in the entirety of the text - Complete Text of Norm 34831 Amends for the National Groundwater, Irrigation and Drainage Service, the maximum budget expenditure set for the year 2008 Complete Text record: C0AC9 No. 34831-H No. 34831-H THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF FINANCE Based on the powers conferred by Articles 140, subsections 3) and 18), and 146 of the Political Constitution; Articles 25, subsection 1), 27, subsection 1), and 28, subsection 2), subparagraph b) of Law No. 6227, General Law of Public Administration of May 2, 1978, and its amendments; Law No. 8131, Financial Administration Law of the Republic and Public Budgets of September 18, 2001, and its amendments; its Regulation, Executive Decree No. 32988-H-MP-PLAN of January 31, 2006, and its amendments; Law No. 6877, Law Creating the National Groundwater, Irrigation and Drainage Service (Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento, SENARA), of July 18, 1983; Executive Decree No. 33646-H of March 22, 2007, and its amendments; Law No. 8659, Amendment of Law No. 8627 "Law of the Ordinary and Extraordinary Budget of the Republic for the Economic Year 2008" and Second Extraordinary Budget of the Republic for the Economic Year 2008 of August 7, 2008, and Law No. 8669, Amendment of Law No. 8627 "Law of the Ordinary and Extraordinary Budget of the Republic for the Economic Year 2008" and Third Extraordinary Budget of the Republic for the Economic Year 2008 of September 30, 2008.

1. 1That by means of Law No. 6877, Law Creating the National Groundwater, Irrigation and Drainage Service (SENARA), published in La Gaceta No. 143 of July 29, 1983, SENARA was created, whose objectives, among others, are to promote the agricultural development of the country, through the establishment and operation of irrigation, drainage and flood protection systems, to contribute to preferentially developing those agricultural development projects that are based on a just distribution of land, and to ensure that in the territory benefited by the creation of irrigation and drainage districts, a rational and democratic change in land ownership is carried out.
2. 2That the General Manager of SENARA, through official communication No. GE-626-08 of October 2, 2008, requests an increase in the expenditure limit corresponding to the year 2008 for SENARA, in the amount of ¢236,300,000.00 (exactly two hundred thirty-six million three hundred thousand colones), in order to meet institutional commitments in accordance with the National Basic Grains Plan and various expenses of the Institutional Operating Plan, including: building, premises and land rentals, general services (cleaning, security, company physician, and courier services), and per diem within the country.
3. 3That said amount will be financed with government transfers from the Ministry of Agriculture and Livestock, incorporated through Law No. 8659, Amendment of Law No. 8627 "Law of the Ordinary and Extraordinary Budget of the Republic for the Economic Year 2008" and Second Extraordinary Budget of the Republic for the Economic Year 2008, published in La Gaceta No. 164, of August 26, 2008, and Law No. 8669, Amendment of Law No. 8627 "Law of the Ordinary and Extraordinary Budget of the Republic for the Economic Year 2008" and Third Extraordinary Budget of the Republic for the Economic Year 2008, published in Supplement No. 39, to La Gaceta No. 196, of October 10, 2008.
4. 4That by means of Executive Decree No. 33646-H, published in La Gaceta No. 58 of March 22, 2007, and its amendments, the General Budget Policy Guidelines for 2008 were issued, establishing in Article 1 of said decree the maximum budget expenditure for the year 2008 for the institutions covered by the scope of the Budget Authority.
5. 5That through official communication No. STAP CIRCULAR 0687-07 of April 20, 2007, SENARA was informed of the maximum authorized budget expenditure for the year 2008, in the sum of ¢1,933,500,000.00 (exactly one billion nine hundred thirty-three million five hundred thousand colones), which does not include the additional resources indicated in the second whereas clause of this Decree.
6. 6That with official communication No. DM-785-08 of July 30, 2008, the Minister who heads the Productive Sector endorses the request made by SENARA.
7. 7That due to the foregoing, it is necessary to modify the maximum budget expenditure set for SENARA for the year 2008, increasing it by the sum of ¢236,300,000.00 (exactly two hundred thirty-six million three hundred thousand colones). Therefore,

1. 1Que mediante la Ley Nº 6877, Ley de Creación del Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA), publicada en La Gaceta Nº 143 de 29 de julio de 1983, se crea el SENARA, cuyos objetivos, entre otros, son fomentar el desarrollo agropecuario del país, mediante el establecimiento y funcionamiento de sistemas de riego, avenamiento y protección contra inundaciones, contribuir a desarrollar preferentemente aquellos proyectos de desarrollo agropecuario que se sustenten en una justa distribución de la tierra y procurar que en el territorio beneficiado por la creación de distritos de riego y avenamiento, se efectúe una modificación racional y democrática en la propiedad de la tierra.
2. 2Que el Gerente General del SENARA, mediante el oficio Nº GE-626-08 de 2 de octubre del 2008, solicita ampliar el límite de gasto correspondiente al año 2008 para el SENARA, por la suma de ¢236.300.000,00 (doscientos treinta y seis millones trescientos mil colones exactos) con la finalidad de atender los compromisos institucionales de conformidad con el Plan Nacional de Granos Básicos y gastos varios del Plan Operativo Institucional, entre los que tenemos: alquileres de edificios, locales y terrenos, servicios generales (limpieza, seguridad, médico de empresa y mensajería) y viáticos dentro del país.
3. 3Que dicho monto será financiado con transferencias de gobierno del Ministerio de Agricultura y Ganadería, incorporadas mediante la Ley Nº 8659, Modificación de la Ley Nº 8627 "Ley de Presupuesto Ordinario y Extraordinario de la República para el Ejercicio Económico del 2008" y Segundo Presupuesto Extraordinario de la República para el Ejercicio Económico del 2008, publicada en La Gaceta Nº 164, de 26 agosto del 2008 y la Ley N° 8669, Modificación de la Ley Nº 8627 "Ley de Presupuesto Ordinario y Extraordinario de la República para el Ejercicio Económico del 2008" y Tercer Presupuesto Extraordinario de la República para el Ejercicio Económico del 2008, publicada en el Alcance Nº 39, a La Gaceta Nº 196, del 10 de octubre del 2008.
4. 4Que mediante el Decreto Ejecutivo Nº 33646-H, publicado en La Gaceta Nº 58 de 22 de marzo del 2007 y sus reformas, se emitieron las Directrices Generales de Política Presupuestaria para el 2008, estableciéndose en el artículo 1º del citado decreto, el gasto presupuestario máximo del año 2008, para las instituciones cubiertas por el ámbito de la Autoridad Presupuestaria.
5. 5Que mediante el oficio Nº STAP CIRCULAR 0687-07 de 20 de abril del 2007, se comunicó al SENARA el gasto presupuestario máximo autorizado para el año 2008, por la suma de ¢1.933.500.000,00 (mil novecientos treinta y tres millones, quinientos mil colones exactos), la cual no contempla los recursos adicionales señalados en el considerando segundo de este Decreto.
6. 6Que con el oficio Nº DM-785-08 de 30 de julio del 2008, el señor Ministro rector del Sector Productivo avala la solicitud planteada por el SENARA.
7. 7Que por lo anterior, resulta necesario modificar el gasto presupuestario máximo fijado al SENARA para el año 2008, incrementándolo en la suma de ¢236.300.000,00 (doscientos treinta y seis millones, trescientos mil colones exactos). Por tanto,
