in the entirety of the text - Full Text of Standard 34863 Update of the area of the Urban Quadrants of the District Capitals of Pacayas and Capellades of the Canton of Alvarado, Cartago, located in the Special Protection Zone of the GAM Full Text record: C0F8C No. 34863-MP-MIVAH No. 34863-MP-MIVAH THE PRESIDENT OF THE REPUBLIC, THE MINISTER OF THE PRESIDENCY AND THE MINISTER OF HOUSING AND HUMAN SETTLEMENTS In exercise of the powers conferred by subsection 18) of Article 140 and 146 of the Political Constitution, Article 28, second paragraph, subsection b) of the General Public Administration Law (Law No. 6227 of May 2, 1978); the Urban Planning Law (Law No. 4240 of November 15, 1968); Executive Decree No. 25902-MIVAH-MP-MINAE of February 12, 1997, published in Supplement No. 15 to La Gaceta No. 66 of April 7, 1997; General Regulation for Urban Development in the Urban Quadrants enabled by Executive Decree No. 25902-MIVAH-MP-MINAE, published in Supplement No. 92 to La Gaceta No. 244 of December 20, 2000; Urban Planning Agreements and Instruments issued by the INVU Board of Directors based on the technical recommendations of its Urban Planning Directorate; and

1. 1That through an agreement adopted by the Board of Directors of the National Institute of Housing and Urban Planning, as recorded in Article II, subsection 2) of the minutes of ordinary session No. 5677, held on June 11, 2008, as reported through official letter No. C.J.D 072-2008 of June 18, 2008, signed by the President of the Board of Directors of the National Institute of Housing and Urban Planning, it is reported that the Municipality of the canton of Alvarado, Cartago, does not have a Regulatory Plan, for which reason, in coordination with the National Institute of Housing and Urban Planning (INVU), it agreed to carry out efforts to analyze the possibilities of updating the Urban Growth Area of the GAM for the district capitals of Pacayas and Capellades, in accordance with the Agreement of the Municipal Council, ordinary session No. 82 of December 3, 2007.
2. 2That, as indicated in the Agreement adopted by the Board of Directors of the National Institute of Housing and Urban Planning, as recorded in Article II, subsection 2) of the minutes of ordinary session No. 5677, held on June 11, 2008, as reported through official letter No. C.J.D 072-2008 of June 18, 2008, signed by the President of the Board of Directors of said Institute, the Urban Planning Directorate, in coordination with officials of the Municipality of Alvarado, carried out field inspections and technical studies in early 2008, which included topography, hydrology, road linkages, well protection, vegetation cover, and services.
3. 3That, in accordance with the agreement adopted by the Board of Directors of the National Institute of Housing and Urban Planning, as cited in the preceding paragraph, the district capitals of Capellades and Pacayas have experienced unplanned linear growth, for which the update proposal aims to identify lands near these urban areas with growth potential, in order to provide housing for the population of these localities with a view to accommodating the natural growth of their population.
4. 4That the Urban Planning Directorate requested technical studies from the Urban Planning Project for the Greater Metropolitan Area (PRUGAM) as the entity responsible for updating the GAM Plan, thereby using the Environmental Fragility Indices, as indicated in the cited agreement of the Board of Directors of the National Institute of Housing and Urban Planning.
5. 5That, according to the cited official letter, PRUGAM, within its competence for updating the GAM Plan and as a body attached to the Urban Planning Directorate, according to Official Letter PRUGAM-0231-08 of April 17, 2008, recommended carrying out a study of greater depth and scale detail, in accordance with the SETENA Protocol, for which the review and approval of the environmental fragility indices of the canton of Alvarado will be considered.
6. 6That the creation of articulated, delimited, and planned urban centers is clearly necessary, considering social, environmental, and infrastructure aspects, defining new expansion centers, and not promoting linear developments, which are evidently inconvenient, not only for urban development but also for the Protection Areas, all in accordance with the provisions of Articles 1 and 25 of the Urban Planning Law.
7. 7That, in accordance with official letter No. C.J.D 072-2008 of June 18, 2008, signed by the President of the Board of Directors of the National Institute of Housing and Urban Planning, the Urban Planning Directorate presented the studies justifying the update of the urban quadrants of the district capitals of Capellades and Pacayas of the canton of Alvarado, Cartago, as well as the corresponding maps.
8. 8That, according to information from the National Institute of Housing and Urban Planning, the Municipality of Alvarado, in ordinary session No. 107 of June 9, 2008, Chapter I), Article 2), subsection 3), approved the update proposal for the quadrants of Capellades and Pacayas prepared by the Urban Planning Directorate of the INVU.
9. 9That, according to Official Letter No. PRUGAM-0315-2008 of July 5, 2008, in the preparation of the Regulatory Plan for the canton of Alvarado, Cartago, the PRUGAM Project will take into account the provision agreed upon by the INVU and approved by the respective Municipality, which defines the urban containment limits of the municipality.

10.-That, based on the foregoing considerations, the National Institute of Housing and Urban Planning unanimously approved the update of the Urban Quadrants of the district capitals of Capellades and Pacayas of the canton of Alvarado, Cartago, in the GAM protection zone, as presented by the Urban Planning Directorate, which must be in accordance with the parameters established in Executive Decree No. 25902-MIVAH-MP-MINAE and the General Regulation for Urban Development in the urban quadrants enabled by said decree, endorsed by the Urban Planning Directorate and the Board of Directors of the National Institute of Housing and Urban Planning. Therefore,

1. 1Que a través de acuerdo adoptado por la Junta Directiva del Instituto Nacional de Vivienda y Urbanismo, según consta en el Artículo II, inciso 2) del acta de la sesión ordinaria Nº 5677, celebrada el 11 de junio del 2008, según se informa a través de oficio Nº C.J.D 072-2008 de 18 de junio del 2008, suscrito por el Presidente de la Junta Directiva del Instituto Nacional de Vivienda y Urbanismo, se informa que la Municipalidad del cantón de Alvarado de Cartago, no cuenta con Plan Regulador, por lo que en coordinación con el Instituto Nacional de Vivienda y Urbanismo (INVU), acordó realizar gestiones con el propósito de analizar las posibilidades de actualizar el Área de Crecimiento Urbano de la GAM para las cabeceras de distrito de Pacayas y Capellades, esto según Acuerdo del Consejo Municipal, sesión ordinaria N° 82 del 3 de diciembre del 2007.
2. 2Que tal y como señala el Acuerdo adoptado por la Junta Directiva del Instituto Nacional de Vivienda y Urbanismo, según consta en el Artículo II, inciso 2) del acta de la sesión ordinaria Nº 5677, celebrada el 11 de junio del 2008, según se informa a través de oficio Nº C.J.D 072-2008 de 18 de junio del 2008, suscrito por el Presidente de la Junta Directiva de dicho Instituto, la Dirección de Urbanismo en coordinación con funcionarios de la Municipalidad de Alvarado realizó inspecciones de campo y estudios técnicos a principios del año 2008, que comprendieron la topografía, hidrología, amarres viales, protección de pozos, cobertura vegetal y servicios.
3. 3Que de conformidad con el acuerdo adoptado por la Junta Directiva del Instituto Nacional de Vivienda y Urbanismo, según se cita en el numeral precedente, las Cabeceras de distrito de Capellades y Pacayas han experimentado un crecimiento lineal sin planificación, para lo cual la propuesta de actualización tiene como objetivo identificar los terrenos cerca de estas áreas urbanas con posibilidades de crecimiento, para dotar de vivienda a la población de estas localidades con miras a atender el crecimiento vegetativo de su población.
4. 4Que la Dirección de Urbanismo solicitó los estudios técnicos al Proyecto de Planificación Urbana para la Gran Área Metropolitana (PRUGAM) como ente responsable de la actualización del Plan GAM, utilizando al efecto los Índices de Fragilidad Ambiental, según se indica en el acuerdo citado de la Junta Directiva del Instituto Nacional de Vivienda y Urbanismo.
5. 5Que acorde con el oficio de cita, el PRUGAM dentro de su competencia de actualización del Plan GAM y como órgano adscrito a la Dirección de Urbanismo, según Oficio PRUGAM-0231-08 de 17 de abril del 2008, recomendó realizar conforme el Protocolo de SETENA un estudio de mayor profundidad y detalle de escala, para lo que se tomará en consideración la revisión y aprobación de los índices de fragilidad ambiental del cantón de Alvarado.
6. 6Que resulta de evidente necesidad la creación de centros urbanos articulados, delimitados y planificados, considerando aspectos sociales y ambientales, de infraestructura, definiendo nuevos centros de expansión, y no promoviendo desarrollos lineales, los cuales resultan a todas luces inconvenientes, no. solo para el desarrollo urbano sino también para las Áreas de Protección, todo de conformidad con lo establecido en los artículos 1 y 25 de la Ley de Planificación Urbana.
7. 7Que de conformidad con el oficio Nº C.J.D 072-2008 de 18 de junio del 2008, suscrito por el Presidente de la Junta Directiva del Instituto Nacional de Vivienda y Urbanismo, la Dirección de Urbanismo presentó los estudios que justifican la actualización de los cuadrantes urbanos de las Cabeceras de distrito de Capellades y Pacayas del cantón de Alvarado de Cartago, así como los planos correspondientes.
8. 8Que según se informa por parte del Instituto Nacional de Vivienda y Urbanismo, la Municipalidad de Alvarado en sesión ordinaria N° 107 de 09 de junio del 2008, Capítulo I), Artículo 2), inciso 3), aprobó la propuesta de actualización de los cuadrantes de Capellades y Pacayas realizada por la Dirección de Urbanismo del INVU.
9. 9Que conforme Oficio N° PRUGAM-0315-2008 de 05 de julio del 2008, en la elaboración del Plan Regulador del cantón de Alvarado de Cartago, el Proyecto PRUGAM tomará en cuenta la disposición acordada por el INVU y aprobada por la Municipalidad respectiva que define los límites de contención urbana del municipio.

10.-Que por las anteriores consideraciones, el Instituto Nacional de Vivienda y Urbanismo, aprobó por unanimidad la actualización de los Cuadrantes Urbanos de las Cabeceras de distrito de Capellades y Pacayas del cantón de Alvarado de Cartago en la zona de protección del GAM, según fue presentada por la Dirección de Urbanismo la que debe darse en concordancia con los parámetros establecidos en el Decreto Ejecutivo Nº 25902-MIVAH-MP-MINAE y el Reglamento General de Desarrollo Urbano en los cuadrantes urbanos que habilita ese decreto, avalada por la Dirección de Urbanismo y la Junta Directiva del Instituto Nacional de Vivienda y Urbanismo. Por tanto,
