The said minutes read literally as follows:

Dear Sirs/Madams:

By this means, I transcribe to you an agreement taken by the Municipal Council of Osa, in ordinary session No. 31-2008, held on August 6, 2008, which states:

Agreements and motions Agreement 7-By Mr. Jorge Alberto Cole de León, Municipal Mayor of Osa, seconded by the Proprietary Councilmember Jessica Hernández Sanarrusia, which reads literally as follows:

I.-Whereas the modification of the Regulatory Plan of Punta Dominical dates back several years, having been duly endorsed at each of its stages by the competent institutions, ergo the Costa Rican Tourism Institute and this Municipality, as recorded in the various agreements taken in ordinary session 08-05, held on February 23, 2005, ratified on March 2, 2005, and by virtue of the publication stage of the corresponding maps still being pending for its completion, a final procedure that has not been observed by the Administration, it is necessary that this Corporation, as administrator of the maritime-terrestrial zone, contribute to the completion of this process.

II.-That the Municipality, as part of the Public Administration, must abide by the Principle of Singular Non-Derogability of Acts (Principio de Inderogabilidad Singular de los Actos), whose main meaning, except for exceptions exhaustively stated in Law, prohibits the possibility of issuing acts contrary to those previously dictated by it. In the event of non-compliance with the scope of this principle, it is empowered by the Principle of Self-Protection (Principio de Autotutela) to review the acts dictated in contravention of the foregoing and to restore the situation to its original state.

III.-That agreement No. 5 of Chapter III, adopted by this Municipal Council, in extraordinary session No. 13-2008, held on July 7, 2008, was issued without considering the existence of previous acts issued by the Municipal Administration itself, which demonstrate an intent different from that referenced in said agreement-, among others, official communication DAM-ALCAOSA-141-2008, signed by the Municipal Mayor and addressed to the Director of Urban Planning of INVU. In this sense, this agreement No. 5 constitutes an unjustified impediment to achieving the purpose noted in the first whereas clause, as it makes it conditional on the fulfillment of a future and uncertain assumption that matches a requirement lacking any legal support whatsoever, in which case it contravenes the mandates imposed on the Administration by the Law for the Protection of Citizens from Excessive Requirements and Administrative Procedures No. 8220. Therefore:

Having considered the foregoing considerations, the Municipal Council of Osa agrees:

1-To render without effect agreement No. 5, of Chapter III, adopted in extraordinary session No. 13-2008, held on July 7, 2008.

2-In application of Article 21 of Law No. 6043, to approve the content of the maps corresponding to the final procedure of Modification or Land-Use Change (Cambio de Uso de Suelo) of the Regulatory Plan of the Coastal Sector of Punta Dominical and to authorize their corresponding publication.

3-To authorize the Municipal Administration to execute all pertinent actions to conclude the modification process of the Regulatory Plan of the Coastal Sector of Punta Dominical.

4-To inform the Urban Planning Directorate (Dirección de Urbanismo) of the Instituto Nacional de Vivienda y Urbanismo, as well as the Macroprocess of Planning and Development (Macroproceso de Planeamiento y Desarrollo) of the Costa Rican Tourism Institute, of this agreement, in order to request their collaboration in everything that this procedure entails so as to finalize this process and thus guarantee the municipal domain over this zone in accordance with what is established by the Constitution of the Republic and the same Law No. 6043. To dispense with the commission procedure and declare the agreement definitively approved.

Once the present agreement was known and analyzed, the Municipal Council submitted it to a vote and agreed to approve it definitively by means of the votes of the Proprietary Councilmembers Alba Cerdas Aguilar; Jessica Hernández Sanarrusia, Sonia Segura Matamoros and Marvin Antonio Loría Murillo. It is not omitted to state that this vote presents one vote against from the Proprietary Councilmember Daisy Anchía Angulo. Therefore, the Municipal Council of Osa agrees to render without effect agreement No. 5, of Chapter III, adopted in extraordinary session No. 13-2008, held on July 7, 2008. Furthermore, in application of Article 21 of Law No. 6043, the content of the maps corresponding to the final procedure of Modification or Land-Use Change (Cambio de Uso de Suelo) of the Regulatory Plan of the Coastal Sector of Punta Dominical is approved and their corresponding publication is authorized. In the same manner, the Municipal Administration is authorized to execute all pertinent actions to conclude the modification process of the Regulatory Plan of the Coastal Sector of Punta Dominical. And finally, proceed to inform the Urban Planning Directorate (Dirección de Urbanismo) of the Instituto Nacional de Vivienda y Urbanismo, as well as the Macroprocess of Planning and Development (Macroproceso de Planeamiento y Desarrollo) of the Costa Rican Tourism Institute, of this agreement, in order to request their collaboration in everything that this procedure entails so as to finalize this process and thus guarantee the municipal domain over this zone in accordance with what is established by the Constitution of the Republic and the same Law No. 6043. Notify the Costa Rican Tourism Institute, via fax No. 231-0311; the Instituto Nacional de Vivienda y Urbanismo, to fax No. 257-1220 (Máster Leonel Rosales Maroto), as well as Mr. Jorge Alberto Cole de León, Municipal Mayor of Osa, and Isabel Chaves Bonilla, Head of the Maritime-Terrestrial Zone Department. That is all.

The present document is issued, in Ciudad Cortés, at twelve hours and thirteen minutes on February thirteenth, two thousand nine, at the request of the interested party.

