Therefore, The following is issued:

REGULATION ON TECHNICAL REGULATIONS FOR THE CORRECT USE OF THE TURTLE EXCLUDER DEVICE (DET), BY THE INSHORE SHRIMP TRAWL FLEET

This Regulation shall be of mandatory observance and application for those inshore shrimp trawl vessels that carry out commercial shrimp fishing activities or operations in Costa Rican jurisdictional waters, in which case the turtle excluder devices must be carried at all times and be properly installed in the nets when executing fishing operations.

For the purposes of this regulation, the following shall be understood as:

a- Incidental capture: The capture of any species of sea turtle, occurring fortuitously, and carried out in the zones, seasons, and with the fishing gear and characteristics authorized by INCOPESCA for shrimp fishing.

b- Turtle Excluder Device (DET): The rigid-type turtle excluder devices (DET) are apparatuses installed between the body and the codend (bolso) of shrimp trawl nets; they consist of a cylindrical extension of netting (paño de red), a solid grid fixed inside at an angle of inclination varying between 30° and 55°, depending on the turtle excluder device in question, whose function is the deflection of adult and juvenile sea turtles towards an opening known as the "escape exit".

c- Shrimp trawl vessel: any vessel used for capturing marine shrimp species by means of trawl nets.

General specifications for turtle excluder devices. The characteristics of the DET regarding shape, dimensions, construction materials, assembly, installation, and grid inclination must facilitate the exclusion of turtles, preventing their passage into the codend (bolso) of the net and allowing their exit through an escape exit. Likewise, the DET must facilitate the passage of shrimp into the codend (bolso). The DETs must consist of the following components.

• a)Escape exit. b) Solid grid. c) Escape exit flap. d) Floats (for excluders with an escape exit in the lower part and when the buoyancy of the DET is less than its weight).
• a)Escape exit. The escape exit is a rectangular cut, which may have the following dimensions:
• 1)Double skirt or double flap DET: 142 cm (56 inches) transversely and 51 cm (20 inches) longitudinally, measured with stretched netting (paño estirado), from one half mesh forward of the grid, where the cutting of the opening begins.

The flap for this escape exit corresponds to specification 1) of subsection c).

• 2)Single flap DET: 180 cm (71 inches) transversely and 66 cm (26 inches) longitudinally, measured from one half mesh forward of the grid, where the cutting of the opening begins. The flap to be used with this escape exit is regulated in specification 2) of subsection c).
• b)Solid grid. There will be two possibilities for its construction; in the first case, it must be a rigid structure consisting of an oval or semi-rectangular frame without corners, with minimum dimensions of 81 cm by 115 cm and maximum of 107 cm by 130 cm, with vertical bars firmly attached to the frame at both ends and distributed equidistantly, with a maximum separation of 15.2 cm (6 inches) for DETs constructed with aluminum tubing with a minimum thickness of 1.5 inches, and in the second case, there must be a maximum separation of 10.2 cm (4 inches) for any other type of tube or rod, measured from edge to edge of the bars and with respect to the frame.

For this case, the grids may be made of any of the following materials: galvanized or stainless steel rod of 7.9 mm (5/16 inches) minimum diameter for the frame and 6.4 mm (1/4 inches) for the vertical bars; aluminum bar or rod of 19.1 mm (3/4 inches) minimum diameter for the frame and 16 mm (5/8 inches) for the vertical bars; aluminum tubing with a minimum of 32 mm (1 1/4 inches) outer diameter for the frame and bars, or schedule 40 galvanized steel tubing with a minimum outer diameter of 12.7 mm (1/2 inch) for the frame and 9.5 mm (3/8 inch) for the vertical bars.

Grid position: it must be installed inside the body of the DET inclined forward (anterior part of the DET oriented in the direction of the mouth-codend (bolso) of the net), when the escape exit is at the bottom, or backward (posterior part of the DET), when the escape exit is at the top. The inclination of the grid with respect to the horizontal axis of the DET must have an angle between 30° and 55°. The grid must be firmly attached to the netting extension along the perimeter of the frame by means of lashings with twine.

