1Que es función esencial del Estado proteger la salud y la vida de las personas y animales, así como garantizar la protección de los cultivos de las plagas que pongan en riesgo o causen daños a la producción agrícola.
2Que corresponde al Ministerio de Agricultura y Ganadería a través del Servicio Fitosanitario del Estado velar por la protección fitosanitaria de los cultivos en nuestro país, disponiendo, una vez comprobada la existencia de una plaga , las medidas técnicas y de control que eviten la propagación de estas.
3Que las condiciones climáticas que han afectado a todo el país en los últimos tiempos, han sido las más propicias para el desarrollo de ciertas plagas de importancia económica y cuarentenaria que afectan cultivos básicos y de
4Que el Servicio Fitosanitario del Estado ha confirmado la presencia de Thrips palmi, según reporte del laboratorio de Diagnóstico Fitosanitario Nº 681, del 09 julio del 2008, de una muestra de vainica procedente de la localidad de Cañas Gordas, del Distrito de Agua Buena, Cantón de Coto Brus, fronterizo con Panamá lo que provoca alerta y amerita que a esta plaga se le brinde un control adecuado, con la finalidad de que la misma no alcance poblaciones que pongan en riesgo el agro nacional.
5Que Thrips palmi es una plaga con un rango de hospederos sumamente amplio, transmisor de enfermedades virales y además se constituye en una limitante muy seria para la capacidad exportadora del país.
6Que el Poder Ejecutivo, previa recomendación del Servicio Fitosanitario del Estado, podrá decretar estado de emergencia fitosanitaria, cuando existan plagas de importancia, que constituyan o representen una amenaza para la economía nacional, como lo es la antes mencionada.
7Que el Servicio Fitosanitario del Estado ha implementado medidas fitosanitarias con el fin de erradicar esta plaga, dada la ubicación en donde se encuentra actualmente. Por tanto:

Artículo 1 — A state of national phytosanitary emergency is declared, due to the pest Thrips palmi.

Artículo 2 — Every producer or occupant of properties under any title is obligated to report the presence of the pest to the State Phytosanitary Service.

Artículo 3 — The owners or occupants of areas where the pest is detected must collaborate with the officials of the State Phytosanitary Service or whomever it designates, for the application of the officially recommended control measures.

Artículo 6 — The State of phytosanitary emergency shall be maintained for a period of two years, starting from the publication of this Decree.

Artículo 7 — The State Phytosanitary Service shall be responsible for issuing and executing the technical phytosanitary measures necessary for the control of the aforementioned pest.

Artículo 8 — It shall be effective as of its publication.

Artículo 6 — El Estado de emergencia fitosanitaria se mantendrá por un período de dos años, a partir de la publicación de este Decreto.

Artículo 7 — El Servicio Fitosanitario del Estado se encargará de dictar y ejecutar las medidas fitosanitarias técnicas necesarias para el control de la plaga antes mencionada.

Artículo 8 — Rige a partir de su publicación.
