global positioning equipment.
5. 5That by means of Decreto Ejecutivo Nº 32452-H, published in La Gaceta Nº 130 of July 6, 2005 and its amendments, the "Guideline for the application of Article 6 of Law Nº 8131 of the Financial Administration of the Republic and Public Budgets and the regulation of the class of public sector income called Financing" is issued.
6. 6That Article 7 of the decree cited in the preceding considering states that financing resources coming from prior periods—free surplus (superávit libre)—are part of the equity of the organs and entities and can be used in subsequent periods to finance expenditures related to the ordinary activity thereof, which serve the interest of the community, the public service, and institutional purposes, provided that—as in the present case—they are not permanent in nature or generate an obligation that requires financing over time, such as the creation of positions for fixed posts, or any other commitment of the same nature.
7. 7That by means of Decreto Ejecutivo Nº 34404-H, published in La Gaceta Nº 56 of March 19, 2008 and its amendments, the General Budget Policy Guidelines for the year 2009 were issued, establishing in Article 1 of said Decree the budget expenditure for the year 2009 for the entities covered by the scope of the Budgetary Authority (Autoridad Presupuestaria).
8. 8That with Decreto Ejecutivo Nº 35047-H, published in La Gaceta Nº 79 of April 24, 2009, the maximum budget expenditure authorized for the Forestry Fund (Fondo Forestal) for the year 2009 was increased, which was set at ¢427,587,227.00 (four hundred twenty-seven million five hundred eighty-seven thousand two hundred twenty-seven colones exact), a figure that does not contemplate the expenditures indicated in considering 4 of this decree.
9. 9That due to the foregoing, it is necessary to modify the maximum budget expenditure set for the Forestry Fund (Fondo Forestal) for the year 2009, increasing it by the sum of ¢70,570,024.00 (seventy million five hundred seventy thousand twenty-four colones exact). Therefore;

en la totalidad del texto - Texto Completo Norma 35362 Modifica para el Fondo Forestal, el gasto presupuestario máximo para el 2009 Texto Completo acta: C7D89 Nº 35362-H EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE HACIENDA Con fundamento en las atribuciones que les confieren los artículos 140 incisos 3) y 18) y 146 de la Constitución Política; los artículos 25 inciso 1), 27 inciso 1) y 28 inciso 2) acápite b) de la Ley Nº 6227, Ley General de la Administración Pública de 2 de mayo de 1978 y sus reformas; la Ley Nº 8131, Ley de la Administración Financiera de la República y Presupuestos Públicos de 18 de setiembre de 2001 y sus reformas; su Reglamento, el Decreto Ejecutivo Nº 32988-H-MP-PLAN de 31 de enero de 2006 y sus reformas; la Ley Nº 7554, Ley Orgánica del Ambiente de 4 de octubre de 1995 y sus reformas; la Ley Nº 7575, Ley Forestal de 13 de febrero de 1996 y sus reformas; la Ley Nº 7788, Ley de Biodiversidad de 30 de abril de 1998 y sus reformas; el Decreto Ejecutivo Nº 32452-H de 29 de junio de 2005 y sus reformas y el Decreto Ejecutivo Nº 34404-H de 5 de marzo de 2008 y sus reformas.

1. 1Que la Ley Nº 7554, publicada en La Gaceta Nº 215 de 13 de noviembre de 1995 y sus reformas, establece que el Estado debe velar por la utilización racional de los elementos ambientales, con el fin de proteger y mejorar la calidad de vida de los habitantes del territorio nacional. Asimismo, está obligado a propiciar un desarrollo económico y ambientalmente sostenible, entendido como el desarrollo que satisface las necesidades humanas básicas, sin comprometer las opciones de las generaciones futuras.
2. 2Que el Fondo Forestal creado mediante la Ley Nº 7575, publicada en el Alcance Nº 21 a La Gaceta Nº 72 de 16 de abril de 1996 y sus reformas, está administrado por el Sistema Nacional de Áreas de Conservación, según lo establecido en la Ley Nº 7788, publicada en La Gaceta Nº 101 de 27 de mayo de 1998 y sus reformas.
3. 3Que por medio del oficio DM-602-2009 de 21 de abril de 2009, el Ministro de Ambiente, Energía y Telecomunicaciones, solicita ampliar el gasto presupuestario máximo del Fondo Forestal en ¢70.570.024,00 (setenta millones quinientos setenta mil veinticuatro colones exactos), con el fin de atender gastos inherentes a las necesidades del área forestal y cubrir gastos de hospedaje y alimentación de los funcionarios que laboran en las actividades de control y protección forestal.
4. 4Que dicho monto se financiará con superávit libre institucional y servirá para atender erogaciones relacionadas con gastos de hospedaje y alimentación de los funcionarios que laboran en actividades de control y protección forestal; adquisición de equipo de trabajo como cintas diamétricas; clinómetros; brújulas, entre otros, destinados a Áreas de Conservación; equipo de transportes para actividades de supervisión y control forestal; y adquisición de equipos de posicionamiento global.
5. 5Que mediante el Decreto Ejecutivo Nº 32452-H, publicado en La Gaceta Nº 130 de 6 de julio de 2005 y sus reformas, se emite el "Lineamiento para la aplicación del Artículo 6 de la Ley Nº 8131 de la Administración Financiera de la República y Presupuestos Públicos y la regulación de la clase de ingresos del Sector Público denominada Financiamiento".
6. 6Que el artículo 7 del decreto citado en el considerando anterior, dispone que los recursos de financiamiento que provienen de vigencias anteriores -superávit libre- son parte del patrimonio de los órganos y las entidades y pueden utilizarlo en períodos subsiguientes para financiar gastos que se refieran a la actividad ordinaria de éstas, con los cuales se atienda el interés de la colectividad, el servicio público y los fines institucionales, siempre que -como en el presente caso- no tengan el carácter permanente o generen una obligación que requiera financiarse a través del tiempo, como la creación de plazas para cargos fijos, o cualquier otro compromiso de la misma naturaleza.
7. 7Que mediante el Decreto Ejecutivo Nº 34404-H, publicado en La Gaceta Nº 56 de 19 de marzo de 2008 y sus reformas, se emitieron las Directrices Generales de Política Presupuestaria para el año 2009, estableciéndose en el artículo 1º del citado Decreto, el gasto presupuestario del año 2009 para las entidades cubiertas por el ámbito de la Autoridad Presupuestaria.
8. 8Que con el Decreto Ejecutivo Nº 35047-H, publicado en La Gaceta Nº 79 de 24 de abril de 2009, se amplió el gasto presupuestario máximo autorizado al Fondo Forestal para el año 2009, el cual se fijó en ¢427.587.227,00 (cuatrocientos veintisiete millones quinientos ochenta y siete mil doscientos veintisiete colones exactos), cifra que no contempla los gastos indicados en el considerando 4 de este decreto.
9. 9Que por lo anterior, resulta necesario modificar el gasto presupuestario máximo fijado al Fondo Forestal para el año 2009, incrementándolo en la suma de ¢70.570.024,00 (setenta millones quinientos setenta mil veinticuatro colones exactos). Por tanto;