• c)Escape exit flap. The escape exit flap may have the following dimensions:
• 1)Double skirt or double flap DET: Two sections of rectangular netting, with a maximum of 147.3 cm (58 inches) in width, measured with stretched netting (paño estirado), which are installed in the body of the DET covering the escape exit (142 cm by 51 cm), overlapping one over the other by no more than 38.1 cm (15 inches) along their entire length, without any seam in the overlap that fixes one section of netting to the other, except at the seam that joins the sections (flaps) to the anterior edge of the escape exit. The sections (flaps) may extend behind the grid up to a maximum of 61 cm (24 inches), and must be fixed along their entire length. This flap shall be used with option 1) of subsection a) of section 3.1.3.
• 2)Single flap DET: One section of rectangular netting 337.8 cm (133 inches) wide by 147.3 cm (58 inches) long, measured with stretched netting (paño estirado). This flap is installed in the body of the DET covering the escape exit (180 by 66 cm = 71 x 26 inches), with the longest edge (337.8 cm) attached to the anterior edge of the escape exit, being able to overlap at that site up to a maximum of 12.7 cm (5 inches). The lateral edges may be fixed to the body of the DET up to 15.2 cm (6 inches) behind the posterior edge of the escape exit, and may extend freely (without being fixed to the netting) up to a maximum of 61 cm (24 inches) behind the grid. This flap shall be used with specification 2) of subsection a) of specification 3.1.3.

Both types of flaps may overlap the body of the DET on the netting anterior to the escape exit by a maximum of 2 or 3 meshes, and are fixed by a seam along the entire line of meshes, equidistant to the front margin of the opening or joined to it; laterally it may overlap the body of the DET up to a maximum of 2 or 3 meshes and be equally fixed by a seam, including up to a maximum of 15.2 cm (6 inches) behind the union of the grid with the body of the DET at its lower part, a point from which the flap must remain completely free.

• d)Floats (for excluders with an escape exit in the lower part and when the buoyancy of the DET is less than its weight). The buoyancy that excluders with an escape exit in the lower part must have for their adequate stability, hydrodynamics, and functioning must be equal to or greater than their weight in the water. If the buoyancy of the excluder is not equal to its weight, floats must be incorporated to supplement it. A buoyancy of 9 to 10 kilograms-force (Kgf) provided by floats of polyurethane, polyvinyl chloride (PVC), ethylene-vinyl acetate (EVA), other rigid plastic, or aluminum is sufficient.

Requirements and position of the floats when the escape exit is at the bottom: In the case of polyurethane floats, they must be two bodies with similar dimensions, weight, and shape, with a buoyancy force of 4.5 Kgf each, fixed by means of polyamide (PA) or polyethylene (PE) line on both sides of the upper central part of the grid (at the point of union with the body of the DET) in a symmetrical manner. In this case, they may be placed outside the body of the DET or inside it behind the frame of the grid.

When it is a spherical float of PVC, other rigid plastic, or aluminum, it must provide a buoyancy of at least 9 Kgf; be fixed to the upper central part of the grid (at the point of union with the body of the DET) and always outside the body of the DET.

Requirements and position of the floats when the escape exit is at the top: The same types of floats may be used when the DET has an escape exit at the top, in which case, they must be installed outside the body of the DET, one on each side of the grid below the margin of the escape exit flap.

During the fishing trip, each vessel must carry on board a minimum of one DET as a spare and in good condition.

The inspectors of INCOPESCA and the personnel of the National Coast Guard Service shall be the only authorities fully empowered to inspect and verify at any moment whether the vessels subject to this regulation satisfactorily comply with what is regulated in this matter.

In accordance with the provisions established in Agreement AJ.D:I P./594-2005, it is the responsibility of the Directing Body of the Fisheries Legal Procedure to hear and resolve in the administrative venue those complaints received upon petition of a party or ex officio, filed against persons who violate this regulation.

Anyone who fails to comply with the regulations contemplated in this regulation, after due process with effective guarantee of the right of defense, shall be sanctioned in accordance with the following provisions:

A- A fine of five to fifteen base salaries and the suspension of the fishing license with extensive effect for other benefits for a period of 2 calendar months counted from the finality of the sanction shall be imposed on anyone proven to be carrying out fishing operations without the DETs installed.