Estimados sr. (as):

Por este medio transcribo a su persona acuerdo tomado por el Concejo Municipal de Osa, en sesión ordinaria Nº 31-2008, celebrada el día 6 de agosto del 2008, el cual dice:

Acuerdos y mociones Acuerdo 7º-Del Señor Jorge Alberto Cole de León, Alcalde Municipal de Osa, acogido por la Regidora Propietaria Jessica Hernández Sanarrusia, el cual dice literalmente así:

I.-Siendo que la modificación del Plan Regulador de Punta Dominical, data de varios años, habiéndose avalado oportunamente en cada una de sus etapas, por las instituciones competentes, ergo Instituto Costarricense de Turismo y esta Municipalidad como así consta en los distintos acuerdos tomados en sesiones ordinaria 08-05, celebrada el 23 de febrero del 2005, ratificada el 2 de marzo del 2005 y en virtud de estar pendiente para su finalización, la etapa de publicación de los mapas correspondientes, trámite último que no ha sido observado por la Administración, resulta menester que esta Corporación, como administradora de la zona marítima terrestre, coadyuve en la finalización de este proceso.

II.-Que la Municipalidad como parte de la Administración Pública, debe estarse al Principio de Inderogabilidad Singular de los Actos, cuya acepción principal, salvo excepciones taxativamente señaladas en Ley, le veda la posibilidad de emitir actos contrarios a los dictados previamente por ella. De incumplir los alcances de ese principio, se encuentra facultada por el Principio de Autotutela, para revisar los actos dictados en contraposición de lo expuesto y restituir la situación a su estado original III.-Que el acuerdo Nº 5 del Capítulo III, adoptado por este Concejo Municipal, en sesión extraordinaria Nº 13-2008, celebrada el día 7 de julio del 2008, fue dictado, sin reparar en la existencia de actos previos dictados por la Propia Administración Municipal, que evidencian una voluntad distinta de la referida en dicho acuerdo-, entre otros, oficio DAM-ALCAOSA-141-2008, suscrito por el señor Alcalde Municipal y dirigida al Director de Urbanismo del INVU. En este sentido, este acuerdo Nº 5, constituye un impedimento injustificado para alcanzar la finalidad apuntada en el considerando primero, toda vez que lo supedita al cumplimiento de un supuesto futuro e incierto, que concuerda con un requisito que no encuentra soporte jurídico alguno, en cuyo caso, se contrapone a las ordenanzas que le impone a la Administración, la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos Nº 8220. Por tanto:

Vistas las anteriores consideraciones, el Concejo Municipal de Osa, acuerda:

1º-Dejar sin efecto el acuerdo Nº 5, del Capítulo III, adoptado en sesión extraordinaria Nº 13-2008, celebrada el día 7 de julio del 2008.

2º-En aplicación del artículo 21 de la Ley Nº 6043, aprobar el contenido de los mapas, correspondientes al trámite final de Modificación o Cambio de Uso de Suelo del Plan Regulador del Sector Costero de Punta Dominical y autorizar su correspondiente publicación.

3º-Autorizar a la Administración Municipal, para que ejecute la totalidad de acciones pertinentes, a efecto de concluir el proceso de modificación del Plan Regulador del Sector Costero de Punta Dominical.

4º-Informar a la Dirección de Urbanismo del Instituto Nacional de Vivienda y Urbanismo, así como al Macroproceso de Planeamiento y Desarrollo del Instituto Costarricense de Turismo, del presente acuerdo, a fin de solicitar su coadyuvancia en todo lo que el presente trámite implique a fin de finalizar este proceso y así garantizar el dominio municipal sobre esta zona de conformidad con lo establecido por la Constitución de la República y la misma Ley Nº 6043. Que se dispense de trámite de comisión y se declare acuerdo definitivamente aprobado.

Una vez conocido y analizado el presente acuerdo, el Concejo Municipal, lo somete a votación y acuerda aprobarlo de manera definitiva por medio de los votos de los Regidores Propietarios Alba Cerdas Aguilar; Jessica Hernández Sanarrusia, Sonia Segura Matamoros y Marvin Antonio Loría Murillo. No se omite manifestar que tal votación presenta un voto en contra por parte de la Regidora Propietaria Daisy Anchía Angulo. Por tanto el Concejo Municipal de Osa, acuerda dejar sin efecto el acuerdo Nº 5, del Capítulo III, adoptado en sesión extraordinaria Nº 13-2008, celebrada el día 7 de julio del 2008. Además en aplicación del artículo 21 de la Ley Nº 6043, se aprueba el contenido de los mapas, correspondientes al trámite final de Modificación o Cambio de Uso de Suelo del Plan Regulador del Sector Costero de Punta Dominical y autorizar su correspondiente publicación. Del mismo modo se autoriza a la Administración Municipal, para que ejecute la totalidad de las acciones pertinentes, a efecto de concluir el proceso de modificación del Plan Regulador del Sector Costero de Punta Dominical. Y por último procédase a informar a la Dirección de Urbanismo del Instituto Nacional de Vivienda y Urbanismo, así como al Macroproceso de Planeamiento y Desarrollo del Instituto Costarricense de Turismo, del presente acuerdo, a fin de solicitar su coadyuvancia en todo lo que el presente trámite implique a fin de finalizar este proceso y así garantizar el dominio municipal sobre esta zona de conformidad con lo establecido por la Constitución de la República y la misma Ley Nº 6043. Comuníquese al Instituto Costarricense de Turismo, por medio del fax Nº 231-0311; Instituto Nacional de Vivienda y Urbanismo, al fax Nº 257-1220 (Máster Leonel Rosales Maroto), así como al señor Jorge Alberto Cole de León, Alcalde Municipal de Osa y a Isabel Chaves Bonilla, Encargada del Departamento de Zona Marítimo Terrestre. Es todo.

Se extiende la presente solicitud, en Ciudad Cortés, a las doce horas y trece minutos del trece de febrero del dos mil nueve, a solicitud del interesado.
