Considering: 1st—That the Governing Council, as recorded in article three of the minutes corresponding to ordinary session number seven, held on June twenty-one, two thousand six, proceeded to appoint the members of the Board of Directors of the National Groundwater, Irrigation, and Drainage Service (Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento, SENARA), as follows: Alfredo Volio Pérez, ID 1-545-822, Minister of Agriculture and Livestock, who shall preside until May 8, 2010; Octavio Jiménez Pinto, ID 9-036-980; Carlos Dengo Garrón, ID 1-861-352; Jaime Villalobos Vargas, ID 4-095-207; Carlos Manuel González Alvarado, ID 1-160-660; Saúl Cárdenas Vásquez, ID 5-170-439, representing the Cooperative Movement, elected from a slate (terna) composed of Messrs. Saúl Cárdenas Vásquez, ID 5-170-439; Jesús Villalobos Gamboa, ID 2-329-038; and Félix Cabezas Várela, ID 5-0191-0049; sent for that purpose by Mr. Víctor H. Said agreement indicated that these appointments were effective as of June 21, 2006, and for the remainder of the corresponding legal period, that is, until May 31, 2010, in the case of the 4 (four) members appointed by the Governing Council, and until May 31, 2008, in the case of the remaining 2 (two) members.
2nd—That Mr. José Manuel González Ramírez, Secretary General of the Agrarian Union of the Palmar Río Frío Settlement, by means of a writing dated October 4, 2008, filed a writ of amparo (recurso de amparo) before the Constitutional Chamber seeking a declaration of nullity of the Governing Council agreement contained in article three of the minutes of ordinary session number 7, held on June 21, 2006.
3rd—That the Constitutional Chamber of the Supreme Court of Justice, through ruling 2008-12582, corresponding to expediente 06-12255-0007-CO, granted said writ and annulled the aforementioned Governing Council agreement. The Governing Council agrees: Based on resolution 2008-12582, which annulled the agreement made by the Governing Council recorded in article three of the minutes of ordinary session number seven, held on June twenty-one, two thousand six, and on the provisions contained in Article 5 of Ley Nº 6877 of July 18, 1983, which creates the National Groundwater, Irrigation, and Drainage Service (Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento, SENARA), the Board of Directors of SENARA is integrated with the following members: The Minister of Agriculture and Livestock, Mr. Javier Flores Galarza, bearer of identity card number one-four hundred seventeen-nine hundred eight, who shall preside; Mr. Jaime Villalobos Vargas, bearer of identity card number four-zero ninety five-two hundred seven; Mr. Carlos Dengo Garrón, bearer of identity card number one-eight hundred sixty one-three hundred fifty two; Ms. Gloria Abraham Peralta, bearer of identity card number one-four hundred sixteen-zero fifty six; and Ms. Carolina Delgado Ramírez, bearer of identity card number one-seven hundred eighty five-nine hundred seventeen; who shall serve in their positions as of today and until May eight, two thousand ten. As representative of the Cooperative Sector, Mr. Edgardo Araya Gamboa is appointed, bearer of identity card number two-two hundred seventy seven-four hundred eighteen, who was elected from the slate (terna) prepared by the National Council of Cooperatives and communicated via official letter SE-387-2008 of September 8, 2008, signed by the executive secretary of that Council, Mr. Rigoberto Sánchez Bolaños, in which, in addition to Mr. Edgardo Araya Gamboa, Mr. Francisco Renick González was proposed, bearer of identity card number two-three hundred twenty seven-four hundred eighty one, and Ms. Ivannia Quesada Villalobos, bearer of identity card number two-five hundred-two hundred thirty seven. This appointment is effective as of today and until May thirty-one, two thousand ten.
