LETTER OF INTENT ON AGRICULTURAL AND RURAL MATTERS BETWEEN THE MINISTRY OF AGRICULTURE AND FORESTRY OF NICARAGUA AND THE GOVERNMENT OF COSTA RICA, THROUGH THE MINISTRY OF AGRICULTURE AND LIVESTOCK The Ministry of Agriculture and Forestry of Nicaragua and the Government of Costa Rica, through the Ministry of Agriculture and Livestock of Costa Rica, hereinafter "the Parties",

1. That both Ministries understand the importance of cooperation on agricultural and rural matters, as a valuable instrument that constitutes a contribution to the economic and social development of their respective countries; 2. That the exchange of experiences, education, and training in agricultural and rural matters in the public and private sphere will contribute to the improvement of socioeconomic conditions in both countries; 3. That the signing of this Letter of Intent between both Parties reflects the special interest in broadening and deepening mutual knowledge in the field of the agricultural sector; 4. That these efforts represent a significant contribution aimed at fostering greater interaction between the public sectors of both countries, in order to contribute to the improvement of their competitive capacities, to the improvement of the services and public servants of the sector, as well as to facilitate the integration of the agricultural sector and related activities into international markets.

5. The desire of both institutions to establish in the future a broad Cooperation Program on agricultural and rural matters, and 6. That this legal instrument is based on the purposes and principles of the Tegucigalpa Protocol and on Article 8, subsection g) of the Central American Social Integration Treaty, which promotes cooperation among the member States of the Central American Integration System.

HEREBY EXPRESS THEIR FIRM INTENTION TO:

Establish a cooperation mechanism aimed at the development of the institutional capacities of the agricultural and rural sector, such as: research, dissemination, training, and operation of a broad program directed at addressing and promoting the development of the agricultural and rural sector.

Establish a Work Program between the parties, which allows them, in a coordinated manner, to promote and support the development, growth, stability, and global competitiveness of the agricultural and rural sector, being able to count on the collaboration of the private sector, public and private bodies and institutions for its execution, in order to achieve the objective set forth in Article 1.

Implement, through institutional activities, the cooperation to be developed under this Letter of Intent, taking into consideration the provisions of cooperation on agricultural and rural development matters, based on joint technical assistance programs that may include:

a. The joint organization of study visits, consultancies, conferences, seminars, workshops, meetings, exchange of experiences between professionals, technicians, and specialists from the private, academic, and government sectors, to strengthen the development, implementation, and analysis of policies and standards on agricultural and rural matters; b. The facilitation to promote the development and/or exchange of best practices, information, and data, on agricultural and rural matters, likely to be of interest to both Parties; c. The compilation, publication, and exchange of information on policies, laws, standards, regulations, and development indicators for the agricultural and rural sector, as well as on the mechanisms for compliance with legal standards; d. Any other modality agreed upon by the Parties.

Designate as focal points to develop and follow up on the scope of this Letter of Intent, the Heads of International Cooperation of both parties, with the objective of coordinating, as well as defining a stable framework of collaboration for the development of joint programs and projects, which result in mutual benefit and the consolidation of ties between the agricultural sector of both countries.

In this sense, the Parties shall have the following responsibilities:

1. Develop a work program to promote the implementation of the Letter of Intent.

2. Establish the appropriate follow-up mechanisms to achieve the objectives of this Letter of Intent and exchange information on the progress of cooperation programs, projects, and activities; 3. Evaluate the programs and results obtained through this Letter; 4. Prepare new programs within the original purpose that, eventually, may cover other areas of mutual interest not contemplated in this Letter of Intent, and which would be formalized through Annexes that will form an integral part of this instrument; 5. Undertake any other activities agreed upon by the Parties.

