1. 1That in accordance with Law No. 7384, Law Creating INCOPESCA, and Law No. 8436, Fisheries and Aquaculture Law, it is the authority and competence of INCOPESCA to establish, based on technical, scientific, economic, and social criteria, closure zones or seasons (zonas o épocas de veda), whether by area or by specific species, in order to protect and utilize hydrobiological resources in a sustainable manner.
2. 2That it has been technically demonstrated that one means of conserving hydrobiological resources and guaranteeing sustainable utilization is by establishing closure periods and areas (periodos y áreas de veda), which it is therefore appropriate to define for their application.
3. 3That the Gulf of Nicoya is a natural refuge for a great variety of species and considered one of the most important fishing zones in the country.
4. 4That in accordance with the results of the research that, in recent years, has been carried out by researchers from the Research and Development Department of INCOPESCA, the School of Biological Sciences of the Universidad Nacional, and the Center for Marine Research of the Universidad de Costa Rica, it is urgent and necessary to implement management measures for the principal species of commercial value that have the Gulf of Nicoya as their habitat.
5. 5That in accordance with Article 36 of Law No. 8436, Fisheries and Aquaculture Law, the Executive Branch may authorize the allocation of funds from the National Budget in favor of the Joint Institute for Social Assistance (Instituto Mixto de Ayuda Social, IMAS), for the purpose of developing socioeconomic assistance programs specially designed for that purpose, in favor of fishermen who are affected by closure periods, provided it is proven that they have no other sources of income and are in a condition of poverty. These programs will necessarily involve community work services (servicios de trabajo comunal) by the beneficiaries.
6. 6That in accordance with Article 133 of Law No. 8436, Fisheries and Aquaculture Law, it is the responsibility of the National Coast Guard Service authorities to carry out operations aimed at arresting and seizing goods, equipment, fishing gear, or fishery products used to commit crimes and infractions against fisheries legislation or obtained as a product of such acts. The National Coast Guard Service shall act ex officio or at the request of accredited inspectors of INCOPESCA or of third parties. For the better fulfillment of the purposes of this Law, INCOPESCA shall establish the necessary coordination agreements or mechanisms with the National Coast Guard Service. Therefore:

en la totalidad del texto - Texto Completo Norma 200 Establece prohibiciones a las Flotas Pesqueras Comerciales a faenar con cualquier tipo de arte de pesca en áreas comprendidas, a la Flota Semi-Industrial camaronera de arrastre realizar su actividad en ninguna epoca del año en la zona comprendida Texto Completo acta: C73B9 INSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA INSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA (Nota de Sinalevi: El Instituto Costarricense de Pesca y Acuicultura mediante acuerdo N° 227 del 10 de julio de 2009, publicado en La Gaceta N° 147 del 30 de julio de 2009, acordó incluir en todos los alcances establecidos en este acuerdo a aquellos peones o ayudantes de pescadores propietarios de embarcaciones pertenecientes a la Flota Artesanal en Pequeña Escala, que se vean afectados con la declaratoria de veda acordada por la Junta Directiva en el Golfo de Nicoya, durante el período comprendido entre el 01 de octubre al 15 de noviembre del 2009) SECRETARÍA DE JUNTA DIRECTIVA AJDIP/200-2009.-Puntarenas, a los doce días del mes de junio del 2009.

1. 1Que de conformidad con la Ley Nº 7384, Ley de Creación del INCOPESCA y la Ley Nº 8436, Ley de Pesca y Acuicultura, es atribución y competencia del INCOPESCA establecer conforme a criterios técnicos, científicos, económicos y sociales, las zonas o épocas de veda, sea por áreas o por especies determinadas, a fin de proteger y aprovechar los recursos hidrobiológicos de manera sostenible.
2. 2Que está demostrado técnicamente que una de las formas de conservación de los recursos hidrobiológicos y de garantizar un aprovechamiento sostenible, es estableciendo periodos y áreas de veda, lo cual resulta conveniente definir para su aplicación.
3. 3Que el Golfo de Nicoya es un refugio natural para gran variedad de especies y considerado una de las zonas pesqueras más importantes del país.
4. 4Que de acuerdo con los resultados de las investigaciones que en los últimos años han venido realizando, investigadores del Departamento de Investigación y Desarrollo del INCOPESCA, la Escuela de Ciencias Biológicas de la Universidad Nacional, y del Centro de Investigaciones Marinas de la Universidad de Costa Rica, es urgente y necesario la implementación de medidas de manejo de las principales especies de valor comercial que tienen cómo habitat el Golfo de Nicoya.
5. 5Que de conformidad con el artículo 36 de la Ley Nº 8436, Ley de Pesca y Acuicultura, el Poder Ejecutivo podrá autorizar el destino de fondos del Presupuesto Nacional a favor del Instituto Mixto de Ayuda Social (IMAS), con el propósito de desarrollar programas de asistencia socioeconómica diseñados especialmente con tal propósito, a favor de los pescadores que se vean afectados en los períodos de veda, siempre que se compruebe que no tienen otras fuentes de ingresos y se encuentran en condición de pobreza. Estos programas implicarán necesariamente servicios de trabajo comunal por parte de los beneficiarios.
6. 6Que de conformidad con el artículo 133 de la Ley Nº 8436, Ley de Pesca y Acuicultura, corresponde a las autoridades del Servicio Nacional de Guardacostas realizar los operativos tendientes a arrestar y decomisar bienes, equipo, artes de pesca o productos pesqueros utilizados para cometer delitos e infracciones contra la legislación pesquera u obtenidos como producto de tales hechos. El Servicio Nacional de Guardacostas actuará de oficio o a instancia de los inspectores acreditados de INCOPESCA o de terceros. Para d mejor cumplimiento de los fines de esta Ley, el INCOPESCA establecerá los convenios o los mecanismos necesarios de coordinación con el Servicio Nacional de Guardacostas. Por tanto:
