in the entirety of the text - Complete Text of Rule 606 Reform of the Regulation for the Special Contracting of Technical Audits for the Road Conservation Projects of the National Road Council Complete Text of Minutes: BEFC6 NATIONAL ROAD COUNCIL AMENDMENT TO THE REGULATION FOR THE SPECIAL CONTRACTING OF TECHNICAL AUDITS FOR THE ROAD CONSERVATION PROJECTS OF THE NATIONAL ROAD COUNCIL Interested parties in participating in the formation and registration of the referred Registry are hereby notified that, in accordance with the authorization granted by the Office of the Comptroller General of the Republic (Contraloría General de la República) through official communication Nº 08299 (DCA-2439) of August 13, 2008, and the firm agreement adopted through Article III of Session Nº 606-08 held on August 28, 2008, by the Administrative Board of the National Road Council (Consejo Nacional de Vialidad), the following is hereby proceeded with regarding the modification of Articles 14, 24, and 44 of the cited Special Contracting Regulation. Likewise, it is made known and evident that the remaining articles not affected by this amendment will remain valid in their content, as published in La Gaceta Nº 148 of Friday, August 3, 2007.

Henceforward, Articles 14, 24, and 44 shall read as follows:

"Article 14.-Technical Requirements. The technical admissibility and permanence requirements in the Eligible Registry (Registro de Elegibles) that the Supplier must meet are established below:

• a)Have 2 technical auditors (auditores técnicos), Engineering professionals, with a bachelor's degree (grado académico de licenciatura). Both must have quality auditor training, and must have documented quality auditor courses or modules for at least 50 hours.

Additionally, they must:

. Be incorporated into the Federated College of Engineers and Architects (Colegio Federado de Ingenieros y Arquitectos), and must be up to date with their obligations.

. Have a minimum of 3 years of experience since their incorporation into the Federated College of Engineers and Architects.

. Their participation in quality audits of any type and/or contracting, execution, supervision (fiscalización) of road projects (one or several as long as the work was mostly continuous), whether maintenance, rehabilitation, improvement, reconstruction, or new construction, as well as in applied research in Pavement Engineering, will be considered as experience.

• b)Have a technical expert who must hold a bachelor's degree (licenciado) in Civil Engineering or Construction Engineering with a minimum of 3 years of experience in the execution of road projects. Their participation in the contracting, execution, supervision (fiscalización) of road projects, whether maintenance, rehabilitation, improvement, reconstruction, or new construction, as well as in applied research in the construction of road projects, will be considered as experience." "Article 24.-Causes for Exclusion. The following are causes that empower the Institution to exclude organizations from the registry:
• a)Death or dissolution of the natural or legal person.
• b)The express manifestation of the registered supplier.
• c)Disqualification (inhabilitación) in accordance with Article 100 of the Administrative Contracting Law (Ley de Contratación Administrativa).
• d)By decision of the Administration not to continue contracting technical audits for the projects, provided there are reasons of public interest, fortuitous event, or force majeure.
• e)Due to the organization's failure to address, within the granted period, the legal, technical, and financial requirements requested by the Administration.
• f)The presentation of false information regarding technical or legal aspects relevant to its registration.
• g)When it is determined that the organization has engaged in unfair competition practices.
• h)When, in the execution of the contract, the organization has violated any internal regulation or one related to the payment of taxes.
• i)When the organization has reached the limit amount for fines, leading to the resolution of the contract.
• j)When the performance evaluation is unacceptable.
• k)When it is proven that any activity has been carried out that has endangered trust in the independence of judgment and integrity of the organization, in relation to the audit activities it performs.
• l)Due to the interest in renewing its offer in the eligible registry (registro de elegibles).
• m)When, after the 12-month validity period, no evidence has been provided of additional training of the auditors in quality management and/or technical audits for a total of 50 hours. Except for technical auditors (auditores técnicos) with training of 300 hours or more, either because this is recorded in the eligible registry at the time of registration, or because through additional training during execution, the hours were completed and the supporting documentation is provided." "Article 44.-On the Execution Period. The Office of the Comptroller General of the Republic, through official communication Nº 08299 (DCA-2439) of August 13, 2008, established the validity of this special contracting system as 24 months, counted from the notification of that official communication; thus, the execution period of the contracts generated under this Regulation shall be one year, which may be extended at the discretion of the Administration." The other articles and provisions established in the Special Regulation for this contracting that are not modified by this publication shall remain unchanged and valid for their application in accordance with the content provided for each of them.

