in the entirety of the text - Complete Text of Norm 35030 Amends for the Wildlife Fund (Fondo de Vida Silvestre, FVS) administered by the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC), the maximum budgetary expenditure set for the year 2009 Complete Text of record: C519D No. 35030-H No. 35030-H THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF FINANCE Based on the powers conferred by articles 140, subsections 3) and 18) and 146 of the Political Constitution; articles 25, subsection 1), 27, subsection 1) and 28, subsection 2), subparagraph b) of Law No. 6227, General Law of the Public Administration of May 2, 1978 and its amendments; Law No. 8131, Law of the Financial Administration of the Republic and Public Budgets of September 18, 2001 and its amendments; its Regulation, Executive Decree No. 32988-H-MP-PLAN of January 31, 2006 and its amendments; Law No. 7317, Wildlife Conservation Law of October 30, 1992 and its amendments; Law No. 7554, Organic Law of the Environment of October 4, 1995 and its amendments; Law No. 7788, Law of Biodiversity of April 30, 1998; Law No. 8691, Law of the Ordinary and Extraordinary Budget of the Republic for the Economic Year 2009 of December 10, 2008 and Executive Decree No. 34404-H of March 5, 2008 and its amendment.

1. 1That through Law No. 7554, Organic Law of the Environment, published in La Gaceta No. 215 of November 13, 1995, it is established that the State must ensure the rational use of environmental elements, in order to protect and improve the quality of life of the inhabitants of the national territory. Likewise, it is obligated to promote economically and environmentally sustainable development, understood as development that satisfies basic human needs, without compromising the options of future generations.
2. 2That through Law No. 7317, published in La Gaceta No. 235 of December 7, 1992, the Wildlife Fund (FWS) was created, administered by the National System of Conservation Areas, as established in the Biodiversity Law No. 7788, published in La Gaceta No. 101 of May 27, 1998.
3. 3That through official communication SINAC-DE-1649 of September 30, 2008, the Director of the National System of Conservation Areas (SINAC), requested to expand the maximum authorized budgetary expenditure for 2009, in order to incorporate into its budget the sum of ¢6,045,000,000.00 (six billion forty-five million exact).
4. 4That the above amount will be covered with resources from a transfer from Law No. 8691, Law of the Ordinary and Extraordinary Budget of the Republic for the Economic Year 2009, published in Supplement No. 56 to La Gaceta No. 253 of December 31, 2008, to meet the needs for acquisition of cages for transporting mammals, wild birds, seizure products, investigations, disease, etc., which will be distributed to each of the conservation areas that make up the national system of areas.
5. 5That through Executive Decree No. 34404-H and its amendment, published in La Gaceta No. 56 of 19 March 2008, the General Budgetary Policy Guidelines for the year 2009 were issued, establishing in article 1 of the aforementioned decree, the maximum budgetary expenditure for that period, for the entities covered by the scope of the Budgetary Authority.
6. 6That through official communication STAP-CIRCULAR-0679-08 of April 7, 2008, the Wildlife Fund was notified of the maximum authorized budgetary expenditure for 2009 of ¢7,530,000,000.00 (seven billion five hundred thirty million exact colones), which does not include the additional expenses referred to in the third considering clause of this decree.
7. 7That through official communication DM-1189-2008 of October 16, 2008, the Minister Rector of the Environment, Energy and Telecommunications Sector, endorsed the request made by the Wildlife Fund (FVS).
8. 8That due to the foregoing, it is necessary to amend the maximum budgetary expenditure set for the Wildlife Fund administered by the National System of Conservation Areas, increasing it by the sum of ¢6,045,000,000.00 (six billion forty-five million exact). Therefore,

