I.-That Article 32 of the Associations Law No. 218 of August 8, 1939 and its amendments, confers upon the Executive Branch the power to declare of Public Utility those simple Associations, federated or confederated, whose development and activities are particularly useful for the interests of the State, and therefore contribute to addressing a social need.

II.-That the Administrative Association of the Integrated Aqueduct of San Antonio Mollejones de Pejiballe of the Canton of Pérez Zeledón, legal identification number three-zero zero two-two hundred three thousand three hundred seventy-three, was registered in the Associations Registry of the Public Registry since May 28, 1997, under file No. 8599.

III.-That the purposes pursued by the Association, according to Article Three of its Bylaws, are: "(...) Article Three: The purposes of the Association are the following: a- The construction, operation, and reconstruction of the aqueduct system for the communities of San Antonio and Mollejones de Pejibaye de Pérez Zeledón in San José. b) To administer, operate, and maintain in good condition the aqueduct, in accordance with the provisions and Regulations issued in this regard by the Costa Rican Institute of Aqueducts and Sewers (Instituto Costarricense de Acueductos y Alcantarillados), hereinafter AyA. c) To obtain effective participation from the community, in the construction and maintenance of the aqueduct. d) To carry out and, where appropriate, collaborate with other organizations, on educational programs and campaigns related to the rational use and sustainability of the aqueduct system. e) To help explain and disseminate within the community the provisions and Regulations of AyA. f) To cooperate with the plans, projects, and works undertaken by AyA in the community. g) To participate in the surveillance and protection of the aqueduct's supply sources, prevent their contamination, and assist in the protection of the hydrographic basins of the region (...)" IV.-That such purposes address a social need of the highest order, for which they deserve the support of the Costa Rican State. Therefore, THEY DECREE:

I.-Que el artículo 32 de la Ley de Asociaciones número 218 de ocho de agosto de mil novecientos treinta y nueve y sus reformas, confiere al Poder Ejecutivo la potestad de declarar de Utilidad Pública a las Asociaciones simples, federadas o confederadas, cuyo desarrollo y actividades sean particularmente útiles para los intereses del Estado, y que por ello contribuyan a solventar una necesidad social.

II.-Que la Asociación Administradora del Acueducto Integrado de San Antonio Mollejones de Pejiballe del Cantón de Pérez Zeledón, cédula jurídica número tres-cero cero dos-doscientos tres mil trescientos setenta y tres, se inscribió en el Registro de Asociaciones del Registro Público desde el veintiocho de mayo de mil novecientos noventa y siete, bajo el expediente Nº 8599.

III.-Que los fines que persigue la Asociación, según el artículo tercero de sus Estatutos, son: "(...) Artículo Tercero: Los fines de la Asociación son los siguientes: a- La construcción, operación y reconstrucción del sistema de acueducto de las comunidades de San Antonio y Mollejones de Pejibaye de Pérez Zeledón de San José. b) Administrar, operar y conservar en buenas condiciones el acueducto, de acuerdo con las disposiciones y Reglamentos que al respecto emita el Instituto Costarricense de Acueductos y Alcantarillados, en adelante AyA. c) Obtener la participación efectiva de la comunidad, en la construcción y mantenimiento del acueducto. d) Realizar y en su caso colaborar con otros organismos, en los programas y campañas de índole educativas relacionadas con el uso racional y la sostenibilidad del sistema de acueducto. e) Ayudar a explicar y divulgar en la comunidad las disposiciones y Reglamentos de A y A. f) Cooperar con los planes, proyectos y obras que emprenda A y A en la comunidad. g) Participar en la vigilancia y protección de las fuentes de abastecimiento del acueducto, evitar las contaminaciones de aquellas y ayudar a la protección de las cuencas hidrográficas de la región (...)" IV.-Que tales fines solventan una necesidad social de primer orden, por lo cual merecen el apoyo del Estado Costarricense. Por tanto,
