1. 1That by Law No. 6877, published in La Gaceta No. 143 of 29 July 1983, the National Groundwater, Irrigation and Drainage Service (Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento, SENARA) was created, whose objectives, among others, are to promote the agricultural development of the country, through the establishment and operation of irrigation, drainage, and flood control systems, to contribute to preferentially developing those agricultural development projects that are based on a just distribution of land, and to seek that in the territory benefited by the creation of irrigation and drainage districts, a rational and democratic modification in land ownership is carried out.
2. 2That by official letter No. GE-627-08 of 2 October 2008, the General Manager of the Service requests to increase the maximum budgetary expenditure for 2009, by the sum of ¢1,845,000,000.00 (one billion eight hundred forty-five million exact colones), of which, ¢1,442,200,000.00 (one billion four hundred forty-two million two hundred thousand exact colones), will be used for the National Basic Grains Plan and ¢402,800,000.00 (four hundred two million eight hundred thousand exact colones), for operating expenses of the institution from the services and materials and supplies line items.
3. 3That the resources come from a transfer from Law No. 8691, Ordinary and Extraordinary Budget Law of the Republic for the 2009 Fiscal Year, published in Supplement No. 56 to La Gaceta No. 253 of 31 December 2008, for ¢3,170,262,007.00 (three billion one hundred seventy million two hundred sixty-two thousand seven exact colones), to cover the National Basic Grains Plan and institutional operating expenses.
4. 4That by Executive Decree No. 34404-H and its amendment, published in La Gaceta No. 56 of 19 March 2008, the General Budgetary Policy Guidelines for the year 2009 were issued, establishing in article 1 of the cited decree, the maximum budgetary expenditure for the year 2009, for the entities covered by the scope of the Budgetary Authority.
5. 5That by official letter No. STAP CIRCULAR 0670-08 of 8 April 2008, SENARA was notified of the maximum budgetary expenditure set for the year 2008, for the sum of ¢2,049,500,000.00 (two billion forty-nine million five hundred thousand exact colones), which does not include the additional resources indicated in the second considering clause of this decree.
6. 6That by official letter No. DM-1281-88 of 20 November 2008, the Minister responsible for the Productive Sector endorses the request made by SENARA.
7. 7That due to the foregoing, it is necessary to modify the maximum budgetary

1. 1Que mediante la Ley Nº 6877, publicada a La Gaceta Nº 143 de 29 de julio de 1983, se crea el Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA), cuyos objetivos, entre otros, son fomentar el desarrollo agropecuario del país, mediante el establecimiento y funcionamiento de sistemas de riego, avenamiento y protección contra inundaciones, contribuir a desarrollar preferentemente aquellos proyectos de desarrollo agropecuario que se sustenten en una justa distribución de la tierra y procurar que en el territorio beneficiado por la creación de distritos de riego y avenamiento, se efectúe una modificación racional y democrática en la propiedad de la tierra.
2. 2Que mediante oficio Nº GE-627-08 de 2 de octubre del 2008, el Gerente General del Servicio, solicita ampliar el gasto presupuestario máximo para 2009, por la suma de ¢1.845.000.000,00 (mil ochocientos cuarenta y cinco millones de colones exactos), de los cuales, ¢1.442.200.000,00 (mil cuatrocientos cuarenta y dos millones doscientos mil colones exactos), se utilizarán para el Plan Nacional de Granos Básicos y ¢402.800.000,00 (cuatrocientos dos millones ochocientos mil colones exactos), para gastos operativos de la institución de las partidas de servicios y de materiales y suministros.
3. 3Que los recursos provienen de una transferencia de la Ley Nº 8691, Ley de Presupuesto Ordinario y Extraordinario de la República para el Ejercicio Económico para el año 2009, publicada en el Alcance Nº 56 a La Gaceta Nº 253 de 31 de diciembre del 2008, por ¢3.170.262.007,00 (tres mil ciento setenta millones doscientos sesenta y dos mil siete colones exactos), para cubrir el Plan Nacional de Granos Básicos y los gastos operativos institucionales.
4. 4Que mediante el Decreto Ejecutivo Nº 34404-H y su reforma, publicado a La Gaceta Nº 56 de 19 de marzo del 2008, se emitieron las Directrices Generales de Política Presupuestaria para el año 2009, estableciéndose en el artículo 1 del citado decreto, el gasto presupuestario máximo del año 2009, para las entidades cubiertas por el ámbito de la Autoridad Presupuestaria.
5. 5Que con oficio Nº STAP CIRCULAR 0670-08 de 8 de abril del 2008, se comunicó al SENARA, el gasto presupuestario máximo fijado para el año 2008, por la suma de ¢2.049.500.000,00 (dos mil cuarenta y nueve millones quinientos mil colones exactos), la cual no contempla los recursos adicionales señalados en el considerando segundo de este decreto.
6. 6Que con el oficio Nº DM-1281-88 de 20 de noviembre del 2008, el señor Ministro rector del Sector Productivo avala la solicitud planteada por el SENARA.
7. 7Que por lo anterior, resulta necesario modificar el gasto presupuestario máximo fijado para el Servicio para el 2009, incrementándolo en la suma de ¢1.845.000.000,00 (mil ochocientos cuarenta y cinco millones de colones exactos). Por tanto,