Likewise, a suspension shall be imposed on the vessel captain, disqualifying them for three calendar months from exercising their functions as such before the Port Captaincy (Capitánía de Puerto) and INCOPESCA, without detriment to the employer's liability.

B- The suspension of the fishing license with extensive effect for other benefits for a period of 2 calendar months counted from the finality of the sanction shall be imposed on anyone proven to be engaging in the following conduct:

a- Fishing with the DET's escape exit sewn shut. b- Installing the DET in a contrary position. c- Escape exit smaller than 62 inches.

Likewise, a suspension shall be imposed on the vessel captain, disqualifying them for three calendar months from exercising their functions as such before the Port Captaincy (Capitánía de Puerto) and INCOPESCA, without detriment to the employer's liability.

Those who again incur the actions typified in subsections A) and B) above within a period of one calendar year shall be sanctioned with the cancellation of the corresponding fishing license.

C- The suspension of the fishing license with extensive effect for other benefits for a period of 1 calendar month counted from the finality of the sanction shall be imposed on anyone proven to be engaging in the following conduct:

• a)Installing the turtle excluder device with an escape exit between 63 and 71 inches. b) Installing the turtle excluder device with a skirt (Falda) of 34 or more inches long. c) Installing the turtle excluder device with an angle greater than 65 or less than 25 degrees. d) Not carrying a spare turtle excluder device. e) Installing the turtle excluder device, including the spare, with non-regulated materials. f) Installing the turtle excluder device with the lateral seam of the skirt (falda) greater than or equal to 10 inches. g) Improperly installing buoys that interfere with the exit of turtles.

Likewise, a suspension shall be imposed on the vessel captain, disqualifying them for one calendar month from exercising their functions as such before the Port Captaincy (Capitánía de Puerto) and INCOPESCA, without detriment to the employer's liability.

D- The suspension of the fishing license with extensive effect for other benefits for a period of fifteen calendar days counted from the finality of the sanction shall be imposed on anyone proven to be engaging in the following conduct:

• a)Installing the turtle excluder device with a skirt (Falda) 28 to 33 inches long. b) Installing the turtle excluder device with an angle of more than 55 and less than 65 degrees, or greater than or equal to 20 and less than 30 degrees. c) Installing the turtle excluder device with a skirt (falda) seam greater than 6 and less than 10 inches. d) Placing the turtle excluder device without the regulatory buoys.

If conduct less serious than those established in this regulation occurs, the permit holder shall be notified so that they immediately make the correction, modification, and adjustment to the provisions in force on the matter.

Final Agreement.

For the purposes of complying with the provisions of Law No. 8325, the General Technical Directorate and the Research Department shall proceed to carry out the corresponding studies that allow defining the seasons, zones, or areas in which turtle excluder devices must be used.

Por tanto, Se emite el siguiente:

REGLAMENTO SOBRE REGULACIONES TÉCNICAS DEL USO CORRECTO DEL DISPOSITIVO EXCLUIDOR DE TORTUGAS (DET), POR PARTE DE LA FLOTA CAMARONERA DE ARRASTRE DE ORILLA

El presente Reglamento será de acatamiento y aplicación obligatoria para aquellas embarcaciones camaroneras de arrastre de orilla, que ejerzan actividades u operaciones de pesca comercial del camarón en aguas jurisdiccionales costarricenses, en cuyo caso los dispositivos excluidores de tortugas deberán portarse en todo momento y estar debidamente instalados en las redes al ejecutarse las faenas de pesca.

Para los efectos de la presente regulación entiéndase por:

a- Captura incidental: La de cualquier especie de tortuga marina, ocurrida de manera fortuita, y que se llevé a cabo en las zonas, épocas y con las artes de pesca y características que para la pesca de camarón haya autorizado el INCOPESCA.

b- Dispositivo Excluidor de Tortugas Marinas (DET): Los dispositivos excluidores de tortugas marinas (DET) del tipo rígido, son aparejos que se instalan entre el cuerpo y bolso de las redes de arrastre camaroneras; están conformados por una extensión cilíndrica de paño de red, una parrilla sólida fijada en su interior con un ángulo de inclinación que varía entre 30° y 55°, dependiendo del dispositivo excluidor de que se trate, cuya función es el desvío de tortugas marinas adultas y juveniles, hacia una abertura conocida como "salida de escape".

c- Embarcación camaronera de arrastre: cualquier embarcación utilizada para la captura de especies de camarón marino por medio de redes de arrastre.