1. Agree on a work program that reflects the national priorities for cooperation activities. The work program may include long, medium, and short-term activities related to:

a. The strengthening of management systems for agricultural and rural development matters in each of the Parties, including the strengthening of institutional and legal frameworks, and the capacity to develop, apply, administer, and enforce legislation in these matters.

b. The development and promotion of incentives and other voluntary and flexible mechanisms, in order to foster the development of agriculture and the rural environment, including the development of market initiatives for the sector.

c. The promotion of business associations and strategic alliances to address current and future issues.

2. The initial Work Program, on a priority basis, among other actions, will contemplate:

a. Exchange on the development of agricultural activities carried out in both countries; b. Exchange of relevant information for decision-making by producers in the agricultural sector; c. Exchange of information and experiences regarding the application of sanitary and phytosanitary standards and territorial rural development; d. Facilitation in the development and transfer of technology, and training to promote the development of sustainable agriculture; e. Organization of meetings that facilitate business linkages between small and medium-sized producers in the sector; f. Exchange of information on national sanitary legislation and regulations that govern in each country, for the management of fishery, aquaculture, and agricultural resources.

g. Stimulate and facilitate, as appropriate, direct contacts and cooperation between governmental entities, multilateral organizations, foundations, universities, research centers, non-governmental organizations, State institutions, companies, and other entities, to undertake cooperation activities that contribute to the comprehensive development of the agricultural and rural sector in their respective countries.

The forms of financing the activities to be developed from this Letter shall be decided by the Parties in each specific case.

1. Develop all cooperation activities within the framework of this Letter of Intent, in accordance with the availability of funds, human, and other resources, as well as with the applicable laws and regulations in their respective States.

2. Consider, for the elaboration of joint work plans, the mechanisms through which cooperation activities may be financed, as well as the adequate allocation of human, technological, material, and organizational resources necessary for the effective execution of cooperation activities, in accordance with the capacities of the Parties. The following financing mechanisms may be considered for cooperation on agricultural and rural development matters:

a. Cooperation activities financed in a coordinated manner, as agreed by the Parties; b. Cooperation activities in which each institution assumes the costs of its own participation; and c. Cooperation activities financed, as appropriate, by private institutions, foundations, or non-governmental organizations, international public organizations, including through ongoing programs; or d. Through a combination of the above.

1. This Letter of Intent shall have an initial term of four years and may be renewed by prior agreement between the parties, for equal periods, and shall enter into force on the date the Parties communicate, through diplomatic channels, the fulfillment of their internal requirements.

2. This Letter of Intent may be denounced by either Party, through diplomatic channels, at any time. The denunciation shall take effect six months after the date of its communication to the other Party.

The denunciation shall not affect the completion of the activities started during its validity and that are in progress.

3. This Letter of Intent may be amended by mutual consent and shall enter into force, in accordance with the first paragraph of this article.

We sign, in the city of San José, Costa Rica, at sixteen hundred hours on the third day of October of the year two thousand eight, in two copies of equal legal value.

CARTA DE INTENCIONES EN MATERIA AGROPECUARIA Y RURAL ENTRE EL MINISTERIO AGROPECUARIO Y FORESTAL DE NICARAGUA Y EL GOBIERNO DE COSTA RICA, A TRAVÉS DEL MINISTERIO DE AGRICULTURA Y GANADERÍA El Ministerio Agropecuario y Forestal de Nicaragua y el Gobierno de Costa Rica, a través del Ministerio de Agricultura y Ganadería de Costa Rica, en adelante "las Partes",

1. Que ambos Ministerios entienden la importancia de la cooperación en materia agropecuaria y rural, como un valioso instrumento que se constituye en un aporte al desarrollo económico y social de sus respectivos países; 2. Que el intercambio de experiencias, formación y capacitación, en materia agropecuaria y rural en el ámbito público y privado contribuirá al mejoramiento de las condiciones socioeconómicas en ambos países; 3. Que la suscripción de la presente Carta de Intenciones entre ambas Partes refleja el interés especial por ampliar y profundizar el conocimiento mutuo en el ámbito del sector agropecuario; 4. Que estos esfuerzos representan un aporte significativo orientado a fomentar una mayor interacción entre los sectores públicos de ambos países, en aras de contribuir al mejoramiento de sus capacidades competitivas, a la mejoría de los servicios y servidores públicos del sector, así como para facilitar la inserción del sector agropecuario y actividades conexas en los mercados internacionales.

