"Article 1.- The "Inter-institutional Commission for the Prevention, Control and Combat of Marine Pollution by Hydrocarbons", hereinafter referred to as "The Commission", is hereby created, which shall act under the coordination of the Ministry of Public Works and Transport, with the principal objective of coordinating the establishment of a technical response group to prevent, control and combat marine pollution by hydrocarbons in Costa Rican jurisdictional maritime waters and of developing a "National Contingency Plan to Prevent, Control and Combat Marine Pollution by Hydrocarbon Spill".
"Article 2.- The Commission shall be composed of representatives from the following Institutions:
- a)The Director General of the División Marítimo Portuaria of the MOPT or their duly designated representative, who shall chair it.
- b)The President of the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias (CNE) or their duly designated representative; c) The Executive President of Refinadora Costarricense de Petróleo (RECOPE) or their duly designated representative; d) The Executive President of the Junta Administrativa Portuaria y de Desarrollo Económico de la Vertiente Atlántica (JAPDEVA) or their duly designated representative; e) The Executive President of the Instituto Costarricense de Puertos del Pacífico, (INCOP) or their duly designated representative; f) The Director of the Dirección de Hidrocarburos of the Ministerio del Ambiente y Energía (MINAE) or their representative duly designated by the Minister; g) The Director of the Servicio Nacional de Guardacostas of the Ministerio de Seguridad Pública or their duly designated representative; h) The Director of Vigilancia Aérea of the Ministerio de Seguridad Pública or their duly designated representative; i) The Director of the Centro de Investigación en Ciencias del Mar y Limnología (CIMAR), of the Universidad de Costa Rica or their duly designated representative".
"Article 4.- The Commission shall meet at the central headquarters of the División Marítimo Portuaria of the MOPT or at the location it agrees upon, and shall have, for the fulfillment of its functions, the technical and logistical support it requires from the entities that compose it. Likewise, the human resources already existing in said institutions may be utilized".
"Article 6.- The Commission shall meet ordinarily during the first week of each month and, extraordinarily, whenever convened by its President, with at least five calendar days' notice".
"Article 7.- The Commission shall establish its own working procedures and norms".
"Article 10.- For the definition of the 'National Contingency Plan to Prevent, Control and Combat Marine Pollution by Hydrocarbon Spill', the Commission may request the collaboration of the International Maritime Organization (OMI) and the Comisión Centroamericana de Transporte Marítimo (COCATRAM), through the División Marítima Portuaria. The National Contingency Plan must be published in the Diario Oficial La Gaceta for the information of the maritime-port subsector".