Especificaciones generales de los dispositivos excluidores de tortugas marinas. Las características del DET en cuanto a forma, dimensiones, materiales de construcción, armado, instalación e inclinación de la parrilla, deben facilitar la exclusión de las tortugas, impidiendo su paso hacia el bolso de la red y permitiendo su salida a través de una abertura de escape. Asimismo, el DET debe facilitar el tránsito del camarón hacia el bolso. Los DET deben estar conformados por los siguientes componentes.

• a)Abertura de salida o escape.
• b)Parrilla sólida.
• c)Tapa de la abertura de escape.
• d)Flotadores (para excluidores con abertura de escape en la parte inferior y cuando la flotabilidad del DET sea menor a su peso).
• a)Abertura de salida o escape. La abertura de salida es un corte rectangular, que puede tener las siguientes dimensiones:
• 1)DET doble falda o solapa: 142 cm (56 pulgadas) en sentido transversal y 51 cm (20 pulgadas) en sentido longitudinal, medidos a paño estirado, desde media malla adelante de la parrilla, donde se inicia a cortar la abertura.

La tapa para esta abertura de escape corresponde a la especificación 1) del inciso c).

• 2)DET de una sola tapa: 180 cm (71 pulgadas) en sentido transversal y 66 cm (26 pulgadas) en sentido longitudinal medido desde media malla adelante de la parrilla, donde se inicia a cortar la abertura. La tapa a utilizar con esta abertura de escape se regula en la especificación 2) del inciso c).
• b)Parrilla sólida. Existirán dos posibilidades para su construcción, en el primer caso, debe ser una estructura rígida conformada por un marco oval o semirectángular sin esquinas, con dimensiones mínimas de 81 cm por 115 cm y máximas de 107 cm por 130 cm, con barras verticales fijadas firmemente al marco a ambos extremos y distribuidas equidistantemente, con una separación máxima de 15.2 cm (6 pulgadas) para los DET'S construidos con tubo de aluminio con un grosor mínimo de 1.5 pulgadas y en el segundo caso, deberá existir una separación máxima de 10.2 cm (4 pulgadas), para cualquier otro tipo de tubo o varilla y medidos de borde a borde de las barras y con respecto al marco.

Para este caso, las parrillas pueden ser de cualquiera de los siguientes materiales: varilla de acero galvanizado o inoxidable de 7.9 mm (5/16 pulgadas) de diámetro mínimo para el marco y 6.4 mm (1/4 pulgadas) para las barras verticales; barra o varilla de aluminio de 19.1 mm (3/4 pulgadas) de diámetro mínimo en el marco y 16 mm (5/8 pulgadas) para las barras verticales; tubo de aluminio con un mínimo de 32 mm (1 1A pulgadas) de diámetro exterior para marco y barras, o tubo de acero galvanizado cédula 40 con diámetro exterior mínimo de 12.7 mm (1/2 pulgada) para el marco y de 9.5 mm (3/8 pulgada) para las barras verticales.

Posición de la parrilla: debe estar instalada en el interior del cuerpo del DET en forma inclinada hacia adelante (parte anterior del DET orientado en sentido boca-tolso de la red), cuando la abertura de escape es inferior, o hacia atrás (parte posterior del DET), cuando la abertura de escape es superior. La inclinación de la parrilla respecto al eje horizontal del DET debe tener un ángulo entre 30° y 55°. La parrilla debe estar sujeta firmemente a la extensión de paño a lo largo del perímetro del marco mediante uniones con hilo.