en la totalidad del texto - Texto Completo Norma 606 Reforma Reglamento para la Contratación Especial de Auditorías Técnicas para los Proyectos de Conservación Vial del Consejo Nacional de Viabilidad Texto Completo acta: BEFC6 CONSEJO NACIONAL DE VIALIDAD MODIFICACIÓN AL REGLAMENTO PARA LA CONTRATACIÓN ESPECIAL DE AUDITORÍAS TÉCNICAS PARA LOS PROYECTOS DE CONSERVACIÓN VIAL DEL CONSEJO NACIONAL DE VIALIDAD Se les comunica a los interesados en participar en la conformación e inscripción del referido Registro, que de conformidad a la autorización otorgada por la Contraloría General de la República mediante oficio Nº 08299 (DCA-2439) del 13 de agosto del 2008 y al acuerdo firme adoptado mediante artículo III de la sesión Nº 606-08 celebrada el 28 de agosto del 2008, por el Consejo de Administración del Consejo Nacional de Vialidad, se procede de seguido en lo conducente a la modificación de los artículos 14, 24 y 44 del citado Reglamento Especial de Contratación, asimismo se hace saber y se pone de manifiesto, que el resto de los artículos no afectados por la presente modificación permanecerán vigente conforme su contenido, tal y como se publicaron en La Gaceta Nº 148 del viernes 3 de agosto del 2007.

Así en adelante los artículos 14, 24 y 44 se leerán de la siguiente manera:

"Artículo 14.-Requisitos técnicos. A continuación se establecen los requisitos técnicos de admisibilidad y permanencia en el Registro de Elegibles que tendrá que cumplir el Proveedor:

• a)Contar con 2 auditores técnicos, profesionales en Ingeniería, con grado académico de licenciatura. Ambos deberán contar con formación de auditores de calidad, debiendo tener cursos o módulos de auditor calidad documentados por al menos 50 horas.

Adicionalmente deberán:

. Estar incorporados al Colegio Federado de Ingenieros y Arquitectos, debiendo estar al día con sus obligaciones.

. Tener una experiencia mínima de 3 años desde su incorporación al Colegio Federado de Ingenieros y Arquitectos.

. Se tomará como experiencia su participación en auditorías de calidad de cualquier tipo y/o contratación, ejecución, fiscalización de proyectos de vialidad (uno o varios siempre que se hayan dado labores mayoritariamente continuas), tanto de mantenimiento, rehabilitación, mejoramiento, reconstrucción o construcción nueva, así como en investigación aplicada en Ingeniería de Pavimentos.

• b)Contar con un experto técnico que deberá ser un licenciado en Ingeniería Civil o en Ingeniería en Construcción con experiencia mínima de 3 años en ejecución de proyectos viales. Se tomará como experiencia su participación en la contratación, ejecución, fiscalización de proyectos de vialidad, tanto de mantenimiento, rehabilitación, mejoramiento, reconstrucción o construcción nueva, así como en investigación aplicada a la construcción de proyectos viales." "Artículo 24.-Causas de exclusión. Son causas que facultan a la Institución para la exclusión del registro a las organizaciones, las siguientes:
• a)Muerte o extinción de la persona física o jurídica.
• b)La manifestación c) La inhabilitación de conformidad con el artículo 100 de la Ley de Contratación Administrativa.
• d)Por decisión de la Administración de no continuar contratando las auditorías técnicas para los proyectos siempre que medien motivos de interés público, caso fortuito o fuerza mayor.
• e)Por la no atención de la organización, en el plazo conferido, a los requerimientos legales, técnicos y financieros, solicitados por la Administración.
• f)La presentación de información falsa, sobre aspectos técnicos o legales relevantes para su inscripción.
• g)Cuando se determine que la organización ha incurrido en prácticas de competencia desleal.
• h)Cuando en la ejecución del contrato, la organización haya violado alguna normativa interna o relacionada con el pago de impuestos.
• i)Cuando la organización haya alcanzado el monto límite por multas, procediendo la resolución del contrato.
• j)Cuando por la evaluación del desempeño sea no aceptable.
• k)Cuando se compruebe que se ha llevado a cabo alguna actividad que haya puesto en peligro la confianza en la independencia de juicio e integridad de la organización, en relación con las actividades de auditoría que realiza.
• l)Por el vencimiento o expiración del plazo de inscripción -seis meses- y no haya interés por parte del proveedor de renovar su oferta en el registro de elegibles.
• m)Cuando al cabo de los 12 meses de vigencia no se haya suministrado evidencia de capacitación adicional de los auditores en gestión de calidad y/o auditorías técnicas por un total de 50 horas. Exceptuando de auditores técnicos con capacitación de 300 horas o más, sea porque así consta en el registro de elegibles en el momento de la inscripción, o porque con capacitación adicional durante la ejecución se completaron y se suministre la documentación que lo comprueba." "Artículo 44.-Del plazo de ejecución. La Contraloría General de la República mediante oficio Nº 08299 (DCA-2439) del 13 de agosto del 2008, estableció la vigencia de este sistema especial de contratación en 24 meses, contados a partir de la notificación de ese oficio; de modo que el plazo de ejecución de las contrataciones que se generen amparadas en este Reglamento será de un año, pudiendo prorrogarse a criterio de la Administración." Los demás artículos y disposiciones establecidas en el Reglamento Especial para esta contratación que no se encuentren modificados por esta publicación, se mantendrán inalterables y vigentes para su aplicación conforme al contenido previsto para cada uno de ellos.