en la totalidad del texto - Texto Completo Norma 35030 Modifica para el Fondo de Vida Silvestre (FVS) administrado por el Sistema Nacional de Áreas de Conservación (SINAC), el gasto presupuestario máximo fijado para el año 2009 Texto Completo acta: C519D Nº 35030-H Nº 35030-H EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE HACIENDA Con fundamento en las atribuciones que les confieren los artículos 140, incisos 3) y 18) y 146 de la Constitución Política; los artículos 25, inciso 1), 27, inciso 1) y 28, inciso 2), acápite b) de la Ley Nº 6227, Ley General de la Administración Pública de 2 de mayo de 1978 y sus reformas; la Ley Nº 8131, Ley de la Administración Financiera de la República y Presupuestos Públicos de 18 de setiembre del 2001 y sus reformas; su Reglamento, el Decreto Ejecutivo Nº 32988-H-MP-PLAN de 31 de enero del 2006 y sus reformas; la Ley Nº 7317, Ley de Conservación de la Vida Silvestre del 30 de octubre de 1992 y sus reformas; la Ley Nº 7554, Ley Orgánica del Ambiente del 4 de octubre de 1995 y sus reformas; la Ley Nº 7788, Ley de Biodiversidad del 30 de abril de 1998; Ley Nº 8691, Ley de Presupuesto Ordinario y Extraordinario de la República para el Ejercicio Económico para el año 2009 de 10 de diciembre de 2008 y el Decreto Ejecutivo Nº 34404-H de 05 de marzo de 2008 y su reforma.

1. 1Que mediante la Ley Nº 7554, Ley Orgánica del Ambiente, publicada a La Gaceta Nº 215 del 13 de noviembre de 1995, se establece que el Estado debe velar por la utilización racional de los elementos ambientales, con el fin de proteger y mejorar la calidad de vida de los habitantes del territorio nacional. Asimismo, está obligado a propiciar un desarrollo económico y ambientalmente sostenible, entendido como el desarrollo que satisface las necesidades humanas básicas, sin comprometer las opciones de las generaciones futuras.
2. 2Que mediante la Ley Nº 7317, publicada a La Gaceta Nº 235 del 7 de diciembre de 1992, se crea el Fondo de Vida Silvestre (FVS), administrado por el Sistema Nacional de Áreas de Conservación, según lo establecido en la Ley de Biodiversidad Nº 7788, publicada a La Gaceta Nº 101 del 27 de mayo de 1998.
3. 3Que mediante el oficio SINAC-DE-1649 de 30 de setiembre de 2008, el Director del Sistema Nacional de Áreas de Conservación (SINAC), solicitó ampliar el gasto presupuestario máximo autorizado para el 2009, con el fin de incorporar a su presupuesto la suma de ¢6.045.000.000,00 (seis mil cuarenta y cinco millones exactos).
4. 4Que el monto anterior se cubrirá con recursos provenientes de una transferencia de la Ley Nº 8691, Ley de Presupuesto Ordinario y Extraordinario de la República para el Ejercicio Económico para el año 2009, publicada en el Alcance Nº 56 a La Gaceta Nº 253 de 31 de diciembre de 2008, para solventar las necesidades de adquisición de jaulas para transportar mamíferos, aves silvestres, productos de decomisos, investigaciones, enfermedad, etc, las cuales serán distribuidas a cada una de las áreas de conservación que conforman el sistema nacional de áreas.
5. 5Que mediante el Decreto Ejecutivo Nº 34404-H y su reforma, publicado a La Gaceta Nº 56 de 19 de marzo de 2008, se emitieron las Directrices Generales de Política Presupuestaria para el año 2009, estableciéndose en el artículo 1º del citado decreto, el gasto presupuestario máximo de ese período, para las entidades cubiertas por el ámbito de la Autoridad Presupuestaria.
6. 6Que con el oficio STAP-CIRCULAR-0679-08 de 7 de abril de 2008, se comunicó al Fondo de Vida Silvestre, el gasto presupuestario máximo autorizado para el 2009 por ¢7.530.000.000,00 (siete mil quinientos treinta millones de colones exactos), el cual no contempla los gastos adicionales a que hace referencia el considerando tercero de este decreto.
7. 7Que con el oficio DM-1189-2008 del 16 de octubre de 2008, el señor Ministro Rector del Sector Ambiente, Energía y Telecomunicaciones, avaló la solicitud planteada por el Fondo de Vida Silvestre (FVS).
8. 8Que por lo anterior, resulta necesario modificar el gasto presupuestario máximo fijado para el Fondo de Vida Silvestre administrado por el Sistema Nacional de Áreas de Conservación, incrementándolo en la suma de ¢6.045.000.000,00 (seis mil cuarenta y cinco millones exactos). Por tanto,