• c)Tapa de la abertura de escape. La tapa de la abertura de escape puede tener las siguientes dimensiones:
• 1)DET doble falda o solapa: Dos secciones de paño de forma rectangular, con un máximo de 147.3 cm (58 pulgadas) de ancho, a paño estirado, las cuales se instalan en el cuerpo del DET cubriendo la abertura de escape (de 142 cm por 51 cm), traslapándose una sobre otra no más de 38.1 cm (15 pulgadas) a todo lo largo de las mismas, sin costura en el traslape que fije una sección de paño con la otra, excepto en la costura que une las secciones (tapas) con el borde anterior de la abertura de escape. Las secciones (tapas) pueden extenderse por detrás de la parrilla hasta un máximo de 61 cm (24 pulgadas), debiendo estar fijas en toda su longitud. Esta tapa se utilizará con la opción 1) del inciso a) del apartado 3.1.3.
• 2)DET de una sola tapa: Una sección de paño rectangular de 337.8 cm (133 pulgadas) de ancho por 147.3 cm (58 pulgadas) de largo a paño estirado. Esta tapa se instala en el cuerpo del DET cubriendo la abertura de escape (de 180 por 66 cm = 71 x 26 pulgadas), con el borde más largo (337.8 cm) pegado al borde anterior de la abertura de escape, pudiéndose traslapar en ese sitio hasta un máximo de 12.7 cm (5 pulgadas). Los bordes laterales pueden fijarse al cuerpo del DET hasta 15.2 cm (6 pulgadas) por detrás del borde posterior de la abertura de escape, y puede extenderse libremente (sin estar fijadas al paño) hasta un máximo de 61 cm (24 pulgadas) por detrás de la parrilla. Esta tapa se utilizará con la especificación 2) del inciso a) de la especificación 3.1.3.

Ambos tipos de tapas pueden traslaparse sobre el cuerpo del DET, en el pafio anterior a la abertura de escape a un máximo de 2 ó 3 mallas, y se fijan mediante costura a todo lo largo de la línea de mallas, equidistante al margen delantero de la abertura o unida al mismo; lateralmente puede traslaparse al cuerpo del DET hasta un máximo de 2 ó 3 mallas y quedar igualmente fija mediante costura, incluso hasta un máximo de 15.2 cm (6 pulgadas) por atrás de la unión de la parrilla con el cuerpo del DET en su parte inferior, punto a partir del cual, la tapa debe quedar completamente libre.

• d)Flotadores (para excluidores con abertura de escape en la parte inferior y cuando la flotabilidad del DET sea menor a su peso). La flotabilidad que deben tener los excluidores con abertura de escape en la parte inferior, para su adecuada estabilidad, hidrodinámica y funcionamiento, debe ser igual o mayor a su peso en el agua. Si la flotabilidad del excluidor no es igual a su peso, deben incorporarse flotadores que la complementen. Es suficiente una flotabilidad de 9 a 10 kilogramos fuerza (Kgf) proporcionada por flotadores de poliuretano, cloruro de polivinilo (PVC), acetato viniletílico (EVA), otro plástico rígido o aluminio.

Requisitos y posición de los flotadores cuando la abertura de escape es inferior: En el caso de flotadores de poliuretano, deben ser dos cuerpos con dimensiones, peso y forma similares, con fuerza de flotación de 4.5 Kgf cada uno, fijados mediante cabo de poliamida (PA) o polietileno (PE) a ambos lados de la parte superior central de la parrilla (en el punto de unión con el cuerpo del DET) en forma simétrica. En este caso, pueden ir afuera del cuerpo del DET o en su interior por detrás del marco de la parrilla.

Cuando se trate de un flotador esférico de PVC, de otro plástico rígido o de aluminio, éste debe cubrir por lo menos la flotabilidad de 9 Kgf; ir fijo a la parte superior central de la parrilla (en el punto de unión con el cuerpo del DET) y siempre por fuera del cuerpo del DET.

Requisitos y posición de los flotadores cuando la abertura de escape es superior: Los mismos tipos de flotadores pueden ser usados cuando el DET tenga abertura de escape por arriba, en cuyo caso, deben instalarse por fuera del cuerpo del DET, uno a cada lado de la parrilla por debajo del margen de la tapa de la abertura de escape.

Durante el viaje de pesca en cada embarcación se deberá de llevar a bordo, un mínimo de un DET como repuesto y en buen estado.

Los inspectores de INCOPESCA y el personal del Servicio Nacional de Guardacostas serán las únicas autoridades plenamente facultados para inspeccionar y comprobar en cualquier momento si las embarcaciones afectas a la presente regulación cumplen satisfactoriamente con lo regulado en la materia.

