EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE AGRICULTURA Y GANADERÍA En ejercicio de las facultades que les confieren los artículos 140, incisos 3), 8), 18) y 20) y 146 de la Constitución Política; los artículos 25, 27.1, 28.2 b) de la Ley Nº 6227 del 2 de mayo de 1978, Ley General de la Administración Pública; la Ley Nº 7664 del 8 de abril de 1997, Ley de Protección Fitosanitaria; Ley Nº 7818 del 2 de setiembre de 1998, Ley Orgánica de la Agricultura e Industria de la Caña de Azúcar; Ley Nº 6735 del 29 de marzo de 1982, Ley del Instituto de Desarrollo Agrario; Ley No.8634 del 23 de abril del 2008, Ley del Sistema de Banca para el Desarrollo.
Considerando:
10.-Que el Poder Ejecutivo, previa recomendación del Servicio Fitosanitario del Estado, podrá decretar estado de emergencia fitosanitaria, cuando existan plagas de importancia, que constituyan o representen una amenaza para la economía nacional, como lo es la antes mencionada. Por lo tanto:
Emergencia Fitosanitaria en los cantones de Pérez Zeledón y Buenos Aires en la Zona Sur, y San Carlos y Los Chiles en la Zona Norte por la presencia de la plaga Puccinia kuehnii (Roya Naranja)
Decretan:
la Ley de Protección Fitosanitaria, realizando la liquidación correspondiente a posteriori, conforme a los procedimientos administrativos que regulan la materia.
(Nota de Sinalevi: Mediante el artículo 1° del decreto ejecutivo N° 35581 del 13 de octubre de 2009, se prorroga por un año más el estado de emergencia fitosanitaria establecido en este decreto)