5. El deseo de ambas instituciones de establecer a futuro un amplio Programa de Cooperación en materia agropecuaria y rural, y 6. Que el presente instrumento jurídico se fundamenta en los propósitos y principios del Protocolo de Tegucigalpa y en el artículo 8 inciso g) del Tratado de la Integración Social Centroamericana, que promueve la cooperación entre los Estados miembros del Sistema de la Integración Centroamericana.

MANIFIESTAN SU FIRME INTENCIÓN DE:

Establecer un mecanismo de cooperación orientado al desarrollo de las capacidades institucionales del sector agropecuario y medio rural como: la investigación, difusión, capacitación y operación de un amplio programa dirigido a atender y procurar el desarrollo del sector agropecuario y medio rural.

Establecer un Programa de Trabajo entre las partes, que les permita de manera coordinada, promover y apoyar el desarrollo, crecimiento, estabilidad y competitividad global del sector agropecuario y medio rural, pudiendo contar para su ejecución con la colaboración del sector privado, organismos e instituciones públicas y privadas, con el fin de alcanzar el objetivo señalado en el Artículo 1.

Implementar a través de actividades institucionales, la cooperación a ser desarrollada bajo esta Carta de Intenciones, tomando en consideración las disposiciones de cooperación en materia agropecuaria y de desarrollo rural, sobre la base de programas conjuntos de asistencia técnica que pueden incluir:

a. La organización conjunta de visitas de estudio, asesorías, conferencias, seminarios, talleres, reuniones, intercambio de experiencias entre profesionales, técnicos, y especialistas del sector privado, académico y gobierno, para fortalecer el desarrollo, implementación y análisis de las políticas y estándares en materia agropecuaria y rural; b. La facilitación para promover el desarrollo y/o intercambio de mejores prácticas, información y datos, en materia agropecuaria y rural, susceptibles de interés para ambas Partes; c. La recopilación, publicación e intercambio de información sobre políticas, leyes, normas, regulaciones e indicadores de desarrollo del sector agropecuario y rural, así como sobre los mecanismos de cumplimiento de las normas legales; d. Cualquier otra modalidad que convengan las Partes.

Designar como puntos focales para desarrollar y darle seguimiento a los alcances de esta Carta de Intenciones, a los Responsables de la Cooperación Internacional de ambas partes, con el objetivo de coordinar, así como definir un marco estable de colaboración para el desarrollo de programas y proyectos conjuntos, que redunden en el beneficio mutuo y en la consolidación de los vínculos entre el sector agropecuario de ambos países.

En este sentido, las Partes tendrán las siguientes responsabilidades:

1. Desarrollar un programa de trabajo para promover la implementación de la Carta de Intenciones.

2. Establecer los mecanismos de seguimiento oportunos para lograr los objetivos de esta Carta de Intenciones e intercambiar información sobre el progreso de los programas, proyectos y actividades de cooperación; 3. Evaluar los programas y resultados obtenidos por medio de esta Carta; 4. Preparar nuevos programas dentro del objeto original que, eventualmente, podrán cubrir otras áreas de interés mutuo, que no se encuentren contemplados en esta Carta de Intenciones, y que se formalizarían mediante Anexos que formarán parte integrante del presente instrumento; 5. Emprender cualesquiera otras actividades que las Partes acuerden.

