No. 123.-San José, November 25, 2008 THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF THE PRESIDENCY In execution of the provisions of the Government Council in the sole agreement recorded in article five of the record of ordinary session number one hundred thirteen, held on October eight, two thousand eight, AGREE:
Whereas: 1st-That the Government Council, as recorded in article three of the record corresponding to ordinary session number seven, held on June twenty-first, two thousand six, proceeded to appoint the members of the Board of Directors of the National Service for Groundwater, Irrigation and Drainage (SENARA), as follows: Alfredo Volio Pérez, ID card 1-545-822, Minister of Agriculture and Livestock, who will preside over it until May 8, 2010; Octavio Jiménez Pinto, ID card 9-036-980; Carlos Dengo Garrón, ID card 1-861-352; Jaime Villalobos Vargas, ID card 4-095-207; Carlos Manuel González Alvarado, ID card 1-160-660; Saúl Cárdenas Vásquez, ID card 5-170-439, representing the Cooperative Movement, chosen from a shortlist composed of Messrs. Saúl Cárdenas Vásquez, ID card 5-170-439; Jesús Villalobos Gamboa, ID card 2-329-038 and Félix Cabezas Várela, ID card 5-0191-0049; sent for that purpose by Mr.

Said agreement indicated that these appointments were effective as of June 21, 2006 and for the remainder of the corresponding legal period, that is, until May 31, 2010 in the case of the 4 (four) members designated by the Government Council, and until May 31, 2008, in the case of the remaining 2 (two) members.
José Manuel González Ramírez, General Secretary of the Agrarian Union of the Palmar Río Frío Settlement, by means of a writing dated October 4, 2008, filed an amparo (amparo) appeal before the Constitutional Chamber seeking to have the agreement of the Government Council contained in article three of the record of ordinary session number 7, held on June 21, 2006, declared null and void.

As representative of the peasant federations legally registered with the Ministry of Labor and Social Security, Ms. Victoria Viales Bustos is appointed, holder of identity card seven-zero seventy seven-three hundred twenty-nine, who was chosen from the shortlist prepared by the Rerum Novarum Workers Confederation and communicated via official letter CTRN-No. 423-2008 of September 3, 2008, signed by the President of that Confederation, Mr. Rodrigo Aguilar Arce, in which, in addition to Ms. Victoria Viales Bustos, Mr. Adrián Soto Pérez, holder of identity card number two-five hundred seventeen-two hundred eighty-six, and Mr. Melvin Chavarría Rojas, holder of identity card number five-two hundred fifty two-one hundred ninety-three, were proposed. En dicho acuerdo se indicó que estos nombramientos regían a partir del 21 de junio del 2006 y por el resto del periodo legal correspondiente, sea hasta el 31 de mayo del 2010 en el caso de los 4 (cuatro) miembros designados por el Consejo de Gobierno, y hasta el 31 de mayo del 2008, en el caso de los restantes 2 (dos) miembros.

Este nombramiento rige a partir del día de hoy y hasta el treinta y uno de mayo del dos mil diez. Como representante de las federaciones campesinas legalmente inscritas en el Ministerio de Trabajo y Seguridad Social, se nombra a la señora Victoria Viales Bustos, portadora de la cédula de identidad siete-cero setenta y siete-trescientos veintinueve, quien fue elegida de la terna confeccionada por la Confederación de Trabajadores Rerum Novarum y comunicada mediante oficio CTRN-Nº 423-2008 de 3 de setiembre del 2008, suscrito por el Presidente de esa Confederación el señor Rodrigo Aguilar Arce, en las que además de la señora Victoria Viales Bustos se propuso al señor Adrián Soto Pérez, portador de la cédula de identidad número dos-quinientos diecisiete-doscientos ochenta y seis y al señor Melvin Chavarría Rojas, portador de la cédula de identidad número cinco-doscientos cincuenta y dos-ciento noventa y tres.