De conformidad con lo establecido en el Acuerdo AJ.D:I P./594-2005, corresponde al órgano Director de Procedimiento Jurídico Pesquero conocer y resolver en sede administrativa aquellas denuncias recibidas a gestión de parte o bien de oficio, interpuestas en contra de personas que transgredan la presente regulación.

Quien incumpliese las regulaciones contempladas en el presente reglamento, previo debido proceso con garantía efectiva del derecho de defensa, será sancionado, de conformidad con las siguientes disposiciones:

A- Se impondrá una multa de cinco a quince salarios bases y la suspensión de la licencia de pesca con efecto extensivo para los demás beneficios por un plazo de 2 meses calendario contados a partir de la firmeza de la sanción, a quien se compruebe realizando las faenas de pesca sin los DET'S instalados.

De igual manera se impondrá una suspensión al capitán de la embarcación de inhabilitación de tres meses calendario para ejercer sus funciones como tal ante la Capitanía de Puerto e INCOPESCA, sin demérito de la responsabilidad patronal.

B- Se impondrá la suspensión de la licencia de pesca con efecto extensivo para los demás beneficios por un plazo de 2 meses calendario contados a partir de la firmeza de la sanción, a quien se compruebe ejerciendo las siguientes conductas:

a- Pescar con la abertura de salida del DET cosido.

b- Instalar el DET en posición contraria.

c- Abertura de salida menor a las 62 pulgadas.

De igual manera se impondrá una suspensión al capitán de la embarcación de inhabilitación de tres meses calendario para ejercer sus funciones como tal ante la Capitanía de Puerto e INCOPESCA, sin demérito de la responsabilidad patronal.

Quienes incurran nuevamente en las acciones tipificadas en los incisos A) y B) anteriores dentro del plazo de un año calendario, se procederá a imponer como sanción la cancelación de la correspondiente licencia de pesca.

C- Se impondrá la suspensión de la licencia de pesca con efecto extensivo para los demás beneficios por un plazo de 1 mes calendario contados a partir de la firmeza de la sanción, a quién se compruebe ejerciendo las siguientes conductas:

• a)Instalar el dispositivo excluidor de tortugas con una abertura de salida entre 63 y 71 pulgadas.
• b)Instalar el dispositivo excluidor de tortugas con una Falda de 34 o más pulgadas de largo.
• c)Instalar el dispositivo excluidor de tortugas con ángulo mayor a 65 o menor a 25 grados.
• d)No portar dispositivo excluidor de tortugas de repuesto.
• e)Instalar el dispositivo excluidor de tortugas incluyendo el repuesto con materiales no reglamentados.
• f)Instalar el dispositivo excluidor de tortugas con el cocido lateral de la falda mayor o igual a 10 pulgadas.
• g)Instale inadecuadamente boyas que interfieran con la salida de tortugas.

De igual manera se impondrá una suspensión al capitán de la embarcación de inhabilitación de un mes calendario para ejercer sus funciones como tal ante la Capitanía de Puerto e INCOPESCA, sin demérito de la responsabilidad patronal.

D- Se impondrá la suspensión de la licencia de pesca con efecto extensivo para los demás beneficios por un plazo de quince días calendario contados a partir de la firmeza de la sanción, a quién se compruebe ejerciendo las siguientes conductas:

• a)Instalar el dispositivo excluidor de tortugas con una Falda de 28 a 33 pulgadas de largo.
• b)Instalar el dispositivo excluidor de tortugas con un ángulo de más de 55 y menos de 65 grados, o mayor o igual a 20 y menor de 30 grados.
• c)Instalar el dispositivo excluidor de tortugas con un cocido de la falda mayor a 6 y menor a 10 pulgadas.
• d)Colocar el dispositivo excluidor de tortugas sin las boyas reglamentarias.

De presentarse conductas menos gravosas a las establecidas en la presente regulación, se procederá a percibir al permisionario a fin de que de manera inmediata realice la corrección, modificación y ajuste a las disposiciones vigentes en la materia.

Acuerdo firme.

A los efectos de dar cumplimiento a lo dispuesto en la Ley Nº 8325, la Dirección General Técnica y el Departamento de Investigación procederán a realizar los estudios correspondientes que permitan definir las épocas, zonas o áreas en las que deberán utilizarse los dispositivos excluidores de tortugas.