1. Acordar un programa de trabajo que refleje las prioridades nacionales para las actividades de cooperación. El programa de trabajo puede incluir actividades de largo, mediano y corto plazo, relacionadas con:

a. El fortalecimiento de los sistemas de gestión en materia agropecuaria y de desarrollo rural de cada una de las Partes, incluidos el fortalecimiento de los marcos institucionales y legales, y la capacidad para desarrollar, aplicar, administrar y hacer cumplir la legislación en estas materias.

b. El desarrollo y promoción de incentivos y otros mecanismos voluntarios y flexibles, a efectos de fomentar el desarrollo de la agricultura y el medio rural, incluyendo el desarrollo de iniciativas de mercado para el sector.

c. El fomento de asociaciones y alianzas estratégicas empresariales para abordar temas actuales y futuros.

2. El Programa de Trabajo inicial de manera prioritaria entre otras acciones contemplará:

a. Intercambio sobre el desarrollo de las actividades agropecuarias que se desarrollan en ambos países; b. Intercambio de información relevante para toma de decisiones de productores y productoras del sector agropecuario, c. Intercambio de información y experiencias en materia de aplicación de normas sanitarias y fitosanitarias y del desarrollo rural territorial; d. Facilitación en el desarrollo y la transferencia de tecnología, y la capacitación para promover el desarrollo de la agricultura sostenible e. Organización de encuentros que faciliten la vinculación de negocios entre los pequeños y medianos productores del sector; f. Intercambio de información en materia de legislación y reglamentación sanitario nacional que rige en cada país, para la administración del recurso pesquero, acuícola y agropecuario.

g. Estimular y facilitar según sea apropiado, contactos directos y cooperación entre las entidades gubernamentales, organizaciones multilaterales, fundaciones, universidades, centros de investigación, organizaciones no gubernamentales, instituciones del Estado, empresas y otras entidades, para emprender actividades de cooperación que contribuyan al desarrollo integral del sector agropecuario y medio rural en sus respectivos países.

Las formas de financiación de las actividades a desarrollar a partir de la presente Carta serán decididas por las Partes en cada caso concreto.

1. Desarrollar todas las actividades de cooperación en el marco de esta Carta de Intenciones, de conformidad con la disponibilidad de fondos, recursos humanos, y de otra índole, así como a las leyes y regulaciones aplicables en sus respectivos Estados.

2. Considerar, para la elaboración de los planes de trabajo conjuntos, los mecanismos a través de los cuales se puedan financiar las actividades de cooperación, así como la asignación adecuada de recursos humanos, tecnológicos, materiales y organizativos que sean necesarios para la efectiva ejecución de actividades de cooperación, de conformidad con las capacidades de las Partes. Los siguientes mecanismos de financiamiento pueden ser considerados para la cooperación en materia agropecuaria y de desarrollo rural:

a. Actividades de cooperación financiadas de manera coordinada, según lo acuerden las Partes; b. Actividades de cooperación en las que cada institución, asuma los costos de su propia participación; y c. Actividades de cooperación financiadas, según sea apropiado, por instituciones privadas, fundaciones, u organizaciones no gubernamentales, organizaciones públicas internacionales, inclusive por medio de programas en curso; o d. Mediante una combinación de las anteriores.

1. La presente Carta de Intenciones tendrá un plazo inicial de cuatro años pudiendo renovarse previo acuerdo entre las partes, por períodos iguales y entrará en vigor en la fecha en que las Partes comuniquen, por la vía diplomática, el cumplimiento de sus requisitos internos.

2. Esta Carta de intenciones podrá ser denunciada por cualquiera de las Partes, por la vía diplomática, en cualquier momento. La denuncia surtirá efecto transcurridos seis meses después de la fecha de su comunicación a la otra Parte.

La denuncia no afectará la culminación de las actividades que se iniciaren durante su vigencia y que se encuentren en ejecución.

3. Esta carta de intenciones podrá ser modificada por mutuo consentimiento y entrará en vigencia, de conformidad con el párrafo primero de este artículo.

Firmamos, en la ciudad de San José, Costa Rica, a las dieciséis horas del día tres de octubre del año dos mil ocho, en dos ejemplares de igual valor legal.
